(Amended) Conditional Use Planned Development to permit a rest home
in R-7 District.
RECOMMENDATION
Recommend approval for the following reasons:

The use provides a reasonable land use transition between the General
Business (B-3) zoning to the east and the single family residential
uses to the west.
Through the imposition of conditions, the ~Commission and Board can
further insure land use compatibility.
CONDITIONS
The Conditional Use Planned Development shall be granted for the pur-
pose of operating a rest home for a maximum of ten (10) persons.
The following conditions notwithstanding, the plan prepared by
Charles C. Townes and Associates, dated September 1, 1983, shall be
considered the plan of development.
The driveway and parking area shall be surfaced with six (6) inches
of #21 or #2lA stone. The driveway and parking area shall be defined
by durable material (i.e., timber curbing or other similar
treatment).

Other than normal maintenance, there shall be no exterior alterations
or additions to the existing structure to accommodate this use.
In conjunction with the granting of this request, schematic plan ap-
proval shall be granted.

public sewer intended. Additional sewer
connection fees must be paid.
Environmental Engineering:
Drains to Appomattox River via various trib-
utaries. Randolph Street (unimproved) expe-
riencing some erosion problems.
Fire Service:
Ettrick Fire Station, Company #12. At pre-
sent, fire service capability adequate.
General Plan:
Single family residential
Transportation:
This use will have a minimal impact on area
traffic patterns.
DISCUSSION
The applicants are requesting a Conditional Use Planned Development to
permit a rest home for ten (10) persons in a Residential (R-7) District.
Subsequent to submission of the application and, at Staff's suggestion,
the applicants petitioned the Board of Supervisors to vacate Bremo Avenue,
which formed the eastern boundary of the site. On September 28 the Board
approved this vacation; therefore, an additional twenty-five (25) feet of
property has been acquired (see attached Master Plan).

The suggestion to vacate Bremo Avenue resulted because the existing drive-
way does not conform to the required twenty-four (24) foot width and the
parcel was too narrow in the rear to accommodate parking. Further, the
parking area originally shown was located adjacent to a single family
dwelling and could not be effectively screened. Vacation of Bremo Avenue
allows the driveway and parking area to be relocated to the west of the
existing structure and adjacent to General Business (B-3) zoned property.
Staff is of the opinion that the use provides a reasonable land use tran-
sition between commercially zoned property to the east and the single fam-
ily residential uses to the west. It should be noted that the Fire Pre-
vention and BOCA Codes address requirements relative to fire protection
measures and square feet per resident. Further, this use is regulated by
State Codes through the Department of Welfare and Institutions.
CASE HISTORY
Planning Commission Meeting (8/23/83):
At the request of the applicants, the Commission deferred this request for
sixty (60) days to allow Bremo Avenue to be vacated.
Planning Commission Meeting (10/25/83):
On motion of Mr. Daniel, seconded by Mr. Thomas, the Commission resolved
to recommend approval of this request, subject to the conditions herein.
AYES: Messrs. Thomas, Miller, Moszer, Lindsey and Daniel.
ABSENT: Mr. Belcher.
The Board of Supervisors, on Wednesday, November 23, 1983,'beginning at 2:00
p.m., will take under consideration this request.
