Hubbard, Jr. Matoaca Magisterial District 6120 Matoaca Road January 26, 2011 BS RE VEST: Renewal of manufactured home permit 04SR0156 to permit a temporary manufactured home in a Residential (R-7) District. RECOMMENDATION Recommend approval for the following reasons: A. This request is for renewal of a previously approved manufactured home permit. B. The request is compatible with, and representative of, existing area development. (NOTE: SHOULD THE BOARD WISH TO APPROVE THIS REQUEST, CONDITIONS MAY BE IMPOSED. THE ORDINANCE LIMITS THE MAXIMUM PERIOD OF TIME FOR WHICH THIS PERMIT MAY BE GRANTED TO SEVEN (7) YEARS.) CONDITIONS 1. The applicant and/or immediate family member(s) of the applicant shall be the owner and occupant of the manufactured home. (P) (Note: Immediate family members are limited to natural or legally defined offspring, stepchild, spouse, sibling, grandchild, grandparent or parent of the app scant.) 2. This manufactured home permit shall be granted for a period not to exceed seven (7) years from date of approval. (P) 3. No additional permanent-type living space may be added onto this manufactured home. This manufactured home shall be skirted, but shall not be placed on a permanent oun anon. Tax ID 780-622-4266. Existing Zoning: R-7 Size: 9.4 acres Existing Land Use: Manufactured home Adjacent Zoning and Land Use: North - R-7; Vacant South - A and R-7; Single-family residential or vacant East - A and R-7; Single-family residential West - R-7; Single-family residential or vacant t Itilities~ Private well and septic T . Comprehensive Plan: The subject property is located within the boundaries of the Southern and Western Area Plan, which suggests the property is appropriate for residential use of 1-5 acre lots; suited to R- 8 8 zoning. Area Development Trends: Area properties are zoned Residential (R-7) and Agricultural (A) and are occupied by single-family dwellings on acreage parcels or are vacant. It is anticipated that area development east of Hickory Road and north of Matoaca Road will continue for residential uses on one (1) to five (5) acre parcels while properties south of Matoaca Road will be at higher residential densities of up to two and one-half (2.5) units to the acre, as suggested by the Plan. 2 11SN0173 JAN26-BOS-RPT Zoning and Permit History: On August 28, 1996 the Board of Supervisors approved a temporary manufactured home permit on the request property (Case 97SN0108). The applicant, Mary Hubbard, occupied the manufactured home on property owned by her father, John M. Hubbard, Jr. This approval was for a period of seven (7) years, expiring in August of 2003. On November 25, 2003 the Board of Supervisors approved a renewal of Case 97SN0108 (Case 04SR0156). Conditions permitted the applicant, Mary H. Barlow (formerly Mary Hubbard), and/or the property owner, John M. Hubbard, Jr., as occupants of the manufactured home. This approval was for a period of seven (7) years, expiring in November of 2010. Pro osal: The applicant is seeking renewal of this manufactured home permit for an additional seven (7) years (Condition 2). The applicant has requested that the permit include immediate family member(s) of the applicant as the owner and occupant of this unit (Condition 1). Immediate family, as defined by Ordinance, is limited to a child, spouse, sibling, grandchild, grandparent or parent of the applicant. CONCLUSIONS The temporary manufactured home continues to be in keeping with development in the surrounding area, being single-family dwellings on acreage parcels. As conditioned, this use should maintain compatibility with these neighboring uses for this temporary period of time.
