Specifically, an increase in the number of permitted storage trailers and an extension in the time waste maybe stored prior to refrigeration is requested. PROPOSED LAND USE: Continued operation of a packaged medical waste transfer facility is proposed. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The proposed zoning and land uses conform to the Consolidated Eastern Area Plan, which suggests the property is appropriate for industrial use. B. The packaged medical waste transfer facility is compatible with existing and anticipated area industrial development. C. The packaged medical waste transfer facility has operated on the request property for approximately seventeen (17) years with no known adverse impacts on public health and safety. The increase in the number of storage trailers from two (2) to four (4) would not substantially alter operations. Providing a FIRST CHOICE community through excellence in public service D. As conditioned, the time proposed for waste storage prior to refrigeration is stricter than current state health regulations, and therefore, should be adequate to ensure the facility continues to operate in a safe manner. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITION NOTED "STAFF/CPC" WAS AGREED UPON BY BOTH STAFF AND THE COMMISSION.) CONDITION (STAFF/CPC) With the approval of this request, Condition 1 of Case 03 SR0213 shall be amended as follows: A maximum of four (4) storage trailers shall be permitted on-site at any one (1) time. Any medical waste stored in these trailers for more than seventy-two (72) hours shall be refrigerated, maintained at an ambient temperature between thirty-five (35) and forty-five (45) degrees Fahrenheit. Facilities shall be restricted to those improvements necessary to accommodate medical waste transfer to and temporary storage in these trailers in accordance with state and county requirements. (All other conditions of Case 03 SR0213 shall remain in force and effect.) GENERAL INFORMATION Location: The request property fronts the north line of Bellwood Road, east of Haven Avenue and is better known as 1306 Bellwood Road. Tax ID 798-677-Part of 3046. Existing Zonin I-3 Size: 1.4 acres Existing Land Use: Industrial Adjacent Zoning and Land Use: North, South, East and West - I-3; Industrial or vacant 2 12SN0244-SEP 19-BOS-RPT UTILITIES Public Water and Wastewater Systems: The use of the public water and wastewater systems is not required for the packaged medical waste transfer facility. Health Department: The Health Department has no adverse comments to this prof ect. ENVIRONMENTAL Drainage and Erosion: This request will have no impact on these facilities. PUBLIC FACILITIES Fire Service: The Centralia Fire Station, Company Number 17, currently provides fire protection and emergency medical service (EMS). This request will have a minimal impact on Fire and EMS. County Department of Transportation: This request will have no impact on these facilities. Virginia Department of Transportation (VDOT~: This request will have no impact on these facilities. LAND USE Comprehensive Plan: The subject property is located within the boundaries of the Consolidated Eastern Area Plan, which suggests the property is appropriate for industrial use. It is anticipated that moderate and heavy industrial use will continue in the area, as suggested by the Plan. Area Development Trends: Area properties are zoned and occupied by industrial uses or are vacant. 3 12SN0244-SEP 19-BOS-RPT Zoning HistorX: On November 21, 1995 the Board of Supervisors, upon a favorable recommendation by the Planning Commission, granted conditional use approval to permit a packaged medical waste transfer facility in a Heavy Industrial (I-3) District (Case 96SN0126). Conditions of approval limited approval to two (2) years; permitted two (2) storage trailers; required waste to be refrigerated at all times; addressed security and spill containment; and required signs to identify that the facility stored medical waste. On March 11, 1998 the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved renewal of conditional use (Case 96SN0126) to permit the continued operation of the packaged medical waste transfer facility (Case 98SR0167). At the Planning Commission's recommendation, the Board imposed a condition renewing this conditional use for a five (5) year period to allow reevaluation of the facility. In addition, conditions of approval permitted two (2) storage trailers; required waste to be refrigerated at all times; addressed security and spill containment; and required signs to identify that the facility stored medical waste. On April 23, 2003 the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved renewal of conditional use (03 SR0213) to permit the continued operation of the packaged medical waste transfer facility without a time limitation on the use. Conditions of approval limited the use to two (2) storage trailers; required waste to be refrigerated at all times; addressed security and spill containment; and required signs to identify that the facility stored medical waste. Site Design: The packaged medical waste transfer facility consists of an enclosure secured by a chain link fence and locked gate. Access is provided via a gravel road to Bellwood Road. Vehicles receiving packaged medical wastes from area medical facilities transport these packages to the request property and transfer the packages to trailers parked within the fenced enclosure. Once the trailers are filled, the packages are transported to medical waste treatment facilities. Minimal improvements have been made to the request property. These improvements include facilities to contain accidental spills of medical waste prior to disinfection and cleanup, provisions to ensure that packaged medical waste is protected from rainfall during transfer from trucks to trailers, and site security in accordance with Department of Environmental Quality (DEQ) and county requirements. Zoning conditions require the site security plan and a medical waste spill containment plan to be periodically reviewed throughout the life of the facility. The request property lies within a Post Development Area. Redevelopment of the site or new construction must conform to the development standards of the Zoning Ordinance which address access, parking landscaping, setbacks, signs, lighting, and screening of dumpsters and loading areas. 4 12SN0244-SEP 19-BOS-RPT Architecture: The request property lies within a Post Development Area. Any new structures, additions or alterations must conform to the architectural standards of the Zoning Ordinance for properties within a Post Development Area. Current Proposal: Conditions of zoning limit the operation to two (2) packaged medical waste storage trailers and require refrigeration of medical waste at all times. These conditions have been imposed with various zoning approvals (Cases 96SN0126, 98SR0167 and 03SR0213) over the seventeen (17) years the facility has operated. With this request the applicant proposes to increase the number of storage trailers to four (4) trailers and to modify the refrigeration requirement so that waste would be required to be refrigerated after seventy-two (72) hours instead of immediately. (Condition) The increase in the number of storage trailers from two (2) to four (4) would not substantially alter current operations. In addition, adequate security, facilities to contain accidental spills and provisions to protect medical waste from rainfall equal to what is provided for the existing storage trailers would be required for the proposed two (2) additional trailers. Conditions of Case 03 SN0213 would remain in force and effect. The Virginia Department of Health regulations address temperature control relative to waste storage periods. The state regulations require medical waste stored for more than seven (7) days to be refrigerated. In addition, the regulations require procedures to be provided to ensure that the timeframes and refrigeration requirements are met, as well as documentation of the dates the waste is first placed in storage. Should this request be approved, the Condition would require packaged medical waste stored for more than seventy-two (72) hours to be refrigerated. The proposed storage period prior to refrigeration is stricter than current state regulations and therefore, should be adequate to ensure the facility continues to operate in a safe manner. CONCLUSIONS The packaged medical waste transfer facility conforms to the Consolidated Eastern Area Plan which suggests the request property and surrounding area are appropriate for industrial use, and is compatible with existing and anticipated area industrial development. The facility has operated on the request property for approximately seventeen (17) years with no known adverse impacts on area uses or public health and safety. It has posed no known public health problems. As conditioned, the time proposed for waste storage prior to refrigeration is stricter than current state health regulations and therefore, should be adequate to ensure the facility continues to operate in a safe manner. 5 12SN0244-SEP 19-BOS-RPT Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (8/21/12): The applicant accepted the recommendation. There was no opposition present.
