The committee has published a 67-page report detailing four major recommendations: 1) to invest in human capital; 2) to support systems that sustain lifelong learning; 3) to ,provide social capital and ensure information; and 4) communication and technology (ICT) literacy. A copy of the report will be presented to each Board member. Mr. Edward DeGennaro, chairman of the committee, will make the presentation. Summary of Information: Chesterfield County Board of Supervisors approve the and re-appointments to serve on the Camp Baker The Camp Baker Management Board has the responsibility of overseeing and monitoring the operation of Camp Baker. The positions representing the Midlothian and Dale Magisterial Districts and the At-Large position expire April 30, 2011. Four applications were received for these positions. Mr. Hubert Urban resides at 132100 Jarman Lane, Richmond, VA 23235, and has served on the Camp Baker Management Board, representing the Midlothian District, for a term of three years, and has expressed a willingness to continue for another term. Mr. Mills is willing to serve in the At-Large position for a three-year term. The Board of Supervisors and the Camp Baker Management Board concur with the appointments of Mr. Urban, Mr. Lumpkin, and Mr. Mills. The terms would be effective May 1, 2011 through April 30, 2014. Under the existing Rules of Procedure, appointments to boards and committees are nominated at one meeting and appointed at the subsequent meeting unless the Rules of Procedure are suspended by a unanimous vote of the Board members present. Rollston, Jr. will retire from Chesterfield Fire and Emergency Medical Services Department, Chesterfield County, on June 1, 2011; and WHEREAS, prior to beginning his career with Chesterfield Fire and EMS, Lieutenant Rollston served as a dispatcher in the Police Department from October 1979 to May 1981, and as a deputy in the Sheriff's Department from December 1981 until October 1982, while also serving as a volunteer firefighter; and WHEREAS, Lieutenant Rollston began his Fire and EMS service as a volunteer at the Wagstaff Fire and EMS Station in 1975 and faithfully served the citizens of Chesterfield County for more than 35 years, attended Recruit School #13 in 1982 and served in various assignments, as a firefighter at the Manchester and Midlothian Fire and EMS Stations, and as a lieutenant at the Bensley, Clover Hill, Swift Creek and Enon Fire and EMS Stations; and WHEREAS, Lieutenant Rollston was an advanced life support provider and an active technical rescue team member; and WHEREAS, Lieutenant Rollston was assigned to the Fire and Life Safety Division in 2000 and obtained various related certifications; and WHEREAS, Lieutenant Rollston graduated from the Virginia Fire Marshals Academy as a sworn law enforcement officer in November 2000; and WHEREAS, Lieutenant Rollston served on the Fire Marshals Law Enforcement Process Action Team in 2002 and was instrumental in establishing law enforcement sworn fire marshals in Chesterfield County; and WHEREAS, Lieutenant Rollston received his Department of Criminal Justice general and firearms instructor certifications in 2004; and WHEREAS, Lieutenant Rollston was selected for and graduated from the Alcohol, Tobacco, Firearms and Explosives accelerant canine handler's school in 2004 and served in that capacity with his dog Hero for over six years; and WHEREAS, Lieutenant Rollston received a Certificate of Commendation in 2005 for the rescue of a citizen from a structure fire; and WHEREAS, Lieutenant Rollston obtained the necessary requirements and experience to successfully receive his certification as a Fire Investigator from the International Association of Arson Investigators. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors recognizes the contributions of Lieutenant Robert C. Traylor, Fire and Emergency Medical Services, Upon His Retirement County Administrator's Comments: County Administrator: i Action Requested: Adoption of the attached resolution. Summary of Information: Lieutenant Steven V. Traylor will retire from the Fire and Emergency Medical Services Department on May 1, 2011, after providing 38 years of dedicated service, including four years as a volunteer. Preparers Edward L. Senter Attachments: ^ Yes ^ No Title: Fire Chief #000018 RECOGNIZING LIEUTENANT STEVEN V. TRAYLOR UPON HIS RETIREMENT WHEREAS, Lieutenant Steven V. Traylor will retire from the Chesterfield Fire and Emergency Medical Services Department on May 1, 2011; and WHEREAS, Lieutenant Traylor joined the department as a volunteer member in 1973, began his career attending Recruit School #8 in 1977, and has faithfully served Chesterfield County for 38 years in various assignments, as a volunteer district chief at the Dale Fire Station, a firefighter at the Wagstaff Fire and EMS Station, a sergeant at the Dutch Gap, Bensley, and Dale Fire and EMS Stations, and as a lieutenant at the Airport, Manchester and Buford Fire and EMS Stations; and WHEREAS, Lieutenant Traylor has been a member of the Hazardous Incident Team since 1993 and trained to the level of Hazmat Specialist; and WHEREAS, Lieutenant Traylor was assigned as one of the first Tactical Safety Officers in the department; and WHEREAS, Lieutenant Traylor was recognized, along with his crew, with an EMS Unit Citation for his part in rescuing trapped occupants from a vehicle accident in March 1995; and WHEREAS, Lieutenant Traylor was recognized with an EMS Lifesave Award for his actions in April 1995, which saved the life of a cardiac arrest patient; and WHEREAS, Lieutenant Traylor was awarded the Chesterfield Fire and Emergency Medical Services Department Medal of Valor, as well as an EMS Lifesave Award, for his heroic actions during Tropical Storm Gaston in August 2004, including breaching a roof and masonry walls, and carrying people to safety over a makeshift ladder bridge during the rescue of occupants at the Falling Creek Apartments, and was also recognized by the International Association of Fire Chiefs, receiving the Benjamin Franklin Fire Service Award of Valor for those actions; and WHEREAS, Lieutenant Traylor was recognized for being a member of a team that rescued a tree-service worker who was trapped 50 feet up in a tree and unable to descend due to a malfunctioning harness in March 2010. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors recognizes the contributions of Lieutenant Steven V. Summary of Information: At the March 9th meeting, the Board of Supervisors recognized finalists in the 2011 National Achievement Scholarship Program. Since that time, Ms. Yeshi Lemma, a senior at Manchester High School, received notification that she was a finalist in the 2011 National Achievement Scholarship Program. YESHI LEMMA AS A CHESTERFIELD COUNTY 2011 NATIONAL ACHIEVEMENT SCHOLARSHIP FINALIST WHEREAS, Chesterfield County is a four-time winner of recognition as "One of the 100 Best Communities in America for Young People" by General Colin Powell's organization, America's Promise-the Alliance for Youth; and WHEREAS, Chesterfield County Public Schools are consistently rated highly for providing what parents want for their children's education; and WHEREAS, while the county and its schools can provide many opportunities for young people to succeed, it is the diligence and personal pursuit of excellence on the part of a young person that ultimately ensures their success; and WHEREAS, Ms. Yeshi Lemma of Manchester High School has excelled in her academic pursuits; and WHEREAS, this young scholar has been named as a finalist in the 2011 National Achievement Scholarship program; and WHEREAS, Ms. Lemma now has an opportunity to earn one of approximately 800 Achievement Scholarship Awards, worth more than $2.5 million, that will be offered this spring to African American high school seniors who are among the highest-scoring entrants this year; and WHEREAS, Chesterfield County is proud of the accomplishments of Ms. Lemma, and on behalf of the citizens of Chesterfield County, extends sincere congratulations. Subject: Resolution Recognizing May 2-6, 2011, as "Business Appreciation Week" in Chesterfield County County Administrator's Comments: County Administrator: Staff recommends the Board of Supervisors establish the week of May 2-6, 2011, as "Business Appreciation Week" in Chesterfield County and adopt the attached resolution. Summary of Information: The Commonwealth of Virginia is adopting May 2-6, 2011, as "Business Appreciation Week" and is encouraging all localities to do the same. The 2011 Business Appreciation Week theme is "Entrepreneurship and Innovation for a Sustainable Future." Chesterfield businesses continue to be innovative and look for ways to incorporate green technologies into their operations; therefore, in recognizing "Business Appreciation Week" in conjunction with the state's efforts, the Board of Supervisors will be recognizing the valuable economic and employment benefits that the businesses provide and how they are entrepreneurial in nature. Yes ^ No # oo~a~2 RECOGNIZING MAY 2-6, 2011, AS "BUSINESS APPRECIATION WEEK" IN CHESTERFIELD COUNTY WHEREAS, Chesterfield County has a diverse base of business and industry that supports our local economy; and WHEREAS, these seven thousand four hundred seventy four businesses are both domestically and internationally based and range in size from very small entrepreneurial companies to large corporations; and WHERAS, these businesses have found Chesterfield County to be a very attractive place to conduct business and recruit and retain skilled employees; and WHEREAS, nearly $120 million has been invested and 531 new jobs created by industry thus far in Fiscal Year 2010-2011, with the total impact of County businesses being an integral part of the local economy and vital to supporting the high quality of life enjoyed by Chesterfield residents; and WHEREAS, these businesses provide 113,673 essential employment opportunities for the residents of Chesterfield County, as well as incorporate new technologies that make them more competitive and sustainable long into the future; and WHEREAS, business tax revenues are critical in offsetting the cost of county-provided services these businesses created more than $165 million of new construction in 2010 contributing more than $1.5 million an additional in real estate tax revenue. Summary of Information: The attached resolution recognizes the contributions of Chesterfield County Career and Volunteer EMS responders during "National Emergency Medical Services Week." Senter, Jr. Title: Attachments: ^ Yes ~ No OQ~J~D~L4 Fire Chief RECOGNIZING MAY 15-21, 2011, AS "EMERGENCY MEDICAL SERVICES WEEK" WHEREAS, providing emergency medical services is a vital public function; and WHEREAS, the members of emergency medical services are ready to provide high quality lifesaving care to those in need twenty four hours a day, seven days a week; and WHEREAS, immediate access to high quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and WHEREAS, injury prevention and the appropriate use of the EMS system will help reduce national health care costs; and WHEREAS, the emergency medical service is comprised of emergency physicians, emergency nurses, emergency medical technicians, paramedics, firefighters, communications officers, educators, administrators and others; and WHEREAS, working together, Chesterfield County's emergency crews responded to more than 25,000 medical emergencies in 2010, representing countless hours of dedicated service to the community; and WHEREAS, the members of emergency medical services, whether career or volunteer, engage in many hours of specialized training and continuing education to enhance their lifesaving skills; and WHEREAS, the residents and guests of Chesterfield County benefit daily from the knowledge, skills, and dedication of these highly trained individuals; and WHEREAS, it is appropriate to recognize the value and the accomplishments of the emergency medical services providers from Chesterfield Fire and EMS, Defense Supply Center Richmond, Chesterfield County's Emergency Communications Center, and the volunteer rescue squads of Bensley-Bermuda, Ettrick-Matoaca, Forest View, and Manchester. Subject: Adoption of a Resolution Supporting the Sustainable Transportation Initiative of Richmond (STIR) County Administrator's Comments: County Administrator: Adopt the attached resolution. Summary of Information: Mrs. Durfee has requested the Board consider adopting the attached resolution in support of the Sustainable Transportation Initiative of Richmond (STIR). STIR exists to ensure the Greater Richmond Region's future transportation system by promoting an array of cost effective, sustainable transportation choices for citizens in the region. These transportation choices are designed to move people in a manner that maintains access and mobility while minimizing the impact of travel on the environment. Projects that STIR is supporting include: community support for advancing DOT Tiger grants (Department of Transportation-Transportation Investment Generating Economic Recovery); support for making Richmond a pilot city for the Urban Mobility Network (as funded by Ford Motor Company); and support for Richmond as a pilot for the G.M./Segway PUMA Project. All of these projects incorporate transportation systems that provide state of the art alternatives to traditional transportation. STIR will be chaired in the upcoming year by Kim Scheeler from the Greater Richmond Chamber of Commerce. The Executive Committee is composed of regional leaders including Tom Silvestri from Richmond Times-Dispatch, Greg Wingfield from the Greater Richmond Partnership, Bob Crum from RRPDC, and Gary Rhodes, President of J. Subiect: Change Order to United Refrigeration of Virginia, Incorporated for the Construction of the Security, HVAC and Electrical Upgrades at the Chesterfield County Jail Annex County Administrator's Comments: County Administrator: Board Action Requested: Authorize the County Administrator to execute a change order with United Refrigeration of Virginia, Inc. in the amount of $66,488.00 for the Security, HVAC and Electrical Upgrades at the Chesterfield County Jail Annex. Summary of Information: On September 23, 2009, the Board of Supervisors awarded a construction contract to United Refrigeration of Virginia in the amount of $1,767,500 for security, HVAC and electrical upgrades in the County Jail Annex. The Annex project includes selective interior demolition, replacement of the electronic security/CCTV system and detention lock hardware, replacement of the integrated HVAC/fire/smoke management system and replacement of the emergency generator with a unit adequately sized for the facility. To ensure that the primary goals of the project were met, certain necessary improvements were deferred pending evaluation of actual costs versus the available funding. Also, during the course of the project unknown conditions were discovered that required additional infrastructure repairs. Summary of Information: Chesterfield Berry Farm proposes to conduct outdoor music during the May strawberry season on the lawns of the Chesterfield Berry Farm which is located at 26002 Pear Orchard Road, Moseley, Virginia. The music will be held on Saturdays and Sundays from April 30 through June 6, 2011. A Strawberry Festival is planned for April 30 and May 1, 2011. The Berry Farm opens at 9:00 a.m. Music will begin at 11:00 a.m. and end at 4:00 p.m., with all other activities ending at 6:00 p.m. The bands for the series have not been contracted for at this time. The Berry Farm is currently seeking sponsors to help defray the costs of the event. All net proceeds from the music series will go to the Berry Farm. The Berry Farm will assume full financial responsibility for the Festival and music series. The Berry Farm will have food, water, and soft drinks available for purchase during festival hours. Portolets remain on the location throughout the May season and are serviced twice a week by Nes services. The Berry Farm maintains appropriate clean-up and trash disposal. There is ample parking, and off-duty police officers will assist with parking, crowd control and other security needs. Emergency medical and fire department officials are aware of the event and will be available to render service. The music/entertainment arrangements have been reviewed by the County Attorney's Office and meet the substantive requirements of the ordinance. These arrangements provide adequate measures to ensure public safety, fire prevention, medical protection, sanitation, traffic control, insurance coverage, relevant permits and security. Although the Board of Supervisors may require a bond to ensure compliance with the permit, the Board traditionally has not required a bond except when the event occurs on County property. Summary of Information: AAC Technology Partners, LLC is a technology consulting firm retained by Chesterfield Utilities to provide project management and quality assurance services during the development of the Customer Information System (CIS). The overall project budget is $4,000,000. The approach to this project is divided into three phases: 1) Needs Assessment/Vendor Selection; 2) Development; and 3) Implementation/Go Live. 1) Needs Assessment/Vendor Selection On September 27, 2006, the Board of Supervisors authorized the County Administrator to execute a contract with AAC Technology Partners, LLC to provide consultant services to assist Utilities staff with needs assessment, Request For Proposals (RFP) development, evaluation of RFP responses, and contract negotiations in selecting a new software solution to meet our business requirements. This original contract with AAC Technology Partners, LLC for this phase of the project was in the amount of $194,600. 2) Development The original contract contained a provision for the county to request additional services associated with development of the Customer Information System project. On April 23, 2008, the Board of Supervisors authorized the County Administrator to execute an amendment to the contract in an amount of $412,800 for 15 months to provide project management and quality assurance services during the development phase of the CIS. Due to unanticipated project delays, an additional six (6) months was added to this phase with the second amendment. we are again experiencing a few delays with development and an additional two months is needed to complete the development phase of the project. 3) Implementation/Go Live The contract's second amendment included services related to implementation of the new system and technical assistance during the post go-live period. These services will provide continued support to our staff for three (3) months during the post go-live phase to ensure software functionality and seamless transition for our customers from the old system to the new CIS. Summary of Information: The county regularly participates in an annual VDOT matching fund program (Revenue Sharing) wherein the county may provide up to $1,000,000 in anticipation of an equal match by the Virginia Department of Transportation (VDOT). VDOT advised localities that the General Assembly approved modifications to the FY2012 Revenue Sharing program (Attachment A) Most significant among the modifications is a potential increase in VDOT funding of up to $200 million. Last year, only $15 million was allocated to the program. The modifications also include increasing the maximum match request to $10 million. Previously, the maximum match request was $1 million. These changes are expected to be approved by the Governor and become effective July 1, 2011. Applications for Revenue Sharing funds are due to VDOT by April 29, 2011. The standard $1 million plan would be funded via $500,000 from the FY2012 Capital Improvement Program for the revenue sharing program, $434,700 from the Industrial Access Account, and $65,300 from previously designated road matching funds (see Attachment B). Additionally, if the Board wishes to pursue the amended maximum match request, staff has developed a funding plan that would allow the county to apply for the full $10 million match. The $10 million plan is comprised of the following sources, as detailed in Attachment B: 1) the $1 million listed above, 2) $5.5 million in 2004 bond sale proceeds that are available from the Route 10 (I-95 to Ware Bottom Spring Road) Widening Project due to favorable bids and additional federal support, 3) $1 million in additional general road improvement funds / project savings, 4) $1,000,000 in Shed 6 transportation proffer funds (use per policy), 5) $634,700 in capital reserve funds, and 6) $865,300 in additional Industrial Access funds (for a total of $1.3 million). Moreover, this funding plan would not jeopardize any existing transportation project, nor would it hamper the county' s ability to meet the needs of future economic development efforts via the Industrial Access Account as a balance of more than $1 million would remain in that account for FY2012. The additional revenue sharing funds, if approved by VDOT, could be used to address priority projects and other local projects desired by the Board. Three Alternates are presented for the Board's consideration. Refer to Attachment C for proposed projects for the alternates. The Board's Priority List of Highway Projects is also attached for reference (Attachment D). In order to meet the application deadline of April 29, 2011, the Board is requested to act on this item. Authorize the Chairman of the Board of Supervisors and County Administrator to execute easement agreements for relocation of utilities; and 6. Authorize the County Administrator to proceed with the advertisement for construction of the projects. District: Countywide PROPOSED MODIFICATIONS TO VDOT REVENUE SHARING PROGRAM (anticipated to become effective July 1, 2011) • Increases the maximum funding that can be allocated towards the program to $200 million. Warren Chairman, Board of Supervisors Dear Chairman Warren: My name is Debra Girvin and I live on Taylor Road which is far west in Chesterfield County off Hull St. Road. Because of where I live and the nature of my work I must travel the Hull Street Road Corridor daily, and in some instances I pass through the intersection of Hull and Winterpock and Hull at Hampton Park/Otterdale 4 times a day or more. This section of a major Chesterfield corridor can be a nightmare to navigate. With the growth that has taken place in the area over the past 10 years the infrastructure has not kept pace. A bottleneck frequently occurs at the Woodlake intersection and continues west to Hampton Park. Accidents are frequent. As one might imagine, this slows things down even more. In 1999 making changes to this section of Hull Street Road was listed as a Regional Project and has been on the priority list of projects ever since. In 2001 the scope was changed. This scope change was a result of funding, or the lack thereof, not a change in the data or growth patterns of the area. In 2010 a project listed in two phases was number 4 on the Priority List of Highways. This item is listed on a public approved document as 4a. Winterpock Road to Woodlake Parkway - $12M and 4b. Woodlake Parkway to Otterdale Road - $25M. It is my understanding that this list was prepared by Mr. McCracken, Director of Transportation and presented to the Board of Supervisor at the March 23, 2011 meeting with minimal changes. Those changes kept 4a. as 4a, but moved 4b to number 10 on the list. Most certainly every project on this list has value to the county and the quality of life for its citizens. My confusion comes from the fact that once this list was prepared by Mr. McCracken and his qualified department and presented to the Board of Supervisors it took approximately 15 minutes for the Board to make changes to the list and it was rearranged. One of those changes includes widening the Powhite to Watermill Parkway being moved up on the list. As a business person and taxpayer I expect that Mr. McCracken and his department used bona fide calculations and criteria to create the list as it was submitted. They are experts in this area and I would trust the board would depend strongly on their recommendations. I do not understand the criteria the Board of Supervisors applied while making their decisions to rearrange the list. These types of activities affect all of the citizens of Cheste~eld County and the Board of Supervisors should always have the county as a whole in mind when examining the crucial issues relating to infrastructure. As excited as I am about the forward momentum regarding roads in the county and the possibility of receiving additional monies through revenue matching I am distressed regarding the quick actions taken by the Board and that those actions do not appear to be based in the data. Even in an election year, I expect the decisions of this Board to be based in fact and data and to reflect what is right for the county as a whole. This board has impressed me over the past few years and has indeed helped to move the county through tough economic times with wisdom and grace. This quick action on the transportation list seemed to have the "old board" sitting in the shadows and doing the coaching. I cannot help but feel that the data would indeed support keeping a project that has been on the books since 1999 and located in an area with increased growth, both in residential and business (economic development) in its recommended position of 4a and 4b. McCracken, Director of Transportation r April 26, 2011 Chesterfield Board of Supervisors Jay Stegmaier, County Administrator John McCraken, Transportation Director To All: It has recently come to my attention that there has been some shifting of priority for Chesterfield County's most needed road projects and that a "final" recommendation from the Board of Supervisor's will be set tomorrow. Given this very recent change and the quick determination of the road projects' final priority listing, I wanted to present some thoughts to the Board. All of you know me as someone who often works on behalf of the County in various business and economic development environments and has been very supportive of much of the BOS' progressive handling of issues related to the business and citizen community. The BOS in conjunction with the county administration have done a tremendous job in leading our county through very difficult times and has positioned Chesterfield for successful growth as the economy and politics allow. It is certainly recognized that funding for infrastructure in the County will be tight for the foreseeable future and that priority of where that precious money is spent needs to be very carefully considered. While local, regional, and statewide politics can often play a part of important decisions for our County, I encourage you all to stick to logic as this list of the County's road priorities are being finalized. My significant concern is the shuffling of the top ten or so road projects on the County's priority list. A year ago, the two-phase widening of Route 360 between Winterpock and Otterdale Roads was listed as the #4 project. My understanding now is that some of the BOS members have decided to move Phase 1 of the Route 360 project to #6 on the list and move Phase 2 to #9. I do not know the definite reasoning behind these recent shifts in priority but 1 understand it may be because of perceived economic development benefits of certain projects over others. I certainly support the County's desire to focus infrastructure around economic development potential but I do not see that focus in this shifting of priorities away from the Route 360 corridor. The western Hull Street corridor west of Route 288 has been one of the best commercial economic development engines the County has seen in many years. The commercial development happened here not just because of existing residential development, but because of the substantial road improvements that have come over the last ten or more years. New n residential development was also encouraged farther West by the existing road improvements and the new road construction that occurred over the past five years. It is apparent with the zoned and in-process residential development that will be coming west of Woodlake and Hampton Park, that significant additional economic development will be likely on one of the County's busiest corridors. This scenario is also heavily supported by the income levels in that area of the County. Additionally, this is a significant current quality of life issue in this corridor as it has become very crowded at many different times of the day and on weekends, not just during weekday rush hours. The moving of the Powhite Parkway extension to Brandermill Parkway to #3 on this list is fairly difficult to understand. There may be some benefits for rush hour traffic but I cannot believe that this project would be more beneficial to the County's current needs than the Route 360 widening. Unless the County is ready to commit to many tens of millions more to improve the roads beyond the Powhite extension I cannot see any near-term economic development enhancement or substantial impact to the citizens in the Old Hundred Road corridor. Route 360 West has been a relative gold mine to the County's economic development growth over the past ten years and much of that can be attributed to proper road improvements and attractive zoning requirements. By not maintaining the Route 360 expansion as a top three priority the County will be ignoring the current need of the existing citizens, small businesses and large businesses, and greatly stymieing one of the County's economically most successful highway corridors. Honestly, it feels like there is more politics than logic in the most recent priority list. While politics are a necessary evil in most everything all of us do, I do believe the County has benefitted in recent years from more logic in its development decisions. 1 look forward to a respectful and logical discussion as the road priorities are discussed at Wednesday's BOS meeting. Since I could not receive a definitive understanding of how minority populations are determined from the deputy county attorney, I am convinced there is a CRACKING of some precincts, and STACKING them in other districts in order to achieve a corrupt redistricting effort. Specifically speaking, precinct #515 (or #516 as the map lists it or the Davis precinct) has a majority minority population. During the last census redistricting in 2001, this precinct was moved out of the Dale district to the Clover Hill district to so- call balance the district population, or weaken the minority voting strength in the Dale district. Now, during this redistricting period that same precinct is being moved from the Clover Hill to the Midlothian district. I there forth, believe that a legitimate explanation should be reviewed, if not by this board by the Department of Justice, on the cause of this precinct's move from one district to another, during these redistricting procedures. Summary of Information: An amendment to the state constitution which creates a real estate tax exemption for disabled veterans was proposed and agreed to by the General Assembly in 2009 and 2010, and ultimately was passed by a vote of the people on November 2, 2010. The constitutional amendment directed the General Assembly to provide the exemption by general law, which the General Assembly did during the 2011 session by passing Senate Bill 987. Senate Bill 987 requires localities to adopt a local ordinance implementing the tax exemption. Senate Bill 987 was signed by the Governor on April 6. Summary of Information: On February 24, 2010, the Board authorized staff to proceed with the acquisition of right-of-way and easements for the Chalkley Road Curve Realignment Project. The Board also authorized the advertisement of an eminent domain public hearing, if needed. Settlements have been reached with nine of the ten landowners impacted by the project. Custalow. The county needs to acquire 1.047 acres in fee right-of-way, 0.398 acre in slope and drainage easement, and 0.01 acre in Dominion Virginia Power easement from this owner. The county's consultant appraised the acquisition at $21,475. At the request of the owner, an offer letter, based on the appraisal, was mailed on July 20, 2010. Several discussions between the county's consultant and the owner occurred with no counter offer being made by the owner. On April 12, 2011, the property owner met with the county's consultant and provided a verbal counter offer of $68,300. Staff feels this amount cannot be justified. Staff has notified the owner of the eminent domain request before the Board. If the county proceeds with eminent domain, a certificate of deposit will be filed with the court which will immediately entitle the county to enter and use the right-of-way and easements prior to the commencement and conclusion of eminent domain proceedings in court. The county will then be obligated to purchase the right-of-way and easements from the landowner. Sufficient funds are available in the budget to pay the anticipated condemnation costs. Staff will continue to attempt to negotiate a settlement with the owner after the certificate is filed, and pursuant to the certificate, the owner, upon request, will be paid the amount which the county's appraisal reflects is owed. The project is scheduled to be under construction this summer, but the schedule is contingent on utility relocations. Recommendation: Staff recommends the Board authorize the exercise of eminent domain on Renee B. Subiect: Public Hearing to Consider an Ordinance Redistricting Magisterial District Boundaries and Adjusting Voting Precinct Boundaries and Polling Places County Administrator's Comments: County Administrator: Adopt an ordinance redistricting magisterial district boundaries and adjusting voting precinct boundaries and polling places. Summary of Information: Every ten years, after census figures are released by the Federal government, state and local governments are required to redistrict their election districts to ensure substantial population equality among the districts in accordance with the constitutional requirement of "one person, one vote." State and local governments received census data in February. Accordingly, it is now time for the County to redistrict magisterial district boundaries. The 2010 census data for Chesterfield is shown on Attachment 1 to this item. The county's population grew from 259,903 in 2000 to 316,236 in 2010. A disproportionate amount of the growth occurred in the Matoaca magisterial district. Accordingly, in order to achieve population equality among the districts, significant portions of Matoaca magisterial district will need to be redistricted into Clover Hill, which is below the population average. Adjustments between Clover Hill and Midlothian, and between Matoaca and Midlothian, are also proposed. Adjustments between Bermuda and Dale also Preparers James J.L. In order to achieve population equality, each magisterial district may vary by no more than 5% above or below the average figure of 63,247. Over the past few weeks, staff has met individually with the Board members to create redistricting proposals for public discussion and the Board's consideration. Based on these discussions, two plans (Plan A and Plan B) have been developed and advertised. In addition to meeting the population equality requirements of the Constitution, these plans assure that each election district will be compact and contiguous, that all election district boundaries will be clear and observable as required by state law, and that no racial retrogression occurs in districts represented by minority representatives, as required by federal law. Staff conducted community meetings on April 11 at the Board's Public Meeting Room and on April 14 at Greenfield Elementary School to publicize and explain the proposed plans and obtain citizen input. Board members have been provided minutes of these meetings. Attached as Attachment 2 are charts showing the new population of the magisterial districts if Plan A is adopted, as well as a map, ordinance and textual description of the changes proposed by Plan A. Attached as Attachment 3 are the same documents for Plan B. Plan A creates three new voting precincts and polling places. Plan B creates two new voting precincts and polling places. These changes are necessary to conform with anticipated General Assembly election district boundaries. Additional changes may be necessary as the General Assembly continues to consider its redistricting plan. The Registrar anticipates requesting additional precinct splits later this year, in preparation for next year's Presidential election, in order to avoid overcrowding in precincts which experienced heavy voter turnout in the 2008 Presidential election. After the Board adopts its redistricting plan, the plan must be submitted to the United States Department of Justice for approval before it can be implemented. The Justice Department has 60 days to review the plan. The Board needs to adopt a plan at this meeting to obtain Justice Department approval, in time for any August primary elections which may be scheduled.
