Summary of Information: Bon Air Baptist Church has partnered with the Chesterfield County Parks and Recreation Department to provide recreational programs for the 50 and over population. Bon Air Baptist Church provides numerous classrooms, game rooms and gym space as well as assistance from their own Recreation Director and Assistant Recreation Director and numerous support staff at no cost to the county. Summary of Information: Mr. Steven O'Leary is being recognized for his eleven years of service as a member of the Airport Advisory Board. STEVEN O'LEARY FOR HIS SERVICE AS A MEMBER OF THE CHESTERFIELD COUNTY AIRPORT ADVISORY BOARD WHEREAS, Mr. Steven O'Leary was originally appointed as the Dale District representative on the Chesterfield County Airport Advisory Board from July 2000 to March 2003; and WHEREAS, Mr. O'Leary moved to the Midlothian District in March 2003, and was reappointed as the Midlothian District representative, serving until July 2011; and WHEREAS, Mr. O'Leary joined us with a unique background as a professional aviation planner and provided guidance and assistance during the runway's rehabilitation, north terminal apron construction, development of the airport's rules and regulations and with the future development of the airport during the master planning process; and WHEREAS, immediately following the tragic event of September 11, 2001, Mr. O'Leary was instrumental in creating and adopting a General Aviation Security Plan for Chesterfield's airport, and the county received the governor's award for taking this initiative; and WHEREAS, Mr. O'Leary was of great assistance evaluating and developing the proposal for the Chesterfield Aviation/Science Museum and for participating in the Chesterfield County Airport's annual air shows; and WHEREAS, Mr. O'Leary provided guidance and leadership as chairman of the Airport Advisory Board for four years; and WHEREAS, the Chesterfield County Airport has been named one of the best reliever airports in the state, and during Mr. O'Leary's tenure on the Airport Advisory Board the airport has grown to be one of the most well-regarded airports in the Commonwealth of Virginia; and WHEREAS, the continuing growth in airport activities during Mr. O'Leary's tenure has had a beneficial economic impact on Chesterfield County, as recognized in a recent economic impact study conducted by the State of Virginia. NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors, this 21St day of September 2011, public recognizes Mr. Steven O'Leary and expresses its sincere gratitude and appreciation for his service to the county as a member of the Chesterfield County Airport Advisory Board. Subject: Nomination/Appointment to the Richmond First Tee Board of Directors County Administrator's Comments: County Administrator: Board Action Regueste2i": Nominate/appoint an individual to serve as an at-large member of the Richmond First Tee Board of Directors. Summary of Information: The Richmond First Tee is a not-for-profit corporation that manages and develops the First Tee Chesterfield golf course at Harry G. Daniel Park at Iron Bridge "to provide affordable and accessible quality golf facilities and programs especially for youth." Two applications were received for appointment to the vacancy on the First Tee Board. Parks and Recreation recommends that the Board nominate and appoint Mr. Scott A. Rinaldi. Board members concur with this appointment. The term will be effective immediately and will expire on May 31, 2014. Under the existing rules of procedure, appointments to boards and committees are nominated at one meeting and appointed at the subsequent meeting unless the rules of procedure are suspended by a unanimous vote of the Board members present. Subject: Streetlight Cost Approval County Administrator's Comments: County Administrator: Board Action Requested: This item requests Board approval of a streetlight installation in the Dale District. Summary of Information: Requests for streetlights, from individual citizens or civic groups, are received in the Department of Environmental Engineering. Staff requests cost quotations from Dominion Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections and 2. A petition is required which must be signed by 75% of the residents within 200 feet of the proposed light and shall include a majority of the homeowners living at the proposed locations. Summary of Information: Each year, the United States Fire Administration recognizes the week of October 9 as "Fire Prevention Week" to educate the community in an effort to prevent injuries and death. This year's theme is, "It's Fire Prevention Week. Protect your Family from Fire!" Jr. Attachments: ^ Yes ~ No ®®~0~0 Title: Fire Chief RECOGNIZING OCTOBER 9-15, 2011, AS "FIRE PREVENTION WEEK" IN CHESTERFIELD COUNTY WHEREAS, the County of Chesterfield is committed to ensuring the safety and security of all those living in and visiting our county; and WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are where people are at greatest risk to fire; and WHEREAS, cooking equipment is the leading cause of home structure fires and associated injuries, and the third leading cause of home fire deaths; and WHEREAS, cooking-related fires are the greatest fire cause in Chesterfield County; and WHEREAS, heating appliances and smoking materials are among the leading causes of all reported home fires; and WHEREAS, the winter heating season is quickly approaching and supplemental heating appliances will become more prevalent; and WHEREAS, the risk of dying in a home structure fire caused by smoking materials rises with age; and WHEREAS, working smoke alarms cut the risk of dying in reported home fires in half; and WHEREAS, Chesterfield Fire and EMS personnel are dedicated to reducing the occurrence of home fires and home fire injuries through prevention and protection education; and WHEREAS, Chesterfield County residents are responsive to public education measures and are able to take personal steps to increase their safety from fire, especially in their homes; and WHEREAS, Chesterfield County residents who have planned and practiced a home fire escape plan are more prepared and will therefore be more likely to survive a fire; and WHEREAS, the 2011 Fire Prevention Week theme, "It's Fire Prevention Week. Protect your Family from Fire!" effectively serves to remind us all of the simple actions we can take to keep our homes and families safe from fire during Fire Prevention Week and year-round. The Economic Development Authority approved the renewal of the line of credit at their meeting on September 15t''. Support Agreement: The pace of the Cloverleaf project has been hampered by a weak economic backdrop and its impact on financial and capital markets. Accordingly, the parameters of the project, such as the introduction of a phased redevelopment plan, have evolved over time to more realistically reflect economic conditions. At the same time, that evolution has included an expanded commitment from the principal anchor, Kroger, who is now scheduled to construct a flagship 123,000 square foot store complete with fueling station. Eager to begin, Kroger is scheduled to close soon with Crosland on the land purchase for its new store which it anticipates opening in Fall 2012. Similar to the development plan, the financial side of this transaction has also evolved over time and, in an effort to be able to proceed with the project and deliver Kroger's parcel in a timely manner, staff is requesting Board approval of a number of documents that will finalize the financing of the project. The basic structure of the financing plan remains that the Chippenham Place Community Development Authority ("CDA") would issue a bond whose debt service would be paid via incremental tax revenues generated from the project, and supported by a special assessment in the case of a tax revenue shortfall. The proposed revision to the basic structure is that the Economic Development Authority will be the maker on a new line of credit instrument with Wells Fargo, but will pass through those proceeds to the CDA. Repayment of the line of credit will occur from the CDA revenues and supported by a support agreement containing a moral obligation from the county. This proposed change provides a number of benefits to the project including a significant reduction in borrowing costs and a quicker path to demolishing the mall. Under this arrangement, the county would be agreeing to provide a layer of moral obligation similar to what it already has behind the EDA's existing line of credit except that it will be able to look to the incremental taxes and special assessments for funding. Shea ICe,,r ~-a-~~~ ~arhes To the Board of Supervisors: September 21, 2011 Thank you for allowing me the opportunity to speak to you again today..I would like to begin my presentation by reading the following from the Building Inspection Department's Web Site: After my request at the July meeting for help with the serious structural defects and mold contamination in my home, it was my understanding that Mr. Dupler was going to require the Building Inspection Department to have Main Street Homes uncover the framing that was done to my home in July 2010 without a permit so that it could be properly inspected for possible remaining damage not repaired and to make sure it was framed to code.. I made this request because Mr.Dupler had sent me a copy of the permit request that Main Street was allowed to file after the fact in May 2011. I knew the permit request did not represent the actual scope of the work I observed being done to my house last summer. I was also not supplied with any drawings along with the permit request sent me by Mr. Dupler ,which are required per code to support the scope of work performed. I felt these drawings were left out purposely by Main Street, especially since they had prevented me from having a copy of the sub-contractor's inspection report they were given prior to performing the work to my roof.. Since I have documented that Main Street covered up other known leaking issues last summer that they did not repair, I felt it was only prudent to ask the county building inspection department to follow the building code to the letter regarding framing inspections. Code requires any framing to be inspected to be uncovered. Main Street also, prior to the inspection done this past August, supplied Mr. Dupler with pictures that were supposedly taken of the work in progress at my home last summer, however, as I pointed out to Mr. Dupler on August 30~`, the pictures are obviously not of my home.. The roof color is different and the shingles in are very worn which indicates the roof pictured is much older than my 3 year old roof was . The picture of the amount of framing material and sheathing removed is much less than the amount actually taken off my roof. (I have pictures of the debris removed from my roof last summer and I was the only one taking pictures while the work was done.). There also, is obviously co-axial cable running down through the ceiling of the home that Mr. Dupler was given pictures of. I do not have any co-axial cable in my bedroom at all... On August 30~', Mr. Dupler along with Roger Robertson, Rick Witt and Chris Davis came to my home to perform the required inspection of the framing done in 2010. Main Street had not been required to uncover anything. The building officials were only able to look up through a small opening in the ceiling near the edge of the roof line of my bedroom because the rest of the sheet rock in the ceiling is still in place.. They also could not inspect from the attic because the ceiling in my bedroom is vaulted so the framing is not accessible. Their inspection consisted of pictures taken by a camera they put up through the ceiling. They took moisture readings in my bedroom wall, but say there is no moisture in the wall so therefore there are no problems there, even though on July 6~, Klaus Worrell, structural engineer whose report I gave you at the last meeting, told these same county officials and I believe Ms. Durfee can attest to this, that the wall the new roof framing timbers were placed on is severely water damaged, and not structurally sound. Chunks of the framework near the floor have actually fallen out. I was told in August 2010 by Roger Robertson, when I first contacted him for help that if Main Street placed new roofing timbers on a water damaged wall, they would be made to remove the wall and rebuild it.. This has not been required of Main Street either. The building officials refuse to accept the structural engineer's opinion that the wall in my bedroom is not structurally sound. They all agreed on August 30'~ that there was nothing wrong with the wall. Mr. Dupler and the building officials also went out on my deck, climbed on a ladder and looked at my roof... They all declared they saw no holes in the shingles that were reported in the roofing inspection by Charles Wright that I gave to you at the last meeting. They saw nothing wrong with the flashing in the valley that has allowed water to come down and through the walls of my home or the vent pipe flashing, although, no one actually crawled up on the roof to inspect the vent pipes.. Mr. Dupler had emailed me on June 14~' stating he had talked to Mr. Wright and was planning to meet him at my home to see exactly what the roofer said was done incorrectly and allowing my roof to leak .. That has never happened, however. I have included a report and a pictures in your packet that I just received yesterday from a forensic architect who was at my home on August 30`~ during the inspection, and inspected the roof, moisture content, and other code violations in my home after the county building officials left. His picture of the roof clearly shows a nail hole in the top of a shingle that per his report, is 15 inches from the location of the ladder used to inspect the roof by the county. He could also see other nail holes. This corroborates Mr. Wright's roofing report The Building Officials, also went into the crawl area of my home on the 30'``.. They acknowledged in a letter dated July 19"' from Rick Witt, theconditioned crawl area was not installed to code. This code violation should have been observed during the final inspection on my home while under construction... They were unable to find any high moisture readings in the crawl and therefore deny that there is a mold problem there, even though the structural engineer has provided pictures of mold growing on floor joists. They found no moisture in the area of the bedroom where the roof had been leaking and replaced, however, that area is cantilevered out from the foundation so it is not accessible from the crawl space.. They say they can do nothing about the crawl area not meeting code because my home is past a 3 year statute of limitations.. Main Street however, I have documented through Mo1dX who did a mold remediation estimate on my home, has done mold remediation on a number of other homes on my street, some of which were past the 5 year statute of limitations of our structural warranty. I have to ask, why have they ignored my mold issues? The forensic architect also did thermal imaging on August 30~' of the foundation and found high water content in the foundation wall under my bedroom and under the area where the roofer said the valley was improperly flashed.. In fact, there has been so much water coming down that corner of the foundation, that the mortar joint in the corner has started to erode and there is a 5 inch gap where there is no mortar at all.. This is the same area where the structural engineer discovered the windows of the kitchen are not flashed properly. Code violations regarding f lashing should have been uncovered by the county during a veneer inspection while my home was under construction. The forensic architect also did moisture readings on the wall inside the kitchen of my home (pictures are included in his report). His report says there is a 32% moisture content in the sheet rock. On September 6'~ I received a letter from Rick Witt, Head of Building Inspection which read that the inspection of the work done in July 2010 has been passed and he encouraged me to work together with the builder to resolve the remaining code violations in my home.. I had tried to work with the builder for more than 3 years before coming to the county in August 2010 for help. Vernon McClure of Main Street Homes never responded to my requests for a meeting or sent anyone other than CTR Roofing, the original roofer out to inspect my home.. Of course, their conclusion was "nothing was wrong" with the shingles or flashing. It was only after I physically appeared at Vernon's office in early 2010, that he sent anyone out to even check my leaking issues.. He still however, ignored my request for a meeting and only did minimal band aid repairs.. After spending thousands of dollars on experts, mold testing, and documenting that Vernon knew there were a lot of leaking and code problems that he covered up and did not address, I have come full circle.. I still have received no help from the county with making my home a safe, code compliant home to live in. Instead, I have a home that I have to vacate to preserve my health,and that I will lose to foreclosure. I can't help but feel that I am an exception to the Building Inspection Department's responsibility to the citizens of Chesterfield.. Mr. Warren, I have been trying to reach you by email and by phone to set up a meeting with you since you are now my supervisor. Ms. Durfee has gone out of her way to try to get the Building Inspection Department to do their job prudently, but her attempts have failed. No one has done what she required in her meetings at my home . I must now look to you for your support in this matter and to keep me from being the exception to the county building inspection department's responsibilities. I have reviewed the reports prepazed by various experts, consultants, contractors and suppliers regazding their findings and was present on August 30, 2011 when the County Building Department performed their inspection. As of August 30, 2011, the County Building Department declared that the final inspection of your home was performed and approved, yet recognized as late as July 19, 2011 code violations were found but was powerless to enforce the minimum life-safety codes established by the Commonwealth of Virginia due to statutory limitations as to when these code defects were found However, I believe that certain installations did not conform to code requirements, at the time of construction, and still exist based on my preliminary review. However, I will reserve final comments until destructive testing can be performed. Although remedial repair to the bay window roof in the master bedroom may have resolved some of the water intrusion issues, acknowledged by the Building Department, nothing was done by Main Street Homes with the mold issues which where a direct result of defective construction and acknowledged moisture intrusion. Failure to take swift action on this item has allowed the mold contamination to render the house uninhabitable and a health risk according to your doctor's report. The property cannot be sold without disclosure of the previous moisture issues and current mold contamination which will require an expensive dismantling and cleaning process or a significant reduction in the sale price of the home. Moisture issues still exist within the residence. During the August 30, 2011 inspection by the Building Department, it was asked of the inspectors to test the drywall areas for moisture. The response was that drywall contains moisture and therefore no reading would be valid. Technically, this is incorrect, according to ASTM Committee C11, which deals with gypsum products. While there are no technical standards for acceptable moisture content of drywall, relative readings can produce an accurate analysis of the drywall conditions. With the use of an infrared camera and a Wagner non-destructive moisture meter, I found elevated moisture levels below the widow in the breakfast azea consistent with the description of moisture stains on drywall for the master bedroom and Simonton Window's November 29, 20101etter stating that moisture related intrusion is directly a result of improper installation in failing to properly apply flashing. Simonton's observations were in the presence of Clayton Shepherd of Main Street Homes and to my knowledge the window installation defects noted by Simonton Windows has never been addressed by Main Street Homes. A report by C.L. Wright Roofing, Inc., 3/20/11, observed misplaced and exposed nails throughout the entire roof. On August 30, 2011, Building Officials observed the reaz portion of the roof from a ladder placed on the deck. Building Officials said they did not see any evidence of misplaced nails. After county officials had left the site, CFI placed a ladder in the exact location as the Building Officials and observed at least one instance of improperly placed and exposed nail within 15-inches of the ladder placement. Further evaluation of Wright Roofing's letter will be made during the testing phase to quantify the magnitude of this defect. Main Street Homes' position is that there is no code requirement for building wrap below vinyl siding as supported by the County Building Officials. Main Street Homes further claims that the installation of building wrap was an extra to the contract price of the home and that's why all other homes besides yours had building wrap. We can find no evidence that building wrap was a listed extra on your purchase documents. While the 2003 International Residential Code, Table 703.4 excludes sheathing paper below vinyl siding; our initial discussions with the International Code Council technical department leads us to believe that failure to follow manufacturer's recommended installation practices is a code violation and that the Statewide Energy Code may be violated based on Ms. Barnes' observations of air infiltration. In addition to possible code violations, documents and observations by other trades show a general failure by Main Street Homes to meet the industry standard of care in the construction of your home. CFI will be performing additional testing and evaluation of the alleged construction defects, code violations and industry standards and provide you with a full report of findings, photographs and test results, at that time. As such, we reserve the right to amend this preliminary report based on the outcome of that future evaluation process. Public Comment on EMC Policy recommendations from Planning Commission The Planning Commission received public input on their recommendations to revise the EMC sign policy on June 21, 2011. The current EMC sign policy has been in effect since 2001. Citizens offering public input were generally positive about the changes recommended for the EMC sign policy. On a 4 to 1 vote, the Commission resolved to recommend approval of the amendments to the Board of Supervisors. See proposed recommendations to revise the 2001 EMC sign policy attached. I am speaking tonight in regard to the commissions proposed policy for electronic signs. While I can support most of the Commission's proposed policy, I ask the Board to adopt the 30 second messacte interval so our business corridors do not begin to look like a Las Vegas hotel strip with signs flashing every 10 seconds. I want to relate a personal electronic sign experience. Several years ago I was severely rear ended on Midlothian Turnpike as I braked for ared-light, by a driver who admitted she was looking at an electronic sign at Bethlehem Baptist church. She admitted to the Police officer saying, "She was so engrossed in watching the sign that she did not notice the traffic slowing" and she hit me so hard that the gas tank was shoved into the motor and my Jeep was left inoperable. It is also important that the Board amend the proposed policies by leaving the following existing policies in place: Prohibit electronic signs in our five distinctive, historic Villages: Midlothian, Bon Air, Ettrick, Matoaca, & Chester. The Zoning Ordinance Sec. 19-605 seeks to protect their important role as "part of the county's cultural, architectural, and historic heritage." As a result, all signs are smaller and more landscaping is required in the Villages. 2. Prohibit electronic signs in the Courthouse Area Design District. The Zoning Ordinance Sec. 19-588 purpose for the District - is to encourage architectural features that are compatible with the historic structures in the County Courthouse Complex area. I think it is obvious why such signs should not be permitted here. 3. Prohibit electronic signs on Hull Street Road between Chippenham and Courthouse Road. The Rte 360 Corridor Committee has worked for decades to enhance the eastern Hull St corridor. And this area is currently in a study for revitalization. It is, of course, left to you to determine if a proliferation of electronic signage is beneficial or detrimental. I, for one, feel we are bombarded with signs, banners, balloons, clowns, Uncle Sam and various animals all hawking to get our attention; all --while we attempt to navigate vehicles down busy business roads. A good question that needs an answer is: are Traffic signals becoming just one more flashing light? In my mind colorful flashing lights should be reserved for emergency services and law enforcement. Oh wait; we may not need them if drivers have their eyes on the road and not on flashing signs. Perhaps, the current policies should remain. In the instance of a warranty, should a contractor or property owner default, code enforcement can be used to bring a site into compliance as is done with landscaping issues beyond the initial year time period. At the Commission's public hearing, questions were posed as to whether the County's bonding policy requiring that an insurance company have a minimum A.M. Best rating of A and a size of VII drives up the interest rate for the insured. Further the development community indicated that very few local bonding agencies meet the requirements. According to the Department of Risk Management, the county's requirements do not impact interest rates. Rather interest rates are generally based upon the financial strength of the entity getting the bond. As a matter of note, there have been times when an entity was unable to obtain bonding from an insurance company with the A rating and VII size, and the County has under special circumstances, accepted bonds from a lesser rated insurance company. The Commission suggested that the Board may wish to consider directing staff to evaluate the bonding requirements. Summary of Information: As directed by the Board of Supervisors, the Planning Commission held a public hearing on a proposed code amendment relating to the encroachment of storm water and best management practice facilities (SWM/BMP) into buffers. On July 19, 2011, the Commission recommended denial of the attached amendment and forwarded it to the Board for consideration. The Commission indicated that the current process allowing a developer to seek reduction of required buffers from the Commission through the plans review process affords those impacted by such a proposal immediate consideration through the public process, rather than an appeal procedure as suggested through the amendment. This amendment was proposed through the Evaluation of Development Regulations (Cost of Development) Project. The attached ordinance addresses encroachment of SWM/BMP facilities in buffers. Currently, the Ordinance prohibits such encroachments unless approved by the Planning Commission during plan review. The proposed amendment would allow administrative approval of an encroachment provided it is staff's determination that the encroachment will not violate the spirit and intent of the required buffer. All basins required by the director of environmental engineering as either a stormwater management facility or a Best Management Practice for water quality improvement or designed as a retention or detention facility for any new development or redevelopment of property shall conform to the following criteria: 000 (2) Perimeter yards. Although the current fees for an appeal by a person aggrieved by a decision of the planning director relating to site plan review are $400 for residential uses and $350 for office, commercial and industrial uses, the proposed amendment would allow a person aggrieved by the encroachment of SWM/BMP into a required buffer to appeal to the Planning Commission without paying an appeal fee. After a public hearing, the Board of Supervisors may recommend changes in the proposed amendment. Fee recommendations could range from (i) no change in the current fee schedule to (ii) no fee for appeal of this specific buffer decision and (iii) any combination in between. Legal authority for enactment of these fees, levies, increases and/or reductions includes the Chesterfield County Charter and Va.
