Dear Honorable Members of the Board of Supervisors:
The Multicultural Advisory Commission was created and appointed by the Chesterfield County Board of
Supervisors in December 2008. The Commission was established to develop a better understanding
across Chesterfield's richly diverse cultures through assessment, dialogue and education about
multicultural issues. The Multicultural Advisory Commission collects, explores and analyzes data and
seeks input from representatives of various cultures and prepares recommendations to the Board of
Supervisors for improving, creating or revising policies and practices in the county government that will
positively impact multicultural communities. The Commission affirms Chesterfield County's commitment
to be a welcoming community that recognizes that diversity is one of its greatest strengths enabling it to
continue to attract and retain people of all cultures.
This annual report is presented to the Board of Supervisors to show the accomplishments of the
Multicultural Advisory Commission for calendar year 2012. The Commission and four subcommittees
have met throughout the year working on restructuring the mission, vision and goals of the Commission
and developing a strategic planning document for guidance. The following are the Commission's
highlights:
Accomplishments/Hi_ghli_phts
• The Multicultural Advisory Commission had five new members appointed by the Board of
Supervisors in 2012: Victor Branch, Malik Kahn, Minesh Patel, Ben Romer and Millard Stith.
• The Commission held a retreat May 3, 2012 for all members to discuss the goals, objectives and
work plan for the year.
• Commission chair and vice chair met with the Board of Supervisors and County Administrator to
discuss the Commission work plan for the year.
• The Commission has four engaged subcommittees: Education, Health, Housing and
Workforce/Business Development that met regularly throughout the year. Each of these
committees expanded their team to include internal and external partners (i.e. county and school
staff, corporate, education and community organizations).
• The Commission met with Dr. Jimmy Powell, Learning Consultant, Chesterfield University, and
worked extensively on developing a two year strategic planning document.

• The Commission held a Community Dialogue session on November 15, 2012 at Elkhardt Baptist
Church. The session was designed to meet with community leaders and representatives from
various organizations for an open dialogue discussion on experiences in the county and region in
areas such as housing, education, quality of life, business and economic development.
Key Initiatives/Priorities:
To establish the Multicultural Advisory Commission as the mechanism to address broad
interrelated community issues, open lines of communication and increase interaction between
multicultural communities and all Chesterfield communities.
2. To connect, collaborate and create increased opportunities to advance the quality of life within the
multicultural communities of Chesterfield and the region through the identification of best practices
and economic development strategies in health, housing, business and education.
3. To conduct a community assessment to identify the capabilities, strengths, resources and needs
of the various cultural/ethnic communities in Chesterfield County.
4. To increase economic development for small family businesses,and tourism through the creation
of an annual international festival and expanded farmers market activities.
Next Steps:
• Approval of the strategic planning direction 2013-2014 by the Board of Supervisors.
• Confirmation of Commission appointment terms for 2013-2014.
• Continuation of and the appointment of new Commission members.
• Establish a schedule to meet with individual Board of Supervisors bi-annually.

During the growing season of 2012, Providence United Methodist Church's
Missions Garden provided large amounts of fresh produce with weekly
deliveries to help feed the men living at the Good Samaritan Shelter while
recovering from addictions.

RECOGNIZING PROVIDENCE UNITED METHODIST CHURCH'S MISSION GARDEN
WHEREAS, On August 1, 1807, two acres of land in Chesterfield
County, Virginia, along with a small log cabin on the site, were deeded
to the Methodist Society by John J. Kleinhoff and his wife, Sarah; and
WHEREAS, Sarah Kleinhoff transferred another acre of land to the
trustees of Providence Church on January 2, 1813, adding to the site,
which by now included a building that had been erected since 1807; and
WHEREAS, over the years, more land was deeded by several other
individuals and families, and new construction was completed at the
Providence United Methodist Church site; and
WHEREAS, the church's outreach programs, like its physical site,
have grown throughout the years since the church's founding; and
WHEREAS, the church's Missions Garden is helping to feed men
residing at the Good Samaritan Shelter; and
WHEREAS, these men are receiving shelter and employment from Good
Samaritan while recovering from addictions; and
WHEREAS, Mr. Joe Gillette, Mr. Paul Martin and Mr. Morris Knight
oversee most of the work in the church's garden; and
WHEREAS, this year, Providence United Methodist Church's Missions
Garden produced 150 pounds of squash, 150 pounds of cucumbers, 100
pounds of potatoes, 125 ears of corn, 70 pounds of string beans and 8
pounds of radishes; and
WHEREAS, during the growing season, the Missions Garden provided
regular deliveries of fresh produce to the shelter to help feed the
residents there; and
WHEREAS, Chesterfield County values the many civic contributions
that churches such as Providence United Methodist Church make to quality
of life for all residents of Chesterfield County.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 12th day of December 2012, on behalf of all
Chesterfield County residents, extends appreciation and best wishes to
the congregation of Providence United Methodist Church for its Missions
Garden outreach program.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be
provided to Mr. Joe Gillette, Mr. Paul Martin and Mr. Morris Knight, and
that this resolution be permanently recorded among the papers of this
Board of Supervisors of Chesterfield County, Virginia.

Representative; and Mr. Vincent Burgess, Member-At-Large, Clover Hill
District. Each of these candidates has specific expertise and experience

Summary of Information:
The purpose of the Community Policy and Management Team (Code of Virginia ~
2.2-5204 and ~ 2.2-5205), is to implement the requirements of the
Comprehensive Services Act, including the expenditure of funds appropriated
by the localities and allocated by the State. The governing body of each
jurisdiction must appoint a CPMT.
Minimum mandatory membership of each CPMT includes local agency heads or their
designees from the Community Services Board, Department of Social Services,
Juvenile Court Service Unit and school division. Additional members include
a parent representative and private provider representative, if a private
organization or an association of providers is located within the locality.

RECOGNIZING DEPUTY FIRE MARSHAL FRANCIS J. KINNIER, JR.
UPON HIS RETIREMENT
WHEREAS, Deputy Fire Marshal Francis J. Kinnier, Jr. retired from
Chesterfield Fire and Emergency Medical Services Department, Chesterfield
County, on December 1, 2012; and
WHEREAS, Deputy Fire Marshal Kinnier began his service with Chesterfield
County in June 1984 as a Plans Review Technician in the Fire Prevention
Bureau of the Chesterfield Fire Department; and
WHEREAS, Deputy Fire Marshal Kinnier has positively impacted fire safety
for the residents and visitors of Chesterfield County by his early efforts at
requiring fire sprinklers in multi-family housing; and
WHEREAS, Deputy Fire Marshal Kinnier served as a dedicated member of the
county's Site Plan Team; and
WHEREAS, Deputy Fire Marshal Kinnier has been a leader in the fire code
and plans review community with his service representing Chesterfield County
on the National Certification Program for Construction Code Inspectors that
develops testing examinations for fire protection plans examiners and fire
protection specialists; and
WHEREAS, Deputy Fire Marshal Kinnier served as a member of the Board of
Directors for the Safe Building Correlating Council to improve building
construction as a result of the September 11, 2001, attacks on the World
Trade Center towers; and
WHEREAS, Deputy Fire Marshal Kinnier served on the Environmental
Protection Agency's Congress for New Urbanism Smart Growth and Emergency
Response Advisory Committee that developed recommendations for fire
protection features in non-traditional urban developments; and
WHEREAS, Deputy Fire Marshal Kinnier developed and managed two projects
that received National Association of Counties Awards in 2005 and 2007; and
WHEREAS, Deputy Fire Marshal Kinnier served as a minimum staffing
firefighter/Emergency Medical Technician for Chesterfield Fire and Emergency
Medical Services between 1986 and 1991.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the contributions of Deputy Fire Marshal Francis J.
Kinnier, Jr., expresses the appreciation of all residents for his service to

RECOGNIZING MRS. JULIA A. WALLENBERG UPON HER RETIREMENT
WHEREAS, in October 1996, Mrs. Julia A. Wallenberg joined the Chesterfield
County Sheriff's Office as a part-time Senior Office Assistant and faithfully served
Sheriff Clarence G. Williams, Jr. and current Sheriff, Dennis S. Proffitt; and
WHEREAS, in December 1997, Mrs. Wallenberg was promoted to full-time status by
virtue of her strong job performance; and
WHEREAS, Mrs. Wallenberg was selected as Employee of the Quarter in October
1998 and March 2000; and
WHEREAS, Mrs. Wallenberg was selected as Sheriff's Office Employee of the Year
for 2000; and
WHEREAS, in July 2000, the state Compensation Board created a new position for
every Sheriff's Office operating a jail facility dedicated to management of the Local
Inmate Data System, LIDS; and
WHEREAS, in August 2000, Mrs. Wallenberg was promoted to LIDS Technician, where
she worked until retirement utilizing her knowledge, skills and abilities to ensure
the proper classification of inmates entrusted to the Sheriff's custody; and
WHEREAS, Mrs. Wallenberg's superior job performance led to the Classification
Unit receiving five consecutive "exceptional" ratings as part of regular state
Compensation Board LIDS audits; and
WHEREAS, due to Mrs. Wallenberg's expertise, LIDS technicians from throughout
the state were sent to train with her; and
WHEREAS, Mrs. Wallenberg received numerous letters of commendation and
appreciation in recognition of her job performance.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the outstanding contributions of Mrs. Julia A. Wallenberg,

RECOGNIZING LIEUTENANT COLONEL BARRY N. WOODY UPON HIS RETIREMENT
WHEREAS, Mr. Barry N. Woody began his public safety career in 1969,
serving both the Richmond City Bureau of Police and the Richmond City
Sheriff's Office; and
WHEREAS, in April 1991, Mr. Woody accepted an opportunity to advance his
public safety career by joining the Chesterfield County Sheriff's Office as a
Sergeant; and
WHEREAS, Mr. Woody faithfully served under past Sheriff Clarence G.
Williams, Jr. and current Sheriff Dennis S. Proffitt; and
WHEREAS, Sergeant Woody initiated the first Internal Affairs Unit in the
Chesterfield County Sheriff's Office for handling investigations and
complaints; and
WHEREAS, in December 1992, Sergeant Woody was promoted to Lieutenant
assigned to the Internal Affairs Unit; and
WHEREAS, Lieutenant Woody initiated the first Capias letter mailing
program to notify wanted individuals about turning themselves in, resulting in
monetary savings for the county as well as increases in the number of cleared
Capias papers; and
WHEREAS, in December 1993, Lieutenant Woody was promoted to Major and
assigned as the Jail Administrator; and
WHEREAS, Major Woody has demonstrated his commitment to the progress of
the criminal justice system in Chesterfield County by participating on the
Chesterfield/Colonial Heights Community Criminal Justice Board during the
creation and implementation of various initiatives such as the Day Reporting
Center, Adult/Juvenile Drug Court, Video Arraignment, opening of the new
Juvenile and Domestic Relations Courthouse and the Fatality Review Committee;
and
WHEREAS, in July 2007, Major Woody was promoted to Chief Deputy and was
assigned to the Operation Division overseeing jail and courts operations; and
WHEREAS, in November 2008, Chief Deputy Woody was promoted to Lieutenant
Colonel assigned to Operations; and
WHEREAS, Lieutenant Colonel Woody has been assigned to all Sheriff's
Office command positions during his twenty-one years of service, including
Jail Administrator, Courts Commander and Support Services Commander.

RECOGNIZING LIEUTENANT CAROL A. WOODY UPON HER RETIREMENT
WHEREAS, on October 24, 1994, Mrs. Carol A. Woody joined the Chesterfield
County Sheriff's Office as a deputy and faithfully served former Sheriff Clarence
G. Williams, Jr. and current Sheriff, Dennis S. Proffitt; and
WHEREAS, Deputy Woody received "Commendable Achievement" recognition for job
performance while a deputy assigned to the jail evening shift; and
WHEREAS, Deputy Woody was promoted to Sergeant and assigned to Circuit Court
Security on August 3, 1996, becoming the first female Sergeant assigned to court
security in the history of the Chesterfield Sheriff's Office; and
WHEREAS, Sergeant Woody received a commendation for job performance in
organizing and supervising operations for multiple sequestered juries and for
developing forms and procedures for handling sequestered juries; and
WHEREAS, Sergeant Woody was promoted to Lieutenant on August 6, 1998, and
assigned to Support Services as Human Resource Officer for the Sheriff's Office;
and
WHEREAS, Lieutenant Woody was the first female lieutenant in the history of
the Chesterfield Sheriff's Office; and
WHEREAS, Lieutenant Woody was the first lieutenant assigned to the newly
constructed and opened Juvenile Domestic Relations Courthouse in May 2000; and
WHEREAS, Lieutenant Woody received commendation for job performance for
ensuring an orderly transition into the new Juvenile and Domestic Relations
Courthouse, to include establishing standard operating procedures for court
security, inmate holding and inmate transportation; and
WHEREAS, Lieutenant Woody is a Charter Member of Chesterfield County's
"First Choice" Toastmasters chapter; and
WHEREAS, Lieutenant Woody led efforts to ensure the safety and security of
Chesterfield County citizens and employees by developing building evacuation maps
for both Courthouse facilities; and
WHEREAS, through the years, Lieutenant Woody has supported Chesterfield
County, the Sheriff's Office and county citizens through participation in numerous
committees such as the Jail Ways and Means Committee, Shop With A Cop, Special
Olympics, Inmate Outreach, Model County Government Day, Shop Talk Newsletter
Committee, MS Challenge, Heart Walk and the Fatality Review Committee.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of

RECOGNIZING MS. DOROTHY CLINKSCALES UPON HER RETIREMENT
WHEREAS, Ms. Dorothy Clinkscales will retire on December 31, 2012,
after providing more than 23 years of dedicated and faithful service to
the citizens of Chesterfield County; and
WHEREAS, Ms. Clinkscales began her career with the Chesterfield
County Department of Mental Health Support Services in the Residential
Services Division on November 19, 1989, as a Residential Supervisor; and
WHEREAS, in 1998, Ms. Clinkscales was integral in developing a center
based Day Support Service, where she served as Services Supervisor from
1998 until her retirement; and
WHEREAS, Ms. Clinkscales served as a member of the Supervisory
Leadership Team for Services Supervisors and was a member of many of the
work teams within Intellectual Disabilities Day Support Services and
Mental Health Support Services, including the Red Cross and American Heart
instructors team, and the Day Support Health and Safety Committee; and
WHEREAS, Ms. Clinkscales was directly responsible for accountability
in the billing of services, and the oversight of clinical documentation of
services for the program; and
WHEREAS, Ms. Clinkscales directly provided supervisory and leadership
to the Program Supervisors and the Consumer Service Representatives staff
for Day Support Services; and
WHEREAS, through her professional leadership, Ms. Clinkscales was
responsible for numerous Day Support personnel being professionally
trained in the clinical aspects of treatment planning, programming,
documentation of services, and quality care for consumers with
intellectual disabilities; and
WHEREAS, Ms. Clinkscales collaborated with Program Supervisors to
ensure that staff shortages were covered and training needs met; and
WHEREAS, Ms. Clinkscales served on the Parent Quality Council for Day
Support; and
WHEREAS, Ms. Clinkscales served on the Inter-agency Risk Management
Committee, and was an active member of the Richmond Wide-Day Focus
Committee, as well as the Logisticare Council; and
WHEREAS, Ms. Clinkscales was an integral member of the work team that
was the recipient of the National Association of Counties Achievement
Award in 2001 for the Best Choice Program in Program Design; and
WHEREAS, Ms. Clinkscales was a major contributor to the curriculum
planning and development team for the promotion of the Winchester Green
site in 2006; and
WHEREAS, Ms. Clinkscales was the recipient of three county
certificates of achievement, including the Quality Generalist, Quality
Specialist, and Quality Manager, and she is also the proud graduate of the
county's Total Quality Improvement certificate and credentialing from the
Chesterfield University Center for Organizational Excellence; and
WHEREAS, Ms. Clinkscales performed as an internal program trainer for
Direct Support Professionals, and implemented an Internal Audit Review
process for the Day Program; and
WHEREAS, Ms. Clinkscales achieved the status of a CARF Accredited
auditor in 2009; and
WHEREAS, Ms. Clinkscales successfully wrote and was awarded four
grants for vehicles for the Day Support Program through the Department of
Rail and Public Transportation to aid in safe and accommodating
transportation for individuals served; and
WHEREAS, Ms. Clinkscales coordinated the effort for several provider
fairs for the Day Support services; and
WHEREAS, in completion of her services with Chesterfield Mental
Health Support Services, Ms. Clinkscales had dedicated a total of 38 years
of employment in the Commonwealth of Virginia to serving the needs of
individuals with intellectual disabilities.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of

RECOGNIZING SERGEANT WILLIAM H. MORGAN UPON HIS RETIREMENT
WHEREAS, Sergeant William H. Morgan will retire from the Chesterfield
County Police Department on January 1, 2013, after providing more than 27
years of dedicated and professional service to the citizens of Chesterfield
County; and
WHEREAS, Sergeant Morgan has faithfully served the county in the
capacity of Patrol Officer, Detective, Detective First Class, Senior Police
Officer and Sergeant; and
WHEREAS, during his tenure, Sergeant Morgan has served as a Field
Training Officer, Evidence Technician, Alcohol Breathalyzer Operator, Marine
Patrol Officer, High Intensity Patrol Unit member, Peer Counselor,
Administrative Sergeant, FTO Sergeant and Training Sergeant; and
WHEREAS, Sergeant Morgan was the recipient of a Life Saving Award for
his actions in February 2000, performing chest compressions for an extended
period of time on a person who was not breathing and had no pulse; due to his
efforts, paramedics were able to concentrate on the procedures needed to give
the patient the best chance of survival, and Sergeant Morgan is credited with
making it possible for the patient to survive; and
WHEREAS, Sergeant Morgan participated as a supervisor and as a team
member in numerous drug surveillances and the execution of search warrants,
leading to the seizure of drugs, thousands of dollars, and the arrest of
subjects involved in the distribution of illegal drugs in Chesterfield County
and surrounding jurisdictions; and
WHEREAS, Sergeant Morgan received a Unit Citation Award while serving as
supervisor for the Vice and Narcotics Unit for conducting a large drug
investigation during 2003, and the Unit worked with Circuit Court Judges and
Commonwealth's Attorneys to conduct numerous arrests, resulting in one of the
largest methamphetamine seizures in the history of the Chesterfield County
Police Department; and
WHEREAS, Sergeant Morgan was commended for his actions in the
apprehension of a homicide suspect wanted by the Richmond Police Department;
once notified that the two suspects were last seen running toward
Chesterfield, Officer Morgan and his fellow officer conducted an extensive
search on foot, questioned citizens and obtained information about the
possible identity and last known location on one of the suspects, and
Officer Morgan was able to track the suspect's footprints at the location and
found him hiding in bushes; due to Officer Morgan's professionalism and
dedication, the suspect was arrested, turned over to the Richmond Detectives
and subsequently charged with the homicide; and
WHEREAS, Sergeant Morgan was recognized for his outstanding efforts in
coordinating the successful "Operation Rock Slide" undercover operation,
resulting in the seizure of illegal narcotics and assets for forfeiture and
123 criminal indictments on 32 individuals; and

WHEREAS, Sergeant Morgan is recognized for his professional attitude,
teamwork, and communications and human relations skills, which he has
utilized within the Police Department and in assisting citizens of
Chesterfield County; and
WHEREAS, Sergeant Morgan has received numerous letters of commendation,
thanks and appreciation during his career from the citizens of Chesterfield
County for service rendered; and
WHEREAS, Sergeant Morgan has provided the Chesterfield County Police
Department with many years of loyal and dedicated service and consistently
served as an outstanding role model during his career; and
WHEREAS, Chesterfield County and the Board of Supervisors will miss
Sergeant Morgan's diligent service.

Set a public hearing for January 9, 2013 to consider amendments to Chapter
19, and adoption of a policy regulating alternative financial institutions.
Summary of Information:
On November 15, 2012 the Planning Commission voted 5-0 to recommend approval
of zoning ordinance amendments and a new policy regulating alternative
financial institutions (AFIs) These businesses include: check cashing
establishments; motor vehicle title lenders, pawnbrokers, payday lenders, and
precious metals dealers.
Proposed Ordinance: The proposed ordinance would: 1) define AFIs; 2) list
AFIs as conditional uses in C-5 zoning districts; and 3) list consumer
finance companies as conditional uses in C-5 zoning districts. These changes
recognize AFIs as intensive land uses that warrant careful zoning review. The
code currently uses this approach for check cashing establishments and
pawnbrokers. The proposed code amendment would extend this approach to motor
vehicle title lenders, payday lenders, and precious metals dealers. The
inclusion of consumer finance establishments as a conditional use in C-5
districts is necessary since the existing code does not enumerate this use.

Proposed Policy: The proposed policy would provide guidance for evaluating
zoning applications for AFIs. This approach is similar to how the county
addresses certain intensive land uses (such as communication towers). The
policy would not apply to consumer finance establishments. The proposed
policy addresses the following concerns:
1) Co-Location: Only one type of AFI could be located in a single building.
However, payday lenders could offer check cashing services.
2) Comprehensive Plan Designation: AFIs would be limited to areas planned for
intensive commercial development.
3) Distance Separation: AFIs would need to be located at least one mile apart,
to encourage de-concentration of such uses.
4) Proximity to Residential Areas: AFIs could not be located next to
residential uses, to encourage adequate separation.
5) Revitalization Areas: AFIs could not be located in revitalization areas.
6) Signage: AFI signs would need to conform to sign packages in shopping
centers, and could not display neon window signs (except "open" for
business signs) .
In order to address community concerns received through the public hearing
process, the Commission adjusted the draft policy to include the co-location
restrictions and distance separation standards summarized above.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTIONS 19-175 AND 19-301 RELATING TO
ALTERNATIVE FINANCIAL INSTITUTIONS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:

DIVISION 22. C-5 GENERAL BUSINESS DISTRICT

Sec. 19-175. Conditional uses.
The following uses may be allowed by conditional use in the C-5 District, subject to the
provisions of section 19-13:
(a) Any conditional use allowed in the C-3 District, unless previously permitted in
the C-5 District.
(b) Adult businesses.
(c) ~~rAlternative financial institution.

~ Consumer finance companies.

(i) Travel trailer parks.
(j) Subject to the following requirements, other uses which are not specifically
enumerated in this chapter and which are of the same general character as the
specifically enumerated uses allowed in this district. Before the planning
commission and board of supervisors hear an application pursuant to this

subsection, the director of planning shall consider, among other things, the
following: the size and proposed configuration of the site; the size, height and
exterior architectural appearance of any proposed structure or structures; noise;
light; glare; odors; dust; outdoor activities; traffic; parking; signage; and hours of
operation. Based on these considerations, he shall determine that the proposed
use's operating characteristics are substantially similar to, and its impact on
neighboring properties no greater than, the operating characteristics and impacts
of the specifically enumerated uses allowed in this district.

ARTICLE VI. DEFINITIONS
Sec. 19-301. Definitions.
For the purposes of this chapter, the following words and phrases shall have the
following meanings:
Alternative financial institution: Any check cashing establishment, motor vehicle title
lender pawnbroker, payday lender, or precious metals dealer, as defined in this chapter.

Consumer fiance company: Any establishment, other than a bank, credit union, or
savings and loan, engaged in the business of making loans to individuals for personal, family
household, or other nonbusiness purposes.

Motor vehicle title lender: Any establishment engaged in the business of lending money
secured by anon-purchase interest in a motor vehicle.

Payday lender: Any establishment, other than a bank, credit union, or savings and loan,
engaged in the business of making short-maturity loans on the security of (i) a check, (ii) any
form of assignment of an interest in the account of an individual at a depository institution, or
(iii any form of assignment of income payable to an individual, other than loans based on
income tax refunds.

Precious metals dealer: Any~erson or establishment defined as a dealer in County Code
~ 15-131 that is not accessory to a jewelry or coin store.

DRAFT: ALTERNATIVE FINANCIAL INSTITUTION POLICY
Planning Commission and Board of Supervisors Zoning Guidance
(NOTE: The following general guidelines will be used for evaluation of zoning applications for
alternative financial institutions. Compliance with these guidelines will not automatically address
all site or operationally specific concerns associated with a particular zoning application.
Additional conditions of zoning may be imposed and/or recommended to address such concerns,
or to insure compliance with the Plan for Chesterfield or the purposes of the Zoning Ordinance.)
A. Definition: Alternative financial institutions (AFIs) provide short-term, high-interest
personal lending services. These institutions include: check cashing establishments (not
including incidental check cashing), motor vehicle title lenders, pawnbrokers, payday
lenders, precious metals dealers, and other businesses with similar business models and
land use impacts that are not specifically enumerated by the Zoning Ordinance, as
determined by the Director of Planning. AFIs do not include banks, credit unions, or
savings and loan associations.
B. Criteria: AFIs should be located in compliance with the following criteria and standards:
Criteria Standards
A maximum of one AFI shall be permitted in a single building. One
Co-location type of AFI shall not offer services associated with another type of
AFI. However, this provision shall not prohibit payday lenders from
offering check cashing services.
AFIs shall be located only in areas designated by the
Comprehensive Plan Comprehensive Plan for General Business use. Special
Designation consideration may be given to areas designated for Community
Business use, based on proffered conditions providing adequate
land use transition and compatibility.
Distance Separation A minimum distance separation of 5,280 feet shall be provided
between AFIs, as measured between closest property lines.
Proximity to AFIs shall not be located on property that is contiguous to property
Residential Uses designated on the Comprehensive Plan for residential use, or is
zoned or developed for residential uses.
AFIs shall not be located in any of the following areas:
• Eastern Midlothian Turnpike
Revitalization Areas • Eastern Route 360 Corridor (Route 150 to Route 288)
• Ettrick / VSU
* Meadowdale / Meadowbrook Area
• Northern Jefferson Davis Corridor

grant funds from the Department of Homeland Security for training expenses
and operational support associated with the management of the Central
Virginia All-Hazards Incident Management Team.
Summary of Information:
The Board of Supervisors is requested to approve the acceptance and
appropriation of $60,000 in grant funds awarded from the Department of
Homeland Security for training expenses and operational support associated
with the management of the Central Virginia All-Hazards Incident Management
Team (IMT). Chesterfield County, serving as a member of the Central Virginia
Urban Area Work Group (UAWG) of the UASI Grant, will function as a regional
project manager for the training activities and the operational support
associated with the Central Virginia All-Hazards IMT. The Central Virginia
All-Hazards IMT is comprised of members from the Central Virginia Urban Area
Workgroup, of which Chesterfield is a member as well. Chesterfield County
serves as the program manager for the IMT. No local match is required.

Summary of Information:
On June 27, 2012, the Board of Supervisors approved a Memorandum of
Understanding with Virginia State University. On July 20, 2012, Virginia
State University requested the County begin design work to extend public
waterline improvements along Chesterfield Avenue to the campus. In
accordance with the executed Memorandum of Understanding dated May 9,
2012, the university agreed to pay all costs associated with extending the
public waterline along Chesterfield Avenue to a location that will easily
intercept its feed from Petersburg.

The project consists of the construction of approximately 930 linear feet
of 12-inch diameter ductile iron waterline, 240 linear feet of 6-inch PVC
waterline, 4-inch meter and vault, and associated work along Chesterfield
Avenue and University Avenue between an existing public 12-inch waterline
and an existing VSU 6-inch waterline. Staff received bids from seven
responsive bidders ranging from $197,175.00 to $269,995.00.
Lyttle Utilities, Inc. submitted the lowest bid in the amount of
$197,175.00. Staff has evaluated the bids and recommends award of the
contract to the lowest bidder.
Staff requests that the Board accept the 1000 contribution from Virginia
State University; appropriate the funds; and award the construction
contract.

for the Nutrient Compliance Project at the Proctors Creek Wastewater
Treatment Plant in the amount of $291,227.22 and authorize the County
Administrator to execute the necessary documents.
Summary of Information:
Change Order Number Nine represents the modification to several concrete
structures, changes to piping, addition of valves and a credit for smaller
pumps as part of the work at the wastewater plant.
The current contract amount is $38,556,141.92; with approval of this
change order, the new contract amount will be $38,847,369.14.
Funds are available within this project. The county administrative policy
for change orders requires all change orders exceeding $50,000 be approved
by the Board of Supervisors.

Summary of Information:
It is the policy of the county to acquire right of way whenever possible
through development to meet the ultimate road width as shown on the County
Thoroughfare Plan. The dedication of this parcel conforms to that plan, and
will decrease the right of way costs for road improvements when constructed.

Board Action Request
The Board is requested to authorize the award of a construction contract, up
to $400,000, to the lowest responsive and responsible bidder and authorize
the County Administrator to execute all necessary change orders, up to the
full amount budgeted for the Clover Hill Revenue Sharing Sidewalk Project.
Summary of Information:
In October 2011, the Board allocated FY2013 Chesterfield Revenue Sharing
funds to the Clover Hill Revenue Sharing Sidewalk Project (previously
referred to as "Swift Creek Middle School/Clover Hill High School Sidewalk").
The design of the project is complete and the project was advertised for
construction on December 2, 2012. Bids are due on January 3, 2013. If
favorable bids are received, construction is anticipated to begin on January
21, 2013 and should be completed within a month, weather permitting.

Grant Loan for Crystal Y. Fordham

The Board is requested to authorize the County Administrator to sign all
documents necessary to subordinate Crystal Y. Fordham's Community Development
Block Grant loan to a loan from Sun Trust Bank.
Summary of Information:
In 2009, the County loaned $28,365 in Community Development Block Grant funds
to Crystal Y. Fordham for home rehabilitation construction work on her
residence at 4024 Lamplighter Drive in the Dale District. The County
recorded a deed of trust mortgage to secure the loan. The County's deed of
trust was a second deed of trust, subordinate in interest to a 2004 loan from
Sun Trust Bank in the amount of $117,750. Under the terms of the County's
loan, Ms. Fordham is not required to re-pay any of the loan proceeds,
provided she continues to live at the Lamplighter Drive residence for a
period of 15 years.

Earlier this year, Ms. Fordham experienced financial difficulties as a result
of a job loss, which caused her to become delinquent in the re-payment of her
loan to Sun Trust. Ms. Fordham has now found employment again and is making
payments on her loan to Sun Trust. However, the delinquent payments for the
period of Ms. Fordham's unemployment are still due to Sun Trust. In order to
avoid foreclosure, Sun Trust has agreed to re-structure Ms. Fordham's loan so
that the delinquent payments will be due at the end of the loan. However,
Sun Trust must re-record its deed of trust mortgage in order to accomplish
this re-structuring, and its new, re-recorded mortgage will be a second deed
of trust, subordinate to the County's CDBG loan, unless the County agrees to
subordinate the CDBG loan. Sun Trust is unwilling to agree to re-structure
the loan unless the County agrees to such a subordination so that Sun Trust
can remain the first lien-holder on the property.
Staff believes that subordinating the CDBG loan to Sun Trust's re-structured
loan will not prejudice the County's rights, since the new loan will be for
the same amount as the original loan, $117,750. Moreover, the re-structuring
will prevent foreclosure and allow Ms. Fordham to remain in the house, which
is consistent with the County's requirement that Ms. Fordham remain in the
home for 15 years after the rehabilitation work was completed. Accordingly,
subordination is also consistent with the purpose of the County's CDBG
rehabilitation program. For these reasons, staff recommends that the Board
authorize the County Administrator to sign the documents necessary to
accomplish subordination of the County's CDBG loan to Ms. Fordham's re-
structured Sun Trust loan.

resolution declaring January 2013, as "Crime Solvers Month" in Chesterfield
County.
Summary of Information:
The Chesterfield County/Colonial Heights Crime Solvers program is a non-
profit organization that has been helping to prevent and solve crimes since
1984 by providing a collaborative mechanism among local business partners,
law enforcement officials, citizens and the media to collect anonymous tips
to solve crimes.

RECOGNIZING JANUARY 2013 AS "CRIME SOLVERS MONTH"
WHEREAS, Chesterfield County/Colonial Heights Crime Solvers is a
non-profit organization that enables citizens to assist law-enforcement
agencies by submitting anonymous tips; and
WHEREAS, the Chesterfield-Colonial Heights Crime Solvers program
began in 1984 to provide the public with an anonymous method of
providing information to assist law-enforcement agencies in preventing
and solving crimes; and
WHEREAS, callers may contact the Crime Solvers Hot Line at 748-0660
24-hours-a-day, 365 days a year, or use one of two electronic means to
provide vital information; and
WHEREAS, Crime Solvers provides multi-lingual services in order to
reach an increasingly diverse population; and
WHEREAS, tips can lead to cash awards up to $1,000; and
WHEREAS, Crime Solvers allows callers to maintain their anonymity
because they receive code numbers that identify them, rather than using
their names; and
WHEREAS, since its inception, the Crime Solvers program has
received more than 22,300 tips; and
WHEREAS, information provided to Crime Solvers over the years has
led to Police solving more than 6,795 crimes; and
WHEREAS, Police have recovered nearly $2 million worth of stolen
property; and
WHEREAS, additionally, Police have recovered more than $998,000 in
illegal drugs and narcotics; and
WHEREAS, Crime Solvers has paid out more than $507,000 in more than
8,400 rewards for information relating to crimes in Chesterfield County
and the City of Colonial Heights; and
WHEREAS, Crime Solvers is wholly funded by donations from private
citizens, corporations, civic and social groups, and professional
associations, and receives no funding from tax dollars; and
WHEREAS, this exemplary crime-fighting program has had an extremely
positive effect in the fight against crime in Chesterfield County and
Colonial Heights.
NOW, THEREFORE, BE IT RESOLVED, that the Chesterfield County Board
of Supervisors, this 12th day of December 2012, extends, on behalf of
all residents and business operators of Chesterfield County and the City
of Colonial Heights, sincere appreciation to Chesterfield County/
Colonial Heights Crime Solvers for that organization's outstanding work
in preventing and solving crimes, and best wishes for continued success.
AND, BE IT FURTHER RESOLVED, that the Chesterfield County Board of
Supervisors declares January 2013 to be "Crime Solvers Month" in
Chesterfield County, Virginia, and further resolves that a copy of this
resolution be presented to the Crime Solvers program, and that this

I support keeping small livestock in residential areas, such as chickens, rabbits, or ducks.
At present I believe that requires a conditional use permit for a residential stock farm, with a fee of
500.00 for the first acre, and more for each additional acre used, as well as permission from one's
neighbors..
That is expensive, if all I want is a few hens for eggs, or a bunny or two for a pet. Without the permit, it
is a zoning violation now to keep even a single rabbit or hen as a child's pet in one's backyard.
There should be some kind of flexibility for people who want to keep something other than dogs, cats
or exotics as pets.
There is usually sufficient room for a flock of 2 to 12 hens on most suburban or urban lots. There is
certainly room for a dozen birds where people have more acreage. At least one county I know of bases
how many animals one can have on the acreage and carrying capacity of the land.
When I had a half acre lot, I had a 20 x 40 foot by 6 foot tall dog pen. There was more than enough
space in it for a coop and a dozen chickens to fit comfortably.
A dozen chickens creates less solid waste than a large dog does. If composted, the waste turns into a
valuable commodity. Rabbits waste doesn't even need composting before applying it to the garden.
Keeping coops or hutches clean avoids issues with flies and odor.
One doesn't need a rooster for hens to produce eggs for eating, so that takes care of most of the noise
issues. Hens are relatively quiet, quieter than dogs are at times.
Chickens can contribute to sustainability. Poultry are very good natural pest control, eating fleas, ticks
and mosquitos, as well as many weeds. Ducks will consume slugs and snails and even more weeds. I
have observed groups of chickens consuming invasive, non-native grasses and weeds, eradicating them

landfills.
Rather than limit what people can keep for pets, I think the limits should be on how those pets will
actually affect their neighbors. I think limits should be based on whether it creates actual trespass or
nuisance for one's neighbors. I think appropriate fencing and housing should be used, to prevent
trespass, and avoid creating an eyesore if within view of neighbors. Issues and laws addressing
trespass, cleanliness, odor or noise, that might disturb or infringe on one's neighbor, should be applied
equally to small livestock .

Only fowl six months or older are counted in the ratio.

Neighboring cities that allow chickens:
Petersburg allows 20 chickens, and a rooster, but requires a minimum of 30 feet from any residence or
other building people use.
Richmond allows hens, but requires 1 and `/4 acres and 500 feet from neighbor's homes. Frustrating for
the people in Richmond who mostly live on lots smaller than a `/4 acre. I believe they are in the process
of changing to more chicken friendly laws in Richmond.
There are many other cities and counties that allow keeping small flocks in resdential areas.
Major cities that allow chickens include:
Los Angeles, CA unlimited chickens, must not be within 20 feet of the owner's residence, or 35 feet of
any other dwelling;
New York City. Chickens are considered pets under the Health code. Unlimited number of hens, no
roosters.
Many cities allow 2 to 8 hens on urban or suburban lots, requiring any where between 15 to
500 feet between chickens and neighbor's. One can find examples at

WHEREAS, the County has received a request from Swift Creek Mill Theatre to consider granting it a tax

context of Section 6(A)(6) of Article X of the Constitution of Virginia.

The Board of Supervisors is requested to consider the real estate tax
exemption request of Affordable Residences of Chesterfield, II.
Summary of Information:
Under Virginia law, real and personal property used for benevolent purposes
may be classified as exempt from taxation by the Board of Supervisors. This
year, Affordable Residences of Chesterfield, II("ARCII") a benevolent, non-
profit organization has requested a tax exemption for a 1.622-acre parcel
(Parcel No. 790679718900000) located at 2700 Bensley Commons Boulevard. A
map of the parcel is attached.
ARCII uses the property to provide low cost child care services to poor and
distressed families and individuals living in the adjacent, affordable
housing community, in order to promote health, security, and quality of life
to the residents and to combat deterioration of the community. The child-
care facility is operated by the YMCA at rates below market value.

The parcel is assessed at $1,561,000, leading to an annual real estate tax of
$14,829.50. If the Board chooses to grant the exemption, staff recommends
that the exemption be limited to $5,000, which is the maximum amount
permitted by the Board's policy. The Board may, however, waive its policy by
unanimous vote.
Staff has reviewed the information which state law requires the Board to
consider before granting an exemption and finds that the information is
consistent with ARCII's status as a benevolent, non-profit organization that
is eligible for the tax exemption. The criteria which the Board must
consider under state law are attached.

CHESTERFIELD, II TO BE EXEMPT FROM PROPERTY TAXATION
WHEREAS, subsection 6(A)(6) of Article X of the Constitution of Virginia, on and after January 1, 2003,
authorizes localities to designate as exempt from local taxation the real or personal property, or both, owned by a
non-profit organization that uses such property for religious, charitable, patriotic, historical, benevolent, cultural, or
public park and playground purposes; and
WHEREAS, the County has received a request from Affordable Residences of Chesterfield, II to consider
granting it a tax exemption for a specific piece of real property owned by it in Chesterfield County and described as
County Property Tax Parcel ID No. 790670718900000 (the "Real Property"); and
WHEREAS, in accordance with Va. Code, §58.1-3651 the Board has conducted a public hearing and
considered each of the questions required to be considered before adopting an ordinance granting any such
exemption; and
WHEREAS, the Board has determined that Affordable Residences of Chesterfield, II meets the requirement
for the real property tax exemption that it has requested by reason of its being anon-profit organization which uses
the real property for which it is requesting the exemption for benevolent purposes; and
WHEREAS, it is the policy of the Board to limit tax exemptions for real estate to a maximum amount of
$5,000
NOW THEREFORE BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
1. Affordable Residences of Chesterfield, II is hereby designated a benevolent, non-profit organization
within the context of Section 6(A)(6) of Article X of the Constitution of Virginia.
2. The Real Property is used by Affordable Residences of Chesterfield, II exclusively for benevolent
purposes on anon-profit basis as set forth in Section 1 of this ordinance and is hereby determined to be exempt from
local taxation up to a maximum amount of $5,000. This exemption shall be contingent on the continued use of the
property in accordance with the purpose for which the organization is designated as exempt in Section 1.
This real property tax exemption shall be effective as of January 1, 2013.
4. This ordinance shall not be set out in the County Code but shall be kept on file in the office of the real
estate assessor.
5. This ordinance shall be in effect immediately upon its adoption.

Under Virginia law, real and personal property used for benevolent purposes
may be classified as exempt from taxation by the Board of Supervisors. This
year, Richmond Affordable Housing ("RAH") a benevolent, non-profit
organization has requested a tax exemption for two parcels, a.939-acre parcel
(Parcel No. 790679438400000) and a .605 acre parcel (Parcel No.
790679548400000). The parcels are adjacent and located at 2740 Bensley
Commons Boulevard. A map of the parcels is attached.
RAH uses the .605 acre parcel to provide no cost adult day care services. The
facility is operated by the County's Community Services Board. The adjacent,
.939-acre parcel, is used as a parking lot for the day care facility.

Summary of Information:
Under Virginia law, real and personal property used for cultural purposes may
be classified as exempt from taxation by the Board of Supervisors. This
year, Gujaral Samanvay Parivar a cultural, non-profit organization which
operates as the Cultural Center of India, has requested a tax exemption for a
4.838 acre parcel (Parcel No. 775655394400000). A map of the parcel is
attached.
Gujaral Samanvay Parivar obtained federal, tax exempt 501(c)(3) status many
years ago but has operated under the name of Cultural Center of India for the
past several years. The building on the parcel is used by the Cultural
Center for many cultural activities.

$18,993.35. If the Board chooses to grant the exemption, staff recommends
that the exemption be limited to $5,000, which is the maximum amount
permitted by the Board's policy. The Board may, however, waive its policy by
unanimous vote.
Staff has reviewed the information which state law requires the Board to
consider before granting an exemption and has also considered financial
records which were submitted by Gujarat Samanvay Parivar. These records
indicate that Gujarat Samanvay Parivar receives approximately $150,000
annually from rental of its facility to members of the public for various
social receptions. This revenue is used to defray the organization's
expenses and has not resulted in a profit. Accordingly, staff does not
believe that this rental activity is inconsistent with Gujarat Samanvay
Parivar's status as a cultural, non-profit organization that is eligible for
the tax exemption. The criteria which the Board must consider under state
law are attached.

The Board of Supervisors is requested to consider the real estate tax
exemption request of Richmond Kickers Youth Soccer Club, Inc.
Summary of Information:
Under Virginia law, real and personal property owned by non-profit
organizations and used for public park and playground purposes may be
classified as exempt from taxation by the Board of Supervisors. This year,
Richmond Kickers Youth Soccer Club, Inc. ("RKYSC") a non-profit organization
which owns youth soccer fields, has requested a tax exemption for a 3.129
acre parcel (Parcel No. 774689950500000). RKYSC uses the parcel as youth
soccer fields.
The parcel is assessed at $250,300, leading to an annual real estate tax of
$2,377.85. However, since the amount of the tax could one day exceed $5,000,
if the Board chooses to grant the exemption, staff recommends that the
exemption be limited to $5,000, which is the maximum amount permitted by the
Board's policy. The Board may, however, waive its policy by unanimous vote.

consider before granting an exemption and finds that the information is
consistent with RKYSC's status as a benevolent, non-profit organization that
is eligible for the tax exemption. The criteria which the Board must
consider under state law are attached.

CRITERIA FOR CONSIDERING TAX EXEMPTION
REQUESTS UNDER STATE LA4V
1. RKYSC is exempt from taxation pursuant to ~501(c) of the Internal
Revenue Code;
2. RKYSC does not possess a current annual alcoholic beverage license
for serving alcoholic beverages for use on the property;
3. No director of RKYSC is paid any compensation for service to the
corporation and its salaries are not in excess of reasonable salaries for
services performed by the employees;
4. No part of the net earnings of RKYSC inures to the benefit of any
individual;
5. RKYSC provides services for the common good of the public; and
6. RKYSC does not attempt to influence legislation or intervene in any
political campaign on behalf of any candidate for public office.

AN ORDINANCE TO DESIGNATE REAL
PROPERTY OWNED BY RICHMOND KICKERS YOUTH
SOCCER CLUB, INC. FOR RIDGEDALE PARKWAY FACILITY
TO BE EXEMPT FROM PROPERTY TAXATION
WHEREAS, subsection 6(A)(6) of Article X of the Constitution of Virginia, on and after January 1, 2003,
authorizes localities to designate as exempt from local taxation the real or personal property, or both, owned by a
non-profit organization that uses such property for religious, charitable, patriotic, historical, benevolent, cultural, or
public park and playground purposes; and
WHEREAS, the County has received a request from Richmond Kickers Youth Soccer Club, Inc. to consider
granting it a tax exemption for a specific piece of real property owned by it in Chesterfield County and described as
County Property Tax Parcel ID No. 774689950500000 (the "Real Property"); and
WHEREAS, in accordance with Va. Code, §58.1-3651 the Board has conducted a public hearing and
considered each of the questions required to be considered before adopting an ordinance granting any such
exemption; and
WHEREAS, the Board has determined that Richmond Kickers Youth Soccer Club, Inc. meets the
requirement for the real property tax exemption that it has requested by reason of its being anon-profit organization
which uses the real property for which it is requesting the exemption for public park and playground purposes; and
WHEREAS, it is the policy of the Board to limit tax exemptions for real estate to a maximum amount of
$5,000
NOW THEREFORE BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
1. Richmond Kickers Youth Soccer Club, Inc. is hereby designated anon-profit organization owning
public park and playground property within the context of Section 6(A)(6) of Article X of the Constitution of
Virginia.
2. The Real Property owned by Richmond Kickers Youth Soccer Club, Inc. at its Ridgedale Parkway
Facility is used exclusively for public park and playground purposes on anon-profit basis as set forth in Section 1 of
this ordinance and is hereby determined to be exempt from local taxation up to a maximum amount of $5,000. This
exemption shall be contingent on the continued use of the property in accordance with the purpose for which the
organization is designated as exempt in Section 1.
This real property tax exemption shall be effective as of January 1, 2013
4. This ordinance shall not be set out in the County Code but shall be kept on file in the office of the real
estate assessor.
This ordinance shall be in effect immediately upon its adoption.

located on Hensley Road, a 9.0-acre parcel (Parcel No. 728657812300000) and a
69.0-acre parcel (Parcel No. 727657874000000). RKYSC uses the parcels as
youth soccer fields.
The parcels are assessed at $376,600, leading to an annual real estate tax of
$3,307.70. However, since the amount of the tax could one day exceed $5,000,
if the Board chooses to grant the exemption, staff recommends that the
