On motion of Hr. BrittoD, seconded by Mr. Martin, it is resolved that contract 65-11-40A for the installation of ~ewers in the Cherry Garden~ area be awarded to the $tamie E. On motion of Mr. BritPon~ seconded by Mr. Goyne~ i~ is resolved that Consultants, R. Stuart Royer & Associates, b~ authorized to proceed with planning the enlarg- ing Of the sewage treatment plant and to consider the installation of secondary treatment at bhis time. Mr. Stephen White comes before the Board in behalf of the Rowanty Court Apartment Project on Dupuy Road~ stating that the apartment was planned and financing was arranged and the building permit was applied for on June $~ 1967~ however~ work had commenced before that date and that serious financial difficulties would be encountered if the Corporation had to pay the stated ~300.00 sewer connection fee and requested that this connection charge be reduced to $100.00 since the plannin and construction had been started. Upon consideration whereof, and on ~otio~ of ~r. ~rowning, seconded by Mr. Goyne, it is resolved that the connection charge be reduced to $100.00 on 36-apartment units in this pro3ect. Mr. Browning and Mr. Martin and Mr. Goyne, vote Aye. Mr. Apperson votes ~ay. Mr. Britton does not vote. Goode for a parcel of land in connection with pro- ject C-454 and the stun of 650.00 be offered the heirs of the Brow~ E~tate for a piece of land in Projects 6511-40 A/6, and the County is authorized to condemn these parcels Of la~d if the offered sums in the respective cases are not accepte The matter of the installation of street signs was discussed befoue Mr. Lancaster and he s~ated that the ~ighway Department will furnish the post ~nd erect the signs if said signs are available~ and if the ~ign~ are stolen the Highway Depart ment will erect them if they are replaced by the County. Mr. Lancaster agreed to investigate the {urnishing of posts to the County if the County advanced the hum- The matter of the vacation of g~s easement~ and the granting Of ~as easements was again discussed by the Board with no specific action taken. The Highway Department has officially notified the Board that Adler Road has accepted into the State System: Adler Road - from a point o~' Route 1660, 0.06 mile north of Route 2255 and running east 0.14 mile to Route 1659 0.14 mile There were read certain letters concerning the c6nstruction of Rt. 288, being an extension of Rt. 295 Interstate. The matter of the improvement of the alley behind the Falling Creek Car Repair Building, just south of Chester Hill Circle, as requested by Mr. C. B. Joyner wa~ discussed and it was generally agreed that Mr. Goyne would investigate this re- quest and report at a later date. On motion of Mr. Browning, seconded by Mr. Goyne, it is resolved that Mr. R. V. Lancaster, Resident Engineer, Virginia Department of Highways, be requested to give closer attention to the reporting of dead animals on the highway and the picking up of same. Mr. Lancaster reports that Chippenham Parkway will be opened on or before July 1, 1968. Dr. Martin requested Mr. Lancaster to get a price on surface-treating Salisbury Drive for a distance of .2 or .3 of a mile. On motion of Mr. Browning~ seconded by Mr. Martin, it is resolved that' the High- way Department be requested to ~mprove the east end of South Street in Ettrick. Mr. Chas. W. Beddow presents a petition signed by 8 people requesting the vacati( of a 20-ft. roadway north of Cogbill Road and lying between the subdivision of Alice Heights and North Chesterwood and adequate advertising having been given b law, requests that the Board pass a prepared resolution vacating, this roadway and retaining the 16-ft. easement as requested by the Engineering Department. Mr. Apperson states that the easement is not necessary and that we should vacate the entire road, however, it was generally agreed that the ordinance be passed as requested and if the easement is not neeeded it can be vacated at a later dat~ Upon further consideration and on motion of Mr. Apperson, seconded by Mr. Goyne, the following resolution is adopted: WHEREAS~ Paul E. Adams and Edith W. Adams, his wife, and Leonard R. Toney and Beulah E. Toney, his wife, are the owners of Lots 15 and 1, respectively, of Section A, Alice Heights, Chesterfield County, Virginia, as shown on a plat of Alice Heights made by Brooks and Barton, Certified Land Surveyors, dated August 12, 1958, recorded August 15, 1958, in Plat Book 10, page 89, in the Clerk's Office of the Circuit. Court of the County of Chesterfield,Virginia~ and WHEREAS, Eugene O. Conner, and Ada W. Conner, his wife, and William J. Reid and Mary R. Reid, his wife, are the owners of Lots 1 and 4 of Block A, North Chesterwood Subdivision, Chesterfield County, Virginia, as shown on a plat of North Chesterfield Subdivision, recorded in Plat Book 8, pages 169 and 170, in the Clerk's Office of the Circuit Court of the County of Chesterfield, Virginia, and WHEREAS, the aforesaid owners have petitioned this Board to vacate a 20-ft. roadway lying between Lots 1 and 15 of Section A, Alice Heights, and Lots 1 and 4, Block A, North Chesterwood Subdivision of the hereinbefore described property owned by the petitioners, and WHEREAS, the proposed vacation will not interfere with the rights of any other party~ NOW, THEREFORE, the Board of Supervisors of Chesterfield County, Virginia, doth hereby approve the vacation %o the adjoining land owners of the 20-foot roadway between Lots 1 and 15 of Section A, Alice Heights, Chesterfield County, Virginia, as shown on a plat of Alice Heights, made by Brooks and Barton, Certi- fied Land Surveyors,.dated August 12, 1958, recorded August 15, 1958, in Plat Book 10, page 89~ in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, and Lot~l and 4, Block Ay of North Chesterwood Subdivision as shown on a plat of North Chesterwood Subdivision recorded in Plat Book 8, pages 169 and 170 in the Clerk's Office of the Circuit Court of Chesterfield County which said vacation shall be of all right~ title and interest held by the County of Chesterfield with reservation of the 8-foot easement for drainage and utiliti( now existing on all of the aforesaid lots and across said roadway, and with the fu~he~ reservation of an 8-foot easement for drainage and utilities on each of the hereinbefore mentioned.lots along the Center-line of said 20-foot roadway identical in every respect to the easements now existing along the rear property line of each of the hereinbefore mentioned lots. BE IT FURTHER RESOLVED that the Clerk of the Circuit Court of Chesterfield Count' Virginia, is requested to indicate the vacation of said 20-foot roadway on the margin of the recorded plat of Alice Heights, Section A~ recorded in Plat Book 10 page 89, and on the margin of the recorded plat of North Chesterwood Subdivision recorded in Plat Book 8, pages 169 and 170 and to enter the same on the Grantor!s side of the general index of deeds and the names of the parties hereto. 67-43 Mr. Alexander Neal, Attorney, representing the Random Corporation comes before the Board requesting the rezoning from Agricultural & Residential-2 to General Business (C-2) of several parcels of land of irregular shape fronting 1645 feet, more or less, on Route 892 and extending eastwardly an average of 750 feet, more or less, beginning at a point on Rte. 892 approximately 210 feet, south of Rte. 360 and encompassing the Manchester Lake area which is presently zoned General Business ~C-2), in Manchester Magisterial District. Refer to Sec. 29-15 and 40-3 And stated that he wishes to delete the area for the 22-units southeast of the main tract from the zoning request~ that the problem has been raised by the re- checking of the zoning maps at which time an error was found and that his Company had purchased the land relying on the accuracy of the County's zoning maps. Mr. Neal states further that his Company had done everything to cooperate with th. County, to acquire new outlets for traffic, only to find that prices were far too high. He states further that most people agree that a better access would be desirablelut that the present proposed access would be adequate. Several citizens appear to question the zoning, nine people appeared to objec~ to the request. Mr. Britton states that there will be a new Supervisor on January 1, 1968~ and that he does not want to deal with such a weighty problem at this time, and moves that the matter be delayed for sixty days to give the new Supervisor a chance to review this question. This motion was seconded by Mr. Martin. Mr. Neal states that mortgage money will not beavailable after January 1, 1968 and his Company had done everything possible to be done and that one-third of the land area will be used for recreatton~ that they propose to build 188-units at a cost of over $2,000,000. Mr. Goyne states that he is ready to vote now. A vote being taken, Mr. Britton and Mr. Martin vote Aye. Mr. Goyne, Mr. Apperson, and Mr. Browning vote Nay. Whereupon, Mr. Goyne moves, seconded by Mr. Browning, that this Board approves the zoning request subject to the Planning Commission's recommendation. Mr. Goyne, Mr. Apperson and Mr. Browning vote Aye. Mr. Britton and Mr. Martin vote Nay. Mr. Apperson states that the sole reason for his decision was that the County was in error in the zoning maps. Mr. Britton states that the County'was not in error, the original owner took more land for business that he had zoned. 67-7~. Mr. Robert S. Bruce comes before the Board requesting~he rezoning from Agricul- tural to General Business (C-2) on a parcel of land of irregular shape ~ronting 100 feet on U. S. Rte. 360 (Hull Street Road) and extending southeastwardly 110 feet, being 120 feet southwest of Lancer's Boulevard, in Manchester Magisterial District. Refer to Sec. 29-15 pt. of par. 1. There appearing no one in opposition to this request and the Planning Commission having recommended the same to be approved, it is on motion of Mr. Britton, seconded by Mr. Goyne, resolved that the aforedescribed parcel of'land be and it hereby is rezoned for General Business subject to the approval of the site layout and plans by the County Planner. 67-73. On motion of Mr. Browning~ seconded by Mr. Apperson, it is resolved that the fol- lowing ordinance be and it hereby is adopted: AN ORDINANCE to amend Sec~on 3-3 of Chapter 3 of The Code of the County Chesterfield~ Vtrginia~ by adding thereto a new section to be known as Section 3-3.1 relating to the dumping in the County landfill of material collected of Chesterfield County. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD~ 1. That Section 3-3 of Chapter 3 be amended by adding a new section to be known as Section 3-3.1~ as follows: Sec. 3-3.1. Same --- Not to be used for material collected outside the County. It shall be unlawful for a person who is a resident of the County to dump ~rash, rubbish, tin cans, garbage and other waste substances and material which has been collected outside the County~ at the County dumping ground. 2. This O~dinance shall be in full force and effect from and after its date of passage in accordance with law. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that the allow commercial tree trimmers to use the landfill at Fort Darling for disposal of tree limbs, etc. On motion of Mr. Britton~ seconded by Mr. Browning~ it is resolved that the re- quest of the Fire Marshal for 4-fire hydrants on Rt. 360 be sent to the Enc ing Department. On motion of Mr. Browning, seconded by Mr. Apperson~ it is resolved that the Fir~ Marshal be requested to negotiate a.sale for the 1949 fire engine at the Ettrick Fire Department with some of the adjacent counties. On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved that the erroneous tax claim of Dr. Donald W. Hunt, be, and it hereby is approved for pay- ment. On motion of Mr. Browning, seconded by Mr. Goyne, it is resolved that the of Mr. Thomas M. Lewis for a street light on .Pine Street and the request of Mr. Goyne for a street light at the new location of the Bensley Rescue Squad be and they hereby are referred to the Light Committee. On motion of Mr. Browning~ seconded by Mr. Apperson~ it is resolved that a Vari- ance be granted to Mr. Sterling Collins for the construction of a dwelling on a 100-ft. lot, approximately .6 of a mile from Woodpecker Road on the west side of St. Rte. 760, provided the Health Department gi'ves its approval. There was read a letter from Mr. A. W. Baker, Chairman of the Conservation Com- mittee of the Dale Ruritan Clubs~ suggesting that the County purchase several lo- cations for public parks. Upon consideration whereof, and on motion of Mr. Browning~ seconded by Mr. Apper- son, it is resolved that this matter be studied and report at a later date. There was read a proposal from the Government Information Service and it was generally agreed that the County would not participate in this service at this time. It was pointed out that the General Assembly had to approve the granting of land for the widening of a road to the Ettrick Cemetery as pointed out by an official of the Virginia State College.
