Box 3036 Bon Air, virginia 23235 Dear Mr. Burnett: I am in receipt of the Chesterfield County Board of Supervisors' resolu- tion dated November 26, 1975 whereby the Board requests the State Highway Department to accept the extension of Route 1514 across the Seaboard Coast Line Railroad right of way so that the Railroad Company can make certain improvements at this crossing. I wish to call your attention to my letter of November 12, 1974 whereby I advised the only way the Highway Department will be able to accept the exten- sion of Route 1514 across the S. C. L. Railroad right of way would be via rural addition. This would mean that 100 per cent of the County's rural addition funds for a one-year period would have to be utilized to finance the protective devices, which will be required at this crossing. After I have received a resolution from the Board stating that they wish the rural addition funds be used for this purpos~ I will proceed with the neces- sary paper work to see that this rural addition is accomplished. C. Ritz,-Director of Planning Status of Projects Specifically Requested By The Board Projects requested by the Board and still in process are as follows: Bermuda Magisterial District Ecoff Park - Fencing is not in yet. A final punch list of work was drawn-up for the contractor to do. See park lighting paragraph below. Enon Park - The appraisals have been checked by the State Commission of Outdoor Recreation. The COR has submitted forms to the U.S. Bureau of Outdoor Recreation for approval. We probably won't receive final Federal approval and funding until late December. We have no word yet on the availability of State funding. Cline Automotive (Rt. i/Willis Road) - Bill Poole met with Mr. Cline on October 30, and explained what was needed for a site plan and a Variance; also what would have to be done to obtain approval for the building that he has built. He was to have submitted an application for a Variance to be heard by the Board of Zoning Appeals at the December meeting, but did not respond. The Building Inspector is to contact him again. Curtis Lumber Company Property - On October 2, 1975 in the Chesterfield County General District Court, the Honorable R. D. Laney gave Mr. H. H. Murphy, tenant, until December 18, 1975 to remove all junk motor vehicles and parts thereof from the subject property. Lillie Allen Property - In response to your request we visited the Allen property at 5126 West Hundred Road and found junk, trash, etc. Ronald Allen, executor of the Allen Estate, said that Mr. E. West, Sr. was responsible for the condition and that he had been unsuccessful in getting Mr. West to clean up the property. We obtained a warrant for the arrest of Mr. West and on December 4, 1975, the Honorable J. F. Daffron, Jr. continued this case until January 15, 1976 during which time Mr. West is to remove all junk, trash, etc. Clover Hill Magisterial District Elementary School plans are out to co~tractors to submit bids by December 8, 1975. Dale Magisterial District Dale Park - No new progress. Matoaca Magisterial District Ettrick Park - Fencing is not in yet. A final punch list of work was drawn-up for the contractor to do. See park lighting paragraph below. Harrowgate Park - Ail fill work has been completed. The contractor is working on the parking lots. Mr. Chudoba has not designed a subsurface drainage system yet for the football field. Once this drain system is designed, we will need funding for it as well as for 1 additional parking lot. We will not have this information until the January Board meeting. See park lighting paragraph below. Harrowgate School - Bill Poole met with Mr. Lowman and Bob Williamson (with the School Board) at the school. It was decided that two little league sized fields would be staked out on the site before we decide on a final design. One of these fields will either require moving a playground and a basketball court or else it will have to be located in the woods behind the school. This staking should be done the second week in December. Plans could be drawn up and bids received by the second Board meeting in January. Matoaca Park Fencing is' not in yet. A final punch list of work was drawn-up for the contractor to do. See park lighting paragraph below. Mary L. Campbell Property - In response to a complaint, visited property and found Mr. H. Robertson, tenant, has a junk yard and dump on this property. Sent Mr. Robertson a letter requesting that he clean up the property by September 23, 1975. On October 9, 1975 visited property and found nothing had been done, obtained warrant for the arrest of Mr. Robertson. On November 20, 1975 in the Chester- field County General District Court, Honorable J. F. Daffron, Jr. continued this case until January 15, 1976 during which time Mr. Robertson is to remove all trash, junk, etc. from this parcel. General Park Comments Bids were received from 7 contractors on November 25, 1975. One contractor offered an alternative design that would provide the same amount of light, cost less to install and less to operate. We are checking with VEPCO to ascertain their projected costs and decide which of the 2 lowest bids is actually best. Prices should be available for the December 10, 1975 Board meeting. -2- MORRIS E. We have been requested to bring the other two vacations before the Board, b~t I have been unable to locate the resolutions of the Board a~thorizing the preparation of these ordinances. In the absence of such resolutions, I would request the sponsors, Mr. Apperson and Mr. Homer, to pass the appropriate resolutions at the Board's next meeting on November 12, 1975. AN ORDINANCE to vacate an unimproved fifty (50) foot wide road right-of-way in the subdivisions of Lake Crystal Farms and Central Heights, known and designated as Luck's Lane located between Court House Road and North Cottonwood Road, plats of which made by J. K. Timmons, Civil Engineers and Surveyors, Richmond, Virginia, dated February 7, 1964, and September 15, 1955, respectively and recorded February 11, 1964, and February 16, 1955, respectively, in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Plat Books 13, pages 78 and 79 and Plat Book 9, page 99, the said unimproved fifty (50) foot wide road right-of-way to be vacated being more particularly shown on a plat dated October 15, 1975, made by the Engineering Department, Chesterfield County, Virginia, a copy of which is attached hereto and made a part hereof by this reference. Ritz, ector of Planning SUBJECT: Additional merit increase for Mr. James P. I would like to request a one step merit increase for Mr. James P. Zook in addition to the budgeted merit increase 'January.l, 1976. Mr. Zook began employment as an intern May 15, 1974 working part-time at $3.85 per hour. During this period he was a full time graduate student at VCU culminating in his Masters Degree in Planning awarded in June, 1975, graduating first in his class. In early 1975 Jim was offered a position with James City County. I told him then that I had requested, and expected to have funded, a full time Senior Planner position for him. I also told him that I would start him~at $11,424 or $12,000 and then grant him a 5% increase July 1, 1975. This offer convinced him to stay with us. As it turned out I start- ed him full time at $11,424 May 1, 1975 full time because our other Senior Planner (Poole) was then earning that amount. When the Board authorized a $312 increase, instead of the 5% I had anticipated, Mr. Zook's salary went to $11,736 where it stands now. On January l, 1976 Mr. Zook's funded merit increase would make his salary $I2;312. This request if approved would make his salary then $12,936. I request this extra merit increase for these~reasons: 1. Mr. Zook is currently Chief of Long Range'Planning supervising Mr. Richard Flaherty, Planner I; Mr. Dexter Williams, Planner/Engineer; and Mr. Larry Littman, Intern. He supervises as many employees ~as anyone in our office except myself. This is a Principal Planner'~s position although he is classified as a Senior Planner. Given'this responsibility he is very much underpaid. One of the persons Mr. Zook supervises (Mr. Williams) earns exactly the same salary,-~a tenuous situation at best. 2. Mr. Zook has proved his abilities to the County in~hfs efforts from October, 1974 to date in obtaining EPA approval~of.our Falling Creek and Proctors Creek applications. He proved to be good team member, calculating and comprehensive in these very~ hectic pressurized efforts. 3. Mr. Zook has completely managed our efforts to obtain and stay eligible for HCDA funding including preparation of applications and environmental assessments. - 4. When I have felt it necessary to turn my attention to other more pressing matters, Mr. Zook has represented the County at several Mr. Robert Galusha October 24, 1975 Page.2 RRPDC meetings, almost all Tri-Cities transportation meetings, .and Coastal Zone Management meetings. His educational background and savvy make him the best man on our present staff to represent us in these efforts. 5. Mr. Zook has and is directing the substantial efforts of our staff and consultants on the "701" Comprehensive Planning Grant. 6. Mr. Zook is the only graduate planner, besides myself, on our staff and as such is of considerable value to the County. 7. I consider Mr. Zook to be the most valuable man in our office after Mr. Balderson. 8. It would be difficult to replace Mr..Zook. Finally, I promised him a 5% increase July 1, 1975 and because it was not funded, I could not produce. This was my error but Mr. Zook has suffered. Although he has not indicated dissatisfaction with my error, he has indicated a general disappointment in his present salary with respect to Mr. Poole and Mr. Williams who earn the same salary. We understand that this was an error and that all of us are subject to makinE errors from time to time. It is my further understanding that the Personnel Committee has agreed to classify Mrs. Harrison as a secretary retroactive to J~y i of this year and that her salary will be set at $?B00.00 which is the starting salary for a secretary. In view of the fact that Mrs. Harrison has lost considerable money over'the past four years due to the error in classification, it appears to me to be completely inequitable to also lose the classification-to which she would have been entitled had she been classified properly when employed. Krepela 'm Meeting was called to order ~vMr. Burnett. lOl.O The Honorable Judge D. W. Murphey appeared before the Committee on behalf' of his secretary, Mrs Shirley Harrison. Mrs Harrison had not been properly re- classified at the time positions had been reviewed prior to adoption of the July l, 1975 pay plan. Judge Murphey felt that Mrs Harrison's sala[v warranted ad- justment and back pay authorized at the rate consistent with Grade ll, retroactive to her employment date {approx 4 years ago). lOl.1 The Committee agreed that Mrs Harrison had not been reclassified at the time positions were reviewed for all county employees {1 July 1975); however, due to the fact that there were many other personnel who were in similar cir- cumstances and that the general review and reclassification Occurred on 1-(Im~_~-~~-~ 1975, the Committee agreed to recon~end that Mrs Harrison's salary be adjusted to that consistent with a Secretary, Grade ll {$7368) retroactive to 1 July 1975, and that Mrs Harrison be awarded the scheduled merit increment on 1 January 1976 if recommended by her supervisor. 102.0 Mr. J. D. Williams appeared before the Committee in regard to a personnel action request deferred from an earlier Committee meeting (19 Sept 1975). His re- ouest regarded: (1) a pay increase for Mr. Charles Jones in order to provide a greater pay differential between Mr. Jones and Mr. Orr, both being Deputy License Inspectors; and (2) reclassification of present clerical position and promotion of incumbent. 102.1 Pay differential/salary increase for Mr. Jones was not favorably considered by the Committee. 102.2 Reclassification of clerical position was not favorably considered by the Committee due to insufficient justification. 103.0 Mr. M. F. Woodfin addressed the Committee with the following personnel ac- tion reouests: {1} Establishment of one additional Assistant Custodial Supervisor and appropriation to cover promotion of ~resent employee; (2) Establishment of four additional Custodial II positions, and additional appropriations to cover salaries of new employees; and {3) the establishment of one additional Buyer I position, and appropriation to cover salary requirement of the new employee. lO3.1 The Committee concurred in the request for the establishment of an Assis- tant Custodial Supervisor due to the increase in custodial responsibilities and requirements for a supervisor for the night custodial force; and those additional appropriations to cover salary expenses. 103.2 The Co~ittee recognized the need for additional custodial personnel;- how- ever it was the concensus that there was insufficient justification towarrant four additional positions - two additional positions were recognized by the Com- mittee due to the increase in janitorial responsibilitiesl It should be recog- nized that the four positions were struck from the four positions were struck from the proposed 75-76 budget. Additional appropriations was recon~ended to allow immediate fill of these positions. 103.3 The Committee acknowledged the requirement for one additional Buyer I position. The increased workload described by Mr. Woodfin justified the additional Buyer I position. The Committee also recommended that sufficient funds be provided to cover the expense of hiring a person to fill this position. 104.0 Mr. M. C. Ritz appeared before the Committee requesting a merit increase over and above the increase progran~ed for Jan 1, 1976 for Mr. J. P. Zook. The request was based upon Mr. Ritz' evaluation of Mr. Zook's performance during the time he (Mr. Zook) has been with the County, 104.1 fir. Zook is presently at salary increment $11,736. On 1 Jan 1976 his salary well be increased to $12,312 the additional step as requested would takeMr. Zook to $12,936. It was the concensus that such a merit increase should be granted on the basis of Mr. Ritz' justification that Mr. Zook was an employee of extra ordi- nary value to the County; that his service has been characterized by exceptional meritorious achievement. It was the concensus of the Con~nittee that the County should carefully consider the consequences of not providing sufficient recogni- tion and reward for deserving individuals. Such consideration is critical in maintaining a strong neculeus of young, energetic professionals. The Co~nittee concurred in the request for the additional merit increase and the request for additional appropriation to cover the increase in salary. 105.0 Mr. Galusha advised the Con~nittee that the County Employee Performance Appraisal Program had been finalized and was awaiting Board approval for imple- mentation. lO5.1 The Committee recommended that the Employee Performance Appraisal Program be presented to the Board for adoption at the next regularly scheduled Board meet- ing (26 November 1975). The program concept and the first draft had been reviewed by the Personnel Committee at its 20 October 1975 meeting. The Peavey TNT~ originally requested has 45-watt output and is not as good quality. Amplifiers are varied in quality, but I had two other musician-teachers investigate the various items quoted to make certain we were ordering best quality for the price. ~l~' 8 - Midlothian High School specifically asked for Conn 6-D to match the other French Horns in their band. The Reynolds FE-O~ ard Olds 0-44 are good horns but not the same as the instrument requested. The $23. difference between the lower bid and the requested item is not substantial enough to warrant refusal of the schoolls request. They are still within their allotment of $1,000. ~-~ 9 - The Lewis cello bow quoted at $75. was the bow that was settled upon by the string teacher at Midlothian after considerable shopping. He had several other objective evaluations before specifying this particular bow. He was not interested in cheaper substitutions. I can assure you that I never pass up a lower bid without checking on the quality to make. certain we spend tax money as wisely as possible. In most cases, the better quality is the better bargain. Jones, the following resolution was duly passed by the recorded vote shown below: RESOLUTION WHEREAS, the Governor of the State of Virginia, in order to balance the State budget, has ordered an immediate cut in State aid to local county and city school divisions in the amount of 5%; and WHEREAS, counties and cities receive differing levels of State aid based on a complicated formula, tied to the ability of each county or city to raise needed school funds; thus causing more of an impact on those counties who receive a higher overall percentage of State aid in their budget; and WHEREAS, this cross-the-board reduction in State aid took place automatically, and not within any budget planning time-frame; and WHEREAS, contracts were issued and spending levels were set in good faith which are difficult to amend outside of regular budget cycles; and WHEREAS, the County of Halifax wishes to maintain a high level of quality in the educational programs and not be forced to terminate valuable programs and/ or personnel; THEREFORE, BE IT RESOLVED: that the Halifax County Board of Supervisors urge its representatives to the Virginia General Assembly to reinstate the 5% cut in State aid for the current fiscal year: If a cut is absolutely necessary to the fiscal well being of the State, then institute such reduction in State aid for the Fiscal year beginning July 1, 1976, so that proper and thoughtful budget planning may be accomplished to allow a minimum impact to ongoing educational programs and personnel. VIRGINIA September 16, 1975 M~MORANDUM TO JUDGES AND CLERKS OF DISTRICT COURTS AND TO CLERKS OF CIRCUIT COURTS SUBJECT: FEES PAYABLE TO COURT-APPOINTED DEFENSE COUNSEL Ladies and Gentlemen: It has been determined that there have been instances whem allowances have been made for payment to court-appointed defense counsel im misdemeanor cases tried principally in district courts payable out of the State treasury, while the prosecutions were for violations of county~ city~ or town ordinances. On May 15, 1973, the Attorney General rendered an opinion to the Judge of the Municipal Court of the City of Portsmouth regarding payments made to court- appointed attorneys. The second question and answer from that opinion are quoted below: "Who is to pay court-appointed attorneys in courts not of record in cases where the Commonwealth has initiated the prosecution and in cases where a city has initiated the prosecution?" "Section 19.1-241.11 provides that compensation of counsel appointed to represent misdemeanants shall be fixed by the courts in which the defendant appears. Because the section does not state by whom the compensation is to be paid, it is necessary to look at Chapter 316 of the 1973 Acts as a whole in order to determine the intent of the General Assemb'ly. Section 14.1-184.1 provides for payment of compensation in cases before a court of record, and specifically provides that payment shall be made by the Commonwealth, if the Commonwealth has initiated the prosecution, or by the county,'city= or town, if the county~ city, or town has initiated the prosecution. A fusing of the two sections seems to clearly indicate the intention of the General Assembly that compensation shall be paid bM'the Commonwealth,.~if the Commonwealth ~s i~itia~ed ~h~'-pr~secU~ion, or by the county, city, or town, if the county, city, or town has initiated t~e prosecution. Therefore, in my opinion, the answer to your second inquiry is that in courts not of record the Commonwealth is to pay the ,compomqatton of court-appoit~tod counsel if it has initiated the (Over) From the above opinion it is clear that ~en a person is prosecute_~ for ~violat~°n of a...cou__~nty, city, or town d~e, the compensation of the court-appointed ~Unsel should be paid by such._cQunt~, city, or town. The Comptroller's revised Criminal Form 4 (6-75) has on its face advice reading "DO NOT REQUEST REIMBURSEMENT FOR VIOLATION(S) OF LOCAL ORDINal(S)." In the future when approving claims for payment on these forms nQ cc~penmation for court-appointed defense counsel in connection with local ordinance viQIations should be included. Such claims should b~ approved for pa)~nent by the appropriate localities whose ordinances were violated. When amounts have been paid for services of a court-appointed defense attorney and a recovery is later ma~e from t_~e Re- fendant, such should be paid into the Co~nonwealth, county, city from which payment was initially made, as an item of recovered costs. When a court ascertains that a claim for services of court-appoimted attorneys has been certified for payment by an incorrect unit of government sub- sequent to March 15, 1973 (the effective Rate of the aforementiome~ Iegislatiom), it is our belief that an effort should be made to obtain repayment Commonwealth, county, city, or town which should havebeenchargeR originally. Ritz,~~ Director of Planning Board of Zoning Appeals - Request for Pay Increase On December 2, 1975 the Board of Zoning Appeals unanimously requested that the Board of Supervisors increase their pay from $25 to $50 monthly. I would like to point out the following: 1. Prior to July 1, 1970 the Board members were paid $50 monthly. 2. Each Planning Commissioner is paid $50 monthly. They meet twice a month at night. They also meet at an office in the afternoon prior to the zoning session for a field trip. Their out-of-pocket expenses include their meal on the field trip and travel to review cases and to the Courthouse. The Commission ~et~ two evenings and one afternoon a month not including special meetings (about ten in the last four years). A Planning Commissioner is not paid his salary if he misses both meetings in any given month. 3. A Board of Zoning Appeals member is now paid $25 monthly. They meet once a month at 1:00 P.M. in the afternoon. They usually meet at 11:30 A.M. for lunch prior to their 1:00 meeting. They do not normally take a Joint field trip - each member reviews his District's cases on his own time. Their out-of-pocket expenses include their lunch and travel to review cases and to the Courthouse. They have not met for any special meetings in the last four years. They are paid'their salary regardless of attendance at meetings. 4. An increase in salary for the Board from $25 to $50 monthly would cost $1500 annually. An increase in salary for the Commission from $50 to $100 monthly would cost $3600. 5. There have been considerable inquiries to this office as to why the Board of Zoning Appeals does not meet at night so that people would not have to take off time from work to appea? for or against a case heard by them. When we sought a building permit to construct a two car attached garage, we learned that we could not position the garage as we had intended. The problem arose when we sought to position the garage partially onto a drainage easement. The positioning of the garage on a corner of the easement was made necessary to permit more daylight into the kitchen, that has only one window. The enclosed plot plan shows the existing house, that was shifted off center on lot to avoid this easement. The easement contains a 36" diameter concrete pipe, that has 8' on either side of same. The plot plan illustrates the location of the proposed garage. As illustrated, the garage will not be positioned over this pipe. I conferred in person with your planning department and engineering department. At each office, I was informed that they could not approve my request for a building permit. The engineer suggested that I write you and make a request for a variance to the code to permit me to legally construct this garage. I am anxious to construct the garage and will be happy to meet with you or your appointed representative at the location site to explain the situation and answer any questions. Fugate, Commissioner Virginia Department of Highways and Transportation 1221 East Broad Street Richmond, Virginia 23219 Dear Commissioner Fugate: The County of Chesterfield, Virginia is working with the Greater Richmond Transit Company regarding an application submitted to the Urban Mass Transportation Administration for the acquisition and construction of a transit park-and-ride lot. This facility would be located on the north side of Forest Hill Avenur at the Richmond City Corporate Line. The property includes about 14 acres with a present day market value of $12,400. The property has a relatively low market value because of the utility easements under and over it, its topography and lack of vegetation. The County requests assistance from the Virginia Department of High- ways and Transportation under the provisions of the Code of Virginia, Section 33.1-46.1, from funds appropriated in budget item 329.1 for balance of state transit activities, should the said application to UMTA be approved. We request that the local share be funded from mass transit funds available to this region, unencumbered amounts previous- ly appropriated, and/or next biennium appropriations. The proposed facility would be approximately 14 acres in size, with a capacity of about 700 vehicles and a bus. shelter for waiting passengers. Mr. Douglas B. H.W. tvlATT HEWS Dear Mr. Overstreet: I am in receipt of your notice of a public hearing to be held on December 17, 1975, for the purpose of finalizing the HSA IV application. As you are aware, this subject is of great concern to me and to the Board of Supervisors of Halifax County. We have taken up this subject at several work session meetings of the Board and took the following action at the December 1st meeting: (1) The Board feels that since it is likely that the Health Planning Council will request funds from local units of govermment in the future, that the composition of the Board (under the 30 member plan) be comprised of no less than 10 elected officials and that the 10 consumer positions be filled by appointment of local governments or Plarming District Commissions. These consumers would be bona-fide consumers not directly associated with the local governments. (2) That there be at least one public hearing held in each Planning District concerning the formation of HSA IV prior to the application being submitted to the Federal Government. I personally feel that this is critical and precedent setting because if the HSA is to be effective, all Planning Districts and geographical areas of the region must be working partners and all citizens must have the equal right and convenience of having their views heard. As you are aware, it is a 5-hour round-trip drive from this county to Richmond. If local citizens are to have any input into the planning process, the public hearing must be held at a more convenient location. There is a great deal of concern and suspicion on the part of local units of government that since the application is being prepared by a Richmond based Health Planning Council, that they intend for the future 'HSA to also be Richmond controlled. Holding public hearings in each Planning District would go a long way in dispelling these suspicions. I have been informed by a fellow Administrator that the reason being given for holding only one public hearing was that the Council is trying to meet the first funding cycle of HEW. We are all interested in seeingthe HSA formed as quickly as possible, but not if it means that the entire program will fail Mr. Overstreet Page 2 December 5, 1975 through lack of thoughtful consideration of potential problems. Therefore, I am suggesting that the application be withheld until the second cycle so that these problems can be ironed out to everyone's satisfaction and ineure the future success of the HSA. Please place my name on the agenda to speak at the public hearing on the 17th in any event. I am distributing copies of this letter to several key individuals around the HSA IV area for their thoughts on this matter and I request that they also make you aware of their feelings in this regard. Councill, III, Executive Director SUBJECT: DATE: PD 15 Representation on the HSA' November 13, 1975 The attached paper is an excerpt from the proposed HSA ByLaws which received approval from a subcommittee of the Capital Area Comprehensive Health Planning Council, Inc. (CACHPC, Inc. ) on Monday. It will be recommended to the CACHPC, Inco at its November ?.6 meeting. As you can see, it would limit the number of PD 15 representatives to three (B) elected officials and five (5) consumers. Of the fourteen (14) providers to be appointed, only those from VCU, McGuires Hospital and Blue Cross/Blue Shield are most assuredly to come from our area. Also, nearly as likely would be the ¥irginia Health Department re- presentative, making a total of twelve (12). Our population, under the law's provisions, would indicate eighteen (18) from PD 15, however. Prior discussions with the RRPDC Executive Committee focused unanimous concern about this inequitable situation, particularly relating to the disparate number of local elected officials from PD 15. It is apparent that the numerous HSA membership restrictions imposed both by the law itself and subsequent HEW guidelines are being used against our member localities receiving a fair share of the HSAboard slots. The impact of this is reflected in the governmental representatives proposed and the consumers as well. Our discussion today should focus on what is to be done, if any- thing, ab'Out this proposal. RICHTER COUNTY OF CHESTERFIELD CHESTERFIELD, VIRGINIA POLICE DEPARTMENT December 9, 1975 Honorable Board of Supervisors County of Chesterfield Chesterfield, Virginia 23832 Gentlemen: I believe that the firefighters of Enon Fire Department, specifically, Bruce Vec~ and Rick Collins~ should be recognized for the outstanding performance and aid they rendered to an accident victim at approximately 9:00 p.m., November 26, 1975 on State Route 10 (Hopewell Road). A vehicle came to rest in the creek after being struck by a hit and run driver. The two occupants were trapped in the vehicle, which was upside down in the water. The driver was conscious but pinned in. The passenger, Kathy Philpott, was unconcious and her head was submerged. These two men extracted Miss Philpott and rendered mouth to mouth resuscitation until the arrival of the Hopewell Emergency Crew. Box 1177 Richmond, Virginia 23209 Dear John: At a meeting of the Board of Supervisors of Chesterfield County today, the Board agreed to pay their share of the salary for an additional Assistant Commonwealth's Attorney in my office. I will forward a copy of the resolution to you as soon as it has been prepared. In the meanwhile, I would like to request permission from the Compensation Board to employ an additional assistant. As you know, I currently have three part-time assistants in my office. Herbert Gill, who has been with me for several years, is the equivalent of a full-time assistant because of the n~mber of hours he spends in the office. Because of changes in the operation of General District Courts and the Juvenile and Domestic Relations Courts of the County since I prepared my current budget, I feel it is absolutely necessary that I request an additional assistant. The General District Courts and Juvenile and Domestic Relations Courts now require thirty-seven man hours of time spent in court per week. Each of ~hese courts starts at i0:00 in the morning. If you allow only the hour from 9:00 to 10:00 on each of those days for preparation, this means that two part- time Commonwealth's Attorneys actually spend all the time that they are required to devote to their duties in my office in the courtroom. This allows no time for serious case preparation, no time for office ~rk, no time for legal research, and no time for any Circuit Court experience. M~. John M. Rasnick, Jr. November 26, 1975 Page The Circuit Court of Chesterfield has a criminal term once every other month. There was a time when this would mean all of the Circuit Court criminal work could be done in a two week period. This is no longer true. Statistics will show that the criminal case load in the Circuit Court of Chesterfield County has increased s~bstantially requiring between eighteen and twenty days per term which we are required to spend in actual courtroom work in Circuit Court. This prosecution work is done by Mr. Gill and myself. It again leaves very little time for proper preparation, research, and preparation of briefs. The duties ~hat I have described up to this point deal only with actual courtroom work and preparation therefor. I don't have to tell you or the members of the Board that with an increase in the courtroom work such as I have described there has been a corresponding increase in the general office duties. The telephone never stops ringing in this,office, and we get some criticism for not answering phone calls. The criticism may be Justified, but it becomes a question of priority. Additional duties imposed under the Reciprocal Support Act, extradition proceedings, and speedy trial proceedings, are factors which also have a bearing on my request. Therefore, I request permission from the Compensation Board to employ an additional part-time Assistant Commonwealth's Attorney at a starting annual salary of $10,500.00 to $11,000.00 effective immediately. I know that this is in the teeth of the Governor's hiring freeze, but feel that it is a request that is almost emergency in nature and should be acted on favorably by the Board.
