REQUEST: Rezoning from Agricultural (A) to Residential (R-40).
RECOMMENDATION
Recommend approval of Residential (R-40) zoning for the following reasons:
A. The proposed zoning and land use is compatible with that which cur-
rently exists in the area.
B. The proposed land use conforms to the General Plan 2000.

Public water not available. Intends to in-
stall individual wells. Lies in Swift Creek
sewage drainage area. Closest trunk sewer
located in Brandermill. Extension of public
sewer not feasible at this time; however,
Utilities Department recommends necessary
easements be dedicated for future extension
of sewer along Swift Creek Reservoir. Ap-
plicant intends to install individual septic
tank and drainfieldsystems.
Environmental Engineering:
Terrain nearly level to moderately steep
and, when cleared, has slight to moderate
chance for erosion. Majority of Soils
poorly suited for septic tank and drainfield
systems. A professional soil scientist
should locate drainfields for each lot and
submit this information to the Health De-
partment prior to, or in conjunction with,
final check plats. Property drains to Swift
Creek. Since Swift Creek Reservoir is a
public water course, stringent erosion con-
trol and drainfield selections must be uti-
lized to prevent any adverse effect on the
reservoir.
Schools:
Estimate approximately 5 students will be
generated. Lies in Grange Hall Elementary
School attendance zone: capacity - 687,
enrollment - 556; Swift Creek Middle School
zone: capacity - 1,500, enrollment - 1,577;
and Clover Hill High School zone: capacity
- 1,500, enrollment - 1,396.
Fire Service:
Clover Hill Fire Station, Company #7. Be-
cause this is a volunteer station, fire ser-
vice capability is marginal, depending upon
time of day. Public water not available for
fire protection.
General Plan:
Single family residential use
~ransportation:
Vehicular movements will be distributed
along Genito Road, which had a 1982 traffic
tabulation of 2,389 vehicles per day. Esti-
mate approximately 70 average daily trips
will be generated.
DISCUSSION
The applicant is requesting rezoning to Residential (R-40) with the intent
of developing a seven lot subdivision. On August 23, 1983, the appli-
cant's representative appeared before the Planning Commission requesting
that the property be exempt from the requirement that the property be re-
zoned to a residential classification prior to subdivision approval; how-
ever, it was the determination of the Commission that the property should

be rezoned in accordance with the Commission's policies and regulations of
the Subdivision Ordinance. Residential development of the subject prop-
erty is in accordance with the General Plan 2000 and is compatible with
the existing R-15 zoning to the southwest of the request site.

On motion of Mr. Lindsey, seconded by Mr. Miller, the Commission recom-
mended approval of this request.

Further, the Commission granted tentative subdivision approval.
