RE VEST:
Conditional Use Planned Development to permit acomputer-controlled, variable
message, electronic sign.
PROPOSED LAND USE:
A computer-controlled, variable message, electronic sign, incorporated into a
freestanding identification sign for adrugstore/pharmacy is proposed.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND DENIAL.
AYES: Messrs. Hassen, Bass, Gulley and Waller.
NAY: Dr. Brown.
STAFF RECOMMENDATION
Recommend denial for the following reasons:
A. The proposed computer-controlled, variable message, electronic sign does not
conform to the adopted Electronic Message Center Policy for such signs relative
to location within the Courthouse Area Design District and distance from
residentially-zoned properties.
B. The requested exceptions to the Policy could set a precedent for similar requests.
(NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY
PROFFER CONDITIONS.)

PROFFERED CONDITION
In addition to Ordinance requirements, any computer-controlled, variable message,
electronic sign shall conform to the following standards:
a. Copy shall be limited to a maximum of two (2) lines which shall not move,
but may fade;
b. The message or display shall be programmed or sequenced to change no
more than once every sixty (60) seconds;
c. The copy display color shall either be white or yellow;
d. Flashing and traveling messages shall be prohibited; and
e. Bij ou lighting and animations effects shall be prohibited.
f. The base of each column for the sign shall be constructed of brick or brick
veneer as depicted in the sign elevation titled "CVS/Pharmacy #1547",
prepared by Service Neon Signs Inc. and dated March 24, 2010. (P)

This request will have no impact on these facilities.
Virginia Department of Transportation (VDOT):
Electronic signs located adjacent to federally assisted highways, such as State Route 10,
are subject to VDOT review and/or approval. A design will be required to be submitted
through the VDOT Richmond District, Central Region Permit Office, to be routed to the
appropriate reviewing entity. The plan is to show the location of the sign relative to the
right-of way (and outside the appropriate clear zone) and operational details, as deemed
necessary, for evaluation of the signage.

The area is characterized by commercial and office uses along the east and west lines of Iron
Bridge Road, with residential developments east along Centralia Road.
Zonin Hg istory:
On April 23, 1997 and May 14, 1997, the Board of Supervisors, upon favorable
recommendations by the Planning Commission, approved rezoning of a 3.2 acre tract and
an adjacent 3.5 acre tract, both to Neighborhood Business (C-2) with a Conditional Use
to permit outside public address systems (Cases 97SN0165 and 97SN0160). Individual
drugstores/pharmacies with drive-through windows were planned.
Sins:
The applicant plans to incorporate acomputer-controlled, variable message electronic sign
into an existing freestanding sign. The proposed sign and computer-controlled, variable
message electronic sign would comply with the size and height requirements of the Zoning
Ordinance which currently permit a freestanding sign sixty-two (62) square feet in area
(including changeable copy) at a height of fifteen (15) feet. The proposal would comply
with the adopted Electronic Message Center Policy relative to spacing between signs, lines
of copy, display color, and lack of flashing and traveling messages, bijou lighting and
animation (Proffered Condition). At the request of the Dale District Commissioner, the
Proffered Condition (Item "b") limits the timing of message changes to once every sixty

(60) seconds being more restrictive than the Policy which provides for changes once every
ten (10) seconds.
The Proffered Condition (Item "f') addresses the treatment of the sign base as reflected in
the attached elevation. It should be noted that adherence to other components of the depicted
sign treatment have not been proffered.
The proposal would not comply with the Policy, which prohibits such signs being located
within the Courthouse Area Design District, which abuts Iron Bridge Road between Frith
Lane and Greenyard Road.
Distance from Residentially-Zoned Properties:
The Policy suggests that electronic message centers should not be visible from residentially
zoned properties. If such signs are visible from residentially-zoned properties, the Policy
suggests that the sign be located a minimum of 1,000 feet from such property. The
residential community of Courthouse Woods, located on the north line of Centralia Road, is
approximately 600 feet east of the proposed sign placement at the intersection of Iron Bridge
and Centralia Roads. The proposed sign would be visible from this residential community.
CONCLUSION
The proposed computer-controlled, variable message, electronic sign does not conform to the
adopted Electronic Message Center Policy for such signs relative to its location within the
Courthouse Area Design District and its distance from residentially-zoned properties. Approval of
this requested exception to the Policy could set a precedent for similar requests.
Given these considerations, denial of this request is recommended.
CASE HISTORY
Planning Commission Meeting (7/20/10):
The applicant did not accept the recommendation. There was opposition and support
present. Those in opposition expressed concerns relative to location within a historic
district with a special character and strict adherence to architectural guidelines; setting of
precedent for similar signs; and support for adherence to Policy.
Those in support indicated that with improved technology, electronic message centers
would not compromise other project enhancements; and that the Policy should be
reevaluated.
At the request of Dr. Brown, the applicant agreed to extend the timing of message
changes to once every sixty (60) seconds.

Mr. Bass indicated that timing of the message change was not the issue. Mr. Gulley noted
the location was within a historic district and that he would not support.
Dr. Brown stated that this case was worthy of the exceptions; the proposal was no more
intrusive than permitted signage; that enforcement continues to be an issue for all types of
signage; and that his motion would include the change in the timing to sixty (60) seconds.
A motion by Dr. Brown to approve the request failed for lack of a second.
Mr. Hassen stated that although he favored electronic signs, until the Policy was changed,
he could not support deviations.
On motion of Mr. Hassen, seconded by Mr. Bass, the Commission recommended denial.
AYES: Messrs. Hassen, Bass, Gulley and Waller.
NAY: Dr. Brown.
The Board of Supervisors, on Wednesday, August 25, 2010, beginning at 6:30 p.m., will take
under consideration this request.
