On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that the follow lng Ordinance which was duly advertised on March l0 and April 5, 1967 for hearing on this date, be and it hereby is approved and adopted: AN ORDINANCE to amend The Code of the County of Chesterfield, Virginia, by adding thereto a new section to Chapter I1 to be known as Section 11-21, imposing and providing an assessment as part of the costs incident to each original civil action filed in theCounty Court of Chesterfield County, Virginia, and in the Circuit Court of Chesterfield County, Virginia, and providing tha~ such costs so collected shall be held for the establishment, use and maintenance, of a public law library. BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD, COUNTY, VIRGINIA 1. That The Code of the County of Chesterfield, Virginia, be amended by adding thereto a new section to Chapter 11 to be known as Section 11-21, which shall read as follows: Sec. ll-21. Pursuant to Chapter 3 of Title 42 of the 1950 Code of Virginia, as amended, the County of Chesterfield, a political subdivision of the Commonwealth of Virginia, does hereby assess, as part of the costs inci-, dent to each civil action .filed in the County Court of Chesterfield CounU the sum of fifty cents, and in the Circuit Court of the County of Cheste~ field, the sum of one dollar. Such assessments shall be collected by the Clerk of the Court in which the action is filed and remitted to the County Treasurer of the County of Chesterfield, subject to the disbursements by the Board of Supervisors, for the acquisition of law Books and law periodicals for thc establishment, use and maintenance of a law library, which shall be open for the use of the public, and such disbursements may include compensa- tion to be paid to the librarians and other necessary staff for the maintenance of such library, and acquisition of suitable quarters for such library. The compensation of such librarians and necessary staff and the cost of suitable quarters for such library shall be fixed by the Board of Supervisors of Chesterfield County and paid out of the funds Created by the imposition of this assessment. The assessment provided for herein shall be in addition to all other costs prescribed by law, but shall not apply to any action which the Commonwealth of Virginia, or any political subdivision thereof or the Federal government, is a part, and in which the costs are assessed again. st the Commonwealth, political subdivision thereof, or Federal governmen~ This ordinance shall become effective onand after the 1st day of July, 1967. The matter of the Ordinance to control the sale of pistols was discussed by the Board and Mr. Tom Davis and others owners of gun shops in the County state that they have no objection to the elimination of the requirement of a permit to purchase a gun in the County of Chesterfield· On motion of Mr. Martin, seconded by Mr. Goyne, it is resolved that the following ordinance be and it hereby is approved and adopted: AN ORDINANCE to amend and reordain Section 5-3 of The Code of the County of 'Chesterfield, Virginia to provide for applications made to the Chief of Police by persons desiring a license under Chapter 5 of the aforesaid Code for furnishing certain services or selling'~pistols or revolvers at retail but not purchasing at retail or otherwise acquiring a pistol or revolver, to provide that the Chief of Police make an investigation of the character of the applicant to see if such per- son .be of good moral character and fit to engage in the proposed business or to sell a pistol or revolver. BE IT ORDAINED BY THE BOARB OF SUPERVISORS OF THE COUNTY OF CHESTF~FIELD VIRGIN IA: i. That Chapter 5-3 of The Code of the County of Chesterfield, be amende~ and readopted as follows: Sec. 5-3. Amendments. Every person desiring a license under the provisions of this chapter for furnishing detective service, detective, medicine vendor or desiring to sell or offering to sell at retail pistols or revolvers shall first apply to the chief of police for a permit and shall produce to the chief of police evidence of the good character of the individual, the members of the firm or the chief officers of the corporation, as the case may be. It shall thereupon be the duty of the chief of police to make a reasonable investigation of the character of the individual, or of each member of the firm or of each chief officer officer of the corporation as the case may be, and if he be satisfied that the individual, the members of the firm ii or the principal officers of the corporation, as the case may be, be of good moral, character~and fit to engage in the proposed business or sell a pistol or revolver, Ii he shall issue the permit. The form of the application for the oermit and the for~ of the permit itself shall be prepared and furnished by the chief of police. . There was read a letter from Mr. R. S. Purks, Assistant Chief Law Enforement Divi- sion of the Commission of Game and Inland Fisheries, raising the question of the ownership of two (2) radios given by the County to the Game Commission, specifical] for E. J. Gorman and J. R. Bellamy. After much discussion and consideration.of the matter, and on motion of Mr. Apper- son, seconded by Mr. Browning, it is resolved that the Commission of Game and Inland Fisheries be allowed to keep the two (2) radios, provided they would adjust same to the County frequency so that better communication could be established. O0 On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that this Board requests the Commonwealth's Attorney to study the policy as prescribed by th County Ordinance in the return of money when partially used County licenses are gurned into the Treasurer and to report to this Board as soon as the requested study is made. There was read a report from the Commonwealth's Attorney citing the fact that on May 17, 1913 the Judge of the Circuit Court entered an Order fixing the boundary between Dale and Bermuda Districts and said boundary has not been changed since that time. On motion of Mr. Goyne, seconded by Mr. Apperson, it is resolved that this Board request all County officials to use only the correct boundary line as set out on a map recorded with the Board's papers on this date. And be it Further Resolved, that a copy be sent to the Highway Department with a request to correct the Highway maps as to the magisterial district lines. On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved that the contracl with the Federal Postoffice for the rental on a thirty (30} day basis of a store building owned by the County of Chesterfield Courthouse, be and it hereby is appro. ed, and the Executive Secretary is authorized to sign said contract. On motion of Mr. Apperson., seconded by Mr. Browning,it is resolved that the Execu- tive Secretary be requested to give to our Congressman, Dave E. Satterfield, III, the request that a Federal Building be constructed at the Courthouse to house not only the new postoffice, but the County's Extension, ASC Office and Soil Conserva- tion Office. On motion of Mr. Apperson, seconded by Mr. Britton, it is resolved that the Treas- urer of the County be requested to transfer the following funds from the unappro- priated surplus~ of the General County Fund to the items indicated: lA - $ 7,500.00 ~ 2A - 5,000. O0~' 3E - 10,800.00,~, 13 .- 2,200.00 V,~,' There arose the matter of ambulance service for the southern part of the County and Mr. Browning cites the fact that he has discussed this problem with numerous people in order to find the best solution to this problem. On motion of Mr. Browning~ seconded by Mr. Britton, it is resolved that this Board records the fact that it looks favorably on the establishment of ambulance service for Ettrick and Matoaca and environs. And be it further resolved, that the Executive Secretary notify the existing three Rescue Squads that such action is pending. And be it further resolved, that the Chairman appoint a Committee to study this problem. Whereupon, the Chairman appoints: Mr. Browning, Mr. Goyne and the Executive Secre- tary. This day the County Road Engineer in accordance with directions from this Board mad~ report in writing upon his examination of Cherokee Road, in the Huguenot HUndred Subdivision, Section "A", Midlothian Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established a~ a public road. iUpon consideration whereof, and on motion of Mr. Britton, it is resolved that Chero4 kee Road, in the Huguenot Hundred. Subdivision, Section "A", Midlothian Magisterial District, be and is hereby established as a public road. And be it further resolved, that the Virginia Department of Highways be and it hereW! by is requested to take into'the Secondary'Road System, Cherokee Road, from a point on Rt. 673 .31 mi. north of its intersection with Rt. 143~, eastwardly ~42 mi. to a cul-de-sac. And be it further resolved that the Board of Supervisors guarantee a 66-ft. right o~ way for this road to the Virginia Department of Highways, Plat recorded in Plat Book 15, pages 70 and 71, November ~, 1966. This day the County Road Engineer in accordance with directions from this Board made- report in writing upon his examination of Elk Road, in the Manchester Heights Sub- division, Manchester Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of ~r. Britton, it is resolved that Elk Road, in the Manchester Heights Subdivision, Manchester Magisterial District, be anc~ is hereby established as a public road. And be it further resolved, that the Virginia Department of Highways be and it here~ by is requested to take into the Secondary Road System, Elk Road, from a point on Lancers Boulevard (Rt. 2147) .13 mi. south of its intersection with Rt. 21~8, east- wardly .08 mi. to a dead end. This road serves 7 houses. And be it further resolved that the Board of Supervisors guarantee a 5C-ft. right of way for this road to the Virginia Department of Highways. Dn motion of Mr. Apperson, seconded by Mr. Goyne, it is resolved that this Board requests the State Highway Department to rework a drainage ditch on Rt. 1601, at or near its intersection with Rt. 641, and charge same to the 3¢ Road Fund of the Counl Sn motion of Rtr. Go]me, seconded by Mr. Browning, it is resolved that this Board re. quests the Highway Department to surface treat Oak Lane, leading northwardly from Osborne Road to Shields Avenue, in the co~ing year's budget. Fhere aooeared a delegation to discuss the problems involved in the malfunctioning septic t~nks in the Centralia Gardens area. Mr. Salmon and others cite the problem~ involved. ~r. Painter, County Engineer and ~r. Limerick, from R. Stuart Royer & Associates, state that the cost of a lagoon system would be $2667,00 if each of the 87 homes connected. It was agreed that the people in the area would circulate a petition to be signed by those who would connect to the sewers at the standard rates. ~r. G. L. Crump and Dr. Roy Alcorn come before the Board speaking in behalf of the School Board to transfer $4,240.62 ~ue to the enforced discontinuance of the School Board to oay the retirement for employees. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Apperson, it is resolved that the sum of $4,240.6~9~e transferred from the Operation of School Plant (17E-l) to Administration (17A), and the Treasurer of the County is requested to make said transfer. Mr. Ben Fetters and others of the Certain-Teed Pipe Mfg. Company come before the Board to explain the operation of Certain.Teed which Pipe Company has submitted the low bid of $45,611.28. Mr. Leslie Brooks, Water Supt., states that he has certain reservations concerning the use of this pipe. Mr. Painter, County Engineer, states that they are willing to use Certain-Teed pipe~ provided they get a guarantee from the Company to save the County harmless against. defects of materials installed. Upon consideration whereof, and on motion of ~r. Goyne, seconded by ~r. Browning, i! is resolved that the pipe bid be awarded to the Certain-Teed Pipe Division, provide~ such guarantees are forthcoming. i67-~C. ~Mr. Graham Jennings, representing Mr. James R.
