REQUEST: Conditional use approval to permit a stand up paddle board training business,
incidental to a dwelling, in a Residential (R-9) District.
PROPOSED LAND USE:
A home occupation (a home office for a stand up paddle board training business) is
currently operating from the existing dwelling. A trailer exceeding the maximum
permitted length and number of axles is parked within the rear yard of the property.
Continued operation of the home office and parking of the trailer on the property is
planned.

STAFF RECOMMENDATION
Recommend approval for the following reasons:
A. The proposed land use conforms to the Comprehensive Plan which suggests the
property is appropriate for residential use of 2.0 - 4.0 dwelling units per acre.
B. The proposed land use is representative of and compatible with existing and
anticipated area development.
Providing a FIRST CHOICE community through excellence in public service
(NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNERS MAY
PROFFER CONDITIONS. CONDITIONS NOTED "STAFF/CPC" WERE AGREED UPON
BY BOTH STAFF AND THE COMMISSION.)
PROFFERED CONDITIONS
(STAFF/CPC) 1) This Conditional Use approval shall be granted exclusively to
Christopher Bryan Smith and Camille Elizabeth Smith, and shall
not be transferable with the land. (P)
(STAFF/CPC) 2) This Conditional Use approval shall be for the operation of a
stand-up paddle board training business. (P)
(STAFF/CPC) 3) This Conditional Use approval shall be granted for a period not to
exceed ten (10) years from the date of approval (P)
(STAFF/CPC) 4) No employees shall be permitted to work on the premises other
than family member employees that live on the premises. (P)
(STAFF/CPC) 5) One (1) trailer shall be permitted and limited as follows:
a) The trailer shall not exceed fourteen (14) feet in length and
two (2) axles. The trailer shall not exceed 3,200 pounds. (P)
(STAFF/CPC) 6) The trailer associated with this business shall be parked in the rear
yard of the property, except for the purpose of loading and
unloading the trailer. The trailer shall be no closer than fifteen (15)
feet to any adjacent property (as generally shown on Exhibit A).
Other than the trailer identified in Proffered Condition 5, there
shall be no additional outside storage associated with this use. (P)

new building construction shall be permitted to accommodate this
use. (P)

Public Water Svstem:
The request site is located within the Elkhardt Ground water pressure zone. The request site
is currently connected to the public water system. This request will not impact the public
water system.
Public Wastewater Svstem:
The request site is located within the Falling Creek sewer service area. The request site is
currently connected to the public wastewater system. This request will not impact the public
wastewater system.
ENVIRONMENTAL
Drainage and Erosion:
This request will have no impact on these facilities.
PUBLIC FACILITIES
Fire Cervireā¢
The Manchester Fire Station, Company Number 2, and Manchester Volunteer Rescue
Squad currently provide fire protection and emergency medical service (EMS). This
request will have a minimal impact on Fire and EMS.

County Department of Transportation:
The proposed use on the property will have a minimal impact on the existing
transportation network.
Virginia Department of Transportation (VDOT~:
VDOT understands that sufficient parking is available within the curbed cul-de-sac to
accommodate the occasional trainees without needing a commercial entrance to the
property. Consequently, VDOT has no further comment.
LAND USE
Comprehensive Plan:
The Comprehensive Plan recommends that the subject property be designated as
"Suburban Residential IL" This designation suggests a mix of uses, specifically single-
family dwellings on lots ranging between 12,000 square feet and 25,000 square feet,
dwellings on smaller lots or condominiums under certain circumstances. The proposed
business incidental to a dwelling does not conflict with the Plan's land use designation.
Area Development Trends:
Surrounding properties are zoned Residential (R-7 and R-9) and are occupied by either
single-family residential uses or remain vacant. The subject property is located within the
Creekwood subdivision. It is anticipated residential development will continue in this area,
as suggested by the Plan.
Uses:
Within the Residential (R-9) District, the ordinance permits the operation of a home
occupation subject to certain restrictions. The applicant's operation deviates from these
restrictions in two (2) respects, necessitating conditional use approval. These include:
parking of a trailer that exceeds thirteen (13) feet in length, and having more than one (1)
axle.
Proffered conditions would restrict the operation to an office for astand-up paddle board
training business for the applicant only (Proffered Conditions 1 and 2). The applicant has
proffered a condition to allow the use for a period of ten (10) years (Proffered Condition 3).
Upon expiration, the applicant may reapply for the conditional use.
The applicant has indicated that the business (office for astand-up paddle board training
business) would not involve any clients or employees coming to the property for training
purposes. Rather, the applicant travels to select water destinations in the County to offer
training to his clients. Equipment taken to the training sites is stored and transported on a
vehicle trailer. A trailer, not exceeding fourteen (14) feet in length and two (2) axles would

be permitted for the business operation (Proffered Condition 5). Proffered conditions would
not permit outside employees to work at the residence. In addition, no clients would be
permitted on the property. (Proffered Conditions 4 and 8)
Development Standards:
Proffered Condition 7 would preclude additions and exterior alterations to any structures on
the property for this use, thereby limiting the business to the existing dwelling. With the
exception of the trailer and paddle boards stored on the trailer, no other outside storage
would be permitted. The parked location of this trailer is limited to the rear yard. In addition,
the trailer must be parked a minimum of fifteen (15) feet from any adjoining property.

Si~nage:
No signage would be permitted to identify this use. (Proffered Condition 9)
CONCLUSION
The Comprehensive Plan suggests that the property is appropriate for residential uses. Staff finds
the applicant's request for a business use incidental to a dwelling in conformance with the Plan
designation for the subject property. The proposed land use would be no more intense than a home
occupation, which is permitted land use with restrictions in a Residential (R-9) zoning district. The
conditions proffered by the applicant would limit the scale, character and intensity of the operation.
Given these considerations, approval of this request is recommended.

Planning Commission Meeting (12/10/12):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Gulley, seconded by Dr. Brown, the Commission recommended
approval and acceptance of the proffered conditions on page 2.
