MidlothianMagisterial District North line of Midlothian Turnpike REQUEST: Conditional Use Planned Development to permit automotive repair and a tire business in a Community Business (B-2) District. RECOMMENDATION Recommend approval for the following reason: The proposed land use, if properly conditioned, is compatible with devel- opment along the Route 60 corridor. CONDITIONS The following conditions notwithstanding, the plan submitted with the application shall be considered the Master Plan. This Conditional Use shall be for the purpose of operating an automo- tive repair business and tire sales and service business. There shall be no automobile body repair, tire recapping or vulcanizing permitted. Additional pavement, 26 feet from the centerline of the westbound lane of Route 60, and curb and gutter shall be aonstructed along Route 60. This construction shall be in accordance with VDH&T speci- fications and shall be completed prior to the issuance of an occu- pancy permit. e Other than vehicles awaiting repair, there shall be no outside stor- age nor shall any merchandise for sale be displayed outside. All exterior lighting shall be low level not to exceed a height of 20 feet and shall be positioned so as not to project light into adjacent properties or Route 60. A single freestanding sign shall be permitted identifying these uses. This sign shall not exceed an aggregate area of 100 square feet. The sign may be illuminated, but may be luminous only if the sign field is opaque with translucent letters. The sign shall blend with the architectural style and colors of the structures. e The proposed structures shall employ subdued colors. Colored render- ings shall be submitted to the Planning Commission for approval in conjunction with schematic plan review. Within the fifty (50) foot setback along Midlothian Turnpike, orna- mental trees and shrubs shall be planted. A landscaping plan depict- ing this requirement shall be submitted to the Planning Commission for approval in conjunction with schematic plan review. Curb and gutter shall be installed around the perimeter of driveways and parking area. (EE) 10. These uses shall be screened from the adjacent property to the east which is occupied by a mobile home park. Screening shall consist of topographical conditions and/or solid board fencing. In conjunction with schematic plan submission, a screening plan shall be submitted to the Planning Commission for approval. 11. There shall be no temporary signs permitted on the site. The hours of operation shall be limited to between 8:00 a.m. and 9:30 p.m., Monday through Saturday. There shall be no Sunday operations. All trash and trash containment facilities shall be properly screened and maintained. GENERAL INFORMATION Location: Size: North line of Route 60, approximately 800 feet west of Tuxford Road. Tax Map 18-13 (1) Part of Parcel 1 (Sheet 8). 1.5 acres Existing Zoning: B-2 Existing Land Use: Vacant Adjacent Zoning & Land Use: Utilities: North - 0, Vacant South - A, Single family residential East - B-2, Mobile home park West - B-2, Vacant 16 inch public water line along RoUte 60. Use of public water intended. Lies in Powhite Creek sewage drainage area. Environmental Engineering: Property drains to Pocoshock Creek. Due to borrow pit operation, which has previously occurred on site, property is currently ex- periencing erosion problems. However, ero- sion is confined to site. Curb and gutter should be installed around perimeter of driveways and parking areas. Fire Service: Midlothian Fire Station, Company #5. At present, fire service capability adequate. Installation of a fire hydrant may be required. Transportation: The 1982 traffic tabulation on Midlothian Turnpike was 31,000 vehicles per day. Addi- tional pavement widening and curb and gutter should be constructed along Route 60 to fa- cilitate turning movements. DISCUSSION On January 23, 1980, the Board of Supervisors, upon a favorable recommen- dation from the Planning Commission, rezoned the subject property to Com- munity Business (B-2) in conjunction with the adjacent Office Business (O) and R-15 zonings to the north. The applicants are now requesting a Conditional Use Planned Development to permit an automotive repair and tire business on the subject property. The uses requested are representative of general development trends along the Midlothian corridor. The conditions stated herein are similar to those imposed at the time property to the west was zoned to allow the two car dealerships in Moorefield Office Park. If properly controlled and conditioned, this use will be compatible with those which exists along Midlothian Turnpike. The plan, as submitted, complies with the spirit and intent of the proffered conditions which were offered at the time the property was originally zoned. At the time of schematic plan submission, the internal traffic circulation should be redesigned to minimize conflict points and to discourage parking in non-designated areas. 'Although the adjacent property is zoned Community Business (B-2), it is occupied by a mobile home park. Since this is a residential use, Staff has recommended screening these uses.either by topographical conditions or fencing. 3 83S169/BSNOV3/P CASE HISTORY Planning Commission Meeting (11/3/83): Dr. Moszer stated that additional conditions should be imposed which in- sure protection of and compatibility with adjacent properties. He recom- mended imposition of conditions 11 through 15. On motion of Dr. Moszer, seconded by Mr. Belcher, the Commission recom- mended approval of this request, subject to the conditions herein. AYES: Messrs. Moszer, Belcher, Lindsey and Thomas. ABSENT: Messrs. Daniel and Miller.
