Authorize an application to amend conditional use approval to allow other
jurisdictions to use the County's Public Safety Training Center located at
13900 Allied Road (Tax ID 829-644-2688), in an Agricultural (A) District,
appoint Captain David Stone, Police Department, and Chief Chris Basdikis,
Fire Department, as agents for the Board of Supervisors for the purpose of
this application and waive disclosure.
Summary of Information:
The Police and Fire Departments are requesting that the Board authorize an
application to amend conditional use approval to permit other public safety
agencies to use the police and fire training facilities at the County's
Public Safety Training Center. The Board of Supervisors originally approved a
conditional use in 1991 (Case 91SN0221) to permit a police/fire training
center. Among the conditions of approval is a stipulation that the use of
the driver training facility is restricted to the programs of Police, Fire,
rescue and Sheriff Departments of Chesterfield County, Henrico County and the
City of Richmond. In addition, the police firing range and fire training
facilities are restricted to use by County Police and Fire Departments only.
The Police and Fire Departments seek to allow any public safety agency from
an outside jurisdiction, with the approval of the managing department, to use
the police or fire training facilities.

The Board of Supervisors is requested to appoint Mr. Timothy M. Davey as the
county's citizen representative on the Richmond Regional Planning District
Commission through December 31, 2015 and Mr. William D. Dupler, Deputy County
Administrator for Community Development as the county's alternate member
through December 31, 2015.
Summary of Information:
The Richmond Regional Planning District Commission is composed of
representatives of the Counties of Charles City, Chesterfield, Goochland,
Hanover, Henrico, New Kent, Powhatan, the City of Richmond and the Town of
Ashland. RRPDC promotes regional cooperation, coordinates activities and
policies of member localities, provides planning assistance to localities and
resolves service delivery problems involving one or more member locality.
All five Board members serve on RRPDC. The citizen representative position
has been vacant since December 31, 2011. The county's alternate position has
historically been covered by the Deputy County Administrator for Community
Development. Board members concur with the appointment of Mr. Davey as the
county's citizen representative on RRPDC and Mr. Dupler as the county's
alternate member.

Summary of Information:
The purpose of the Youth Services Citizen Board is to advise the Board of
Supervisors regarding planning and policies affecting youth development and
to provide a community forum to focus on youth issues.
Matoaca District. Supervisor Elswick recommends that the Board nominate and
appoint Tatijana Zamora, student from Matoaca High School, Noel Pena student
from Manchester High School, and Daniel Houck, student from Cosby High
School, for a term of October 1, 2012 through June 30, 2013.
Ms. Zamora, Mr. Pena and Mr. Houck meet all eligibility requirements to fill
the vacancies and have indicated their willingness to serve.
Midlothian District. Supervisor Gecker recommends that the Board nominate and
appoint Ashley Faison and Guy Cheatham, students from James River High
School, to the Youth Services Citizen Board for a term from October 1, 2012

October 9 as "Fire Prevention Week", to educate the community in an effort to
prevent injuries and death. This year's theme is, "Have 2 Ways Out!"
The Fire and EMS Department has a number of open houses and education efforts
scheduled for this year's Fire Prevention Week to raise awareness in
Chesterfield County.

RECOGNIZING OCTOBER 7-13, 2012, AS "FIRE PREVENTION WEEK"
IN CHESTERFIELD COUNTY
WHEREAS, the County of Chesterfield is committed to ensuring the safety
and security of all those living in and visiting our county; and
WHEREAS, fire is a serious public safety concern both locally and
nationally, and homes are where people are at greatest risk of fire; and
WHEREAS, home fires killed more than 2,600 people in the United States
in 2010, according to the latest research from the nonprofit National Fire
Protection Association (NFPA), and fire departments in the United States
responded to more than 369,000 home fires; and
WHEREAS, only one-third of Americans have both developed and practiced a
home fire escape plan, and
WHEREAS, almost three-quarters of Americans do have an escape plan;
however, less than half have actually practiced it, and
WHEREAS, working smoke alarms cut the risk of dying in reported home
fires in half; and
WHEREAS, Chesterfield Fire and EMS personnel are dedicated to reducing
the occurrence of home fires and home fire injuries through prevention and
protection education; and
WHEREAS, Chesterfield County residents are responsive to public
education measures and are able to take personal steps to increase their
safety from fire, especially in their homes; and
WHEREAS, Chesterfield County residents who have planned and practiced a
home fire escape plan are more prepared and, therefore, will be more likely
to survive a fire; and
WHEREAS, the 2012 Fire Prevention Week theme, "Have 2 Ways Out!"
effectively serves to remind us to develop and practice a home fire escape
plans during Fire Prevention Week and year-round.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes October 7-13, 2012, as "Fire Prevention Week"
throughout the county, and urges all the people of Chesterfield County to
practice their home fire escape plan during Fire Prevention Week 2012, and to
support the many public safety activities and efforts of Chesterfield
County's Fire and Emergency Medical Services Department.

IN CHESTERFIELD COUNTY
WHEREAS, legal assistants and paralegals provide skilled and
essential professional services to licensed attorneys throughout
Virginia; and
WHEREAS, legal assistants and paralegals receive formal education
and training and gain valuable experience working under the supervision
of licensed attorneys; and
WHEREAS, the Virginia Alliance of Paralegals Associations (VAPA)
issues educational standards and professional guidelines to ensure that
legal assistants are competent and knowledgeable about their field; and
WHEREAS, the research and administrative work performed by legal
assistants and paralegals are essential to the ability of attorneys to
provide their clients with quality legal services and representation; and
WHEREAS, VAPA member organizations sponsor educational programs,
seminars and forums designed to bring legal assistants together to
exchange ideas and methods used in their occupation; and
WHEREAS, the VAPA encourages legal assistants and paralegals to
adhere to a high degree of ethical and professional conduct and
proficiency by issuing a code of ethics for legal assistants and
paralegals to practice.

abuse.
SAFE, Chesterfield County's substance abuse prevention coalition, is
partnering with Youth Planning and Development, the Police Department and
other community leaders to sponsor several local events during that week,
including an educational forum for medical practitioners and two medication
take-back events.
The Board of Supervisors is requested to adopt the resolution to help bring
visibility to the importance of medicine abuse prevention and to highlight
the Chesterfield community's efforts to prevent and reduce it.

RESOLUTION RECOGNIZING SEPTEMBER 22-29 AS
"WAKE UP TO MEDICATION ABUSE" WEEK
IN CHESTERFIELD COUNTY
WHEREAS, the Centers for Disease Control and Prevention have called
prescription drug abuse a national epidemic among adults and young people;
and
WHEREAS, nationally, the number of drug deaths now exceed the number of
motor vehicle deaths; and
WHEREAS, every day more than 2000 youths in the United States use a
prescription drug to get high for the first time; and
WHEREAS, unintentional drug poisoning is the most frequent cause of
injury hospitalization in youths 15-19 in Virginia; and
WHEREAS, data from the 2012 Chesterfield Community Youth Survey of
youths in grades 8, 10 and 12 shows that the percentage of Chesterfield teens
abusing medications is above national averages in all categories, including
stimulants (such as Adderall, Ritalin); narcotics (such as Oxycontin,
Vicodin); sedatives (barbiturates, sleeping pills); tranquilizers (such as
Valium, Xanax); and over-the-counter medications (such as cough syrup); and
WHEREAS, SAFE, Chesterfield's substance abuse prevention coalition, is
partnering with Youth Planning and Development and a broad cross section of
community sectors, including healthcare professionals, law enforcement, local
and state agencies, educators, pharmaceutics, prevention and treatment
providers, parents, the recovery community and others to develop and
implement local initiatives to address the problem; and
WHEREAS, The Partnership at Drugfree.org, a national organization that
helps parents prevent, intervene and find treatment for drug and alcohol use
by their children, is sponsoring a national "Wake Up to Medication Abuse"
week September 22-29 to raise awareness of medication abuse; and
WHEREAS, SAFE currently incorporates the strategies of this initiative
in its work, which are to:
Educate about the dangers of abusing prescription and over-the-counter
medicines
Monitor prescriptions and over-the-counter medicines
Safeguard and properly dispose of unused medication
Eliminate improper prescribing and dispensing practices; and
WHEREAS, SAFE is sponsoring an Educational Forum on Prescription Drug
Abuse for physicians, physician assistants, nurse practitioners, pharmacists,
and dentists on September 22 at John Tyler Community College; and
WHEREAS, the Chesterfield Police Department, in partnership with SAFE
and Youth Planning and Development, is providing a medication take-back event
on September 22 at Chesterfield Towne Center and on September 29 at the
Eanes-Pittman Public Safety Training Center; and ~p~ ,r-.

WHEREAS, SAFE will be working with the media to call attention to the
issue of medication abuse during the week of September 22-29.

Summary of Information:
Chesterfield County will join states and localities across the nation in
recognizing September 24 as "Family Day - A Day to Eat Dinner With Your
Children." Family Day was established by the Center for Addiction and
Substance Abuse at Columbia University. It focuses attention on research
findings that show children in families that frequently eat dinner
together are much less likely to use tobacco, alcohol or other drugs.
Communities across the country are encouraged to recognize Family Day.
Youth Planning and Development and SAFE Inc. are promoting awareness of
Family Day in Chesterfield County.

RECOGNIZING SEPTEMBER 24, 2012, AS
"FAMILY DAY - A DAY TO EAT DINNER WITH YOUR CHILDREN"
WHEREAS, the observance of "Family Day - A Day to Eat Dinner with
Your Children" provides a unique opportunity for families in Chesterfield
County to join one another at the dinner table as a means of strengthening
family relationships; and
WHEREAS, parental influence is known to be one of the most crucial
factors in determining the likelihood of substance abuse by teenagers; and
WHEREAS, surveys conducted by the National Center on Addiction and
Substance Abuse have consistently found that children and teenagers who
routinely eat dinner with their families are far less likely to use
cigarettes, alcohol and illegal drugs; and
WHEREAS, meal times offer opportunities for families to spend time
together, providing a basic structure that strengthens and encourages
lasting relationships; and
WHEREAS, young people from families who have infrequent family
dinners compared to those that have frequent family dinners are two and a
half times more likely to have used tobacco and marijuana and one and a
half times more likely to have consumed alcohol; and
WHEREAS, the correlation between family dinners and reduced risk for
teen substance abuse is well documented; and
WHEREAS, Chesterfield County Youth Planning and Development and SAFE
Inc., Chesterfield's substance abuse prevention coalition, are promoting
the importance of family dinners to parents in Chesterfield County,
Virginia; and
WHEREAS, the Chesterfield County Board of Supervisors recognizes that
eating dinner as a family is an important step toward raising drug-free
children.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes Monday, September 24, 2012, as "Family Day - A Day
to Eat Dinner With Your Children," to recognize the positive impact of
strong family interaction on the well being and future success of the

RECOGNIZING MS. BELINDA S. DELPH UPON HER RETIREMENT
WHEREAS, Ms. Belinda S. Delph began her tenure in public
service with the Giles County Welfare Department in 1974 and
continued her service at the Roanoke County Department of Social
Services and the Henrico County Department of Social Services
serving as both an Eligibility Worker and a Social Worker; and
WHEREAS, Ms. Delph began her service with the Chesterfield-
Colonial Heights Department of Social Services on September 24,
1984, as an Eligibility Worker and subsequently was promoted on
November 13, 1995, to Social Worker serving child care recipients;
and
WHEREAS, in her role as Child Care Social Worker, Ms. Delph
gained exceptional command of child care policy and was
instrumental in instructing new workers on the team regarding the
policy, and she frequently served as a resource to other team
members regarding the policy; and
WHEREAS, during her tenure at Chesterfield/Colonial Heights,
Ms. Delph served on several agency committees, including Local
Automation, Child Care Payment Issues, Communication, and
Eligibility Intake, all focused on the improvement of internal
processes; and
WHEREAS, she served the citizens of our area while staffing
emergency shelters during Hurricanes Isabel and Irene; and
WHEREAS, Ms. Delph has demonstrated team work as she supported
the mission of the agency and Chesterfield County.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County
Board of Supervisors recognizes the outstanding contributions of
Ms. Belinda S. Delph, expresses the appreciation of all residents
for her service to the county, and offers congratulations upon her
retirement.

WHEREAS, Mr. Glenn A. Birdsong retired from the Chesterfield County
Utilities Department on July 1, 2012; and
WHEREAS, Mr. Birdsong began his public service with Chesterfield County
on May 1, 1978, when he was hired by the Chesterfield County Utilities
Department as a Plant Operator Trainee; and
WHEREAS, Mr. Birdsong was promoted to Chief Plant Operator in 1989,
where he served faithfully until his retirement; and
WHEREAS, Mr. Birdsong directed the day-to-day operations and maintenance
activities of the Falling Creek Wastewater Treatment Plant, which currently
has a treatment capacity of 10.1 million gallons per day, an operating budget
of $3.6 million, sludge handling and disposal programs; and
WHEREAS, Mr. Birdsong also was responsible for the Falling Creek
Wastewater Pumping Station and provided technical direction to a staff of 15
employees including three direct reports; and
WHEREAS, from 1978 to 2012, Mr. Birdsong brought the Chesterfield County
Utilities Department into the new millennium as a responsible protector of
the environment by providing wastewater treatment that is safe, reliable and
environmentally sound; and
WHEREAS, Mr. Birdsong supported training programs that resulted in
operator certification and an Environmental Management System that was
awarded the Exemplary Environmental Enterprise, or E3, designation by the
Department of Environmental Quality in December 2008; and
WHEREAS, Mr. Birdsong acted as an exemplary steward of the public trust
by optimizing plant operations in the most cost-effective manner; and
WHEREAS, Mr. Birdsong strived to ensure the Chesterfield County
Department of Utilities was an employer of choice by selecting and
maintaining a diverse, high-performing workforce though his seasoned
leadership skills; and
WHEREAS, Mr. Birdsong continuously utilized his knowledge of the Falling
Creek Wastewater Treatment Plant operations and equipment to ensure effluent
quality that met state discharge permit requirements; and
WHEREAS, Mr. Birdsong was an active member of the project team for the
design and construction of the $29 million biological nutrient removal
project at the Falling Creek Wastewater Treatment Plant, and through his
seasoned leadership and communication skills, effectively conveyed the
operational needs of the facility ensuring regulatory compliance during the
three-year construction period and well into the future; and
WHEREAS, Mr. Birdsong was highly respected and liked by his peers and
co-workers; and
WHEREAS, Mr. Birdsong willingly and faithfully worked after hours and
during emergencies to ensure continued permit compliance of the Falling Creek
Wastewater Treatment Plant; and
WHEREAS, Mr. Birdsong's efforts were recognized by the wastewater
industry throughout his career through numerous awards and recognitions
including Virginia Water Environment Association's Safety Award, Association
of Metropolitan Sewer Agencies' Gold and Silver Awards, National Association
of Clean Water Agencies' Gold Award, and the Department of Environmental
Quality's E3 Award; and

WHEREAS, Mr. Andrew S. Ross retired from the Chesterfield County

WHEREAS, Mr. Ross began his public service with Chesterfield County

program through internal meetings and numerous training workshops at the
Virginia Tech COTA Center in Roanoke, Virginia; and

Wastewater Treatment Plant was accepted by the Department of Environmental
Quality as an Environmental Enterprise participant in the Virginia
Environmental Excellence Program in March 2008 and then as an Exemplary
Environmental Enterprise, or E3, participant in December 2008; and
WHEREAS, Mr. Ross served as a responsible protector of the

RECOGNIZING MR. JOHN E. WATERS UPON HIS RETIREMENT
WHEREAS, Mr. John E. Waters will retire from the Chesterfield County
Utilities Department on September 1, 2012; and
WHEREAS, in 1981, Mr. Waters began his public service with the
Chesterfield County Utilities Department working as a Principal Plant Operator
at Falling Creek Wastewater Treatment Plant until 1989; and
WHEREAS, in 1985, Mr. Waters enhanced his skills by obtaining his Class 1
Wastewater Operator license; and
WHEREAS, in 1996, Mr. Waters returned to the Utilities Department,
serving as Engineering Assistant and finally Senior Engineering Assistant for
the Industrial Wastewater Pretreatment Program until his retirement; and
WHEREAS, throughout his employment with the county, Mr. Waters provided
hands-on training to many of his co-workers in the industrial wastewater
field; and
WHEREAS, Mr. Waters spent countless hours investigating incidents such as
illicit discharges and sanitary sewer blockages; and
WHEREAS, on numerous occasions, Mr. Waters made exceptional contributions
to the Pretreatment Program by providing solutions and improvements to
industrial customers on matters related to their pretreatment processes; and
WHEREAS, Mr. Waters was recognized by his peers for his teamwork and
professional contributions to the construction and operations of the pilot
plant that was used for valuable research in pretreatment applications; and
WHEREAS, Mr. Waters focused on and provided world-class customer service,
consistently meeting or exceeding expectations by assuring that all customers'
needs and expectations were met in an expeditious, courteous and effective
manner; and
WHEREAS, Mr. waters was highly respected and liked by his peers and co-
workers and he established excellent working relationships with both internal
and external customers; and
WHEREAS, Mr. Waters' jovial personality and great sense of humor enabled
him to create a stress-free work environment; and
WHEREAS, throughout his career with Chesterfield County, Mr. Waters
displayed unparalleled dependability, aptitude, good character and values.

Summary of Information:
Mr. Joe Evans, a Chesterfield County resident, is an alto saxophone jazz
musician who began his career in 1939 and played in many famous jazz bands
over a period of three decades, while also forming two recording companies,
attaining a graduate degree and writing an autobiography about his
experiences in the music industry.
Mr. Holland will be presenting the resolution to Mr. Evans on September 27tH
at an event in his honor.

RECOGNIZING MR. JOE EVANS ON THE OCCASION OF
HIS NINETY-SIXTH BIRTHDAY
WHEREAS, jazz is a music genre enjoyed by millions of fans around the
world; and
WHEREAS, Chesterfield County, Virginia, proudly claims one of the all-
time great jazz saxophonists, Joe Evans, as a resident; and
WHEREAS, Mr. Evans was born in the small town of Bonify, Florida, on
October 7, 1916, and was raised in nearby Pensacola; and
WHEREAS, as a young man, he took saxophone lessons, and became an
accomplished alto saxophone player; and
WHEREAS, in 1939, when he was 23, Mr. Evans left for New York City to
play in the Erskine Hawkins Band, and later that same year, in the Cam
Williams Band; and
WHEREAS, in demand for his musical talent, Mr. Evans advanced his career
by changing bands frequently, building his musical resume' and experience;
and
WHEREAS, over the years, he played with many jazz greats, including Sil
Austin, Paul Williams, Lionel Hampton and Louis Armstrong; as well as Billie
Holiday, .Bill "Bojangles" Robinson, Johnny Hodges, Nat "King" Cole, Cab
Calloway and Charlie Parker, and others; and
WHEREAS, Mr. Evans recalls that, as a young man, he enjoyed watching
boxing greats Jack Johnson and Joe Lewis; and
WHEREAS, during the challenging years of World War II, he admired
President Franklin Delano Roosevelt's oratorical style and inspiring Fireside
Chats; and
WHEREAS, Mr. Evans formed his own independent record business, Cee Jay
Records, with trombonist Jack Rags, and years later, Carnival Records, which
he established while running his own publishing company; and
WHEREAS, Carnival Records produced 63 singles, as well as two albums by
The Manhattans; and
WHEREAS, never satisfied unless he was advancing, the multi-talented Mr.
Evans earned a Master's Degree in Social Services in his senior years; and
WHEREAS, Mr. Evans had his autobiography, titled, Follow Your Heart:
Moving with the Giants of Jazz, Swing, and Rhythm and Blues, co-authored by
Virginia Commonwealth University Professor Christopher Brooks, published in
2008.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, on behalf of all Chesterfield County residents, hereby extends
best wishes and hearty congratulations to Mr. Joe Evans on the occasion of

At its February 8, 2012 meeting, the Board of Supervisors directed the
Planning Commission to return a new draft comprehensive plan to the Board.
The Commission, working with county staff, met numerous times in the spring
and summer of 2012 to assemble and review a new draft comprehensive plan. In
addition, six community meetings concerning the new draft plan were held in
August, 2012. A copy of the August, 2012 draft Comprehensive Plan for
Chesterfield County is attached.
Following a public hearing on September 10, 2012, the Planning Commission, on
September 18, 2012, unanimously recommended approval on a motion of Mr.
Gulley, seconded jointly by Drs. Brown and Wallin.

The Board is requested to set October 10, 2012, as a public hearing date to
consider the restriction of through truck traffic on Westfield Road from
Winterfield Road to Sycamore Square Drive.
Summary of Information:
The county has received a request from residents to restrict any through
truck or truck and trailer or semi-trailer combination, except pickup or
panel trucks, from using Westfield Road (Route 1002) from Winterfield Road
(Route 714) to Sycamore Square Drive (Route 1098). The recommended alternate
route is Winterfield Road (Route 714), Midlothian Turnpike (Route 60) and
Sycamore Square Drive (Route 1098).
The Virginia Department of Transportation (VDOT) has four criteria it
considers when a restriction is requested. A requested restriction must meet
the first two criteria, in that: 1) a reasonable alternate route is provided;
and 2) the character or frequency of truck traffic on the route proposed for
restriction is not compatible with the affected area.
Evaluation of the second criterion will include safety issues, accident
history, engineering of the roadway, vehicle composition, and other traffic
engineering related issues.

exceptions to ordinance requirements for offsite directional signs and
sign setbacks, in Agricultural (A), Neighborhood Business (C-2) and
Community Business (C-3) Districts, appoint Kirk Turner as agent for the
Board of Supervisors for the purpose of this application, and waive
disclosure.
Summary of Information:
The County is seeking to improve directional Signage for destinations in
the vicinity of the county government center complex. This project
includes a variety of small (i.e. a maximum of seven feet in height)
offsite directional signs. Some of these proposed signs would be located
in the public right-of-way; all would be located behind the face of curb/
edge of pavement. Due to a previous zoning approval and zoning regulations
pertaining to offsite directional signs and sign setbacks, the proposed
signs would require an amendment to conditional use case 77SN0036 and
exceptions to ordinance requirements.

Award of Construction Contract for County Project #09-0022, Ecoff Avenue
Waterline Improvements

The Board of Supervisors is requested to award the construction contract to
Southern Construction Utilities, Inc. in the amount of $233,777, authorize a
transfer of $90,000 from the water fund balance to the Ecoff Avenue Waterline
Improvements Project and authorize the County Administrator to execute the
necessary documents.
Summary of Information:
This project consists of the construction of approximately 198 linear feet of
8-inch and 1,635 linear feet of 12-inch ductile iron watermains and
associated appurtenances.
Staff received a total of eight (8) bids. The bids ranged from $233,777 to
$387,487. The lowest bid was from Southern Construction Utilities, Inc. in
the amount of $233,777. The County's Engineering Consultant, Austin
Brockenbrough & Associates, has evaluated the bids and recommends award of
the contract to Southern Construction Utilities, Inc., the lowest responsive
bidder.
Staff requests that $90,000 be transferred from the water balance fund to
this project. Funds for this project are available in the current CIP.

to Dickerson Construction LLC in the amount of $350,315 and authorize the
County Administrator to execute the necessary documents.
Summary of Information:
This project consists of the construction of approximately 1,650 linear
feet of 8-inch and 300 linear feet of 10-inch sanitary sewer mains and
associated appurtenances.
Staff received a total of six (6) bids. The bids ranged from $350,315 to
$622,096.50. The lowest bid was from Dickerson Construction LLC, in the
amount of $350,315. The county's Engineering Consultant, Austin
Brockenbrough & Associates, has evaluated the bids and recommends award of
the contract to Dickerson Construction LLC, the lowest responsive bidder.
Funds for this project are available in the current CIP.

Summary of Information:
A requirement for the grant for the purchase of Historic Point of Rocks is
the conveyance of a perpetual easement for the protection of the
historical values of the property. Staff recommends that the Board of
Supervisors authorize the Chairman of the Board of Supervisors and County
Administrator to execute an open-space easement with Virginia Department
of Historic Resources for the preservation of the property.

Approval of a 45 Mile Per Hour Speed Limit on Magnolia Green Parkway and

Board Action Requested:
The Board is requested to approve a 45 mile per hour speed limit on Magnolia
Green Parkway and Championship Crossing.
Summary of Information:
The section of Magnolia Green Parkway between Hull Street Road and
Championship Crossing, and the section of Championship Crossing between
Magnolia Green Parkway and Hosta Lane are expected to become State maintained
roads in the near future. Residents have requested Mr. Elswick to have speed
limits established during the time the roads transition from County roads to
VDOT maintained roads.
Sections 46.2-878 and 46.2-1300 of the Code of Virginia enable the Board of
Supervisors to establish speed limits on roads within the County that are not
State maintained.
Engineering and traffic studies have been completed for both Magnolia Green
Parkway and Championship Crossing. The studies indicate that the appropriate
speed limit for both roads is 45 miles per hour.

Recommendation:
Staff recommends that the Board adopt the attached resolution establishing 45
mile per hour speed limits on both Magnolia Green Parkway and Championship
Crossing. Staff should be authorized to have the appropriate speed limit
signs installed.

WHEREAS, the section of Magnolia Green Parkway between Hull Street
Road and Championship Crossing, and the section of Championship Crossing
between Magnolia Green Parkway and Hosta Lane are not State maintained
roads; and
WHEREAS, Sections 46.2-878 and 46.2-1300 of the Code of Virginia
enable the Board of Supervisors to establish speed limits on roads within
the County that are not State maintained; and
WHEREAS, a traffic engineering investigation has been completed for
these sections of Magnolia Green Parkway and Championship Crossing.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors hereby establishes a 45 mile per hour speed limit on Magnolia
Green Parkway between Hull Street Road and Championship Crossing and a 45
mile per hour speed limit on the section of Championship Crossing between
Magnolia Green Parkway and Hosta Lane, and that such speed limits shall
be effective when 45 mile per hour speed limit signs are installed.

B. Road characteristics shoulder condition grade, alignment and sight distance:
Championship Crossing is a new, two-lane roadway with 12-foot through lanes and
separate left and right turn lanes at all intersections. The paved shoulder width is
approximately 4 feet, with additional unpaved shoulders available. The pavement is in
excellent condition. The grade is gently rolling and the alignment is good. Vertical sight
distance was found to be acceptable throughout the entire study area. All curves are

be comfortably traversed at the recommended speed limit. No locations are present that
warrant additional traffic control or warning signs. The traffic data indicated that the ADT

C. Roadside development and environment -roadside friction:
This section of Championship Crossing consists of wooded areas and entrances to several
neighborhoods of from 30 to 50 homes. All neighborhood entrances have separate left and
right turn lanes.
Roadside friction considers the frequency of entrances along the roadway and the
impact of these on traffic operations. No significant level of roadside friction was noted in
this study.
D. Parking practices and pedestrian activity:
There is no on-street parking. Sidewalks and pedestrian paths are provided along most
of Championship Crossing, on both sides of the roadway. No pedestrian activity was
observed during the study. No accidents related to pedestrian activity were reported.
E. Reported crash experience for three-year period:

Access Improvement Project

The Board of Supervisors is requested to appropriate $500,000 in anticipated
VDOT reimbursements; authorize the County Administrator to proceed with the
Route 60 Mall Access Improvement Project and to enter into all appropriate
agreements and contracts; and award a construction contract to the lowest
responsible bidder in an amount not to exceed $350,000.
Summary of Information:
In 2012, the county obtained $500,000 in Federal Congestion Mitigation Air
Quality (CMAQ) funding to construct dual left turn lanes along Route 60
eastbound at the main entrance to Chesterfield Town Center and/or Mall Drive.
Staff recommends the county handle the administration of the project. A
VDOT/County design/right-of-way/construction agreement, similar to those the
county has executed in the past, will be necessary. Under the terms of the
agreement, the county will perform the various activities and be reimbursed
by VDOT for the $500,000.

Summary of Information: (Continued)
All the work is anticipated to be within existing right-of-way. A judgment
will be made after preliminary plans have been developed this fall whether to
move forward with improvements at one or both locations. Management at the
Town Center has indicated a preference for the dual left turn lanes at the
main mall entrance; however, sufficient CMAQ funding may not be available to
construct turn lanes at both locations.
It is requested that the County Administrator be authorized to proceed with
the customary project activities including the award of a contract up to
$350,000 to the lowest responsive and responsible bidder.
Recommendation:
Staff recommends the Board take the following actions for the Route 60 Mall
Access Improvement Project:
1. Authorize the County Administrator to enter into the customary
VDOT/County agreements/contracts, permits/mitigation agreements and
surety agreements, acceptable to the County Attorney;
2. Appropriate $500,000 in anticipated VDOT reimbursements;
3. Authorize the County Administrator to proceed with the design and right-
of-way acquisition, including advertisement of an eminent domain public
hearing if necessary;
4. Authorize the Chairman of the Board of Supervisors and County
Administrator to execute easement agreements for relocation of
utilities;
5. Authorize the County Administrator to proceed with the advertisement of
a construction contract for the project; and
6. Authorize award of a construction contract, up to $350,000, to the
lowest responsive and responsible bidder.

Summary of Information:
On August 22, 2012, the Board authorized award of a construction contract, up
to $166,000, for the Harrowgate Road Sidewalk project. The Board was advised
that the project estimate for the base bid was within budget but estimates
for the work including the alternate exceeded current funding. The extent of
the alternate work is depicted on the attachment.
Bids were received for the Harrowgate Road Sidewalk project on August 21,
2012. Virginia Concrete Construction Company submitted the low base and
alternate bids for the project: $147,224 and $48,000 respectively. Both
bids are lower than the engineer's estimate; however, current funding will
only allow construction of the base. An additional $30,000 is needed to
allow construction of both the base and the alternate.

$102,020.14 in change orders through said Change Order Number Four (4).
Summary of Information:
The Board awarded a construction contract to J.W. Epochs, Incorporated for
Maintenance and Repairs of the 1917 Courthouse at its November 30, 2011
meeting, in the amount of $711,500. In order to assure that budgeted funding
would be adequate to cover the critical repairs, the scope of work bid was
limited to the structural repairs of the courtroom and front portion of the
courthouse, along with new restrooms and a ramp for handicap accessibility.
The bid scope also included new air distribution ductwork and replacement of
deteriorated window lintels in the front, two story portion of the building.
At that time, interior repairs to the one-story portion of the building
including the jury room and the judge's chambers were deferred until the

extensive structural repairs were fully addressed. As the project has
proceeded, a number of unforeseen conditions have arisen with the repair of
this historic building, which have been actively managed during the course of
the project. The project contingency has been determined to be adequate to
cover the costs of the additional required work as well as the various
interior repairs to the one story portion of the building. The contractor is
best positioned to perform this additional work, which is included in Change
Order Number Four (4).
For projects over $500,000, county policy requires that when cumulative
change orders exceed 100 of the original contract amount, the Board of
Supervisors must approve. Previous change orders in the amount of $62,941.50
and this Change Order Number Four (4) include additional required electrical,
mechanical and structural repairs to items such as floor joists and
sheathing, trusses, steam and air conditioning lines, framing, ceilings,
electrical wiring and conduit, and interior repairs to the one-story portion
of the building.
Staff requests approval of Change order number four (4) in the amount of
$39,078.64, and requests approval of an increase in the County
Administrator's change order signature authority by an additional $25,000
above the current cumulative value of $102,020.14. This approval will help
ensure the project will not be delayed by unanticipated or unknown changes
required during the final stages of the project, expected to be complete by
end of the year. Sufficient funding is available in the project for this
change order.

Dear Supervisor Gecker & members of the Board:
Thank you for your recent phone call regarding our concerns over the practices we
have experienced from the 2010/2011 theft of our own gold and silver possessions,
which were "fenced" through The Gold Exchange located at 7113 Hull Street Road in
Chesterfield County.
We have read carefully the recent changes to the County Code made by the
Chesterfield Board of Supervisors this summer. We regret we were unaware and
missed the opportunity to speak to the matter at that time. Please let us share some
thoughts for your consideration. We believe there is another area here that cries
out for the attention of your Board. This pertains to the dealers' practice of
immediately melting down the gold and silver objects purchased from any unknown
walk-in seller in possession. Once the item(s) are melted down the evidence of a
possible theft has been irrevocably destroyed. We strongly suggest that the Board
revisit this matter and do our police a favor: require a minimum holding period
before the goods can be either resold or melted down. A mandatory holding period
of 30 des by the dealer is not unreasonable Consider the low "dealer" prices paid
and the current world prices for the raw metals Surely the Board has the authority
to govern this matter while the goods are in the hands of your licensed dealers.
Had such a holding period been in effect in our case, we would have likely been able
to recoup at least a part of our property from a desperate girl in need of money. As
it has turned out, we all lost out to this dealer. What is wrong with this picture?
We have enclosed photocopies of 3 different receipts from THE GOLD EXCHANGE
for items stolen from us by our cleaning lady. Note the dealer purchase prices and
the number of pieces in each instance. Obviously the prices she received were
distress prices, only acceptable to a desperate person. Our cleaning lady confessed
to us that she first had second thoughts about what she had done, and returned the
next day to return the money and reclaim our goods. She was told our silverware
had been melted down the same day she gave it up to the dealer. What does that
suggest?
We have attached three (3) receipts from The Gold Exchange Inc., given to Rita
Marlene Deal (sic) for sales of our silver and gold jewelry she took from our home.
Please note the low prices paid for silverware whose replacement cost is many
times that amount. And this was all melted down the same day, so all the hard proof
was gone that day.
We ask that you use your authority to require at least a 30 day holding period for
precious metal goods taken in by a licensed dealer, to give the victims and the
Chesterfield police an opportunity to retrieve the goods and deny these vultures
their ill gotten gains.

context requires a different meaning:
"Dealer in firearms" means (i) any person, firm, partnership, or corporation
.engaged in the business of selling, trading or transferring firearms at whole-
sale or retail; (ii) any person, firm, partnership, or corporation engaged in the
business of making or fitting special barrels, stocks, or trigger mechanisms to
firearms; or (iii) any person, firm, partnership, or corporation that is a
pawnbroker.
"Engaged in business" means as applied to a dealer in firearms a person,
firm, partnership, or corporation that devotes time, attention, and labor to
dealing in firearms as a regular course of trade or business with the principal
objective of livelihood and profit through repetitive purchase or resale of
firearms, but such term shall not involve a person who makes occasional sales,
exchanges, or purchases of firearms for the enhancement of a personal
collection or for a hobby, or who sells all or part of his personal collection of
firearms.
"Firearms show" means any gathering or exhibition, open to the public, not
occurring on the permanent premises of a dealer in firearms, conducted
principally for the purposes of exchanging, selling or trading firearms as
defined in § 18.2-308.2:2. (1989, c. 490; 1993, c. 477.)

County Administrator Mr. James J. L Stegmaier, my name is L. 1. McCoy, Jr., president of the Chesterfield NAACP.
The phrase "Just Say No" first emerged when First Lady Nancy Reagan was visiting Longfellow Elementary School in
Oakland, California, in 1982. Then in April 2008, First Lady Laura Bush and Secretary of Education Margaret Spellings
participated as guest teachers at Martin Luther King Elementary School in Washington, DC.
But on Wednesday September 13, 2012, the Chesterfield School System denied First Lady Michelle Obama the
opportunity to thank the children at Spring Run Elementary Schoo! for their participation in the White House organic
garden. The county sited this as political.
There is no denying a presidential campaign is being contested between President Obama and former Governor Mitt
Romney. And, there is no doubt that there are individuals in Chesterfield who would prefer a change of the present
administration. And there is definitely a need for more positive relations between all God's children here in Chesterfield.
But a First Lady's visit to our children's place of learning is an opportunity of growth. When First lady Nancy Reagan
visited that Oakland, California elementary school, a school girl asked Mrs. Reagan, What she should do if she was offered
drugs?" The First Lady responded by saying, "Just say no." First Lady Laura Bush, a former librarian and teacher, visited
classrooms in New York, NY, Newark, NJ, Atlanta, GA, Baltimore, MD, and San Francisco, CA.
But, when history is written and First Lady Michelle Obama's visits are recorded, the County of Chesterfield will be a "No-
Show", Missing In Action, Absent Without Leave. This is not the picture Chesterfield should have portrayed to the world nor
to history. Sadly, this is a missed opportunity.

Relating to Possessing Firearms Near County Schools and Parks

Public hearing to consider amending Section 14-11(b) of the County Code to
clarify its application to hunters.
Summary of Information:
County Code § 14-11 (b) prohibits all persons from possessing a loaded firearm
within 100 yards of the property line of a County public school or park.
However, the state enabling legislation applicable to this County Code
provision only applies to hunters; it does not have general application to
all persons. Discharging firearms within 100 yards of these properties and
carrying firearms on school property are already prohibited elsewhere in the
County Code and by state law.
It is necessary to change the language of Section 14-11(b) from "no person"
to "no hunter" to ensure that the County Code is consistent with state law.
This change has been reviewed by the Commonwealth Attorney's Office and the
Police Department; both support the amendment.
Staff recommends that the Board adopt the ordinance amendment after holding a
public hearing.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTION 14-11 RELATING TO POSSESSING
LOADED FIREARMS NEAR PUBLIC SCHOOLS OR PARKS AND
PROVIDING FOR A PENALTY
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 14-I1 of the Code of the County of Chester geld, 1997, as amended,
is amended and re-enacted to read as follows:
Sec. 14-11. -Same-Hunting or carrying a loaded firearm near public schools or
parks.
(a) No person shall shoot, hunt or attempt to hunt with a firearm within 100
yards of any property line of any county public school or county park.
(b) No ~sen hunter shall transport, possess or carry a loaded firearm within
100 yards of any property line of any county public school or county park,
except as otherwise permitted by state law.
(c) This section shall not apply to lands within a national or state park, state
forest or wildlife management area.
(d) The provisions of this section shall not apply to the discharge of a firearm
for the killing of deer pursuant to Code of Virginia, § 29.1-529. This
exemption shall apply on land of at least five acres that is zoned for
agricultural use.
(e) Any person violating the provisions of this section shall be guilty of a
class 4 misdemeanor.
(2) That this ordinance shall become effective immediately upon adoption.

of Chesterfield County, Virginia, at
an adjourned meeting on Wednesday,
September 19, 2012, at 6:30 p.m. in the
County Public Meeting Room at the
Chesterfield Administration Building,
Route 10 and Lori Road, Chesterfield,
Virginia, will hold a public hearing where
persons may appeaz and present their
views concerning:
An Ordinance to amend the Code of the
County of Chesterfield, 1997, as amended,
by amending and re-enacting Section 14-
11 related to hunters possessing loaded
fireazms near public schools or pazks and
providing for a penalty.
The proposed ordinance amendment is
available for examination by the public in
the County Administrator's Office and the
Clerk to the Board's Office (Room 504)
at the Lane B. Ramsey Administration
Building, 9901 Lori Road, Chesterfield
Virginia. If further information is desired,
please contact the County Attorney's Office
at 748-1491, between the hours of 8:30 a.m.
to 5:00 p.m., Monday through Friday. -'

designed to be accessible to persons with

Summary of Information:
The Virginia Department of Transportation is requiring that the county
convey right of way and easements for the Courthouse Road/Hull Street
Road Intersection Project and the Jefferson Davis Highway/CSX Bridge
