REQUEST:
Conditional Use Planned Development to permit use (sale of motorcy-
cles, trailers, and accessories) and bulk exceptions (setback for
outside display) in a Community Business (B-2) District.
RECOMMENDATION
Recommend approval for the following reasons:

The proposed land use conforms to the Proposed Transportation and
Land Use Plan for the Powhite/288 Development Area.
Through the Conditional Use Planned Development, the Commission and
Board may impose conditions which insure that this use will not
adversely affect area development.
CONDITIONS
The following conditions notwithstanding, the plan prepared by the
Planning Department shall be considered the Master Plan. (P)

In conjunction with the approval of this request, the following bulk
exceptions shall be granted:

A forty-five (45) foot exception to the fifty (50) foot setback
for outside display of merchandise for sale along Midlothian
Turnpike. This area shall be delineated by a permanent means
(i.e., concrete curb, timber curb, etc.) to clearly define the
outside display area and discourage display and parking where
not permitted. No more than five (5) items shall be displayed
outside.
An exception to the required 10x20 foot parking space size for
no more than one-half of the required twenty (20) parking
spaces. Parking spaces shall have signs to designate motorcy-
cle parking versus automobile parking. Ail parking shall be
located west of the building, as shown on the Master Plan. The
area in front of the building shall be reserved for outside
display in.accordance with Condition 2a, and a twenty (20) foot
driveway. The area in front of the building shall be signed to
prohibit parking in front of the building and constructed to
discourage parking where not permitted (i.e., timber curbs,
concrete curbs, etc.). (P)

An exception to the requirement that the parking area for
motorcycles stored in the screened storage area be paved.

Uses permitted shall be limited to the sale and repair of motorcy-
cles, motorcycle trailers and motorcycle accessories. Outside
storage shall be permitted, subject to it being screened by a method
approved by the Planning Department at the time of final site plan
review. (P&CPC)
There shall be no additions or alterations other than the shop and
normal maintenance to the existing structure to accommodate this
use. (P)

In conjunction with the approval of this request, the Planning
Commission shall grant schematic plan approval of the Master Plan.
(Note: The request parcel lies within the Special Sign District and all
signs must comply with Division 7.1 of the Zoning Ordinance.)

DISCUSSION
On February 22, 1984, the Board of Supervisors approved the rezoning of
the subject property from Agricultural (A) to Community Business (B-2) o
The Planning .Commission had recommended Convenience Business (B-I) zon-
ing. The applicant, at that time, Cardinal Realty Company, indicated
that the existing structure was to be remodeled for office use. The
property has been used for various Commercial uses since the 1930s.
The current request is for Conditional Use Planned Development to permit
the sale and repair of motorcycles, motorcycle accessories, and motorcy-
cle trailers (Condition 3). Also requested are exceptions to the
required fifty (50) foot setback for outside display and the size of
parking spaces. The proposed use is first permitted by right in a Gen-
eral Business (B-3) District. Concerns relative to the intensity of the
use can be addressed through the Conditional Use Planned Development
process better than through Euclidean B-3 zoning.
With respect to'the requested bulk exceptions~ there is some merit to
granting relief because the existing structure is only set back approxi-
mately 33 feet from Route 60. If the outside display were to be set back
fifty (50) feet from Route 60, as required by the Zoning Ordinance, the
display woUld be seventeen (17) feet beyond the facade of the existing
building. The applicant's Master Plan proposes no setback from Route 60.
Staff is of the opinion that the setback should be such that sight dis-
tance for vehicles exiting the property is not impaired. Furthermore,
the area should be clearly delineated to preclude parking and driving in
the outside display area. There should be no parking in front of the
building because there is not sufficient room to accommodate the outside
display area and driveways plus parking. (Condition 2a)
Because of the limited area needed to park motorcycles, an exception to
the required 10'x20' parking space size is also requested. Staff is of
the opinion that a reduction in the size of one-half the required twenty
(20) parking spaces would be reasonable, given the fact that most of
those patronizing the business will be driving motorcycles. (Condition
2b)

mended approval of this request subject to the conditions on pages 1 and
2.
