PROPOSED LAND USE: A computer-controlled, variable message, electronic sign, incorporated into a freestanding project identification sign for a hotel complex (Shamin Park) is proposed. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reason: The proposed computer-controlled, variable message, electronic sign conforms to the adopted Electronic Message Center (EMC) Policy. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. CONDITIONS NOTED "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION.) Providing a FIRST CHOICE community through excellence in public service PROFFERED CONDITIONS (STAFF/CPC) 1. In addition to Ordinance requirements, any computer-controlled, variable message, electronic sign shall conform to the following standards: a. Copy shall be limited to a maximum of three (3) lines and shall not move but may fade; b. The message or display shall be programmed to change no more than once every thirty (30) seconds; c. Sequential messaging shall be prohibited; d. Flashing and traveling messages shall be prohibited; e. Bijou lighting and animation effects shall be prohibited; £ The electronic message center shall be incorporated into an architecturally designed sign structure that is compatible and complimentary to the building it serves; and g. Brightness shall be limited so as not to exceed 0.3 foot candles above ambient light as measured using a foot candle meter at a distance of seventy-seven (77) feet. (P) (STAFF/CPC) 2. The sign location shall be limited to Tax ID 802-654-8609. (P) GENERAL INFORMATION Location: The request property lies on the south line of West Hundred Road, across from Chestnut Hill Road, and the west line of Old Stage Road, south of West Hundred Road, and better known as 1911 and 2001 West Hundred Road and 12810 Old Stage Road. Tax IDs 802- 654-8609; 803-653-0968; and 803-654-1909. Existing Zoning: C-3 and C-5 Size: 3.6 acres of a 10.4 acre project Existing Land Use: Commercial 2 12SN0177-MAR28-BOS-RPT Adjacent Zoning and Land Use: North - C-3 and C-5; Commercial or vacant South - C-3, C-5, and I-1; Commercial or vacant East - C-5 and I-3; Commercial or industrial West - C-3 and C-5; Office or vacant T TTTT TTTF c Public Water and Wastewater Systems: While installation of the proposed sign will not impact the public utility systems, the applicant is cautioned that the proposed sign must not be placed so as to not conflict with the existing public utility lines, or their easements, on this site. ENVIRONMENTAL: FIRE AND COUNTY DEPARTMENT OF TRANSPORTATION This request will have no impact on these facilities. Virginia Department of Transportation (VDOT~: To date, no comments have been received. T ANTI T TCF Comprehensive Plan: The subject property is located within the boundaries of the Consolidated Eastern Area Plan, which suggests the property is appropriate for community mixed use. Area Development Trends: The area is characterized by commercial, industrial and office uses surrounding the West Hundred Road/Interstate 95 interchange. Sign Design: The applicant plans to replace an existing project identification sign with a new sign to include an electronic message board to identify a hotel complex commonly known as Shamin Park. The proposed sign would comply with the size and height requirements of the Ordinance which currently permit a freestanding sign 62.5 square feet in area (including changeable copy) and fifteen (15) feet in height. The proposal would comply with the Electronic Message Center (EMC) Policy relative to lines of copy, timing of message changes with no sequential messaging sign appearance, brightness and lack of flashing and traveling messages, bijou lighting and animation. The 3 12SN0177-MAR28-BOS-RPT Policy requires a 1,000 foot spacing between Electronic Message Centers (FMC's). Currently, an EMC identifying a competing hotel is located at the northeast corner of West Hundred and Old Stage Roads, approximately 1,020 feet east of the subject property (Tax ID 803-654-7161 and 7928). Proffered Condition 2 would limit the location of the proposed EMC to the property on which the current project sign is located, being the western-most subject parcel. While the sign could be moved within the confines of this parcel, potentially reducing the distance between these neighboring electronic message signs, the Policy provides for less spacing between these signs when identifying similar competing operations. CONCLUSION The proposed computer-controlled, variable message, electronic sign conforms to the adopted Electronic Message Center (EMC) Policy. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (2/21/12): The applicant accepted the recommendation. There was concern expressed relative to the use of approximate measurements when evaluating distances between electronic message center signs. There was support present noting that the Policy allowed consideration for competitive businesses to locate electronic message signs closer than the typical spacing. On motion of Mr. Patton, seconded by Mr. Waller, the Commission recommended approval and acceptance of the proffered conditions on page 2. AYES: Messrs. Gulley, Waller, Brown, Patton and Wallin.
