The GFOA has awarded Chesterfield the Distinguished Budget Presentation Award for the fiscal year beginning July 1, 2003. This is the 19th consecutive year that Chesterfield has won this award. This is the highest form of recognition in governmental budgeting. In order to receive the award a government must produce a document that meets certain criteria as a policy document, as an operation guide, as a financial plan, and as a communications device. Preparer: Joan Salvati Title: Water Quality Administrator Attachments: ~-] Yes No OOCCC3 Chesterfield County October 01, 2002 Methyl Tertiary-Butyl Ether (MTBE) Summary Information Levels of MtBE contained in drinking water should be monitored closely in order to ensure that they do not reach harmful levels. Due to its high solubility in water, small amounts of this compound can spread rapidly through ground or surface water supplies. Studies conducted by the United States Geological Survey (USGS) on a number of lakes further support this concern by having demonstrated that levels of MtBE can occur in concentrations resulting in taste and odor problems. Both these studies and input from the scientific community prompted the Environmental Protection Agency to issue the Drinking Water Advisory of between 20 and 40 ~tg/L. According to EPA, there is insufficient data at thig time on the effects on humans of drinking MtBE contaminated water. EPA further reports that there have been instances of drinking water contamination in both private wells and in reservoirs, noting that the primary sources of the contamination are leaking underground storage tanks and personal watercraft. In response to reported instances of the substance in drinking water, and its unknown human health effects, EPA placed MtBE on the Candidate Contaminant List. In accordance with the Federal Safe Drinking Water Act requirements for Candidate Contaminants, suppliers of public water must conduct monitoring to determine the levels of MtBE in their waters. The purpose of this monitoring is to collect data to deterrcdne what the levels of MtBE are in public water supply reservoirs, and what the risks of those levels are to humans. Staff from EPA headquarters has stated that this monitoring effort must be concluded by 2003. At that time, the agency will review data from those public water suppliers and determine what the "typical" levels of MtBE from this substantial data set. These data, as well as additional data on MtBE's health effects will enable the EPA Administrator to decide whether or not the contaminant should be regulated. Monitoring in Lake Chesdin by the Appomattox River Water Authority for MtBE has revealed levels of between <0.5 to 8 [tg/L. The peak levels appear to correspond with the peak boating use during the summer months. This is consistent with the theory that recreational watercraft are most likely source of small amounts of contamination in surface waters. A Blue Ribbon Panel formed by EPA to advise the agency on this issue reported "The two-stroke engines discharge in their exhaust up to 30 percent of each gallon of gasoline as unburned hydrocarbons." Staff Recommendations It is recommended that the Appomattox River Water Authority's monitoring of MtBE be reviewed and enhanced in order to provide a sampling protocol that is sufficient enough to enable the Authority to make good decisions if and when any regulatory changes are made pertaining to this substance. The Authority would then be in a position to act expeditiously to undertake any actions that may be required to address MtBE in the Lake. Given the current observed levels of MtBE in Lake Chesdin, and the fact that those levels are well below EPA' s drinking water advisory, staff does not feel that prohibiting two stroke engines on the lake is warranted at this time. A thorough review of the MtBE levels in Lake Chesdin should be undertaken on an annual basis to monitor for any increases or decreases in those levels. The County can then reconsider whether or not to recommend further action the Appomattox River Water Authority. Chesterfield County October 01, 2002 Background MtBE is a volatile organic compound (VOC) used almost exclusively as a fuel oxygenate or octane enhancer, allowing gasoline to bum more completely, thereby reducing carbon monoxide emissions and ground-level ozone. It has been used since the late 1970s to replace lead as an octane enhancer. Since 1992, MtBE has been used at higher concentrations to fulfill the oxygenate requirements set by Congress in the 1990 Clean Air Act Amendments, which mandated reformulated gasoline in those areas of the country with the worst ozone or smog problems. Roughly 30% of the U.S.'s gasoline is reformulated, of which about 87% contains MtBE. Studies have shown significant air quality and public health benefits from using oxygenated fuels, and recent declines in toxic air pollutants, such as benzene, may be attributable to the use of reformulated gasoline. Due to its small molecular size and high water-solubility, MtBE xnoves rapidly through soil and into ground and surface water supplies where it dissolves rather easily. Unfortunately, MtBE also appears to be relatively resistant to chemical and microbial decomposition and, thus, tends to persist in water supplies. A number of studies have detected MtBE in ground and surface water throughout the country and some of these have been sources of drinking water. The above notwithstanding, the major source of human exposure to MtBE in most areas is from breathing contaminated air. Summary of Health Effects of MtBE Inhaling gasoline vapors with MtBE has been shown to cause eye/nose/throat irritation, headaches, nausea, dizziness, and mental confusion. However, it is unclear whether these effects are due to MtBE or some other component of gasoline. To date, there are no studies of long-term human exposure to MtBE and there is no direct evidence that MtBE causes cancer in humans. Some studies in rodents have shown increased cancer at high doses (e.g., ingesting 1,000 mg/kg/day, 4 days per week for 2 years; or inhaling 8,000 PPM for 2 years), and other rodent studies have shown effects on the kidney or nervous system at high doses. Animal studies on maternal toxicity have shown fetal developmental disorders at high doses but not at low doses. The EPA Office of Water has concluded that MtBE is a potential human carcinogen at high doses, but that the available data are not adequate to estimate potential health risks of MtBE at low exposure levels in drinking water. ' Timeline of Selected EPA Actions Related to MTBE 1997: MtBE has an unpleasant taste and odor. In its 1997 Drinking Water Advisory, the EPA recommended a Consumer Acceptability Advisory level of 2040 gg/L in order to protect consumer acceptance of drinking water. The EPA's 1997 Drinking Water Advisory does state that keeping levels of contamination in the range of 2040 gg/L or below to protect consumer acceptance of the water would also provide a large margin of exposure (safety) from toxic effects. In this Advisory, the EPA concluded: "There is little likelihood that an MtBE concentration of 20 to 40 gg/L in drinking water would cause adverse health effects in humans..." 1998: EPA placed MtBE on the Drinking Water Contaminant Candidate List (CCL) for further evaluation to determine whether or not to include it in the National Primary Drinking Water Regulation (NPDWR) as a regulated contaminant. 1999: MtBE became incorporated into EPA's Unregulated Contaminant Monitoring Regulation. This regulation requires all large public water systems (such as those of Chesterfield County) to monitor and report the presence of MtBE in their water supplies on a quarterly basis during 2001-2003. EPA will use the data generated through this monitoring effort to make decisions regarding whether or not to regulate MtBE. Chesterfield County October 01, 2002 2002: EPA Region III published its most current Risk Based Concentration (RBC) Table in April 2002. RBCs are chemical concentrations in water, air, fish tissue, and soil that are associated with fixed levels of risk (i.e., a hazard quotient of 1, or a lifetime cancer risk of 10'6). Region llI uses RBCs for chemical screening of sites during a baseline risk assessment. It appears that Region III, for the first time, treated MtBE as a possible carcinogen in this table, reducing that drinking water RBC for MtBE from 6300 Ixg/L to 2.6 gg/L. It is important to note that the RBC Table does not constitute EPA regulation or guidance. Lee Council of the Boy Scouts of America in October 1977; and WHEREAS, the Explorer Post program, sponsored by the Boys Scouts of America, is part of the Learning for Life career education program for young men and women ages 14 through 20; and WHEREAS, the Explorer Post programs are based on five areas of emphasis: career opportunities, life skills, service learning, character education, and leadership experience; and WHEREAS, the Explorer Post concept is based on a unique and dynamic relationship between youth and organizations in their communities by matching people and program resources to the interests of young people in the community, resulting in activities that help youth pursue their special interests, grow, develop and prepare them to become responsible and caring adults; and WHEREAS, the idea of bringing an explorer post to the Chesterfield County Police Department came from three young officers, John Wolford, Randy Watkins and David Hope, and Police Chief J. E. County Administrator: Board Action Requested: To authorize the County Administrator to execute a change order to the design contract with Moseley Architects in the amount of $59,972 for additional design services on the Chesterfield Jail Replacement project. Summary of Information: In June 2002 Chesterfield County engaged a consultant to conduct a comprehensive value engineering study of the design of the Chesterfield Jail Replacement project. This study identified several hundred thousand dollars in potential savings using some suggested alternative design criteria. The architect was also asked to look at ways to trim the costs due to the risk of being over budget. At the request of the County, Moseley Architects developed an alternative design that was able to reduce the configuration of the jail by over 3,500 square feet. This equates to a savings of about $900,000 in construction costs. The architectural process was at the beginning of the design and development phase of the project therefore, the architect had to completely start over again at the schematic phase. Approval of this change order will leave a balance of $135,028 in contingency funding. The Adopted FY2003-2008 Capital Improvement Program includes $19,658,600 in additional state and local funding (planned for FY2004) to complete this project. The County's Change Order Policy specifies that any single change order exceeding $50,000 must be approved by the Board. Staff anticipates that the State Department of Corrections will provide a 25% reimbursement for this change order at project completion. Summary oflnformation: When the Board approved the Secondary Road Six Year Improvement Plan on June 20, 2001, the County Administrator was authorized to execute VDOT/County agreements for the design, right-of-way acquisition, and construction of projects in the plan. The Board also authorized the use of $211,000 in cash proffers to accelerate the work associated with the Matoaca Road/Woodpecker Road intersection project. VDOT funds will finance the remaining project costs. VDOT agreed that the County could manage the design, right-of-way acquisition and construction of this project. The design is complete. In order to move forward with right-of-way acquisition, and construction, funds must be appropriated for VDOT reimbursement. Recommendation: Staff recommends the Board set November 13, 2002, as the public hearing date to consider the appropriation of funds for the Matoaca Road/Woodpecker Road intersection improvement project. Bailey Bridge Road near Deer Run subdivision, Bailey Bridge Road west of Holly Trace subdivision, Bailey Bridge Road west of Bayhill Pointe subdivision, Branders Bridge Road north of Whitehouse Road, Courthouse Road north of Yatesdale Drive, Chalkley Road north of Wellington Farms subdivision and Coxendale Road railroad crossing gates. The anticipated construction date of many projects has been delayed since the previous Plan due to increased costs of completed and ongoing projects and reduced funding. See Attachment D. Other projects have been removed from the Plan. See Attachment E. FY03 and FY04 Secondary Road Improvement Budgets Each year VDOT requests the Board of Supervisors to approve a Secondary Road Improvement Budget. The budget reflects the first year of the Six Year Plan and identifies specific project allocations for the fiscal year. Attachment F identifies the projects and allocations for'FY03 and FY04. In the past, funds ($134,000) have been routinely included in the budget to upgrade qualifying non-State standard roads so that they can be accepted into the State road system, as a rural addition. This year, staff recommends the Board not select a rural addition project. The $134,000 per year designated previously for rural additions should be allocated to other projects. Under the "rural addition" program, VDOT will pay the road construction costs. The County, or others, must pay right-of-way acquisition and utility adjustment costs. In the past, rural addition projects have been selected by the Board on a case-by-case basis as requests are received from citizens. Attachment G lists the qualifying rural addition requests. No rural addition projects are included in the plan. Chesterfield Road Fund Project Development Schedule and Designation of FY04 Pro~ects - The County regularly participates in an annual VDOT matching fund program (Chesterfield Road Fund), wherein the County provides $500,000 in anticipation of an equal match (dollar-for-dollar basis) by VDOT. The exact amount of funds to be matched by VDOT is determined by VDOT after all statewide requests for matching funds have been received. Old Buckingham Road and Matoaca Road/Woodpecker Road intersection are designated to receive funding in FY04. The County FY04 budget anticipates $500,000 for Chesterfield's local match. Funding for the Chesterfield Road Fund projects is provided on a rotational basis among the magisterial districts. The last Chesterfield Road Fund Schedule was approved by the Board in April 2002. The recommended schedule (Attachment B) is a continuation of the currently approved schedule with additional FY09 funding for the Midlothian and Matoaca Districts. Regional Surface Transportation Pro~ram (RSTP) Pro~ect Develo~_ent Schedule - The Metropolitan Planning Organization (MPO) is given the authority to select/approve projects to be funded from RSTP Funds. The Richmond MPO receives approximately $9.5 million each year in RSTP Funds. Chesterfield anticipates receiving approximately $1.1 million annually in RSTP Funds. The last STP Fund Schedule was approved by the Board in June 2001. Attachment C identifies the recommended RSTP Fund Project Development Schedule. Peddlers Every peddler who is not expressly exempt from a license tax under the provisions of this chapter shall obtain a license for the privilege of doing business in the county and shall pay a license tax as set forth below: (a) Unless otherwise provided in this section or in some other section of this chapter, the license tax for each peddler selling or offering for sale goods, wares and merchandise shall be $500.00 for the license tax year. (b) Any person who sells or offers to sell goods, wares, or merchandise to licensed dealers, other than at a definite place of business operated by the seller, and at the time of such sale or exposure for' sale delivers, or offers to deliver, the goods, wares or merchandise to the buyer, is a "peddler at wholesale." Any delivery on the day of sale shall be construed as a delivery at the time of sale. Each peddler at wholesale shall pay a license tax for the tax year; the license tax rate for each peddler at wholesale shall be the same as the license tax rate applicable to a wholesale merchant selling similar goods, wares and merchandise at one definite place of business. (c) No license shall be imposed on any peddler who sells or offers for sale in person or by his employees only the following items or any of them if such items were grown or produced by him or by his employees and were not purchased by him for sale: ice, wood, charcoal, meats, milk, butter, eggs, poultry, game, vegetables, fruits or other family supplies of a perishable nature or farm, domestic or nursery products. (d) A license tax of $25.00 for the license year shall be imposed on any peddler who sells or offers for sale in person or by his employees the following items or any of them if such items were not grown or produced by him or by his employees: meats, milk, butter, eggs, poultry, fish, oysters, seafood, game, vegetables, fruit or other edible family supplies of a perishable nature. (e) A license tax of $25.00 for the license year shall be imposed on any peddler who sells or offers for sale only Christmas trees or Christmas greens not grown or produced by him. (f) A peddler whose activities are conducted solely for charitable purposes and who is not paid for his services shall not be required to pay any license tax under this section. 000048 (g) A license tax of $25.00 for the license year shall be imposed on any peddler whose activities are conducted as part of an event conducted or sponsored by any department of the county government. (h) A peddler who sells fire wood for home consumption shall not be required to pay any license tax under this section. (ri-) (i) A peddler's license shall not be transferable and shall not be subject to proration. (-t-) (k) The license tax imposed under this s~tion shall be imposed upon each person and each agent of a corporation, association, or other entity who conducts the activities of a peddler; except that peddlers who all peddle from or in close proximity to a vehicle and who all peddle the same type of goods, wares or merchandise may obtain a single peddler license for each vehicle, which shall list the names of all those peddlers peddling from or in close proximity to such vehicle. Summary of Information: Staff in the Building Inspection Department has been meeting with citizen groups regarding the impact of blight on the community. The Blight Ordinance was developed to define blight and enable the County to take proactive steps to minimize its impact upon the County's neighborhoods. On September 17, 2002 the Planning Commission held a public hearing on the proposed ordinance and recommended it to the Board of Supervisors for adoption. At the Planning Commission's public hearing, testimony was exclusively in favor of and in support of the proposed ordinance. The proposed Blight Ordinance establishes a procedure to be followed should a property be suspected of being blighted. The property owner (if available) is contacted and asked to correct the conditions identified as potential blight. Should the owner fail to address these conditions or disagree that they are a blighting influence, a public hearing before the Planning Commission is scheduled. At the hearing the owner, County staff, and affected citizens can address the Commission. The Commission then makes an initial determination that the property is blighted and the appropriate remedy. Their findings are forwarded to the Board of Supervisors for a second hearing. At the Board's public hearing, this process allows everyone's input for a final determination that the property is blighted and the appropriate remedy including authorizing County staff to take action to remove any blight if the owner fails to do so. Purpose. The board of supervisors finds that deteriorating properties, including the improvements and the land on which they are built, have a deleterious effect on property values and the quality of life in the area surrounding them. This spot blight ordinance is enacted to provide for the abatement of blight which threatens the health, safety, morals and welfare of the community. Sec. 5-7.2. Blight abatement authorized. The county may acquire or repair any blighted property, as defined in section 5-7.3, by exercise of the powers of eminent domain and, further, shall have the power to hold, clear, repair, manage or dispose of such property for purposes consistent with this ordinance. In addition, the county may recover the costs of any repair or disposal of such property from the owner. Sec. 5-7.3. Blighted property defined. (a) To be blighted a property must have a building or improvement that by reason of dilapidation, obsolescence, overcrowding, faulty arrangement of design, lack of ventilation, light and sanitary facilities, excessive land coverage, deleterious land use or obsolete layout, or any combination of these or other factors, is detrimental to the safety, health, morals or welfare of the community. This definition shall not include farm buildings and structures not used for residential purposes, located on property with an agricultural zoning classification where farming operations take place, and used primarily for any of the following uses or combination thereof: Storage, handling, production, display, sampling or sale of agricultural. horticultural, floricultural or silvicultural products produced on the farm; Sheltering, raising, handling, processing or sale of agricultural animals or agricultural animal products; 3_ Business or office uses relating to the farm operations; 0614(23):56833.1 1 4/5/02 0:51 PM Use of farm machinery or equipment, or maintenance of storage of vehicles, machinery_ or equipment on the farm; 5_ Storage or use of supplies and materials used on the farm; or 6_ Implementation of best management practices associated with farm operations. (b) In determining whether a property meets the definition of blighted set forth above, the county may consider any of the following, or other pertinent, factors: Condemned structure - A structure on the property has been continuously vacant for at least one year, has been condemned as unfit for human occupancy by the building official in accordance with the Virginia Uniform Statewide Building Code, but the building official is unable to find that the criteria for demolition have been met and the owner has failed to take corrective action as directed by the building official; Rat and rodent infestation - There is evidence of rat or rodent infestation or harborages caused by conditions on the property; Previous citations - The property has been used or maintained in a condition which has resulted in the following actions: The owner has been cited on a least three separate occasions because activities or conditions on the property violate state or county criminal laws, or county ordinances governing the use or maintenance of property, and those activities or conditions threaten the public heath, safety, morals, and welfare of the community, or The owner has refused to abate violations as ordered by the court, or has repeated conduct for which the owner has been convicted of violating county ordinances in the past. Inadequate facilities - The property has inadequate sewage, septic, plumbing, well or heating facilities; Potential trespass - If the property is vacant, the owner has failed to take adequate precautions to prevent the use of the property by trespassers; o Nuisance to children - A potential attractive nuisance to children exists on the 0614(23):56833.1 4/5/02 0:51 PM property, including, but not limited to, abandoned wells, basements, excavations. or broken fences; Fire hazard - Any condition exists on the property that has been specifically identified as a fire hazard by the fire department or the building official; and 8_ Substantial dilapidation of buildings or structures as evidenced by either: Structural collapse of either interior or exterior structural elements such floors, walls, roofs, porches, decks and similar appendages which do not pose a danger to the public; or bo Removal or rotting of exterior siding, roofing or sheathing exposing structural members to the weather. Sec. 5-7.4. Procedures for declaring blighB notification of owner~ public hearings (a) The county administrator or his designee shall make a preliminary determination that a property is blighted in accordance with section 5-7.3 and shall notify the owner by regular and certified mail, specifying the reasons why the property is considered blighted. The notice mailed to the owner also shall be posted on the property. The owner shall have 30 days within which to respond with a plan that would cure the blight within a reasonable time. (b) Upon approval of the plan to cure blight the owner shall have 90 days to complete all work approved in the plan. The county administrator or his designee may grant extensions of time to complete work where in his opinion the owner has completed substantial portions of the work in compliance with the plan. (c) If the owner fails to respond within the 30-day period set forth in section 5-7.4(a) with a plan that is acceptable to the county administrator or his designee, or fails to complete the work approved in the plan to cure blight and has not been granted an extension of time to complete such, the county administrator or his designee may (i) request the planning commission to conduct a public hearing and make findings and recommendations that shall be reported to the board of supervisors concerning the repair or other disposition of the property in question and (ii) if a public heating is scheduled, shall prepare a plan for the repair or other disposition of the property. (d) Not less than three weeks prior to the date of the public hearing before the planning commission, the commission shall provide, by regular and certified mail, notice of such hearing to (i) the owner of the blighted property or the agent designated by him for receipt of service of notices concerning the payment of real estate taxes on the property; (ii) the abutting 0614(23):56833.1 3 4/5/02 0:51 PM property owners in each direction, including those property owners immediately across the street or road from the property; and (iii) the representative neighborhood association, if any, for the immediate area. The notice shall include the plan for the intended repair or other disposition of the property. The notice of the public hearing shall be published at least twice, with not less than six days elapsing between the first and second publication, in a newspaper published or having general circulation in the county. The notice also shall be posted on the property. The notice shall specify the time and place of the hearing at which persons affected may appear and present their views, not less than six days nor more than 21 days after the second publication. (e) The planning commission shall determine whether: The property is blighted; The owner has failed to cure the blight or present a reasonable plan to do The plan for the repair or other disposition of the property is in accordance with the countyDs comprehensive plan, zoning ordinance, and other applicable land use regulations; The property is located within an area listed on the National Register of Historic Places or, pursuant to Chapter 19 of the County Code, is located within an historic district or is a designated landmark. In such instances. the planning commission shall consult with the preservation committee regarding the proposed repair or other disposition of the property; and If the property is to be acquired, whether the property is occupied for personal residential purposes and whether it has been condemned for human habitation for more than one year. (f) The planning commission shall report its findings and recommendations concerning the property to the board of supervisors. The board of supervisors, upon receipt of such findings and recommendations, may, after an advertised public hearing, affirm, modify, or reject the planning commission[]s findings and recommendations. If the repair or other disposition of the property is approved, the county may carry out the approved plan to repair or acquire and dispose of the property in accordance with the approved plan, the provision of this section, and applicable law. The county shall have a lien on all property so repaired or acquired under an approved plan to recover the cost of (i) improvements made by the county to bring the blighted property into compliance with applicable building codes and (ii) disposal, if any. The lien authorized by this subsection shall be filed in the circuit court and shall be subordinate to any prior liens of record. 0614(23):56833.1 4/5/02 0:51 PM The county may recover its costs of repair from the owner of record of thc 4 property when the repairs were made at such time as the property is sold or disposed of by such owner. If the property is acquired through eminent domain, the cost of repair may be recovered when the county sells or disposes of the property. In either case, the costs of repair shall be recovered from the proceeds of any such sale. Sec. 5-7.5. Occupied For Residential Purposes Unless otherwise provided for in Title 36 of the Code of Virginia, if the blighted property is occupied for personal residential purposes, the county, in approving the plan, shall not allow for an acquisition of such property if it would result in a displacement of the person or persons living in the premises. The provisions of this subsection shall not apply to acquisitions, under an approved plan, by the county of property which has been condemned for human habitation for more than one year. In addition, the county in exercising the powers of eminent domain in accordance with Title 25 of the Code of Virginia, may provide for temporary relocation of any person living in the blighted property provided the relocation is within the financial means of such person. Sec. 5-7.6. Declaration of nuisance. In lieu of the acquisition of blighted property by the exercise of the powers of eminent domain as herein provided, and in lieu of the exercise of other powers granted in sections 5-7.1 through 5-7.4, the board of supervisors, by ordinance, may declare any blighted property to constitute a nuisance, and thereupon abate the nuisance pursuant to state law. Such ordinance shall be adopted only after written notice by certified mail to the owner or owners at the last known address of such owner as shown on the current real estate tax assessment books or current real estate tax assessment records. Sec. 5-7.7. Provisions cumulative. The provisions of this article shall be cumulative and shall be in addition to any remedies for spot blight abatement that may be authorized by law. Braunstein Title: Executive Director MH/MR/SA Department Attachments: Yes [---] No ~)~JO060 RECOGNIZING THE CHESTERFIELD COUNTY COMMUNITY SERVICES BOARD ON ITS 30~ ANNIVERSARY WHEREAS, in 1971 with the intent of implementing the provisions of Chapter 10, Title 37.1 of the Code of Virginia, 1950, as amended, the Chesterfield County Board of Supervisors formally approved the establishment of a community mental health and mental retardation services program; and WHEREAS, the eight citizens officially appointed by the Board of Supervisors as charter members of the Chesterfield Community Services Board proceeded to develop a strong foundation of mental health and mental retardation programs available to all Chesterfield residents; and WHEREAS, activities and accomplishments during the first decade of services included operation of an outpatient Mental Health Clinic from a trailer located behind the old Health Department building; and WHEREAS, the Chesterfield Community Services Board (CSB), realizing the need for geographic accessibility opened a satellite clinic in Ettrick, as well as established an occupational sheltered workshop for persons with mental retardation; and WHEREAS, the Chesterfield Community Services Board established the first residential group home in the county for persons with mental retardation and subsequently has been recognized nationally for the quality supports that are integrated within community housing options; and WHEREAS, a wide array of quality behavioral health care services are provided for Chesterfield County residents through various programs located throughout the county including: Residential Services, Outpatient Services, Crisis Intervention, Medical Services, Child and Adolescent Services Team, Consumer Service Coordination, Chesterfield Employment Services, Infant Program, Psychiatric Rehabilitation Services, and the Chester House Program (a psychosocial clubhouse model); and WHEREAS, during three decades of providing behavioral health care the Chesterfield CSB was the first CSB to create a comprehensive Primary Prevention Program, establish a mutual agreement with the Medical College of Virginia for the services of an expert psychiatric medical director, develop a Critical Incident Stress Debriefing Program for public safety personnel, create two nationally recognized model programs promoting community integration "Open Doors" and the "Everybuddy Project," as well as construct a specially designed public facility that is considered a state-of-the-art design in the Commonwealth. Subject: Consideration of Request of Columbia Gas of Virginia for Modification of the Airport Industrial Park Restrictive Covenants Relating to Chain Link Fences, Gravel Entrance Drive and Station Area County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to approve a request of Columbia Gas of Virginia for modification of the Airport Industrial Park Restrictive Covenants relating to chain link fences, gravel entrance drive and station area, subject to conditions recommended by staff. Summary of Information: Columbia Gas of Virginia ("Columbia") plans to construct a Point of Delivery Station at 8100 Whitepine Road at the Airport Industrial Park to better serve the users of the Park. Columbia has requested that the County waive that portion of its restrictive covenants applicable to the Industrial Park that forbids chain link and perimeter fences, so as to permit Columbia to erect a chain link fence around the perimeter of the Delivery Station. (See attached proposed site layout). The request has been reviewed and approved by the County's Planning Staff and Department of Economic Development. The applicable restrictive covenants state that "[f]ences will be approved only for limited storage areas. Chain link and/or perimeter fences will not be permitted." Further, the Covenants require all parking, driveway and loading areas to be paved. Columbia has requested a waiver of this provision in order to allow a gravel entrance drive and a gravel parking area within the fenced station area. Planning Staff further recommends that if the Board supports this request that Columbia be required to (1) pave from the curb cut commencing at Whitepine Road to the existing roadbed on the parcel so that gravel does not abut Whitepine Road and (2) construct a gate approved by the Planning Department across the driveway to be located within 50 feet of Whitepine Road. The purpose of the gate would be to prevent access to people who might want to illegally dump on the property. Summary of Information: Grant funds will be used to create a comprehensive program that will utilize the resources and expertise of Community Corrections Services, the Courts, Day Reporting Center, Community Services Board and Social Service in a collaborative effort. Defendants will receive comprehensive and integrated services to address both substance abuse and mental illness in a single location. The program will consist of four phases of intensive treatment and structure that will last between six months and one year. Goals of the program will be to provide the court with appropriate mental health information necessary to determine an appropriate disposition and to create a diversion option for forty dually diagnosed offenders that offers effective services to mentally ill clients who are transitioning from jail, in order to reduce recidivism. Two casemanager positions in CCS will be used for supervision and two Clinician positions one of which would be a Sr. Clinician will provide clinical evaluations and treatment services for the targeted population. A part time van driver would assist in transporting these individuals to required activities at the Day Reporting Center. The grant would pay for rent, equipment, furniture to set up the office, training and for some contracted psychiatric and nursing professional services associated with providing the treatment. REPORTING REQUIREMENTS: 1. Financial Status Report, Standard Form 269 (long form), is due within 90 days after expiration of the budget period, and 90 days after the expiration of the project period on a cumulative basis. The acquisition of this property will address a need identified in the Parks Master Plan to meet the growing recreation need in the infill area of the central part of the County. Summary of Information: On October 1, 2002, a tree planting ceremony was held at Fire Station #15 in honor of the firefighters who lost their lives on September 11, 2001 and for the service of all firefighters in Chesterfield County. Philip Morris will also be planting trees at 12 other fire stations on November 7, 2002 in recognition of the fire service. Preparer: Steve A. FOR ITS CONTRIBUTION TO THE CHESTERFIELD COUNTY DEPARTMENT OF FIRE AND EMERGENCY MEDICAL SERVICES WHEREAS, the tragic events of September 11, 2001 caused the loss of life of 343 firefighters in the New York City Fire Department; and WHEREAS, Philip Morris U.S.A. wanted to honor those lives lost, the spirit and service of all of the firefighters involved in September 11, 2001 and all firefighters in the Chesterfield County Fire and Emergency Medical Services (EMS) Department; and WHEREAS, the community spirit and initiative of the employees of Philip Morris U.S.A. has positively impacted Chesterfield County and the members of the Fire and EMS Department; and WHEREAS, Philip Morris U.S.A., its employees and its dedicated community volunteers organized a tree planting ceremony and provided a recognition plaque for the fire service with the participation of the Chesterfield Boys and Girls Club at Fire Station #15 on October 1, 2002; and WHEREAS, Philip Morris U.S.A. will also plant trees at 12 other fire stations in the county as part of their recognition of the fire service in Chesterfield County; and WHEREAS, Mr. Henry Kidd, a Philip Morris U.S.A. employee, was inspired to create a memorial work of art symbolizing the events of September 11, 2001 and the efforts of fire and police personnel; and WHEREAS, Mr. Kidd presented a copy of his memorial print to Chesterfield Fire and EMS to be displayed at Fire Station 15. Subiect: Public Hearing to Consider a Revision to the Subdivision Ordinance Relative to the Second Access Requirements at the Time of Zoning County Administrator's Comments: County Administrator: Board Action Requested: The Planning Commission and staff recommend the Board of Supervisors approve the amendment to the Subdivision Ordinance relating to second access requirements, as shown in Attachment A. Summary of Information: The new subdivision ordinance, adopted last year, requires a second access to be provided into a new residential subdivision, when more than 50 lots are created (100 lots under certain circumstances). This ordinance was amended at the Board of Supervisor's public hearing at the request of a local land use attorney to allow relief to this requirement at time of zoning Since adoption, a significant number of zoning applications included a request for relief to this standard. Many times, this relief is sought before the developer has completed a detailed engineering analysis of the site. This means the Board of Supervisors must consider the request with minimum detailed information. The Preparer Thomas E. The Planning Commission held a public hearing and recommends approval of an amendment, as shown in Attachment A, to the Subdivision Ordinance to delete the provision that permits relief to the second access through the zoning process for the following reason(s): · The ordinance will still allow relief to the second access at tentative plat review, when sufficient technical information is available; · The technical information to substantiate the need for relief is typically not available at time of zoning; · While participating in the nearly two year effort to revise the Subdivision Ordinance, the development community requested the relief to the access provision as part of the tentative plat process; · There are no standards included in the Subdivision Ordinance to achieve the relief through the zoning process as there are through the tentative subdivision process. The Board conducted a public hearing on the amendment on June 26, 2002, and directed staff to prepare an alternative, which would allow an appeal of the Planning Commission decision to the Board of Supervisors. Staff drafted the language, as shown in AttacP~ent B, which would allow an appeal to the Board of Supervisors if: 1. The Planning Commission's decision will cause emergency services response times to exceed County Fire Department goals, or 2. The Planning Commission's decision will cause traffic volumes on local streets to exceed the Planning Commission's stub road policy. The Board conducted a public hearing on August 20, 2002, and based upon further discussion directed staff to prepare an alternative, which would allow a simpler standard of appeal of the Planning Commission decision to the Board of Supervisors. The Planning Commission revisited the issue at the September 17, 2002 meeting and advises the Board of their support for patterning the appeal decision in the same manner as the Board's review of Substantial Accord decisions.
