REQUEST:Conditional use approval to permit a business (pet grooming) incidental to a
dwelling in an Agricultural (A)District.
PROPOSED LAND USE:
Operation of a pet grooming business is proposedwithin the dwelling.

STAFF RECOMMENDATION
Recommend approval for the following reasons:
A.More intense uses (such as commercial boarding kennels) have been approved on
similar properties without any known adverse impacts onarea residential
development.
B.As conditioned, the proposed land usewould be compatible with existing and
anticipated area residential development.

exclusively, and shall not be transferable or run with the land.(P)

from the date of approval.(P)
(STAFF/CPC)3.The conditional use shall be limited to the operation of a pet
grooming business, for up to a maximum of fifteen (15) animals
per day by appointment only.(P)
(STAFF/CPC)4.There shall be no boarding,breeding or sale of animals associated
with this business.(P)
(STAFF/CPC)5.Other than family member employees that live on the premises,only
one (1) employee shall be permitted to work on the premises and that
employee is limited to part-time for a maximum of twenty-five (25)
hours per week. (P)
(STAFF/CPC)6.No outside runs or cages shall be permitted to contain the animals.
Animals shall only be permitted to be walked outside on a leash as
necessary,andshall not be left unattended.(P)
(STAFF/CPC)7.The outside area(s) where the animals are walked shall be cleaned
and made free of waste daily so as to eliminate odors and
proliferation of insects. All solid waste shall be stored in plastic
containers with lids. Such containers shall be legally disposed of
offsite at least once each month.(P)
(STAFF/CPC)8.No commodity shall be stored or sold on the premises except for
light inventory.(P)
(STAFF/CPC)9.Only one (1) sign shall be permitted to identify this use. Such sign
shall not exceed one (1) square foot in area and shall not be
illuminated.(P)
(STAFF/CPC)10.No assembly or group instruction shall be permitted.(P)
(STAFF/CPC)11.The business shall be permitted to operate between the hours of
7:30 a.m. to 6:00p.m., Monday through Friday;and,from 10:00
a.m. to 6:00p.m. on Saturdays.(P)

existing dwelling to accommodate this use.(P)
(STAFF/CPC)13.No more than one (1) vehicle and one (1) single axle trailer not
exceeding thirteen (13) feet in length and 3,200 pounds usedin
conjunction with the pet grooming business shall be parked on the
premises.No equipment shall be stored outside of the dwelling
except for equipment stored on the vehicle or trailer used in

conjunction with the business.The vehicle and equipment for the
use shall be parked on the premises, but a trailer must be parked,
except for loading and unloading, either in the rear yard or so that
its view is screened from adjacent properties and public roads.(P)

Location:
The request property is located along the eastline of Bethia Road and the westline of
Winterpock Road, across from Royal Birkdale Parkway and better known as 8401 Bethia
Road.Tax IDs 722-666-4632 and 4962.

UTILITIES
Public Water and Wastewater Systems:
The request site is currently connected to the public water system. This request will not
impact the public water system.
The request site is currently utilizing an individual private septic system. This request will
not impact the public wastewater system.
Individual Private Septic System:
The Heath Department must approve any new or expanded use of the individual septic
system.

ENVIRONMENTAL
This request will have a minimal impact on these facilities.
PUBLIC FACILITIES
Fire Service:
The Clover Hill Fire Station, Company Number 7, and Manchester Volunteer Rescue
Squad currently provide fire protection and emergency medical service (EMS). This
request will have a minimal impact on Fire and EMS.
County Department of Transportation:
As conditioned, this request will have a minimal impact on the transportation network.
The Thoroughfare Plan, a component of the Comprehensive Plan, identifies Winterpock
Road in this area as a major arterial with a recommended right-of-way width of ninety
(90) feet.When asked, the applicant was not willing to commit todedicate right-of-way
in accordance with the Plan.
Virginia Department of Transportation (VDOT):
VDOT notes that a low volume commercial entrance with the appropriate sight distance
(and any sight distance easements needed) will be necessary for access to the business on
this site.VDOT has no further comment.
LAND USE
Comprehensive Plan:
The Comprehensive Plandesignates the request property as a Suburban ResidentialII
area where residential use of 2.0 to 4.0 dwellings per acreis appropriate.
AreaDevelopment Trends:
The request property fronts Bethia Road to the eastand Winterpock Road to the west.
Surrounding properties to the north, south and west are zoned Agricultural (A) and are
occupied by single-family residential use on large acreage parcels.Properties across
Winterpock Road to the east are zoned residentially and are occupied by single-family
residential use and commercial outdoor recreational use (golf course).It is anticipated that
residential use will continue in the area as suggested by the Plan.
Use:
The Zoning Ordinance permits the keeping of an unlimited number of dogs in an
Agricultural (A) District as a private kennel.The ordinance defines a commercial kennel as
ì ïíÍÒðïêìóÚÛÞîéóÞÑÍóÎÐÌ
a facility where dogs are kept for boarding, breeding, care, grooming, sale or other purpose
for commercial gain. The proposed land use would be limited to pet grooming only and
would not include breeding,boarding or sale of animals. (Conditions 3 and 4)
Recommended conditions would permit grooming of a maximum of fifteen (15) pets per
day by appointment only; would limit the operation to the applicant exclusively for a period
of five (5) years; and would allow only one (1) part-time employee in addition to family
member employees that live in the home. (Conditions 1, 2 and 5)
According to the applicant, clients would only be accepted by appointment with established
drop-off and pick-up times.Condition 10would prohibit assembly or group instruction on
the request property.This is the same restriction for home occupations in an Agricultural
(A) District.In addition, conditions would limit hours of operationand would require
animals to be on a leash and attended at all times.(Conditions 6 and 11)
Development Standards:
The pet grooming business would be operatedincidental to the existing dwelling.
Recommended conditions would require the use to meet restrictions similar to standards for
a home occupation in an Agricultural (A) District. Condition 12would prohibit additional
buildings and exterior additions or alterations to accommodate the use and Condition 8
would permit only light inventory to be stored or sold on the request property.
Since the keeping of an unlimited number of dogs is permitted by-right in an Agricultural
(A) District as a private kennel, outside run areas would be permitted on the request
property even if this conditional use to permit the pet grooming business is not approved.
However, to further ensure that the residential character of the property is maintained,
Condition 6would not permit outside runs or pens associated with this business.In
addition, the areas where animals are walked outside would be required to be cleaned
daily to eliminate odors and the proliferation of insectsand waste shall be stored and
removed from the property monthly.(Condition 7)
In keeping with limitations for home occupations in an Agricultural (A) District,
Condition 13would limit vehicles permitted for the commercial kennel use to one (1)
vehicle and one (1) single axle trailer, would prohibit outside equipment storage,and
would limit parking for the vehicle and/or trailer.
Signage:
Only one (1) sign with a maximum area of one (1) square foot would be permitted to
identify the commercial kennel.Such sign shall not be illuminated. (Condition 9)
CONCLUSION
Other commercial kennel uses have operated on similar properties with no known adverse
impactson area properties. Conditions are recommended which meet or exceed standards for
home occupations in an Agricultural (A) District. As conditioned, thekennel would be

compatible with area residential development and the residential character of the area will be
maintained.
Given these considerations, approval of this request is recommended.

The applicant accepted the recommendation.There was no opposition present.
On motion of Dr. Wallin, seconded by Mr. Patton, the Commission recommended
approval subject to the conditions on pages 1 through 3.

The Board of Supervisors, on Wednesday, February 27, 2013 beginning at 6:30 p.m., will take
