We are proud to announce that Chesterfield County is the recipient of twelve Achievement Awards this year. Public Affairs also received two awards from the National Association of County Information Officers (NACIO). Subiect: Resolution Recognizing Mr. Charles J. Haessig on His 90th Birthday County Administrator's Comments: County Administrator: Board Action Requested: Ms. Jaeckle requests that the Board of Supervisors adopt the attached resolution recognizing Mr. Charles J. Haessig on his 90th birthday. Summary of Information: Mr. Charles J. Haessig is a Chesterfield County resident who recently celebrated his 90th birthday. He served in the U.S. Navy aboard the U.S.S. Sacramento when Pearl Harbor, Hawaii, was attacked on December 7, 1941. This resolution recognizes his honorable wartime military service and recent birthday. Mr. Haessig is one of seven known survivors of the 1941 Pearl Harbor attack living in the region, and is the only known survivor living in Chesterfield County. Haessig is a Chesterfield County resident; WHEREAS, Mr. Haessig celebrated his 90th birthday on August 9, 2011; WHEREAS, on December 7, 1941, Mr. Haessig was a 20-year-old First Class Seaman serving with the U.S. Navy at Pearl Harbor, Hawaii; and WHEREAS, he was a crewman on the U.S.S. Sacramento, which was at Pearl Harbor having work done on its engine; and WHEREAS, shortly before 8 a.m. on that Sunday morning, Seaman First Class Haessig heard the roar of aircraft engines and looked up to see an aircraft flying low over the Sacramento; and WHEREAS, he suddenly saw a large red circle, the rising sun, on the aircraft, and shouted an alarm that Japanese aircraft were attacking; and WHEREAS, the sound of explosions could then be plainly heard as many of the ships in the harbor came under attack; and WHEREAS, as sailors aboard the ship scrambled to their battle stations, Seaman Haessig and another crew member ran to the ship's armory and began dragging ammunition boxes to a hoist that took the ammunition up to the ship's .50 caliber machine-gun positions; and WHEREAS, the crew of the Sacramento was credited with downing three attacking Japanese aircraft in the attack that killed approximately 2,400 sailors, Marines and soldiers; and WHEREAS, in 1942 and 1943, Mr. Haessig served as a cook aboard several other vessels; and WHEREAS, on February 18, 1944, Seaman Haessig was married while on leave in Indianapolis; and WHEREAS, Seaman Haessig went on to serve in various capacities until his discharge from the Navy on October 3, 1945; and WHEREAS, Mr. Haessig is one of seven known survivors of the 1941 Pearl Harbor attack living in the region, and is the only known survivor living in Chesterfield County; and WHEREAS, Chesterfield County is proud to have this brave veteran as a resident, and recognizes him for his honorable military service during World War II. Summary of Information: On July 21, 2011, the Economic Development Authority ("Authority") held a public hearing and approved the issuance of its tax-exempt multi-family housing revenue bonds in an amount estimated at $25,000,000 (the "Bonds") to finance costs of acquiring, renovating and equipping (a) a 192-unit multifamily housing development known as Colonial Ridge Apartments located at 15101 Lorimer Road in Chesterfield County and (b) a 100-unit multifamily housing development known as Bermuda Run Apartments located at 2609 Mangowood Drive in the County. The state and federal tax laws require and the Authority has recommended that the Board of Supervisors approve the issuance of the Bonds. BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY, VIRGINIA: 1. The Board hereby approves the issuance of the Bonds and the loan of the proceeds of the Bonds to the Borrower as proposed by the Authority, to the extent required by Section 147(f) of the Internal Revenue Code of 1986, as amended, and Sections 15.2-4906 of the Virginia Code of 1950, as amended. 2. Approval of the issuance of the Bonds, as required by Section 15.2-4906 of the Act and Section 147(f) of the Internal Revenue Code, does not constitute an endorsement of the Bonds or the creditworthiness of the Borrower. Pursuant to the Act, the Bonds shall provide that neither the County, nor the Authority shall be obligated to pay the principal and the premium, if any, of the Bonds or the interest thereon or other costs incident thereto except from the revenues and moneys pledged therefor, and that neither the faith or credit nor the taxing power of the Commonwealth of Virginia, the County, or the Authority shall be pledged thereto. 3. It is hereby found and determined that the Borrower's expected operations of the facilities will promote safe and affordable housing in the Commonwealth of Virginia and to benefit thereby the safety, health, welfare and prosperity of the inhabitants of the Commonwealth. 2. The Authority hereby agrees to undertake the issuance of the Bonds upon terms and conditions to be mutually agreed upon between the Authority and the Borrower, and to loan ®00021 the proceeds of such Bonds (the "Loan") to the Borrower for the purpose of financing costs of the Project pursuant to a loan agreement that will provide for the repayment of the Loan in amounts sufficient to pay the principal of, premium, if any, and interest on the Bonds. The Bonds will be issued and secured pursuant to documents which will provide for the precise principal amount of the Bonds, the maturity schedule therefor, the interest rate or rates the Bonds will bear and the denomination, form and other terms of the Bonds and will secure the Bonds by an assignment of all the Authority's rights to the Loan, together with the proceeds thereof and the security therefor. The Bonds will be limited obligations of the Authority payable solely from the revenues pledged thereto. 3. At the request of the Borrower, the Authority hereby appoints Hunton & Williams LLP as bond counsel to supervise the proceedings and approve the legality of the issuance of the Bonds. 4. All costs and expenses in connection with the financing of the Projects, including the fees and expenses of bond counsel, Authority counsel and any agents or underwriters for the sale of the Bonds, shall be paid from the proceeds of the Bonds to the extent allowed by law. If for any reason the Bonds are not issued or if the proceeds thereof cannot be used to pay all such expenses, it is understood that all such costs and expenses shall be paid by the Borrower and that the Authority shall not have responsibility therefor. 5. In adopting this resolution the Authority intends to declare its "official intent" within the meaning of Treasury Regulations 1.150-2 that expenditures with respect to the Projects made prior to the issuance of the Bonds be reimbursed with proceeds of the Bonds. 6. The .Chairman of the Authority is directed to request an allocation of up to $25,000,000 of the "State Ceiling" to the Bonds, pursuant to §§ 15.2-5000 et seq. of the Code of Virginia of 1950, as amended, and applicable regulations adopted by the Virginia Department of Housing and Community Development. 7. The Authority shall perform such other acts and adopt such further proceedings as may be required to implement its undertakings as herein set forth. 8. The Authority hereby recommends that the Board of Supervisors of Chesterfield County, Virginia, approve the issuance of the Bonds for the costs of financing of the Projects pursuant to Section 147(f) of the Code and Section 15.2-4906 of the Act. 9. Subiect: Set Public Hearing to Consider an Ordinance Amendment Relating to Electronic Message Centers and Receive Public Comment on the Electronic Message Center Sign Policy County Administrator's Comments: County Administrator: Set September 21, 2011, for a public hearing to consider amendments to Sections 19-5 and 19-633 of the County Code relating to electronic message centers (EMC) and to receive public comment on the electronic message center sign policy as recommended for revision by the Chesterfield Planning Commission. Summary of Information: A. Public Hearing on Ordinance Amendment The Planning Commission held their public hearing on the attached electronic message center (EMC) sign ordinance amendments on June 21, 2011. On a unanimous vote, the Commission recommended approval of the amendments. These amendments are as follows: 1. Sec. 19-5 relating to enforcement proposes that violations with EMC signs shall be remedied within twenty-four (24) hours of notice. Sec. 19-633(d)(5) relating to sign permitting requires a designated electrical control box that serves only the EMC sign, and a photocell that provides an automatic change of illuminative brightness between sunset and sunrise. 4. Sec. 19-633(i) relates to EMC sign owners who have multiple sign violations. The proposed amendment allows the director of planning to suspend an EMC sign permit for thirty (30) days anytime the holder of an EMC permit receives two (2) notices of violation within twelve (12) months and for each notice of violation within a subsequent twelve (12) month period after each thirty (30) day suspension. During the suspension period, the EMC sign shall be disconnected from electric power. See attached ordinance amendment for Secs. 19-5 and 19-633. B. Public Comment on EMC Policv recommendations from Planning Commission The Planning Commission received public input on their recommendations to revise the EMC sign policy on June 21, 2011. The current EMC sign policy has been in effect since 2001. Citizens offering public input were generally positive about the changes recommended for the EMC sign policy. On a 4 to 1 vote, the Commission resolved to recommend approval of the amendments to the Board of Supervisors. See proposed recommendations to revise the 2001 EMC sign policy attached. Those items in bold reflect recommended changes. 0~-0039 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 19-5 AND 19-633 RELATING TO ELECTRONIC MESSAGE CENTERS BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 19-5 and 19-633 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Sec. 19-5. Enforcement. 000 (6) If the director of planning determines that any person has violated this chapter or failed to comply with any condition of a zoning or development approval, then he shall serve upon that person a notice to comply by either: a. Delivering the notice to the person by hand; or b. Mailing the notice by first class mail to the last known address of the person. The notice shall set forth the nature of the violation or failure to comply. Upon failure of the person to remedy the violation, comply with the condition or receive an extension within ten days after the date of delivery or mailing of the notice, the person shall be subject to the penalties set forth above. With respect to violations or failures to comply involving portable signs, electronic message center signs, or the parking or display of motor vehicles, the person shall remedy the violation or comply with the condition within 24 hours of service of the notice or receive an extension, or the person shall be subject to the penalties above. 000 Sec. 19-633. General regulations. The following regulations apply to all signs, whether or not a sign permit is required, and are in addition to the regulations contained elsewhere in this article: 000 (b) A county sign permit is required for all signs in excess of eight square feet in area, unless otherwise provided in this chapter. At the Commission's public hearing, questions were posed as to whether the County's bonding policy requiring that an insurance company have a minimum A.M. Best rating of A and a size of VII drives up the interest rate for the insured. Further the development community indicated that very few local bonding agencies meet the requirements. According to the Department of Risk Management, the county's requirements do not impact interest rates. Rather interest rates are generally based upon the financial strength of the entity getting the bond. As a matter of note, there have been times when an entity was unable to obtain bonding from an insurance company with the A rating and VII size, and the County has under special circumstances, accepted bonds from a lesser rated insurance company. The Commission suggested that the Board may wish to consider directing staff to evaluate the bonding requirements. The festival capacity is about 5,000 people, attending throughout each day. Pre-sale tickets will be available for both tasters and non-tasters. Tickets will also be sold at the gate. The Chamber will have a contractor provide portable bathroom facilities. The Chamber is negotiating for on-site trash, recycling, and post-event clean-up and trash disposal for the event. The Chamber will have food vendors to provide food and beverages, including water which will be provided free to all attendees and participants. The vendors will obtain permits from the Health Department. The local Rescue Squad and Chesterfield Fire and EMS will be alerted of the event date and time. Adequate parking facilities are available. Cars will be parked in the Chesterfield Administration Building parking lots and adjacent parking areas. Music played at the event will be played in such a manner that it will not constitute a nuisance to adjacent property owners. Off-duty police officers are being employed to handle all security components of the event. The Chamber of Commerce carries a general $2 million liability insurance policy to insure against injury or damage. Chesterfield County is named as an additional insured. The music/entertainment arrangements have been reviewed by the County Attorney's Office and meet the substantive requirements of the ordinance. These arrangements provide adequate measures to insure public safety, fire prevention, medical protection, sanitation, traffic control, insurance coverage, relevant permits and security. This will be the fourth year the Festival will be held at the Historic Courthouse. A full list of all recommended conditions for the operation of the Festival is attached. These conditions include those that were imposed last year and additional conditions to ensure that no excessive drinking takes place, booth and tents are adequately secured, and there are no pets in the Festival area. No drinking takes place after the event is officially over. Staff recommends approval of the permit request subject to the attached conditions. The Board is authorized to require applicants to post a bond sufficient to cover the costs of clean-up after the festival. No food vendor shall cook any food inside a building or trailer unless an approved fire suppression system, which has been successfully inspected within the past six months, is available on site. 3. Permit holder shall provide the Risk Manager with a Certificate of Insurance, in a form approved by the Risk Manager and County Attorney and making the County additional insured with a minimum Commercial General Limit of $2,000,000 per occurrence. 4. Permit holder shall post a cash deposit or bond with the Risk Manager in the amount of $1,500.00 against damage to County property and to insure adequate clean-up of the County premises. 5. No food vendor shall sell any food unless a permit for food vending has been issued by the Health Department. All permit applications shall be filed no later than seven days before the Festival. 6. Permit holder shall comply with all County noise ordinances and with all conditions imposed by County employees and representatives to minimize the impact of noise on neighborhoods in the vicinity of the Festival. 7. Permit holder shall provide, at its expense, the following police officers to serve during all hours while the Festival is open: One police sergeant Six police officers Two motor assistance volunteers 8. The Fire Department does not require an on-site medical station or ambulance. However, if permit holder chooses to have such a station or ambulance present, as in the past, permit holder shall provide the station or ambulance at its expense. 9. Permit holder shall supply, at its expense, a bartender for the VIP tent who shall be on duty at all times during the Festival and who shall be certified by the Virginia ABC Board as an ABC manager. Persons working at the Festival, including staff and volunteers of the Chamber of Commerce, shall refrain from drinking any alcoholic beverage while on duty. 10. The ABC permit for the event shall be obtained at least 21 days prior to the event, and a copy of it shall be provided to the County's Risk Manager at least 14 days prior to the Festival. The ABC permit shall be limited to the exact hours approved for the Festival by the Board of Supervisors. 11. There shall be no violations of the ABC permit. 12. No alcoholic beverage shall be served or consumed after the official closing time approved by the Board of Supervisors for the Festival has passed. 13. Booths shall limit all wine servings to sample sizes. 14. The permit holder and all vendors shall provide the County Risk Manager with copies of certificates of insurance in accordance with condition three at least fourteen days before the event. 15. No County vehicle shall be driven by anyone who is not a County employee. 16. All vendor tents shall be anchored or secured to the ground in a fashion acceptable to the County. 17. There shall be no dogs or other pets in the Festival area, except for service animals. 18. The County shall have the right to cancel the Festival, or any portion of the Festival, if there is both a severe storm warning and actual inclement weather, including lightning in such proximity to the festival area that it could cause a risk of bodily injury or fire, winds gusting up to 40 mph, hail, or rain in sufficient quantities to cause a flash flood warning. The event shall not be canceled for a storm of less than 30 minutes duration unless there is a flash flood warning, but it may be suspended for a storm of any duration if there is lightning in such proximity to the festival area that continuing the Festival would cause risk of injury, death or fire. 19. Failure to comply with any of the aforementioned conditions shall be grounds for revoking the permit. Su~ect: Request for Exception to County Streetlight Policy for the Genito Road/Old Hundred Road/Charter Colony Parkway Sidewalk and Streetlight Project County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to authorize an exception to the county streetlight policy for the use of non-conforming streetlights for the Genito Road/Old Hundred Road/Charter Colony Parkway Sidewalk and Streetlight Project. Summary of Information: In April 2011, the Board of Supervisors approved, as part of the revenue sharing program, a streetlight project for the Genito Road/Old Hundred Road/Charter Colony Parkway intersection. The project includes the installation of approximately 65 streetlights. After consultation with the community, staff proposes to use Dominion Virginia Power (DVP) installed and maintained streetlights in the Carlyle Acorn style with decorative, fluted poles. This style light is consistent with the existing lights in the community. DVP will design, install and maintain the streetlights for an annual fee of $289.68/light. For 65 streetlights, this is an annual cost of $18,829.20. Funding for the streetlights will be addressed during the FY13 budget process. Summary of Information: With the technical assistance of Wells Fargo Insurance Services, a national benefits consulting firm, County and Schools staff recently completed a Request for Proposal process for the 2012 Employee Health Program and a rate renewal process for the Dental Program. In order to continue to provide employees with quality health and dental care options, it is recommended that the county execute a new contract with Anthem and renew its current contract with Delta. Under the proposed 2012 program, employees will have the choice of three different Anthem health plans (two HMOs and a PPO) and three dental plans (basic, comprehensive and a new DHMO). Limited removal of asbestos and interior finishes as required to accomplish this project was initiated in the spring of 2011. Some personnel were relocated prior to commencing the project work. While the initial project work was underway, it was decided to relocate all personnel to other facilities while completing a more extensive scope of necessary repairs due to the overall condition of the building and the presence of asbestos floor tile. Most of the interior space in the two/three story administration building has not been renovated for over 40 years. This request is for additional funding to complete changes to the interior space including removal of all of the asbestos the from the office floors and hallways of the building, cleaning ceiling grids and replacement of damaged grids, installation of new lighting where appropriate, replacement of dirty and damaged ceiling tile, cleaning of ductwork, replacement of worn out carpet and floor the with new finishes and painting most of the interior walls. There will be a portion of this work ($150,000) that will be accomplished under change orders to the general contractor, United General Contractors/United Refrigeration of Virginia, Incorporated. The balance, up to $510,000 will be used on separate county requirements contracts or will be completed with competitive quotes. Summary of Information: In January 2010, the Board of Supervisors authorized the County Administrator to award a construction contract for the Route 10 (I-95 to Ware Bottom Spring Road) Widening Project. The county is managing the joint County/VDOT/Federal Highway Administration (FHWA) project under the customary VDOT/County agreement. The 2004 Bond referendum provided $15 million for the project. An additional $305,000 in developer contributions was also provided. FHWA/VDOT have provided $15.5 million for the project. At the start of the project, staff identified the potential for large change orders and included a $3.8 million contingency in the project budget. In addition to the soil conditions, other major construction issues have also been encountered. Additional bridge piles have to be installed in order to achieve satisfactory bearing capacity. A box culvert has to be redesigned to address soil and underground water level conditions. The project was shut down while a safety plan was developed for driving the piles. New OSHA regulations have restricted the contractor's ability to work under overhead Dominion Virginia Power transmission lines. The contractor has had to employ different construction equipment in order to comply with the new OSHA regulations. Dominion Virginia Power lowered the transmission lines over the project, further restricting the working area. VDOT, FHWA, the contractor and county continue to work to determine the values of the change orders for these issues. The current assessment, which is still subject to change, is a $1.43 million increase in the contract. This work must be completed in order to finish the project. In accordance with county purchasing policy, to avoid delays, staff, in conjunction with VDOT and FHWA, has directed the contractor to proceed with the work required to address the construction issues. In accordance with policy, cumulative change orders over 100 of the original contract value or a single change order over $50,000 requires formal approval by the Board of Supervisors. Sufficient funds remain in the project contingency to cover the increase in the project cost (see attachment). Given the difficult working circumstances that have already been encountered, coupled with the unknown factors that remain, staff anticipates that the potential for additional work needed to complete this project in a timely fashion will be high. As a result, in order to keep the project moving, staff is requesting the Board of Supervisors to grant authority to the County Administrator to execute change orders on the Route 10 (I-95 to ware Bottom Spring Road) Project up to the full amount budgeted to address the current and possible future change orders. Should the Board approve this approach, staff will continue to advise the Board as site conditions necessitate any changes to the terms of the contract. Equipment designed to protect the face and ears shall be provided to participants at such recreational areas, and signs must be posted to warn against entry into the paintball area by persons who are unprotected or unaware that paintball guns are in use. (a) No minor shall discharge any pneumatic gun outdoors within 300 feet of the dwelling of another, a business establishment, private building, public gathering or public meeting place, unless the minor is accompanied by his parent or guardian, or otherwise supervised in accordance with this section. (b) Any minor below the age of 16 who uses pneumatic guns on private or public property shall be supervised by a parent, guardian, or other adult supervisor approved by a parent or guardian. (c) Minors the age of 16 or older may, with the written consent of a parent or guardian, use a pneumatic gun at any place designated for such use by the county or on private property with the consent of the owner. The assessor and the board of equalization shall follow the following procedures in the assessment of real estate in the county: (a) The real estate assessment office shall notify each affected taxpayer in writing on or before February 1 of any year in which the assessor makes a new or changed assessment. The request shall be made on forms prescribed by the board of equalization and made available through the office of real estate assessments. The board of equalization of real estate assessments shall provide all those requesting relief an opportunity to be heard in person, with witnesses, and by counsel, but may also allow submissions of memoranda verified under oath. (~ In any appeal of the assessment of residential property filed by a taxpayer as an owner of real property containing less than four residential units (i) to the board of equalization pursuant to Code of Virginia ~ 58.1-3379 or (ii) to circuit court pursuant to Code of Vir ig nia & 58.1-3984, the assessor shall send the taxpayer a written notice provided for in this subsection. Such notice shall be on the first page of such notice and be in bold type no smaller than fourteen points and mailed to, or posted at the last known address of the taxpayer as shown on the current real estate tax assessment records. In an appeal to the circuit court any such written request by the taxpayer or his duly authorized representative shall be made following the filing of the appeal to circuit court and no later than 45 days prior to trial, unless otherwise provided by an order of the court. Provided the written request is made in accordance with Code of Virginia § 58 1- 3984 and this subsection or any applicable court order the assessor shall provide such records within 15 days of the written request. If the assessor fails to provide the assessment records set out in subsections A B and C of Code of Virginia ~ 58.1-3331 after written request as addressed above, the assessor shall present the following into evidence prior to the presentation of evidence by the taxpayer at the hearing before the board of eaualization or the circuit court as applicable• (i) copies of the assessment records maintained by the assessor under Code of Vir ing is 58.1-3331, (ii) testimony that explains the methodolo ies emplo end by the assessor to determine the assessed value of the property and (iii) testimony that states that the assessed value was arrived at in accordance with en~erall~accepted appraisal practices procedures, rules, and standards as prescribed by nationally reco mg 'zed professional appraisal organizations such as the International Association of Assessing Officers (IAAO) and applicable Virginia law re arding the valuation of property ~ {~} The board of equalization shall publish notice in a newspaper having general circulation in the county, giving the regular time and place of its hearings, and instruct the sheriff to post such a notice at the courthouse and at each voting precinct, at least ten days prior to each sitting in accordance with Code of Virginia, § 58.1-3378. ~f -Ee3 The board of equalization shall rule upon all protested assessments within 90 days from the date of hearing or by June 15, whichever occurs first. Summary of Information: On June 15, 2011, the Board voted to hold a public hearing to consider an ordinance to increase the current fee the County charges to a person passing a bad check from $35 to $50. This increase is authorized by the General Assembly's recent amendment to Virginia Code § 15.2-106. State law also lists the specific reasons for a check being dishonored which are subject to the fee. The ordinance amendment is consistent with the categories of returned checks subject to the fee as set forth in the state law. The Treasurer supports this proposed ordinance amendment.
