PROPOSED LAND USE: An off-site residential community identification sign (Exhibit A) was installed within public right-of--way (the roundabout at Old Hundred Road and Brandermill Parkway) without the requisite zoning approval to replace the original community identification sign removed during reconstruction of the intersection. Modifications to reface the sign are planned to comply with ordinance standards and to offer directions to Clover Hill High School, Swift Creek Middle School, and the Brandermill community. (Exhibit B) PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The ordinance permits residential community identification signs within median strips at each street entrance to the community. As conditioned, the refaced sign (Exhibit B) within the roundabout would be appropriate to replace the community identification signs removed during reconstruction of the intersection. B. As conditioned, the sign will comply with ordinance requirements for residential community identification signs. Providing a FIRST CHOICE community through excellence in public service C. Given the altered traffic patterns with construction of the roundabout and schools locations, the sign will offer a community benefit by directing traffic to public facilities and the Brandermill community. (NOTE: CONDITIONS MAY BE IMPOSED. THE CONDITION NOTED "STAFF/CPC" WAS AGREED UPON BY BOTH STAFF AND THE COMMISSION.) ~n~rnTTTnN (STAFF/CPC) A residential community identification sign shall be permitted within the roundabout of Old Hundred Road and Brandermill Parkway provided such sign is installed as shown on Exhibit B, prepared by Brooks Gray Sign Company and dated September 28, 2012. Within six (6) months of the approval of this request, the Brandermill Community Association shall reface the existing sign (as shown on Exhibit A) to comply with this Condition. The Brandermill Community Association shall be responsible for maintaining the sign in compliance with this Condition. (P) GENERAL INFORMATION T .nrati nn The request property is located within the roundabout at Brandermill Parkway, South Old Hundred Road and Kelly Green Drive. Tax Map 730-682. (VDOT RIGHT-OF-WAY) Existing Zonin R-7 Size: .3 acre Existing Land Use: Vacant/publicrlght-of--way Adjacent Zoning and Land Use: North - A; Church South - R-7; public/semi-public (Swift Creek Middle School) East - R-TH; Vacant West - R-7; Single-family residential (Brandermill community) UTILITIES: ENGINEERING: FIRE AND COUNTY TRANSPORTATION This request will have no impact on these facilities. 2 12SN0194-NOV28-BOS-RPT Vir ing is Department of Transportation VDOT~: VDOT notes that a permit was issued to a responsible party for the sign installation which installation meets all VDOT requirements for such an installation. The section of state code (Section 24VAC-151-580) dealing with non-transportation related elements within the right-of--way states that residential and commercial identification signs that do not interfere with the roadway safety, traffic capacity or maintenance may be authorized with approval of a permit from VDOT. LAND USE Comprehensive Plan: The Comprehensive Plan, designates the north and eastern portions of the request property and properties to the north and east as a Regional Mixed Use Area, where an integrated mixture of highly concentrated corporate office, commercial, light industrial/research and development and higher density residential uses with public spaces would be appropriate. The Plan designates the southern and western portions of the request property and properties to the south and west as a Suburban Residential II area, where residential use at a density of 2.0 to 4.0 dwellings per acre would be appropriate. Area Development Trends: Properties to the north are zoned agriculturally and are occupied by a church use. Properties to the east are zoned Residential Townhome (R-TH) and are vacant. Properties to the south are zoned R-7 and are occupied by public/semi-public use (Swift Creek Middle School) and properties to the west are zoned Residential (R-7) and are occupied by single-family residential use within the Brandermill community. It is anticipated that a mix of residential, public/semi-public, commercial and office uses will continue in the area as suggested by the Plan. Sign Installation/HistorX: A community identification sign for the Brandermill community was eliminated by right-of- way acquisition for the roundabout at Old Hundred Road and Brandermill Parkway. The Brandermill Community Association (BCA) requested permission to locate a community identification sign within the roundabout. The Virginia Department of Transportation (VDOT) supported the concept of a community identification sign within the roundabout and suggested that, if the sign is large enough, it would block the line of site of drivers through the roundabout thereby encouraging drivers to concentrate on navigating the roundabout. County departments discussed the proposal. Staff incorrectly advised the BCA and VDOT that no permit was required by the County since the sign was in public right-of- way. The BCA obtained a permit from VDOT and constructed the existing community identification sign (as shown on Exhibit A) in the roundabout without the requisite zoning approval. 3 12SN0194-NOV28-BOS-RPT Current Proposal: The Zoning Ordinance permits freestanding residential community identification signs where one (1) sign is permitted at each separate street entrance to the residential community. The sign area allowed is twenty (20) square feet for every 200 dwelling units in the residential community with a guaranteed minimum of thirty-two (32) square feet and a maximum area of 100 square feet. Such signs are permitted with a maximum height of fifteen (15) feet outside of village districts. In addition, the ordinance permits residential community identification signs within the median strip of the community's entrance (within the public right-of--way). Approval of this request is sought to permit a community identification sign within the public right-of--way of the roundabout of Old Hundred Road and Brandermill Parkway. Since the roundabout is not a median strip, an exception to this ordinance standard is necessary. Modifications to reface the sign (Exhibit B) are proposed to bring the sign into compliance with the ordinance requirements. Once refaced, the sign will have a sign area of 79.5 square feet (calculated based on the raised copy panels), which is less than the permitted maximum 100 square feet, and a height of 18.6 feet. The ordinance permits architectural elements that enclose the top area of the copy on freestanding signs to exceed the allowable sign height by twenty-five (25) percent which would increase the permitted height of this sign to 18.75 feet. In addition, the refaced sign will identify and offer directions to Clover Hill High School, Swift Creek Middle School, and the Brandermill community. (Condition) CONCLUSION The ordinance permits residential community identification signs within medians. As conditioned, the refaced sign (Exhibit B) within the roundabout would be appropriate to replace the community identification signs removed during reconstruction of the intersection. As conditioned, the sign will be altered to comply with ordinance requirements for residential community identification signs. (Condition) Given the altered traffic pattern resulting from construction of the roundabout and schools locations, the sign will offer a community benefit by directing traffic to public facilities and the Brandermill community. Given these considerations, approval of this request is recommended. 4 12SN0194-NOV28-BOS-RPT CASE HISTORY Planning Commission Meeting (10/16/12): Mr. Kirkland Turner, representative for the Board, accepted the recommendation. The Brandermill Community Association president spoke in support of the request. He said Brandermill made a commitment to maintain the sign landscaping. He stated that despite miscommunication by staff, Brandermill appreciates the County finding an acceptable compromise. Mr. Waller read a statement on behalf of Mr. Gulley who was unable to speak clearly due to an illness. Mr. Gulley's statement recognized that the process was flawed and miscommunications were made; that he appreciated the compromise reached between Brandermill and area residents; and that VDOT representatives stated that the sign would not have a negative impact on safety of the roundabout. On motion of Mr. Waller, seconded by Mr. Patton, the Commission recommended approval subject to the condition on page 2. AYES: Messrs. Gulley, Waller, Brown, Patton and Wallin.
