WHEEE~, by Chapter 36~ of the Acts of of Virginia 19~6, the Board of Supervisors of Chesterfield County Virginia is authorized to adopt regulations to assure the orderly subdivision of land and its development and the harmonious and economic development of the County of Chesterfield, for the co- ordination of streets within subdivisions of land with other existing or planned streets for adequate open spaces for traffic, recreation, light and air and for a distribution of population and traffic which will tend to create conditions favorable to health, safety, convenience and prosperity, and WHE~, notice of intention to adopt such regulations was published once a week for two successive weeks, namely -~~~ ....... , in the Richmond Times-Dis- patch, a newspaper of general circulation in the County of Chestes field by which all persons affected by such regulations were fled to appear on April 13th, 19~8 at l0 o'clock A.M. at the lng ~oom of the Board of Supervisors of Chesterfield County, Vir- ginia at Chesterfield Court House, to present their views in peet thereto; NOW, THEREFORE, Be it ordained by the Board of Supervisors of Chesterfield County, Virginia: L The following regulations are hereby ad0p.~e~d division of land situated within the unincorporated area of Ches- terfield County; and from and after the effective date of this Ordinance, every owner or proprietor of any tract of land to whic~ such regulations apply who subdivide such tract as provided in such regulations shell cause a plat of such subdivision, develope~ and prepared in accordance with such regulations, with references to known or permanent monuments, to be made and recorded in the -2- Office of the Clerk of the Court of the County wherein deeds con- raying such land are required by law to be recorded: Section 1. Definitions - The following words and phrases when used in these regulations shall have the meanings respectively as- cribed to them in this Section, except in those instances where the context clearly indicates a different meaning. (a) "Agent" - The representative duly authorized by the Board of Supervisors to approve the subdivision of land when a proposed subdivision is situated in the unincorporated area of the County, and the City or Town Planning Commission, or its duly authorized representative when a subdivision is situated wholly or partly within the area adjacent to such City or Town whose boundary is fixed by law, or where such subdivision is partly within such City or Town. (b) "Subdivision,, - The division of a lot, tract or parcel of land into three or more lots or other subdivision of laud, for the purpose, whether immediate or fmture, or transfer of ownership or building development, including all changes in street or lot lines, and including any parcel previously separated by the them owner of such tract for such purpose subsequent to the adoption of these regulations; provided, however, the division of land in parcels of one acre or more that does not involve any new public street or easement of access or road shall not be considered a s ubdiv isi on. Section 2. Procedure for the preparation and filing of Plats- (al Whenever a subdivision is proposed to be made and before any sale of said subdivision as. a whole or any part thereof is made, the owner or proprietor of the proposed subdivision, or his duly authorized representative shall file a plat of the proposed subdivision with the agent for approval. The plat and all pro- cedure relating thereto shall in all respects be in ful~l compliant with the provisions of these regulations and all applicable laws and ordinances affecting or regulating the subdivision of land, the use thereof and the erection of buildings or structures therec -3- (b) The owner or proprietor of a proposed subdivision shall cause a preliminary plat to be prepared, accompanied by street profiles when required by the agent, and shall present not less than three prints or copies of each for tentative approval to the agent. (c) The agent shall tentatively approve or disapprove the preliminary subdivision plat and street profile or approve them with modifications, noting thereon any changes that will be re- quired. One copy shall be returned to the owner or proprietor of the subdivision or his representative with the date of said approval or disapproval noted thereon. (d) The agent, in studying the preliminary subdivision plat, shall take into consideration the requirements of the community and the best use of the land being subdivided. ~articular atten- tion shall be given to width, arrangement and location of streets, and alleys or utility easements, drainage, lot sizes and arrange- ment, and other facilities such as parks, playground or school sites, boulevards and main highways. Adequate street connections shall be required by the agent to insure free and safe access to adjoining existing, proposed and possible subdivisions of lands. (e) The owner or proprietor of the subdivision, following the tentative approval of the preliminary subdivision plat and street profile with proposed grades (if required), shall file with the agent within six months five prints on cloth or cloth mounted prints of the final subdivision plat. One copy of street profiles with grades (if required) shall also be file~ with the agent. (f) The final subdivision plat shall be approved by the agent, if found to be in conformity with the requirements of law and these regulations. Such plat shall be filed for recordation in the Clerk's Office in which deeds conveying the land are re- corded within sixty (60) days after final approval thereof, other- wise such approval shall be withdrawn and the plat marked void and ~d to the agent. Section 3. General requirements for subdivision of land: (a) The owner or proprietor of a subdivision shall observe and comply with the following general requirements and principles of land subdivision in preparing the preliminary and final sub- division plat: (1) The plat shall conform to the adopted master plan or one or more parts, sections or divisions thereof of the City, Town or County, as the case may be, if one exists. (2) All streets which are designated as part of the major highway system on such master plan or part, division or section thereof, shall be coordinated with adjoining links in said system and at the same or greater widths. (3) Major highway widths shall confor~ to the widths shown on the major street plan of the City, Town or County, as the case may be, where such plan has been approved by the legislative body of the City, Towh or County, and no street shall have a width of less than 50 feet. The set-back or building line shall conform with the requirements of the zoning ordinance of the City, Town or County, as the case may be, for the district in which the sub- division is located. Where no such set-back or building line re- quirements exist, a minimum set-back of 25 feet shall be required in all cases. Where a street is 50 feet wide, the set-back or building line shall be 30 feet to permit widening of the street. (~) Courts or cul de sacs, where permitted, shall not exceed &00 feet in length and shall not be less than 50 feet wide. All dead-end streets shall terminate in a circular right of way with a minumum diameter of 80 feet. (5) As far as practicable, all proposed streets shall be con- t~nuous and made to connect existing streets without offset. (6) Blocks shall not exceed 1320 feet in length unless per- mitted by the agent. (7! ~.ll lots controlled by these regulations shall front om a public street and shall not extend through to another street. -5- (8) Whenever a proposed street intersects another existing or proposed street so as to form an angle of less than 90 degrees, the angle shall be rounded by a curve of sufficient radius to permit easy turning movements of vehicles. Curb radii at inter- sections shall not be less than 20 feet. (9) Side lot lines in general shall be at right angles or radial to street lines. (10) Reverse frontage of lots at street intersections shall be avoided where possible. (11) Residence lots shall have an average minimum frontage of ~0 feet, average depth of not less than 100 feet, and a minimum area of 5,000 square feet, provided, however, that where the lot area regulations of any zoning ordinance of the City, Town or County, as the case may be, require a larger lot area, then the requirements of such zoning ordinance shall govern. (12) Corner lots shall have a minimum width to provide 15 feet of side yard along the side street in case no lots within the bloc~ are arranged to front thereon, or a side yard having a minimum width of 25 feet if the side street is used for frontage, provided however, where zoning control is in effect the greatest width pro- vided in the zoning ordinance of the City, Town or County, as the case may be, shall govern. (13) Grades: major streets shall, insofar as possible, con- form to the contours to avoid grades in excess of 3 per cent, un- less because of special conditions, the agent permits otherwise. Minor streets and alleys shall avoid grades in excess of 10 per cent. No streets shall have a minimum grade of less than 0.4 per cent. (1~) Alleys with a minimum width of 20 feet shall be provided at the rear of all lots designated for business or industrial use. Alleys, when provided in the rear of residential lots, shall not be less than 16 feet and may. be required by the agent when the lot is less than 75 feet wide. Easements at least 8 feet wide, ~ feet -6- on each side of the rear or side lot line, shall be provided for utilities and drainage where necessary. (15) No land shall be subdivided for residential use if such land is considered unsuitable for building purposes by the agent. (16) Monuments of an approved type shall be set by the owner or proprietor of the subdivision as required by the agent and aS shown on the final plat. (17) Reserved strips restricting access to streets or alleys will not be permitted. (18) Where practicable the center line of all intersecting streets shall meet in a common point and shall intersect one another as near to a right angle as is practicable in each case. (19) No existing local street names or subdivision names shal be duplicated. (b) A variation of the requirements of this section may be permitted when, in the opinion of the agent, topography or other special or unusual conditions necessitate such variation. section 4. The preliminary plan. (a) The subdivider shall present to the agent not less than three copies of the preliminary plan, preferably st a scale of one inch equals one hundred feet, showing the following: (1) Subdivision n~me. (2) Name and address of the recorded owner of the land pro- posed to be subdivided and the owner or proprietor of the sub- division, and the surveyor. (3) The location, width and name of all existing or platted streets or other public ways within or adjacent to the subdivision. existing permanent buildings, railroad rights of way and other im~ portent features. (4) Location and names of adjoining subdivisions and names of the owners of adjoining acreage. (5) Profile of each street with tentative grades, if required by the agent. -7- (9) All parcels of land to be dedicated for public use. Width and location of all building~ lines and easements. Lot lines with approximate dimensions. Proposed method of water supply smd sewage disposal. (10) Proposed use of the property proposed to be subdivided. (ll) Topographic map at a suitable scale and contour int when required by the agent. (12) Date and north point (true meridian where practicable) and scale. (b) The preliminary plat shall be approved or disapproved, or approved with modification within thirty days after the date it is presented to the agent. Unless a final plan is filed with the agent within six months after the approval of the preliminary plat, the approval of the preliminary plat shall be deemed cancelled and void. Section 5. The Final Subdivision Plat. (a) The final subdivision plat shall be clearly and legibly drawn in black India ink. The size of the sheet shall be 16 inc by 2~ inches, including a margin of one-half inch outside ruled border line a~ bottom and right side, and l-l/2 inches for bind- ing on the left 16 inch end and at the top of the sheet. The drawing shall be to a scale of i inch equals 100 feet unless othe~ wise authorized by the agent. If any part of the property is ad- Jacent to the corporate limits of any city or town and within the area whose boundaries are prescribed by law, five prints on cloth or cloth mounted prints shall be furnished to t~he agem~ of ~e cl or town. After approval by the agent of the city or town, two prints will be returned to the owner or proprietor of the subdiwi. sion for submission to the agent of the county for approval, one which shall be for recordation and the other for the County's re- cords. When more than oSe sheet is necessary, an index sheet of the same size may be required by the agent, showing the entire subdivision. A vicinity sketch of the area in the vicinity of the subdivision on a small scale may also be required by the agent. (b) In addition to the requirements for the preliminary plat the final plat shall show: (1) Sufficient data to readily determine the location, bear- ing and length of every street line, lot line, block line, and boundary line and to reproduce the same on the ground from per- manent monuments. Linear dimensions shall be in feet and deci- mals. All dimensions, both linear and angular shall be determined by an accurate controlled survey, which must close and balance within a limit of one foot in ten thousand (lO,000) feet. Accurate co-ordinates of selected and monumented points referenced to the city geodetic system may be required by the agent in location where the geodetic control has been completed. (2) The length of the radii, arcs and central angles of street curves. (3) Lots numbered in numerical order. In tracts containing more th~n one block, the blocks shall be lettered in alphabetical order. In case there is a re-subdivision of lots in any block, such re-subdivided lots shall be numbered numerically, beginning with the number following the highest lot n~mber in the block. (4) Permanent reference monuments prescribed by the agent shall be placed as required by the agent. Such permanent monu- ments shall be of stone or concrete at least 24 inches long and 6 inches square, with a cast iron corner and shall be set to ap- proved finished grades where practicable. (5) All bearings are to be referred to the true meridian where geodetic control has been completed. Where the magnetic meridian is used, the declination shall be stated. (6) The names of all streets and the name of the subdivision, the north point, scale and date. (7) The final subdivision plat shall also contain a state- ment to the effect that the subdivision (insert a correct descrip- tion of the land subdivided) as appears on the plat is with the free consent and in accordance with the desire of the owners or "9- or proprietors of the land subdivided and the trustees in any deed of trust, mortgage or other instrumentality imposing a lien upon said land, if any, which shall be signed by such owners, proprie- tors and trustees and shall be duly acknowledged before some offic. authorized to take acknowledgments of deeds. Section 6. Preparation of Final Subdivision Plat. Every final subdivision plat shall be prepared by a surveyor or civil engineer duly licensed by the Commonwealth of Virginia, who shall endorse upon each such plat a certificate signed by him setting forth the source of title of the owner of the la~d sub- divided and the place of record of the last instrument in the cha~ of title. When the plat is of land acquired from more than one source of title, the outlines of the several tracts shall be in- dicated upon such plat. Section 7. Rec~ordation of Final Subdivision Plat. (a) When a final subdivision plat has been approved, execut- ed and acknowledged as provided in these regulations, it shall be recorded in the office of the Clerk of the Court in Whose office deeds conveying the land contained in the plat are required by to be recorded, and shall be indexed under the names of the ownersl of the land and under the name of the subdivision. (b) No final plat of a subdivision shall be recorded unless and until it shall have been submitted to and approved' by the a. and no Clerk of a Court shall file or record a plat of a subdivis until such plat has been approved by the agent. II. On or before the day of the beginning of publication of notice that it is the intention of the ~oard of Supervisors of Chesterfield County, Virginia to consider this ordinance for adopt ion, ~the Executive Secretary of said Board shall transmit by reg- istered mail a copy of this proposed ordinance to the City Council of the cities of Richmond, Petersburg and Hopewell and the Town Council of the Town of Colonial Heights for their information and consideration, which shall constitute notice to the governing bodies of each such municipal~ corporation of the intention of the said Board to adopt the regulations contained in the proposed -10- And a request of such bodies to review and approve or disapprove oS such regulations as they relate to the subdivision of land adjoin- ing the respective municipalities and within the area the bo~ndariE of which are prescribed by law. The Executive Secretary of ~he Board of Supervisors at the time of so mailing a copy of the pro- posed ordinance to the respective municipalities shall attach to said copies notice in writing of the place and time fixed for the consideration of the proposed ordinance by said Board. The said Executive Secretary shall obtain a receipt from the Post Office Department showing delivery of the copies of the proposed ordinanc. and notice, which he shall preserve among the records of his offic. III. Within five days after this ordinance becomes effective the said Executive Secretary shall file a certified copy thereof with the Planning Commission of the several municipalities adjoin- ing the County of Chesterfield, if any, otherwise, with the mmuic: pal council and in the Clerk's Office of the Circuit Court of the County of Chesterfield, Virginia. IV. This ordinance shall be in force from its passsge. Board of Supervisors Chesterfield Court House, Virginia Dear Sir: On Tuesday night, April 6, at the regular meeting of the ~anchester Citizen's League, the dangerous conditioh now existing at the Atlantic Coast Line Railway crossing on the Warwick Road near Stop 15, was brought to the attention of the group. The rail- road company recently raised the track again and have not provided a sufficient approach. They also made the crossing too narrow for night driving. Several times in the past few weeks cars have driven over the edge of crossing boards and have had to go to the block signal station to have trains stopped until tracks could be cleared of automobiles, Notion was made and passed by the ~anchester Citizen,s League that this fact be presented to the Board of Supervisors, requesting them to take such action as necessary to eliminate this unsafe con- dition. There was also a request:fo?improvement of the general con- dition of this road - the Warwick Road leading through Ampthill Heights to Stop 15 on the Petersburg Pike. REPORT OF THE C~TERFIELD DEPARTMENT OF AGRICULTURE FOR THE MONTH OF March, 1948 The County PMA Committeemen, Mr. E.A. Moseley; Joseph Darling and George McKesson and the County Agent exofficio member, met with the Commur~ity Committeemen from each magisterial district to make allotments under the PNA to each farmer participat- ing, where-by lime; phosphate; crimson clover and ryegrass seed may be purchased. The Rat Campaign, sponsored by the Agricultural Committee of the Bermuda Ruritan Club, of which the Assistant County Agent is Chairman, has created a g~sat deal of interest. This committee reports progress although difficulty has been encountered in getting the poison. During the warm weather the 4H elub calves were ~ehorned. The Pure Bred Guernsey Breeders of Chesterfield, sith the County Agent' attended the State Guernsey meeti~ --~,Assion the Association recommended the dehorning of Dairy Calves Pruning and Poultry culling~ has been timely subjects and demonstrations in different sections of the county have been held.Approximately 2300 chickens were culled. The Soil Conservation office have had au increase in request for farm plans, with special interest in clearing of land and building ponds. Mr. MOser of Henrico is assisting in this work in this county. It is hoped that we will have a full time man before too long. The CoUnty Agent held a meeti~g on Weed control at the Richmond Hotel, March 12th. and a movie of the effect of 2-4D on weeds and crops was shown. Much interest was manifested and the Agent was requested to arrange for a field demonstration some time in the future, when the equipment could be secured. The County Agent attended a forestry demonstration in North Caroiina with county agents and E~tension specialists from Southside Virginia. With 2/3 of the county weeds~ this work is ~ach meeded in Chesterfield. Spray calendars suitable for home orchards and vineyards to suit three(3) and(12~ twelve gallon sprayers have been prepared and distributed. Many request have been made for this calendar. Ladion c~o~er seeding for pastures and individual farm planni_ng have been near the top in request for the month. Miniborya and Meadowbrook farms know the value of~ good pastures and have fertilized at the rate of 800 to 1000 lbs per acre this year. Hybrid corn No. 357will lead in popularity this year. Many farmers expect to plant and fertilize as recommended for members of 100 bushel per acre Club. Agent CHESTERFIELD WELFARE DEPART~ENT REPORT TO BOARD OF SUPERVISORS MAP~ 1948 The Chesterfield Welfare Department is controlled by a Board appointed by the Judge of the CircuSt Court. This Board is composed of three men namely: Nr. E. Bruce Fergusson of Chester, Chairman; Mr. T. D. Watkins of Midlothian,Vice-chairman and Mr. P. W. Covington of RFD. 3, Petersburg. The staff is directly supervised by the local Superintendent who is in turn supervised by a Field Representative from the State Department of Public Welfare. There a~three social workers employed to investigate the cases. The child welfare worker handles all of the children's cases in the county. Her case load varies but averages around fifty children per month. The county is divided into two sec- tions and a social worker is assigned to each section carrying a case load of 100 each, including financial assistance and services. The cler- ical staff is composed of an office assistant and a stenographer. The vari~u$ies of each member of the staff will be discussed in the ~e~ issue and the issues to fol~will be information on categorical assis- tances and services . H, Branch, presiding and with 40 persons in attenlance to discuss progress made during the year of 19~7, to re-elect officers,and to m~e plans for 1948. Reports of receipts and expenses were submitted by the Secretar~ and Treasurer to the officers and members of the ~sso~- cdation. The Association's net receipts for the year was $1.OP. The Fair budget for the year was prepared by a committee previous to this meeting, was submitted by the Secretary to the association for approvial. These reports were discussed and adopted by the association. Farm men and women and ~-H boys and girls of the county ~. ~ ~ are receiving helpful information through visual aid as a result of cooperative purchasing a Sound picture projector by the County advisory board,the farm co~.unity clubs,the Junior council and the 4-H clubs. These pictures are givingnew interest~ to the Extension program, Completed club enrollment consisting of 135 boys and 150 girls for the yea~ Mailed this enrollment to the District office. Attended the Southside Soil Conservation district demonstration held on the Poythress farm, ~ecklinburg county, ~here new practices on a 105 acre farm were being changed. Practices applied: preparing,liming, fertilizering, seeding,fencing etc. fpr p~stures. Eeadow stripping,terri- cing, row layout,Strip cropping,liming etc for crop land. Constructed a one acre fish pond for family needs. Took two Chesterfield farmers to see these practices put in operation. Treated 13 hogs for 6 farmersin three different, communities.
