Ms. Betty W. Taylor will retire on August 1, 2012, after 37 years of service
to Chesterfield County.

RECOGNIZING MS. BETTY W. TAYLOR UPON HER RETIREMENT
WHEREAS, in August 1975, Ms. Betty W. Taylor joined the Chesterfield County
Sheriff's Office as a deputy under the late Sheriff Emmett L. Wingo, and faithfully
served Sheriffs John Mutispaugh, Walter Minton, Clarence G. Williams, Jr. and current
Sheriff, Dennis S. Proffitt; and
WHEREAS, Ms. Taylor was the first female to serve as a courtroom security
deputy; and
WHEREAS, in January 1977, Ms. Taylor was transferred to develop and oversee the
Work Release program; and
WHEREAS, Ms. Taylor assisted in the development, implementation and daily
coordination of other alternative sentencing programs; and
WHEREAS, in July 1995, Ms. Taylor was promoted to classification officer, where
she worked for many years utilizing her knowledge, skills and abilities to aid in the
safe and secure housing of inmates through the use of objective jail classification
processes; and
WHEREAS, Ms. Taylor was transferred to administrative services in October 2005
to serve as an administrative assistant, performing a variety of duties until her
retirement; and
WHEREAS, Ms. Taylor received numerous letters of commendation and appreciation
in recognition of her job performance; and
WHEREAS, Ms. Taylor was selected as Employee of the Quarter in 2009 for her
role in the successful cutover to the county's new automated financial system.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 25th day of July 2012, publicly recognizes the outstanding
contributions of Ms. Betty W. Taylor, expresses the appreciation of all residents for
her service to Chesterfield County, and extends appreciation for her dedicated
service to the county and congratulations upon her retirement, as well as best wishes
for a long and happy retirement.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented to Ms.

WHEREAS, Mrs. Nancy B. McLean joined Chesterfield County on June 10, 1986,
as a part-time Secretary in the Planning Department; and
WHEREAS, Mrs. McLean was promoted to the position of part-time Principal
Account Clerk in the Parks and Recreation Department in 1988; and
WHEREAS, Mrs. McLean was promoted to the position of full-time Accounting
Technician in the Parks and Recreation Department in 1989, where she tracked
Capital Improvement Fund projects and revenues and expenditures for the
department, and coordinated staff conferences and travel; and
WHEREAS, Mrs. McLean was promoted to the position of Administrative
Supervisor at the Chesterfield County Airport in 2000, where she was
responsible for the overall administrative operations of the airport,
including managing Federal Aviation Administration (FAA) and Virginia
Department of Aviation grants and projects; and
WHEREAS, Mrs. McLean was instrumental in creating and hosting tours for
school groups and the public at the airport; and
WHEREAS, Mrs. McLean was instrumental in ensuring the success of three air
shows held at the airport; and
WHEREAS, Mrs. McLean accumulated
improve her skills and knowledge and

WHEREAS, Mrs. McLean completed InFocus training, Seven Habits of Highly

WHEREAS, Mrs. McLean has been a model employee during her many years of
service to the county; and
WHEREAS, Mrs. McLean always accomplished her duties with a positive
attitude and dedication to the employees and citizens of Chesterfield County,
and will be missed by all who dealt with her.

RECOGNIZING MR. ROBERT D. "BOB" RIVERS UPON HIS RETIREMENT
WHEREAS, Mr. Bob Rivers has served the county as the Capital Projects Manager for
26 years; and
WHEREAS, the Capital Projects Management office under Mr. Rivers' guidance has
planned and constructed 10 fire stations, 5 libraries, the 911 center, the Circuit
and General District Courts Building, the Juvenile and Domestic Relations Court
Building, the Riverside Regional Jail, the Lucy Corr Nursing Home, the new County
Jail and numerous other renovations and additions; and
WHEREAS, Mr. Rivers' organization planned and constructed the county's first
LEED-certified building, the Community Development Building; and
WHEREAS, Mr. Rivers has developed numerous processes to ensure the quality and
durability of county buildings; and
WHEREAS, Mr. Rivers embraced the county's commitment to quality and performance
by bringing customers, design consultants and contractors together in focus groups
to discuss how to improve the delivery of county construction projects; and
WHEREAS, Mr. Rivers has mentored and guided staff to advance their professional
development; and
WHEREAS, Mr. Rivers has worked tirelessly assisting the Office of Budget and
Management during the development of the annual Capital Improvement Program; and
WHEREAS, Mr. Rivers has successfully served three General Services directors
during his 26 years with the county; and
WHEREAS, Mr. Rivers has spent countless hours on weekends and evenings to ensure
that projects are delivered successfully with a minimum of disruption to staff and
citizens; and
WHEREAS, Mr. Rivers also has been dedicated to serving the community through the
donation of his time and talents to numerous service organizations.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of Supervisors,

Nominate/appoint representative to the SAFE Board of Directors.
Summary of Information:
SAFE is the county, school and community coalition working to prevent
substance abuse in Chesterfield County. The SAFE bylaws allow for some SAFE
board members to be appointed by the Board of Supervisors.
Board members concur with the appointment of Dr. Santresda "Sandy" Johnson to
the SAFE Board of Directors for a term from August 1, 2012 through July 31,
2015.
Dr. Johnson meets all eligibility requirements and has indicated her
willingness to serve.
Under the existing Rules of Procedure, appointments to boards and committees
are nominated at one meeting and appointed at the subsequent meeting unless
the Rules of Procedure are suspended by a unanimous vote of the Board members

Summary of Information:
The purpose of the Youth Services Citizen Board is to advise the Board of
Supervisors regarding planning and policies affecting youth development and
to provide a community forum to focus on youth issues.
Dale District. Supervisor Holland recommends that the Board reappoint Leah
Hamaker, an adult, to the Youth Services Citizen Board for a term from July
1, 2012 through June 30, 2015.
Supervisor Holland also recommends the Board nominate and appoint Barbara
Winston, an adult, to the Youth Services Citizen Board for a term from July
1, 2012 through June 30, 2015.
Ms. Hamaker and Ms. Winston meet all eligibility requirements to fill the
vacancies and have indicated their willingness to serve.

It is requested that the Chesterfield County Board of Supervisors approve the
following nominees for appointment/reappointment to the Community Criminal
Justice Board (CCJB) for a two-year term according to the adopted by-laws of
the Community Criminal Justice Board. Appointments correspond to prescribed
positions in the Code of Virginia.
Summary of Information:
The Community Criminal Justice Board (CCJB) serves the 12th Judicial Court
Circuit consisting of Chesterfield County and the City of Colonial Heights.
The purpose is to provide for the development, evaluation and planning of
community programs and services for the court in diverting offenders from
local correctional facilities.
At the June 14, 1995 meeting, the Board adopted a resolution entitled Joint
Resolution Providing for the Implementation of the Comprehensive Community
Corrections Act (CCCA) and the Pretrial Services Act (PSA); Establishment of
the Chesterfield County and City of Colonial Heights Community Criminal
Justice Board; and provisions for Joint Exercise of Powers.
The resolution designated the membership by position, according to the Code
of Virginia. The Community Criminal Justice Board members serve for two-year

Request the Board of Supervisors to nominate and appoint one at-large member
to the Citizen's Budget Advisory Committee.
Summary of Information:
On October 8, 2008, the Board of Supervisors created the Citizen's Budget
Advisory Committee to assist in the evaluation and allocation of resources in
accordance with the strategic plan to ensure a high quality of life.
Currently, the committee consists of 6 members and one at-large vacant
membership. The appointment term for the vacant, at-large member is two
years, effective immediately and expiring on September 30, 2014.
This agenda item requests that the Board nominate and appoint one at-large
committee member. Staff recommends the following individual to serve on the
Citizen's Budget Advisory Committee: Mr. John Hilliard.
If the members of the Board of Supervisors desire to nominate and appoint an
individual to this committee at this meeting, they will need to unanimously

WHEREAS, this show of solidarity by law-abiding citizens has been
named "National Night Out"; and
WHEREAS, the National Night Out event taking place on August 7,
2012 will be the 29th annual event of this type; and
WHEREAS, last year's National Night Out campaign involved
citizens, law enforcement agencies, civic groups, businesses,
neighborhood organizations and local officials from 10,000 communities
in 50 states, U.S. territories, Canadian cities and military bases
worldwide; and
WHEREAS, National Night Out is designed to heighten crime- and
drug- prevention awareness; and
WHEREAS, this event also generates support for, and participation
in, local anti-crime programs; and
WHEREAS, National Night Out strengthens neighborhood spirit and
the relationships between police and the communities; and
WHEREAS, these events send a message to criminals that the
communities are organized and fighting back against crime; and
WHEREAS, Chesterfield County has as one of its strategic goals:
"To be the safest and most secure community of its size"; and
WHEREAS, National Night Out is an important component in the
effort to achieve that goal.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors hereby recognizes August 7, 2012, as "National Night

The Falling Creek area of the Jefferson Davis Highway (US Route 1/301), is in
dire need of improved operational and pedestrian accommodations, as well as
economic development opportunities. CCED is requesting from VDOT an
exception from Access Management spacing standards to relocate an existing
crossover on Jefferson Davis Highway to align with Marina Drive and Parkdale
Road. VDOT requires county support to move forward; therefore, public
meetings have been held and this resolution is sought.

WHEREAS, Corporal Poe has faithfully served the county in the capacity
of Police Officer, Training Officer, Senior, Master and Career Officer and

Department, Corporal Poe has served as Field Training Officer, Community
Policing Officer, Evidence Technician, General Instructor, Lead Firearms
Instructor, Range Master, Firearms Instructor, and as a member of the Police
Emergency Response Team, where he has served on the Special Weapons and
Tactical Team, in the role of Sniper Team Leader; and
WHEREAS, Corporal Poe was presented with the Police Combat Award for his
actions to protect fellow officers during a standoff with an armed suspect;

WHEREAS, Corporal Poe received the Meritorious Service Award and a Unit
Citation for his diligent and dedicated performance for more than 20 years as
a member of the Police Department's Special Weapons and Tactical Team; and
WHEREAS, Corporal Poe consistently demonstrated fearless courage and
exceptional performance in the face of critical, volatile and quickly
changing circumstances, which helped successfully resolve numerous tactical
situations, ultimately saving many lives; and
WHEREAS, Corporal Poe was the recipient of a Commendation Award for his
efforts in improving the quality of firearms training and reducing overall
Police Department costs, saving the department thousands of dollars by
designing and implementing a support bracket for gun racks in police
vehicles, personally performing range maintenance and repairs, and utilizing
volunteers to complete projects at the range; and
WHEREAS, Corporal Poe received a Chief's Commendation Award for
distinguishing himself as a member of the Tactical Team while assisting the
DEA Task Force in the extended surveillance and successful arrest of a
suspect considered highly dangerous due to his violent past, suspected drug
use and access to extremely destructive weapons; and
WHEREAS, Corporal Poe is recognized for his communication and human
relations skills, his professionalism and his teamwork, all of which he has
utilized within the Police Department and in assisting citizens of
Chesterfield County; and
WHEREAS, Corporal Poe has received numerous letters of commendation,
thanks and appreciation from the citizens of Chesterfield County for service
rendered; and

support of the Eligibility Division, such as assisting customers with
applications, answering questions, receiving telephone calls from the agency
switchboard, reviewing customer information for completeness, and maintaining
confidential information; and
WHEREAS, Mrs. Sapp was very knowledgeable about the agency's complex
programs and services, and always exhibited a professional demeanor in
working with customers; and
WHEREAS, Mrs. Sapp provided exemplary customer service to the agency's
customers, and was well known for her compassion, empathy and strong work
ethic; and
WHEREAS, Mrs . Sapp frequently was cited by her co-workers as being a
strong team player; and

Approve the FY2013 and FY2014 Performance Contract Between the
Chesterfield Community Services Board and the Virginia Department of
Behavioral Health and Developmental Services.
Summary of Information:
The Code of Virginia requires that the governing body of each locality's
Community Services Board (CSB) approve a performance contract between the
CSB and the Virginia Department of Behavioral Health and Developmental
Services ("Department") This contract, mandated by the state since 1998,
establishes the primary accountability standards and funding mechanisms
between the Department and the local CSB and outlines reporting
responsibilities. The Department uses the reported data to track
compliance with the laws and regulations governing the delivery of
services by the CSB. The reported data is also used in the Chesterfield
CSB's biennial performance report.
The 2012 General Assembly amended the Code of Virginia to change the local
governing body approved contract renewal from an annual basis to a fixed
term of their choosing in order to reduce state and local administrative
burden.

The Chesterfield CSB has selected a two year window to line up with the
county's biennial budget process, though the approved contract can be
amended annually as needed and is subject to subsequent appropriations.
The performance contract reflects the budget approved by the Board of
Supervisors for FY2013. It describes the service and financial
requirements for both the CSB and the Department and includes exhibits
that detail all revenues, expenditures, number of persons projected to be
served, and the types of services to be provided. The performance
contract provides resources for infants, children, adolescents and adults
in the areas of mental health services ($11,734,154), developmental
services ($19,758,300) and substance abuse services ($3,934,100). These
funds were shown as income in the FY2013 county budget.
The CSB Board approved the FY2013 and FY2014 performance contract at its
regular meeting held on June 21, 2012. Staff recommends that the Board of
Supervisors also approve the performance contract.

The Board of Supervisors is requested to approve the FY2013 and FY2014
Performance Contract as required by State Code, between the Chesterfield
Community Services Board (CSB) and the Virginia Department of Behavioral
Health and Developmental Services.
The performance contract provides resources for infants, children,
adolescents, and adults in areas of mental health for $11,734,154,
developmental services (formerly mental retardation) for $19,758,300, and
substance abuse for $3,934,100. These funds are part of the CSB's FY2013
budget.
The total expenditure amount in the Performance Contract is $35,426,554
which differs from the CSB's adopted budget of $36,096,000 by $669,446.
The difference is a result of readjusted, more accurate estimates of pass-
through state aid received through the Richmond Behavioral Health
Authority to cover expenses for clients receiving acute hospital care. The
readjustment does not impact operations or represent a budget shortfall of
any sort.

Chester Presbyterian Church, located at 3424 West Hundred Road in Bermuda

from 5:00 p.m. until 7:00 p.m. on the church lawn. The event will feature
live musical performance by the Slack Family Singers. Approximately 200
people are expected to attend the outdoor concert.
The applicant's plan meets the substantive requirements of the entertainment
permit ordinance, and the property is properly zoned. The church has made
adequate provisions for public safety, fire prevention, medical protection,
sanitation, traffic control, and security. Specifically, 1) the church will
have access to the church's bathroom facilities in two separate buildings on
the church property; (2) the church nurse will be on duty for the event and

5. Permit holder shall provide the Risk Manager with a Certificate of Insurance,
in a form approved by the Risk Manager and County Attorney, as follows:
a. Permit holder must provide a certificate of insurance with a minimum
Commercial General Limit of $5,000,000 per occurrence for General
Liability and $5,000,000 per occurrence for Automobile Liability.
b. Permit holder must provide the Risk Manager with a complete list of all
vendors who will work at the Carnival. Each vendor must provide a
certificate of insurance with a minimum Commercial General Limit of
$1,000,000 per occurrence and $2,000,000 general aggregate.
c. The insurance required by this provision must be provided before the
permit holder or any vendor will be allowed to begin set-up for the event.
6. No carnival ride shall be operated unless a permit for its operation has been

issued by the Building Official. All permit applications have been completed.
7. No food vendor shall sell any food unless a permit for food vending has been
issued by the Health Department. All permit applications have been completed.
8. Permit holder will comply with all County noise ordinances and with all
conditions imposed by County employees and representatives to minimize the impact of
noise on neighborhoods in the vicinity of the Carnival.
9. Failure to comply with any of the above conditions will result in immediate
and automatic revocation of the Music/Entertainment Festival Permit.

powers over these apartments pursuant to a Memorandum of Understanding for
concurrent police jurisdiction over the apartments. The Memorandum of
Understanding must be approved by the Board, and the Circuit Court must then
approve the concurrent jurisdiction arrangement pursuant to a petition filed
by the county.
A proposed Memorandum of Understanding is attached. This MOU does not change
the manner in which police authority has been enforced at VSU in any way but
merely memorializes the long-standing arrangement between the county's Police
Department and the VSU campus police. Under this arrangement, VSU's campus
police are primarily responsible for law enforcement at the University
Apartments at Ettrick, and the county's Police Department provides support to
the VSU police.

Memorandum of Understanding Between the County of Chesterfield and Virginia
State University for Concurrent Police Jurisdiction
This Memorandum of Understanding (MOU), is entered into this _ day of July, 2012 between the
County of Chesterfield, Virginia (the "County"),apolitical subdivision of the Commonwealth of
Virginia, and Virginia State University ("VSU"), a Virginia public university, pursuant to authority
granted by Va. Code ~ 15.2-1727 and Va. Code ~, 23-234.
1. The County and VSU agree to provide for campus officers of the VSU Police Department
(VSU PD) to exercise, concurrently with officers of the Chesterfield County Police Department, the
powers and duties conferred by law upon police officers of the County at a specific location known
as the University Apartments at Ettrick (UAE), which is located at 4010 J. Mitchell Jones Blvd.,
South Chesterfield, VA 23803. The UAE apartment complex is located at the intersection of
Woodpecker Rd. and Hickory Rd., is privately owned by the Virginia State University Foundation,
and is controlled by VSU. Only VSU students and a limited number of faculty members reside at
UAE. The UAE property has controlled access points and security officers on-site provided by or
on behalf of VSU.
2. At its July 25, 2012 meeting, the Chesterfield County Board of Supervisors authorized and
directed County staff to file a petition on its behalf in the Circuit Court of Chesterfield County,
Virginia requesting the Court to grant a petition pursuant to Va. Code ~ 23-234, approving the
exercise of concurrent police jurisdiction by the County's Police Department and the VSU PD at the
UAE apartment complex. The County shall take steps to promptly file such a petition with the
Court. This MOU shall become effective immediately upon the granting of such a petition by the
Court.
3. The County and VSU agree that, pursuant to this MOU, campus officers of the VSU PD
shall exercise primary law enforcement authority at the UAE complex. The County and VSU
further agree that the primary authority granted by this MOU is granted only at the UAE apartment
complex. Such primary authority is not granted for any other location in Chesterfield County. The
police responsibilities of the County= are set forth in paragraph 5 of this MOU
4. This MOLT does not extend law enforcement powers at UAE to any law enforcement
agency not a party to this agreement, or to any party- not granted such powers by state code or
federal laws.

5. When requested to do so by VSU, the Chesterfield County Police Department (CPD) will
endeavor to provide police support and assistance to VSU at UAE; provided, however, that this
MOU in no way restricts or prohibits officers of the CPD from exercising their law enforcement
powers on the property> of USE when those officers, in their discretion, deem it necessary.
G. VSU PD shall provide CPD officers the means to enter the controlled access points at LT ~E
at all times when necessary for CPD officers to pro~-ide police support or otherwise perform their
police duties in accordance with paragraph 5 of this ~ZOU.
7. The County and VSU agree that the timely exchange of information regarding crime and
other public safety issues at or adjacent to U1~E is beneficial to both agencies for the safety of
students as well as residents and businesses in the surrounding community, and they shall endeavor
at all times to use their best effort to exchange such information in a timely fashion.
8. This MOU shall be reviewed every three years and may be terminated by either party by
written notice of termination.

The Board is requested to adopt the attached amendment to the county's cash
proffer policy.
Summary of Information:
The 2010 General Assembly enacted legislation changing the timing for
localities to accept payments of cash proffers on individual residential
lots. The 2010 law only permits localities to accept cash proffers payments
after final inspection of a new residence, but before issuance of a
certificate of occupancy. Like a number of other jurisdictions, Chesterfield
County took the position that the new law could not, by law, apply
retroactively to zoning cases approved prior to July 1, 2010 (the effective
date of the law). For pre-July 1, 2010 zoning cases, the county required cash
proffer payment for a lot to be made at the time provided for in the
proffered condition, that is, at the time the building permit was issued for
the lot. For all zoning cases approved on or after July 1, 2010, the county
accepted cash proffer payments in accordance with the 2010 legislation.

On June 15, 2011, the Board approved revisions to the County's cash proffer
policy which gave persons building homes on lots subject to pre-July 1, 2010
cash proffers three different options to allow them to pay their cash
proffers prior to issuance of a certificate of occupancy rather than at the
time of the issuance of the building permit. These options were developed in
conjunction with - and were supported by - the home-building community as
well as legal counsel representing this community.
However, in the past year or so there have been two developments affecting
the County's cash proffer payment program. First, the Attorney General opined
that the 2010 legislation could legally apply retroactively to cash proffers
approved prior to July 1, 2010, thus effectively rezoning those properties to
change the timing of cash proffer payments. This opinion was subsequently
relied on in a decision of the Circuit Court of James City County holding
that the 2010 legislation applied retroactively (James City County has
indicated it will appeal this decision). Second, the three options the Board
approved last year to allow later cash proffer payments have not been
utilized as much as both staff and the home-building community believed they
would be.
As a result, the Board at its last meeting requested staff to draft an
amendment to the County's cash proffer policy that would allow all cash
proffer payments to be made after final inspection of a new residence but
before the issuance of an occupancy certificate. While staff continues to
believe that the Board is not required to adopt this amendment for pre-July
1, 2010, zoning cases, the Board is legally permitted to make this policy
change. The 2010 legislation is currently written to sunset on June 30, 2017
(the sunset date has already been extended twice by the General Assembly).
Staff will bring this issue back to the Board if the legislation ever sunsets
so that the Board can consider whether or not to reconsider the attached
amendment.

~~ Notwithstanding the provisions of any proffer for a dwelling unit calculated
on a per unit basis and accepted in any zoning case the County will accept the
cash proffer~ayment on such unit after final inspection but before issuance of a
certificate of occupancy whether temporary or final. Other proffered cash
contributions the payment of which is tied in the proffer to a particular time or
event shall continue to be payable in accordance with the terms of the proffer.
Timing for dedication of property or in-kind improvements should be specified in
the proffer. Cash proffers, property dedications and in-kind improvements must
be used for projects identified in the Capital Improvement Program. The Capital
Improvement Program is based in part on the County's Public Facilities Plan,
which projects long-term facility needs.

Summary of Information:
The Old Clover Hill High School, the current polling place for Harbour Pointe
Voting Precinct, can no longer serve as the polling place because of the
renovations currently taking place there. After considerable effort to find
a new polling place, the Registrar and Electoral Board are now requesting
that the polling place for Harbour Pointe Voting Precinct be moved to
Brandermill Church, 4500 Millridge Parkway, Midlothian, VA 23112. The
attached map shows both the current polling place (in red) and the proposed
new polling place (the "x" in green). The Church has graciously agreed to
serve as the polling place. In order to effect this change, the Board must
hold a public hearing and adopt the attached ordinance. Staff recommends
setting the public hearing for August 22, 2012.

RECOGNIZING HEVENER'S TIRE AND AUTOMOTIVE
AS THE 2012 ENVIRONMENTAL STEWARDSHIP AWARD WINNER
WHEREAS, the Chesterfield County Board of Supervisors, Chesterfield
County Economic Development and the Anti-Litter Program established a
Business Awards Program to recognize existing businesses within the county
that contribute to the county's goal of being protectors of the environment;
and
WHEREAS, Hevener's Tire and Automotive, which is located at 11107 Iron
Bridge Road in Chester, employs a total of 12 full- and part-time employees;
and
WHEREAS, since 1973, Hevener's Tire and Automotive has been performing
high quality, guaranteed automotive repairs in Chesterfield County, is
committed to providing superior customer service, and educates its customers
on the importance of keeping Chesterfield County clean and green; and
WHEREAS, Hevener's Tire and Automotive recycles office paper, oil,
metal, anti-freeze, batteries and tires, and the company stores all waste
material in appropriate containers and uses earth-friendly cleaning products
in its facility; and
WHEREAS, the staff of Hevener's Tire and Automotive picks up litter
surrounding the facility once a month or as needed, promotes keeping
Chesterfield clean by displaying Chesterfield County's Anti-Litter Program
educational material, and offers customers earth-friendly tokens for being
responsible protectors of the environment; and
WHEREAS, Hevener's Tire and Automotive offers Chesterfield County
employee discounts for services, and supports the county schools and athletic
programs by offering free oil change coupons and donating sponsorship monies
for fundraising events.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 25th day of July 2012, publicly recognizes Hevener's Tire
and Automotive, expresses gratitude on behalf of the county for its many
contributions to the county, and congratulates them on being the 2012
Environmental Stewardship Award winner.

innovative products and services, job creation, tax revenue and ethical
business standards.
Proseal prides itself as being the most innovative company in the food
packaging industry. Proseal has a highly skilled team of forward-thinking
engineers that use state-of-the-art 3D modeling software, as well as the
latest manufacturing technology. Proseal's team of systems engineers designs
the equipment to create a fully integrated turnkey production line.

the fast-paced food industry; and
WHEREAS, Proseal's President and CEO is Gari Wyatt, who moved to the
United States in 2008 from their headquarters in the United Kingdom to start
the new venture; and
WHEREAS, Proseal's tray sealing machines are innovative because they
reduce packaging weight, improve product presentation and increase the shelf
life of the products; and
WHEREAS, from their headquarters in the United Kingdom, via Internet
connection with the equipment, Proseal is able to remotely monitor and
diagnose faults anywhere in the world; and
WHEREAS, Proseal values its employees by funding educational programs
and apprenticeships, and the company has built strong relationships with both
John Tyler Community College and Virginia Commonwealth University's School of
Engineering; and
WHEREAS, Proseal America sponsors both the Richmond Kickers Youth
Academy Scholarship Fund and the StoweStrong Fund; and
WHEREAS, after rapid growth in Chesterfield County, Proseal has recently
purchased a building of their own in the Airpark, which will allow them to
expand both their building square footage and their employee numbers, and
they anticipate creating 10 new jobs over the next 18 months.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of

Chesterfield Towne Center is owned and operated by Macerich, a national,
publicly-traded Real Estate Investment Trust headquartered in California.
Chesterfield Towne Center is a one million square foot indoor regional
shopping center featuring approximately 130 retailers and is the second
largest center in the Richmond region. The Center contributes over 7 percent
of the entire county's sales tax base over all industries and is the third
largest employer.

AS THE 2012 COMMUNITY IMPACT AWARD WINNER
WHEREAS, the Chesterfield County Board of Supervisors and Chesterfield
County Economic Development established a Business Awards Program to
recognize existing businesses within the county that contribute to the
county's economy and its citizens; and
WHEREAS, Chesterfield Towne Center is located on Midlothian Turnpike and
employs over 1700 employees; and
WHEREAS, Chesterfield Towne Center strongly believes in the importance
of being a positive and dynamic member of the community; and
WHEREAS, Chesterfield Towne Center has participated for many years in
their company's Most Valuable Partner (MVP) Program, partnering with select
local organizations each year; and
WHEREAS, in 2011, the selected partners were Richmond Animal League and
Greater Richmond Food Bank, and Macerich employees donated over 350 hours of
community service to these organizations; and
WHEREAS, through Macerich's Louise Marquez Grant Program, Chesterfield
Towne Center supported the awarding of $5,750 in grant dollars to local non-
profit organizations, including the Chesterfield County Police Foundation,
Stop Child Abuse Now, Chesterfield-Colonial Heights Alliance for Social
Ministry, Christmas Mother, Richmond Animal League, Greater Richmond Food
Bank, ART 180, Chesterfield and Colonial Heights Crime Solvers, Mended Little
Hearts, the Roland McDonald House, and RAMPS (Ramp Access Made Possible by
Students); and
WHEREAS, Chesterfield Towne Center hosts numerous community groups and
organizations throughout the year, including the Riverside School Walk for
Dyslexia, St. Jude's Walk, Chesterfield Fire and EMS MDA Boot Collection
campaign, Salvation Army, Bon Air Junior Women's League, American Red Cross
and Virginia Blood Donor Services; and
WHEREAS, Chesterfield Towne Center has partnered with Shop Chesterfield
First and Chesterfield County Public School PTAs for Denim Days, an annual
collection donated to Goodwill Industries; and
WHEREAS, Chesterfield Towne Center has provided over 5,000 square feet
of leasable shopping area for use as the Chesterfield County Community Room,
which has been utilized at no charge for meetings by non-profits; county
background checks for youth sports; blood drives; and other worthwhile
events.

RECOGNIZING RICHMOND ALARM COMPANY
AS THE 2012 FIRST CHOICE BUSINESS OF THE YEAR AWARD WINNER
WHEREAS, the Chesterfield County Board of Supervisors and Chesterfield
County Economic Development established a Business Awards Program to
recognize existing businesses within the county that contribute to the
county's economy and its citizens; and
WHEREAS, Richmond Alarm Company, which started its business in 1947, is
located on Justice Road in the county and employs 77 people; and
WHEREAS, the company sells, installs, services and monitors electronic
security systems in Central Virginia, and operates the largest security
monitoring center in Virginia, monitoring more than 25,000 security systems
in Virginia, Pennsylvania, Maryland, Delaware and West Virginia; and
WHEREAS, Richmond Alarm Company introduced a new Personal Emergency
Response System to the area last year, which provides a more targeted
response in medical or personal emergencies and allows the user to speak to
the monitoring center staff from a portable pendant, and this innovative
technology provides users the flexibility of leaving their home and still
being protected while in their yard or walking to the mailbox; and
WHEREAS, Richmond Alarm offers its facility for use to Chesterfield
County at no cost for training and meetings; and
WHEREAS, the principals of the business, Jimmy and Wayne Boggs, have
participated in the annual Southside MDA Lockup for the past three years; and
WHEREAS, the company sponsors a matching gift program for Families of
the Wounded Fund, and it also sponsored Chesterfield Fire and EMS in the 2011
Miller and Rhodes Charity Christmas Tree Contest, in addition to sponsoring
and supporting many events with the Chesterfield Chamber of Commerce and
loaning video security systems to local police departments; and
WHEREAS, Richmond Alarm Company values its employees and has a number of
long-time employees working for them, with 10 percent of the employees having
more than 20 years of service with the company; and
WHEREAS, Richmond Alarm has provided paid time-off for its employee J.
Wayne Shimko, who was recently awarded a Certificate of Appreciation by the
Virginia Department of State Police for his volunteer work in providing
technical advice and assistance.

1916; and
WHEREAS, the Boy Scouts of America was founded to build
character, provide citizenship training and promote physical fitness;

WHEREAS, after earning at least twenty-one merit badges in a wide
variety of skills including leadership, service and outdoor life,
serving in a leadership position in a troop, carrying out a service
project beneficial to his community, being active in the troop,
demonstrating Scout spirit, and living up to the Scout Oath and Law,
Mr. Jared Charles Martin, Mr. Duncan MacFarlane Monroe, Mr. Matthew

VOTE "YES" ON THE PROPERTY RIGHTS AMENDMENT
• n November 6, 2012 Virginians hold the security of their property rights in their
own hands. Vote "YES!" on the Property Rights Amendment to the Virginia
Constitution .
The Property Rights Amendment will protect your rights from overreach by state
and local governments-many of whom are now leading the opposition to its
passage. They have mounted an aggressive campaign -one that has been financed by your tax dollars -
to block its passage in November.
The Big Government interest lobbies have united behind an effort to mislead Virginians about
the financial consequences of the Amendment's passage. The questions and answers below dispel their
misinformation by explaining the shortcomings of the current laws and describing the benefits from
passage of the Property Rights Amendment.
While the hard work of passing the Amendment through the last two General Assembly
Sessions is over, the victory will not be won until we, the citizens of Virginia, ratify the Property Rights
Amendment this November. Please encourage your friends, family and neighbors to vote for this
important protection of their property interests. ,
Q. What are my property rights? Why aren't these enough?
A. Currently; Article I, Section 11 of the state Constitution provides that "just compensation" must be
paid when property is taken or damaged for public use. But the current Constitution leaves it to the
Virginia General Assembly to define "public use." Accordingly, government officials in Virginia have
been able to confiscate property for uses that are not truly public (such as economic development). And
when they do take land, they have been able to force property owners to accept less as compensation
than what they are losing.
Q. Why is the proposed Property Rights Amendment better?
A. It does three things to stop government overreaching when it takes land, and from underpaying
property owners. First, it clarifies that government can take private property only when the land will be
for'projects the public will actually use (such as transportation and schools -not private projects that
will only benefit developers) - it makes the words "public use" mean what they say. Second, it will end
the systematic shortchanging of Virginians who lose their business to a condemnation or see their
property's value severely diminished when their highway access is cut off. And third, it enshrines the
right of private property ownership as a fundamental right, recognizing that it has the same status in the
eyes of the law as the rights of freedom of speech or religion.
Q. Why is it important to recognize property rights as a fundamental right?
At Of all the power we give the Commonwealth to regulate our lives, the two greatest are the power to
ta14e an individual's freedom (and in extreme circumstances an individual's life) and to take an
individual's property. Neither should be taken without the greatest deliberation and care. In Virginia,
property rights are often treated as a secondary right. So, in the eyes of the law, property rights are not
as protected, or as respected, as other civil ri~~hts. The Amendment gives property owners much greater
standing in court when the government attempts to take their property.
Q. What is the history of the proposed Property Rights Amendment?
A. The U.S. Supreme Court, in its infamous 200 Kelo decision, ruled that the U.S. Constitution
allowed one person's property to be taken by the government and then sold or given to someone else
who promised to use it to generate more ,jobs and taxes. That ruling awakened Americans to the abuses
taking place in their communities and galvanized their into action. More than 40 states enacted anti-
Kelo reforms. !n 2007, Virginia banned the use of eminent domain for economic development and
enacted other protections. Virginia cities and counties fought hard to stop these reforms and have
lobbied hard to dilute them ever since.
Consequently, the 2007 reforms are only as strong as a majority of the next General Assembly
wants them to be. The only way to make these protections ironclad is to have the voters of Virginia
write them into the Constitution.
Q. What has to happen to pass the Amendment?
A. A constitutional amendment must be approved twice by the General Assembly then ratified in a
referendum by the voters. [n 20 ] 1, the General Assembly passed the Amendment for the first time by
wide, bipartisan majorities in both houses. The House of Delegates passed the Amendment 83-1 ~, and
the Senate passed the Amendment 3~-~. [f the Amendment passes in the 2012 General Assembly. it
will be placed on the statewide ballot next November (2012), where it is expected to pass with an
overwhelming majority. Passage of the referendum would put property rights protections out of reach
of the continuing efforts to water them down.
Q. Could Kelo happen in Virginia?
A. Yes. [t has and cases are currently pending in which it could occur again.
For example, in 2007 in Roanoke, the Roanoke Redevelopment and Housing Authority confiscated a
family-run office furniture and interior decoratin~~ business that Carilion Health System, the city's
biggest employer, wanted for the site of a medical office buildin~~. The RRHA obliged because the
medical building was supposed to generate more taxes and jobs than the office supply company and the
mayor was worried the hospital would leave the city. When the economy went sour, Carilion lost
interest and said it no longer wanted the property. The redevelopment authority went ahead with the
taking anyway, forcing an operating, taxpaying business to move and creating what remains a vacant
lot. This case became known as Virginia's Kelo and others similar to it are currently pending in
Norfolk. Passage of the Amendment will make it impossible for government to take someone's land
and give it to apolitically-favored third party.
Q. Don't property owners already get paid fair market value when their property is taken by
eminent domain?
A. No. In Virginia property owners are never actually made whole when their property is taken by the
Qovernment using the power of eminent domain, because they are forbidden from presenting evidence
as to certain losses and almost never reimbursed for their costs to pursue just compensation. The
Amendment gives meaning to the phrase '`just compensation." Here are examples of government
shortchanging of property owners:
ivorfolk, 200. The City of Norfolk threatened condemnation against The Lafayette Hotel in response
to pressure from leaders of the adjacent neighborhood who wanted it demolished for a park. When the
owner refused to permit the city's appraiser on his property, the city sent a police officer with him to do
his work, resulting in an appraisal and offer of $600.000. When the story broke in the newspaper. the
public outrage forced the city to back down. Two years later, the owner held a public auction for the
property and sold it for $2.2 million. Virginians won't have to rely on public outrage to get a fair shake
in getting just compensation if the Amendment passes.
Fairfax County, 2008. VDOT expanded l.eesbur~ Pike at T}sons Corner from six to eight lanes to
make room for the Metro subway line to Dulles Airport. One or'the losers vas Pike 7 Plaza. The ? 1-
store shopping center not only lost parking spaces. but more importantly, two of its four entrances onto
Leesburg Pike. The lengthy backups into and out of the shopping center's parking lot frustrated
customers and hurt business, making it a far less appealing and less valuable ccmmercial space. Experts
calculated the loss at $16 million..A Fairfax jud~7e ruled that because Pike 7 Plaza still had some
highway access, the law denied its owners the ri<~ht to ask a jury for money to makeup for the
diminished value caused by the traffic snarls.
So, the jury never heard about the $16 million loss the owners forecast and awarded them a payment
only for the land that was taken. $2.1 million. Because VDOT had already given the owners a partial
payment of $4.6 million pending the jury's award, the o~.vners are now responsible for paying back the
$2.~ million difference. Passage of the Amendment will cure injustices like this by allowing owners to
make their case to a jury for damages from lost access.
Q. Two of the most controversial aspects of the Amendment would allow owners to present
evidence to a jury if they have suffered damagesrn the form of "lost access" or "lost profits."
~Vhy are these provisions necessary?
A. Whenever VDOT builds a new road, it creates winners and losers among property owners along its
path, depending on whether it makes it easier -- or harder -- for cars to enter and exit. This can mean
life or death for a business. Presently if you lose access to your property as a result of the use of
eminent domain there is no guarantee that you will be allowed to present this evidence to the jur}'.
In the same way, a property owner whose business is taken by eminent domain is. under present
law, not permitted to present evidence to a jur} as to the lost profits he or she would have made had the
business not been seized. The Amendment permits a propem ow-ner to present evidence to a jur} as to
these lost profits, and allows a jury to award compensation for these lost profits that are proven by the
property.
Opponents of the Amendment have made baseless and inflated claims about the financial effect
from this, contending it would guarantee hefty new payouts of public funds. The only thing the
Amendment guarantees is that the property owners will be allowed to present evidence of damages to
the jury.
Q. Does the Amendment mean that propert3~ owners will automatically recei~~e additional
compensation for lost profits and lost access'.'
A. No. The Amendment simply allows property owners to present evidence to a jury as to the value of
their lost profits and lost access. if any, along with their other evidence as to the just compensation they
believe they are owed. The ultimate determination as to whether a properly owner should receive any
compensation for lost access or lost profits will remain with the jury. The law currently forbids
property owners from presenting this type of evidence.
Q. The Amendment states that "the condemnor bears the burden of proving that the use is
public, without a presumption that it is." What does this mean for property awners?
A. One of the most significant things the Amendment does is to correct an imbalance of power bete een
individuals and the government taking their property. Currently, if an o~~mer challenges a taking as not
being for a public use the owner must prove that the government has acted improperly, and the
govermnent's confiscation of property is al~~ays presumed to be for a public use. The Amendment
reverses this condition so that when a property owner challenges the legality of a taking, the
government must prove that it has exercised its power in accordance with the la~~.
Under present law, the judge must presume that the government is acting legally, no matter how
dubious the circumstances. The proposed constitutional amendment ~~ ill create a check and balance
because it will require public officials to prove to a judge that a taking is for a legitimate public use.
Constitutional amendment (second resolution); taking or damaging of private
property; public use. Revises the prohibition on the enactment by the General
Assembly of laws whereby private property may be taken or damaged. An existing
provision authorizing the General Assembly to define what constitutes a public use
is removed. The proposed amendment provides that private property can be taken or
damaged only for a public use, only with just compensation to the owner, and oni`~
so much taken as is necessary far the public use. Just compensation must equal or
exceed the value of the property taken, lost profits and lest access, and damages to
the residue caused by the taking. A public service company, public service
corporateon, or railroad exercises the power of eminent domain for public use when
such exercise is for the authorized provision of utility, common, carrier, or railroad
services. In all other cases, a taking or damaging of private property is not for
public use if the primary use is for private gain, private hen~fit, private enterprise,
increasing jobs, increasing tax revenue, or econorr~ic development, except for the
elimination of a public nuisance existing on the property. The condemnor bears the
burden of proving that the use is public, without a presumption that it is. The

Summary of Information:
The Police Department has completed a review of the County Ordinances
governing regulated occupations (massage clinics, nightclubs, adult
businesses, precious metal dealers, solicitors, taxicabs, and fortune
tellers) and is proposing several amendments as follows in order to comply
with state law, ease administrative burdens, and strengthen law enforcement
efforts:
1. Eliminate the permit requirement for massage therapists and clinics: As
this profession has matured, it is no longer necessary to regulate it at the

local level other than to require a business license. Massage therapists are
regulated by the state and are required to obtain certification from the
State Board of Nursing. Richmond and Henrico no longer require a local
permit and merely require a business license to be obtained.
2. Broaden the requirement for background checks: Current County
ordinances require applicants for regulated occupations to submit to a
criminal background check. The background checks are processed by the Police
Department through the State Police Central Criminal Records Exchange.
Currently, only the State database of criminal convictions is checked.
Section 15.2-1503.1 of the Code of Virginia authorizes the search of both
state and national criminal conviction databases, but the State Police will
not conduct a national criminal background check unless the applicable County
ordinances explicitly refer to § 15.2-1503.1 of the Code. Accordingly, the
proposed amendments all make explicit reference to authorizing state law so
that national checks can be conducted. The amendments also increase the fees
associated with background checks to cover the cost of the national
background check charged by the State Police. The Police Department also
recommends limiting the time period for which criminal convictions can be
considered to the ten (10) year period immediately preceding application for
the permit.
3. Amend regulations with respect to precious metal dealers as follows:
a. allow the chief of police to revoke a permit for any violation of
the ordinance regardless of whether there is a criminal conviction
for such violation as the ordinance previously required;
b. require the dealer to maintain and file records required by
ordinance with the police department in electronic format, similar
to how such records are currently kept and submitted by pawn
brokers;
c. extend the holding period before resale for precious metals or gems
from ten (10) days to fifteen (15) days as is now required by a
2012 legislative change;
d. require dealers to take photographs of each item purchased to aid
in law enforcement activities; and
e. extend the renewal period from six (6) months to one year to ease
the administrative burden of processing renewal applications.
Staff recommends approving the proposed amendments after holding a public
hearing.

Sec. 15-137. Records, copies of bills of sale required; right of entry of law-enforcement
officials.
(a) Every dealer shall maintain adequate records to reflect the information listed below
which shall appear on bills of sale. The form of the bill of sale shall be provided by the
chief of police. One copy of the bill of sale shall be retained by the dealer for not less
than 24 months, one copy shall be delivered during regular county work hours to the
chief of police at his office within 24 hours of the sale and one copy shall be delivered to
the seller of such precious metals or gems or borrower whose loan is secured by precious
metals or gems. If the purchase or loan occurs during a weekend then the delivery to the
chief of police shall be made no later than 10:00 a.m. of the next regular county work
day. Every dealer shall furnish the information required by this section in a manner
prescribed by the chief of police, which may include electronic format. The required
information is as follows:
(1) The name of the dealer and his employer or principal, if any.
(2) A complete description of each item, including weight, and all names, initials,
serial numbers or other identifying marks or monograms appearing on the
items and the price paid for each item.
(3) The date, time and place of receiving the items.
(4) The name, residence address and phone number, work address and telephone
number, age, sex, race, height, weight, hair and eye color, other identifying
marks, date of birth, driver's license number or Social Security Number and
signature of the seller or borrower.
(5) Verification of the identification of the seller or borrower, including the type
of identification exhibited, the issuing agency and the number thereon.
(6) A statement of ownership from the seller or borrower.
(b) In addition to the information required to be maintained in section (a), every dealer shall
also maintain within its records a photograph of each item received.
~ Every dealer shall admit to his premises during regular business hours the chief of police,
his sworn designee, or any law-enforcement official of the state or federal governments,
and shall permit the chief of police or other such law-enforcement official (i) to examine
all records required by this article and any item listed in a record which is believed by the
chief of police or official to be missing or stolen, and (ii) to search for and take into
possession any item known to him to be missing or known or believed by him to have
been stolen.

Sec. 15-139. Dealer to retain purchases.
(a) The dealer shall retain all precious metals or gems purchased or given as security for a
loan for a minimum of ten fifteen calendar days from the time of filing the bill of sale
with the chief of police. During such period of time the dealer shall not sell, alter or

dispose of any item containing precious metals or gems, in whole or in part, or remove
such items from the county.

Sec. 15-179. Certificate of public convenience and necessity.

(b) A certificate of public convenience and necessity shall be effective until January 31
following its issuance and must be renewed annually. The chief of police shall provide a
form for applications and renewals which includes authorization to conduct a background
check and certification by the applicant that the information contained in the application
is true and correct. Written authorization to conduct a background investigation will

DIVISION 3. DRIVER'S PERMIT
Sec. 15-186. Required.
No person shall drive a taxicab without first attending a basic taxicab driver orientation
program approved by the chief of police, and obtaining a driver's permit from the chief of police.
The chief of police may, however, issue a temporary or provisional permit for a period not to
exceed 90 days during which period such person shall attend the basic taxicab orientation. The
initial driver's permit shall last for 12 months and may be renewed thereafter annually provided
the driver attends follow-up taxicab orientation within 12 months preceding the date of renewal.
Each applicant for a driver's permit shall pay X9:99 $57.00 for the permit and each renewal. The
fee for replacement of lost, stolen or damaged permits shall be $10.00.
Sec. 15-187. Application.

of Chesterfield County, Virginia, at an
adjourned meeting on July 25, 2012, at 6:30
p.m. in the County Public Meeting Room at
the Chesterfield Administration Building,
Rt. 10 and Lori Road, Chesterfield, Virginia
will hold a public hearing where persons
may appear and present their views
concerning:
Repealing Article V of Chapter 15 of
County Code relating to massage clip
