Specifically, deletion of Condition 16 is requested to allow a freestanding sign identifying outparcel development within a shopping center in conformance with current Ordinance requirements. PLANNING COMMISSION RECOMMENDATION THE PLANNING COMMISSION IS SCHEDULED TO HEAR THIS CASE AT THEIR MEETING ON TUESDAY, FEBRUARY 15, 2011. STAFF WILL ADVISE THE BOARD OF THE COMMISSION' S ACTION AFTER THEIR MEETING. RECOMMENDATION Recommend approval for the following reason: The proposed amendment is in keeping with Zoning Ordinance standards. Tax ID 729-707-0485. Existing Zoning: C-2 with conditional use planned development Size: .7 acre Existing Land Use: Commercial Adjacent Zoning and Land Use: North - C-2; Commercial South and East - C-3; Commercial West - R-7; Public/semi-public T 1TTT ,TTTF,~ While installation of the proposed sign will not impact the public utilities system, the applicant is cautioned that the proposed sign must not be placed so as to conflict with the existing public utility lines, or their easements, on this site. ENVIRONMENTAL ENGINEERING AND PUBLIC FACILITIES This request will have no impact on these facilities. T,ANn TIFF, Comprehensive Plan: The subject property is located within the boundaries of the Midlothian Area Community Plan, which suggests the property is appropriate for village shopping district use. 2 11SN0177-FEB23-BOS-RPT Area Development Trends: Surrounding properties are zoned Neighborhood and Community Business (C-2 and C-3), and Residential (R-7) and are developed for commercial and public/semi-public uses, including the Midlothian Station Shopping Center within which the subject property is an outparcel. Property to the west is occupied by a church. Zonin Hg istory: On February 27,1980 the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved a rezoning to Convenience Business (B-1) with conditional use planned development (Case 79SN0211). A shopping center was proposed. Condition 16 of this case limited freestanding signage to one (1) proj ect sign which was subsequently located at the center's entrance on Midlothian Turnpike. On October 28, 1981 the Board of Supervisors approved an amendment to permit a second freestanding project sign on Coalfield Road. (Case 81 SN0109) The subject property represents one (1) of two (2) outparcels within this shopping center. On March 24,1982 the Board of Supervisors approved an amendment to Case 79SN0211 to permit, in part, a freestanding sign to identify a building on this neighboring outparcel, subject to an approved sign rendering (Case 82SN0016). On September 21, 2005 this case was amended to permit this outparcel sign to conform to current Ordinance requirements (Case 05SN0302). This outparcel is currently occupied by a bank use. Suns: Currently, within the Village Districts, the Ordinance permits individual businesses within a shopping center one (1) freestanding sign not to exceed an area of twenty (20) square feet and a height of eight (8) feet. This sign area can be increased by five (5) square feet for the purpose of incorporating changeable copy (reader board). Further, Condition 17 of Case 79SN0211 requires that the proposed sign blend with the Colonial architectural style of the development, and may be illuminated, but not luminous (i.e. internally illuminated). CONCLUSION Deletion of the condition would allow for a freestanding sign identifying outparcel development within a shopping center in conformance with Zoning Ordinance standards. Given these considerations, approval of this request is recommended. 3 11SN0177-FEB23-BOS-RPT CASE HISTORY Staff (1/21/11): If the Planning Commission acts on this request on February 15, 2011, the case will be considered by the Board of Supervisors on February 23, 2011.
