Summary of Information: Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Summary of Information: It is requested the Chesterfield County Board of Supervisors approve one nominee for appointment to the Community Criminal Justice Board (CCJB) for the remainder of a two-year term according to the adopted by-laws of the CCJB. Appointments correspond to prescribed positions in the Code of Virginia. Both the Board of Supervisors and Colonial Heights City Council must approve all nominees. The CCJB serves the 12th Judicial Circuit consisting of Chesterfield County and the City of Colonial Heights. The purpose is to provide for the development, evaluation and planning of community programs and services for the court in diverting offenders from local correctional facilities. It is requested that James J. Brown, be appointed to fill the educational representative position on the CCJB. Summary of Information: The Federal Emergency Management Agency under the "Assistance to Firefighters Grant Program" has awarded $361,847 to the Fire and EMS Department to develop a Comprehensive Personal Protective Clothing Program. This program will allow for the purchase of an ensemble of protective clothing and storage bags for each career and volunteer firefighter. It will also provide for a computer with accessories to inventory and track all components as well as a specialized washer to maintain the gear in a clean and safe condition. This grant requires a 30% local cash match by the department, which will be $155,076. Current-year funding in the amount of $77,576 is available to transfer to the grant project, while the remaining balance ($77,500) will be included in the Fire and EMS Department's FY2004 operating budget. Summary of Information' The Board of Supervisors previously referred to the Planning Commission a proposed change to the zoning ordinance's definition of "group home" in order to align the definition with state law. At the Planning Commission's September 17, 2002 public hearing, the Commission recommended that the Board adopt the attached amendment to County Code § 19-301 relating to the definition of a "group home" State law requires the County to treat a group home licensed by the State Department of Mental Health, Mental Retardation And Substance Abuse Services ("State Dept. of MH, MR & SAS") as a single family dwelling for zoning purposes. A "group home" is defined by state and federal law to be a residential facility where no more than eight mentally ill, mentally retarded, physically handicapped or developmentally disabled persons reside with resident counselors or staff. However, the County's definition of "group home" is broader than the state mandate. Specifically, the County's Preparer: Steven L. At the recommendation of the Planning Commission, the attached ordinance also conforms the County's definition of "group home" to state law by including only those facilities licensed by the State Dept. of MH, MR & SAS. If the definition is changed, any existing group homes with "abused or neglected children", as well as group homes not licensed by the State Dept. of MH, MR & SAS, could continue to operate under the existing definition as a non-conforming use. Staff is not aware of any group homes that accept "abused or neglected children" unless they fit one of the other statutory categories such as "mentally ill." WHEREAS, The Group holds as tenants in common fee title to approximately 145 acres of land in Bermuda District, Chesterfield County, Virginia which is zoned for industrial use ("Property") said Property being more particularly described on Schedule A attached hereto; WHEREAS, the IDA and The Group desire to enter into an agreement to allow the IDA, for the benefit of the County, to obtain title to the Property in order for the County and IDA to market and sell the Property as part of the Meadowville Technology Park; NOW, THEREFORE, for the premises, conditions and valuable consideration as set forth below, the parties agree as follows: 1. Option to Purchase and Dedication. Provided, however, that the location of such dedicated real property shall be determined mutually by the parties. The Group may only reject the CoUnty's location if the location of such real property dedication would make it economically impractical to develop the rest of theProperty. Each dedication shall occur no later than thirty (30) days from the date the IDA or County issues a request for proposals for construction of the improvement necessitating the dedication. The total amount of property dedicated in fee simple to the IDA or County under this section shall not exceed 5 acres. Marketing and Sale of Property. The Group hereby appoints the IDA and the County as the exclusive agents to market the Property for sale. All decisions regarding the marketing and sale of the Property shall be made by the IDA consistent with recommendations from the County's Economic Development Office. 3. Purchase Price. Each time the IDA exercises its right to acquire all or part of the Property under this Option Agreement, the IDA will pay The Group as follows: (a) The IDA will pay The Group a base price of $18,000 per acre for all or part of 0605:56850.3 -2- 000 ,3 the Property purchased under this Option Agreement. An annual escalator of 3.0% shall be applied to The Group's base price beginning on the first anniversary of this Agreement. In addition, The Group will receive 20% of proceeds that exceed the base price of the year of sale generated from any resale of the Property to a third party by the IDA. If, however, the IDA purchases part of the Property in order to keep the term of this Agreement from terminating with no third party under contract to purchase the Property despite good faith efforts by the County or the IDA to secure such a contract, The Group will not receive a 20% share of the proceeds from the eventual resale of that part of the Property. (b) In the event, and at any time, the IDA exercises its option to purchase a part of the Property, the precise location of acreage purchased shall be determined by mutual agreement of the IDA and The Group. If a mutual agreement cannot be reached, the matter will be resolved by a committee consisting of one land planning consultant appointed by the IDA and one land planning consultant appointed by The Group. These two appointees will appoint a third land planning consultant to constitute a committee of three, which shall make a decision binding on The Group and the IDA. (c) The IDA's purchase of the Property shall be contingent upon receiving an appropriation of sufficient funds from the Chesterfield County Board of Supervisors. 4. (c) In the event that the IDA desires to terminate this Agreement after acquiring any part of Property and termination will leave the remaining unpurchased Property without road access, the IDA shall not terminate the Agreement until it has taken appropriate steps to ensure road access for the remaining Property. (d) The Group shall have a right to terminate this Agreement only if it fails to receive the minimum proceeds set forth herein. 5. Representations and Warranties. The Group represents and warrants that: (a) With respect to the environmental condition of the Property, (i) it has complied with all environmental laws and regulations related to use of the Property; (ii) no hazardous substances were disposed of at the Property during its ownership of the Property; (iii) that to the best of its knowledge no hazardous substances were disposed of at the Property prior to its acquisition of the Property; and (iv) it knows of no environmental liabilities or conditions that could materially affect the value of the Property. During the term of this Agreement, The Group shall 0605:56850.3 -4- 000C; 5 allow the IDA, the County or their agents access to the Property upon reasonable advance notice for the purpose of making environmental and feasibility studies of the Property. (b) The Group represents that it shall convey marketable title to any Property purchased under the Option Agreement free and clear of any liens or encumbrance. 6. Rollback Taxes. As part of any purchase of the Property under this option, the IDA shall pay as part of the purchase, rollback taxes, if there are any, that come due to the County as a result of any conveyance to the IDA pursuant to this Agreement. 7. No Assignment. The rights and obligations of each party to this agreement shall not be assigned without the prior written approval of the other party, which approval shall not be unreasonably withheld, except that the IDA may freely assign it rights and obligation to the County upon the approval of the Chesterfield County Board of Supervisors. 8. Successors and Assigns. This Agreement shall be binding upon all valid successors to and assignees of the parties to the agreement. 9. No Commissions. Whittle and Roper Realty Company (Realtor) has represented The Group in this transaction, and The Group agrees to pay a commission to Realtor equal to five (5%) percent commission of each parcel's sales price as set forth in paragraph No. 4, as this Option is exercised and each parcel is closed. The Group agrees to indemnify and save the IDA and County harmless from and against any and all liability, damages, expenses (including without limitation reasonable attorneys' fees), claims and/or judgments incurred by The Group related to its obligation to pay such commission. Subiect: Approval of Membership Dues Withholding Professional Firefighters Association Request from Chesterfield County Administrator's Comments: County Administrator: Board Action Requested: To authorize payroll deduction for professional firefighter association union dues. Summary of Information: Recently the Chesterfield Professional Firefighters Association (CPFA) requested to have their organizational dues withheld from the County paychecks of their members. Similar requests have been made by employee organizations in the past, including one from this association. In the past, the County has limited voluntary deductions to County benefit programs and has consistently denied dues deduction requests. Currently the CPFA union members have the option of having their dues deducted from their Chesterfield County Employees Federal Credit Union (CEFCU) account. CEFCU transfers the members' dues to the CPFA account. This service is provided at no charge to members or the association. County Payroll can provide this service through payroll deduction as requested, however, the County will charge a per transaction fee for this service in order to recoup costs associated with processing. Charges will be based upon the level of services provided by the County. Although the county can legally allow employee unions and associations to use payroll deduction for their dues, once one entity is allowed access, any other similarly-situated entity would also have to be allowed access to the payroll deduction opportunity. After the Board approves having the dues deducted through payroll deduction, Payroll will work with CPFA to establish processes to implement this service effective December 21, 2002. Summary of Information: On July 24, 2002, the Board adopted mandatory water restrictions in response to the current water shortage caused by the recent drought that has afflicted most of Virginia. Those restrictions, which went into effect on August 15, limited lawn watering to alternate days by address and prohibited lawn watering on Mondays altogether. On August 30, however, Governor Warner issued an Executive Order which prohibited all lawn watering, and the Board of Supervisors suspended its mandatory water restrictions and imposed Governor Warner's restrictions in a special meeting held on September 4. That the following ordinance is hereby adopted as follows: Sec. 1. Suspension of mandatory restrictions on use of public water. Due to the adoption by the Governor of Virginia of Executive Order 33 on August 30, 2002, the County ordinance imposing mandatory restrictions on use of public water adopted by the Board of Supervisors on an emergency basis on July 24, 2002 and readopted on August 28, 2002, hereafter referred to as the County Mandatory Water Restriction Ordinance is hereby suspended until such time as Executive Order 33 is no longer in force and effect as to Chesterfield County. At such time as Executive Order 33 is no longer in force and effect as to Chesterfield County, the County Mandatory Water Restriction Ordinance shall immediately become effective again. Sec. 2. Mandatory water use restrictions. No public water, ground water, or surface water shall be used for any of the activities prohibited by Executive Order 33, or by any modification hereafter made to Executive Order 33. Any modification to the water use prohibitions adopted by the Governor shall be prohibited in the County by this ordinance, mutatis mutandis. Except as set forth in subparagraph (b) of this section, if Executive Order 33 is amended, superseded or otherwise modified in a way that permits a water use that is not permitted by the County Mandatory Water Restriction Ordinance, or if the Drought Coordinator grants an exception to the restrictions of the Executive Order that permits a water use that is not permitted by the County Mandatory Water Restriction Ordinance, then the prohibition of the County Mandatory Water Restriction Ordinance shall be in full force and effect, and the water use that would otherwise have been permitted by such amendment, supersession, modification or exception shall still be prohibited in Chesterfield County as provided in such Ordinance. In addition, washing paved areas is prohibited except for health and safety requirements. Watering of newly established lawns and watering of lawns that have been aerated and/or thatched and overseeded, shall be permitted for a period of thirty (30) days after the new lawn has been planted or the existing lawn has been seeded, or until October 31, 2002, which ever comes earlier. Watering is 0505:58854.3 (58964.2) Adopted 9/18/02 prohibited after October 31, 2002. All lawn watering not expressly permitted by this section is prohibited. Sec. 3. These restrictions shall take effect immediately upon adoption of this ordinance. Sec. 4. It shall be a violation of this ordinance for any person to use water or allow, or cause the use of water in violation of any of the provisions of this ordinance. Sec. 5. Penalty. The provisions of section 6 of the County Mandatory Water Restriction Ordinance shall apply to violations of this ordinance. In addition, notice of assessment of fines imposed on violators who are not users of the public water system shall be sent to the address where the violation took place. Sec. 6. This ordinance shall not be set out in the Code. I live in the county, in Brandermill, and I have an asphalt driveway which requires annual maintenance due to cracking from direct exposure to the summer sun. I have been doing this maintenance every fall for about 15 years. The process requires scrubbing the driveway with water and a biogradable detergent to remove oil and grease and then rinsing with water before crack filler and sealer is applied. If this is not done before winter, the driveway will be so damaged by winter conditions that it will require replacement. (Applying the sealer and not cleaning first causes the sealer to lift off the asphalt very quickly.) I am requesting help from the Board of Supervisors, granting me permission to proceed with this maintenance. Terry Wagner of the Virginia Dept. of Environmental Quality has given me written and verbal permission to proceed, stating that the state's laws do not prohibit maintenance and construction activity requiring water, as in my case. He also recommended contacting the county attorney, who, after denying me permission, directed me to the Board of Supervisors for help. Summa~ of Information: The County recently paid for an updated set of aerial photographs of the County. The overfly also generated planning information showing grading contours, digital elevations, and other data used by County departments, the development community, and citizens. Unfortunately the information quickly becomes dated when new development alters contours and elevations and adds impervious areas. To keep the information current, staff recommends the attached amendments to the zoning and subdivision ordinances that would require developers of most commercial and townhouse projects to submit contour, elevation, and other information for their projects in electronic format to the Environmental Engineering Department, which would then update the County's databases. Developers would be required to submit the information after site plan approval (other than minor si te plan and improvement sketches ) and subdivision approval (for townhouses only), but prior to issuance of a land Preparer: Richard M. For those designers unable to submit the information in electronic format, the attached ordinance amendments provide that the County will charge a fee of $75 that reflects the County's actual cost to transfer the data to electronic format. This information was presented to the development community at the December 2001 quarterly meeting. This meeting was followed by subsequent phone calls and inquiries in which a change was made for those engineering firms without computer-aided drafting (Auto CAD). At that time, a $75 fee was added to compensate for those few firms. Notification of a second meeting was sent to approximately 45 design firms, and one landscape architect attended the meeting held Tuesday, July 23, 2002 at the Chester Library. This amount will require that when a plan is submitted, that it be submitted electronically in order to facilitate the revisions needed to the County's GIS information. This requested ordinance change will enhance the ability of staff to update the GIS system in a more timely manner and assist in keeping the information up to date. BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 9-31 of the Code of the County of Chesterfield, 1997, as amended, is amended and re-enacted to read as follows: (a) A partial exemption from real estate taxes is granted to certain commercial and industrial property which qualifies under the criteria listed in subsection (b). (b) For real property to qualify for the partial exemption granted by this section, the following criteria must apply: (1) Any real estate upon which there is an existing commercial or industrial structure shall be deemed to have been substantially rehabilitated, renovated or replaced when a structure 25 years old or older has been improved so as to increase the assessed value of the structure by 15 percent or more. For structures in an area designated by the Commonwealth of Virginia as an enterprise zone, the structure may be 15 years old or older. (2) The base value of the commercial or industrial structure shall be the assessed value of the structure prior to the commencement of the work as determined by the county assessor upon receipt of an application for the tax exemption. (3) The tax exemption provided in subsection (b)(1) shall apply when the rehabilitation, renovation or replacement is completed and the amount exempt from tax shall be equal to the increase in assessed value, if any, resulting from the rehabilitation, renovation or replacement of the assessed commercial or industrial structure, as determined by the county assessor. The exemption shall apply only to any subsequent assessment or reassessment. In any year in which the market value of the qualified real estate decreases below the base value, as determined pursuant to this section, no credit or refund shall be provided to the owner. (4) The exemption shall run with the real estate for five years. (5) Nothing in this section shall be construed to allow the county assessor to list upon the land book any reduced value or any reduced taxes due to the exemption provided herein. 1325:58684.1 O0 0~ (c) Prior to beginning the rehabilitation, renovation or replacement the owner of any real estate meeting the criteria stated in this section shall apply for the exemption on forms provided by the county. Upon receiving the application, the county assessor shall determine the base value of the structure. This base value determination shall be effective for two years from the date of determination, but applicants may reapply after this time period expires. The owner shall pay an application fee of $50.00 for each application which shall be refundable upon completion of the replacement or rehabilitation. Property located in an enterprise zone shall be exempt from paying an application fee. (d) Upon completion of the rehabilitation, renovation or replacement the county assessor shall be notified in writing and shall inspect the property to determine the assessed value of the structure and the amount, if any, of the rehabilitated real estate tax exemption for that structure. No property shall be eligible for exemption unless the appropriate building permits have been acquired, and the county assessor has verified that the rehabilitation, renovation or replacement indicated on the application has been completed and meets the requirements of this section. In determining the base value and the increased value resulting from the substantial rehabilitation, renovation or replacement the county assessor shall employ usual and customary methods of assessing real estate. (e) Where rehabilitation is achieved through demolition and replacement of an existing. structure, the partial exemptions provided in subsection (b) shall not apply when any structure demolished is a registered Virginia landmark or is determined by the Department of Historic Resources to contribute to the significance of a registered historic district. (b) For real property to qualify for the partial exemption granted by this section, the following criteria must apply: (1) The property must be lawfully used for residential purposes. (2) There must be a residential structure on the property no less than 25 years of age which has been rehabilitated, renovated or replaced; provided, however, that if the real estate tax assessment of the structure is more than ten percent lower than the assessment of similar structures in the immediate area, as determined by the assessor, due to the physical condition of the structure, the structure may be 15 years or older in order to qualify under this subsection. (3) If the structure is a multifamily residential structure, the rehabilitation, renovation or replacement must not increase the total square footage of the structure being rehabilitated, renovated or replaced by more than 30 percent. (4) For structures other than multifamily residential structures, the exemption shall apply only to the first 200 percent of any increased square footage due to replacement or rehabilitation. (5) The rehabilitation, renovation or replacement must increase the assessment of the structure by more than ten percent and must be complete. (6) The rehabilitation, renovation or replacement must be accomplished with appropriate building permits. (c) Prior to beginning the rehabilitation, renovation or replacement the owner of any real estate meeting the criteria stated in this section shall apply for the exemption on forms provided by the county. Upon receiving the application, the county assessor shall determine the base value of the structure. Summary of Information: Comcast has filed its proposed plan to raise its rates on Limited Basic programming. The Limited Basic tier includes the first 14 channels of programming which all customers are required to purchase as part of their cable service. A small number of subscribers purchase only the Limited Basic tier. Pursuant to FCC regulations, Comcast has submitted to the County the official notification of the proposed rate increase along with the forms calculating the maximum allowable increase under the federal regulations. Under the filings, Comcast will be permitted to increase the Limited Basic cable rate by $0.89 to a proposed maximum permitted rate of $9.26. Last year, Comcast was permitted to raise the rate to $9.09, but the rate remained at $8.37. Any rate increase will go into effect November 1, 2002. Currently, no federal agency reviews proposed cable rate increases. Federal law permits the County to review rate increases only for the Limited Basic tier. By law, there is no federal or local oversight for the higher and more popular tiers of service. In addition, the County's only oversight over the Limited Basic tier is to determine whether the calculations on Comcast's rate forms have been made in accordance with FCC rules and are complete and accurate. Under our ordinance, the County is permitted, but is not required, to hold a public hearing on proposed Limited Basic tier rate increases and have Comcast appear and justify the reasonableness of its proposed increase. The Board previously requested that this public hearing be set. Although the County may not prevent a rate increase up to the FCC maximum from going into effect on November 1, federal law does permit the County to audit Comcast's records related to the rate increase and order a rate reduction if the records do not support the proposed rate increase. The County has until July 31, 2003 to undertake such an audit and take action to reduce rates. Such an audit could involve hiring an outside consultant.
