Matoaca Magisterial District South line of Bailey Bridge Road REQUEST: Conditional Use to permit a landfill in an Agricultural (A) District. RECOMMENDATION Recommend approval for the following reasons: Ao A landfill has been operated on the site for the past six years with no apparent detriment to area or adjacent property owners. Be The landfill has been operated primarily in accordance with the con- ditions imposed on previous Conditional Uses. The conditions stated herein further insure that adjacent and area property owners will not be adversely affected by continued operation. CONDITIONS This Conditional Use shall be granted to and for James T. Bush Con- struction Co., Inc., exclusively, and shall not be transferable nor run with the land. No dumping shall be permitted closer than 100 fee't from the south, east and west property lines. This 100 foot area shall be considered a buffer zone and shall not be cleared or regraded. Only one access shall be permitted to the parcel in question. The entrance shall be secured with a fence to prohibit indiscriminate dumping of materials. The applicant shall be responsible for the removal of any materials dumped along either the access road or that portion of the parcel not approved for the landfill operation. The existing berm, located along Bailey Bridge Road, shall be main- tained. The height of the berm shall be increased at the northwest and northeast corner to preclude visibility from the entrance of the church and from Bailey Bridge Road. This shall be accomplished with- in thirty (30) days of the final action of this request by the Board of Supervisors. The berm shall be no steeper than 2:1 and shall be planted and maintained with ground cover. This Conditional Use shall be granted for a period not to exceed three (3) years from date of approval and may be renewed upon satis- factory reapplication and demonstration that this operation has not proved a detriment to adjacent and area properties. Operations shall be limited to between the hours of 8:00 a.m. to 6:00 p.m., Monday through Saturday. No Sunday operation shall be permitted. Ail junk material, other than dirt, stone, rock, stumps, building material, and land-clearing material shall be removed from the property. Fill material shall be restricted to stone, soil, rocks, stumps, building material or other natural inert material. No household gar- bage or waste shall be dumped on the site. m 10. At the end of each week all materials shall be leveled and covered with a layer of earth not less than six (6) inches in depth. Upon completion of this operation, a plat showing the location of the fill area and the types of material buried shall be submitted to the Planning Department. 11. 12. All conditions noted herein shall be affixed to a plat of the subject property and, upon approval by the Planning Department, shall be re- corded in the Circuit Court Room with the property reference. Construction of any facilities over the fill area shall not be per- mitted unless soil engineering studies approve the suitability of such construction. 13. During the hours of operation, a supervisor shall be located on the site for the purpose of monitoring and directing the fill activity or the site shall be secured to preclude indiscriminate dumping by the general public. Most landfill activity creates severe soil limitations and often hinders or even pre- cludes future development of site since fill material is subject to displacement and set- tlement. Rate of decay of buried organic material is extremely difficult to predict. Consolidation of fill can be expected to continue for many years with accompanying settlement. Attempting to support any structures over fill involves definite risk. Foundations of buildings, unless properly designed, will be subject to unusual settle- ment resulting in both health and safety problems. Adequate soil bearings for foot- ings may require excavation to the undis- turbed soil surface for the total length of the footing. Another alternative might be to construct a future building on pilings driven through the fill material into the undisturbed soil. Although there are means of supporting foundations for structures, porches, steps, roadways and sewer lines, they are also subject to breaking from set- tlement of buried materials. Depending upon the future type of develop- ment, filling, unless carefully controlled, will not correct natural soil limitations such as wetness or flooding. Fill material for large construction projects is placed in 6 to 12 inch layers, carefully compacted and tested continuously by soils engineer. Ail trash or wood debris is removed from the fill material. Utilization of wood debris for filling can preclude future development of entire parcel. Final grades steeper than 2:1 make slopes almost impossible to stabi- lize against erosion and may be dangerous for pedestrian and vehicular use. The con- ditions stated herein attempt to address these concerns. Clover Hill Fire Station, Company #7. Since this is a volunteer station, fire service 3 83S161/BSNOV3/L capability is marginal, depending upon time of day. General Plan: Vacant/Agricultural Transportation: Vehicular movements will be distributed along Bailey Bridge Road and will have a minimal impact on area traffic. DISCUSSION The applicant has a current agreement with the property owner to continue to operate the landfill. A Conditional Use was first issued on this site in 1976 to L.L. Cashion. At that time, detailed erosion, drainage and reclamation plans were not required for an operation of this nature. The original Conditional Use was granted for three years and subsequently, renewed by Mr. Cashion for an additional three-year period. The current application is for continua- tion of the landfill operation by James T. Bush Construction Co., Inc. The County Soil Scientist, Environmental Engineering and Planning Staff visited the site and found that the landfill has been operated primarily in compliance with previously imposed conditions. There was some evidence that household garbage and waste had been dumped on the site. This could have resulted from the site not being secured during the hours of opera- tion. It is imperative that the applicant be instructed to lock the gate leading into the property when no one is present. This will insure that trespassing and dumping does not occur by unauthorized persons. Further, in order to screen the site along Bailey Bridge Road and from the church, located to the north, the existing earth berm should be raised in height at the northwest and northeast corners. The conditions stated herein ad- dress the increased height of the berm, as well as seeding to preclude erosion problems. CASE HISTORY Planning Commission Meeting (11/3/83): On motion of Mr. Belcher, seconded by Mr. Thomas, the Commission recom- mended approval of this request, subject to the conditions herein. AYES: Messrs. Miller, Moszer, Belcher, Lindsey and Thomas. ABSENT: Mr. Daniel.
