Baker Title: Chief of Police Attachments: Yes ~ No RECOGNIZING MASTER POLICE OFFICER JAMES A. ~BUBBA" ANDREWS UPON HIS RETIREMENT WHEREAS, Master Police Officer James A. ~Bubba" Andrews will retire from the Chesterfield County Police Department on December 1, 2002 after providing over 29 years of quality service to the citizens of Chesterfield County; and WHEREAS, Officer Andrews has faithfully served the county in the capacity of Dispatcher, Patrol Officer, Field Training Officer, Instructor, Hostage Negotiator, Crime Prevention Officer, Community Policing Specialist, Senior Police Officer and Master Police Officer; and WHEREAS, Officer Andrews was selected as Police Officer of the Year for 1996; and WHEREAS, Officer Andrews received the Meritorious Service Award for his work as a Hostage Negotiator where he had a successful rate as a primary negotiator of never losing the life of a victim; and WHEREAS, Officer Andrews has been Chesterfield County's only recipient of the Professional Service Award from the Virginia Crime Prevention Association for significant contributions towards advancing the theory and practice of Crime Prevention in reducing crime; and WHEREAS, Officer Andrews was selected as the first official Community Policing Specialist and implemented the first Community Policing Project in Chesterfield County; and WHEREAS, by building a partnership with ~Ettrick on The Move" and the Ettrick Business Council, Officer Andrews was able to reduce crime and build a better quality of life for the citizens of the Ettrick community; and due to the success of the Ettrick project, he was selected to establish five of the eight current Community Policing Projects in Chesterfield County; and WHEREAS, Officer Andrews started the first Chesterfield County Business Watch Program, which is still currently being used today, and has spoken to many organizations and law enforcement agencies, both locally and nationally, on topics of Community Policing, Crime Prevention, Highway Safety and Public Safety; and WHEREAS, throughout his career, Officer Andrews has obtained numerous Drivate donations for education and prevention through such projects as the revitalization of Safety Town, Community Policing Storefronts, and Public Service Announcements for Highway Safety, which were so successful that Officer Andrews was recognized by the Virginia Department of Transportation and was nominated for the Governor's Transportation Award; and WHEREAS, Officer Andrews has received numerous letters of thanks and appreciation from citizens and businesses for his assistance and crime prevention presentations; and WHEREAS, Chesterfield County and the Board of Supervisors will miss Officer Andrews's diligent service. NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of Supervisors, this 26~ day of November 2002, publicly recognizes Master Police Officer James A. ~Bubba~ Andrews, and extends on behalf of its members and the citizens of Chesterfield County their appreciation for his service to the County, their congratulations upon his retirement, and their best wishes for a long and happy retirement. To Consider a Revision to the Subdivision Ordinance Relative to the Second Access Requirements at the Time of Zoning County Administrator's Comments: County Administrator: Board Action Requested: The Planning Commission and staff recommend the Board of Supervisors approve the amendment to the Subdivision Ordinance relating to second access requirements, as shown in Attachment A. Summary of Information: The Board conducted 'a public hearing on October 23, 2002, and requested staff to prepare an analysis of the relief granted to this provision of the Subdivision Ordinance since its effective date of February 28, 2001. This analysis is provided in Attachment E. During this time period, 16 residential rezoning applications were approved of sufficient size to require a second access. Seven of the cases requested relief from the second access requirement and were approved by the Board of Supervisors. Staff has prepared another alternative, Alternate D, which would allow relief to be granted through the zoning process, subject to limitations and the same standards as provided in the adopted subdivision ordinance. If an applicant cannot meet the limitations and standards, he may submit the tentative subdivision plat to the Preparer Thomas E. Therefore, the status of the subdivision waiver request can be determined before the Board of Supervisors makes a zoning decision. The new subdivision ordinance, adopted last year, requires a second access to be provided into a new residential subdivision, when more than 50 lots are created (100 lots under certain circumstances). This ordinance was amended at the Board of Supervisor's public hearing at the request of a local land use attorney to allow relief to this requirement at time of zoning. Since adoption, a significant number of zoning applications included a request for relief to this standard. Many times, this relief is sought before the developer has completed a detailed engineering analysis of the site. This means the Board of Supervisors must consider the request with minimum detailed information. The Planning Commission requested staff to prepare an ordinance amendment to allow relief to the second subdivision access requirement at the time of tentative subdivision approval when detailed design information is available. The Planning Commission held a public hearing and recommends approval of an amendment, as shown in Attachment A, to the Subdivision Ordinance to delete the provision that permits relief to the second access through the zoning process for the following reason(s): · The ordinance will still allow relief to the second access at tentative plat review, when sufficient technical information is available; · The technical information to substantiate the need for relief is typically not available at time of zoning; · While participating in the nearly two year effort to revise the Subdivision Ordinance, the development community requested the relief to the access provision as part of the tentative plat process; · There are no standards included in the Subdivision Ordinance to achieve the relief through the zoning process as there are through the tentative subdivision process. The Board conducted a public hearing on the amendment on June 26, 2002, and directed staff to prepare an alternative, which would allow an appeal of the Planning Commission decision to the Board of Supervisors. Staff drafted the language, as shown in Attachment B, which would allow an appeal to the Board of Supervisors if: 1. The Planning Commission's decision will cause emergency services response times to exceed County Fire Department goals, or CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 3 2. The Planning Commission's decision will cause traffic volumes on local streets to exceed the Planning Commission's stub road policy. The Board conducted a public hearing on August 20, 2002, and based upon further discussion, directed staff to prepare an alternative which would allow a simpler standard of appeal of the Planning Commission decision to the Board of Supervisors. The Planning Commission revisited the issue at the September 17, 2002 meeting and advises the Board of their support for patterning the appeal decision in the same manner as the Board's review of Substantial Accord decisions. Staff drafted the lanquage, as shown in Attachment C, which would allow an appeal to the Board of Supervisors if: 1. An aggrieved person appeals the decision of the Planning Commission to grant the waiver, 2. An aggrieved person appeals the decision of the Planning Commission to deny the waiver if the decision will cause the volume of traffic on a local street to exceed the Planning Commission's Stub Road Policy. The requirement for access to any proposed subdivision shall be governed by the conditions of that case. b. Relief to these requirements may be granted at the time of zoning for cases filed after (DATE OF ADOPTION/EFFECTIVE DATE) with a preliminary_ tentative plat consisting of an approximate lot and street layout depicting mitigating environmental features that clearly demonstrates: 1. the amount of relief does not exceed the allowable number of lots by more than fifteen (15) percent, and 2. existing severe topographic, physical or extenuating circumstances exist so that there is no other practical means of providing another access, and 3. financial hardship is not the principal reason for the waiver, or 4. without granting relief to these requirements traffic on an existing local street will exceed the planning commission's stub road policy as determined by the director of transportation. c. After (DATE OF ADOPTION/EFFECTIVE DATE), relief to these requirements may be granted by the planning commission or director of planning if: a. 1. existing severe topographic, physical or extenuating circumstances exist so that there is no other practical means of providing another access, and b. 2. financial hardship is not the principal reason for the waiver-r_. c. 3. During this timeframe there have been twenty-three (23) residential zoning cases, sixteen (16) of those case were of sufficient size to require a second access. Of those cases that warranted a second access the following seven (7) cases were granted relief to requirements of the Subdivision Ordinance through the zoning process. (F) 01SN0165 (Arbor Meadows) 6. There shall be no access from this project to the Autumn Oaks Subdivision. There shall be no stub roads or rights-of- way provided along the eastem property boundary. (T) 7. There shall be at least one stub road provided to tax id #776-659-1638. (T) 17. A boulevard type entrance shall be provided at the intersection with the north/south arterial. In conjunction with approval of this request, an exception to section 17-76(h)(1 through 3) of the Subdivision Ordinance shall be granted to delete the requirement to provide a second public road access or a residential collector street for more than fifty (50) lots. A geotechnical report or a report from a registered professional engineer shall be submitted to verify the carrying capacity of any such emergency access materials and design. The exact location, design and provisions for maintenance of such emergency access shall be submitted to the Fire Department for review and approval. This condition supersedes those portions of proffered condition 3 that would other,vise permit up to 250 lots to be developed offa single access. (F) 7. No lots or dwelling units shall be recorded or site plan approved on the property that have access southward to Genito Road until one (1) of the following conditions has been met: (a) Woolridge Road Extended has been constructed, as determined by the transportation department, across the property and connected with Old Hundred Road/Powhite Parkway Extended, as provided in alternative b of proffered condition 3, or with Old Hundred Road, as provided in alternative a of proffered condition 3; or (b) Woolridge Road Extended and Watermill Parkway have been constructed, as determined by the Transportation Department, from Genito Road to Old Hundred Road/Powhite Parkway Extended, to provide through access from Genito Road to Old Hundred Road/Powhite Parkway Extended, as specified in proffered condition 3(a)(i)(b). This condition supersedes any portion of the proffered conditions that would otherwise permit lots or dwellings units on the property with access southward to Genito Road prior to completion, as determined by the Transportation Department, of either the Woolridge Road Extended/Watermill Parkway connection, or the connection of Woolridge Road Extended from the property to Old Hundred Road/Powhite Parkway Extended or the connection of Woolridge Road Extended from the property to Old Hundred Road. (T) The applicant or his assignee and approved by CDOT, the following phasing of the development shall be permitted: a. A' cumulative total of no more than one hundred twenty five (125) residential lots or dwelling units may be recorded or site plan approved on the property with access via Woolridge Road (proposed), as shown on the master plan (hereinafter "Woolridge Road Extended"), from the property southward to Genito Road across the adjacent parcel (tax id 7196872732); b. Residential use of up to 3.63 units per acre is permitted in a residential (R-12) district. The density of the C-2 portion will be controlled by zoning conditions or ordinance standards. The comprehensive plan suggests the property is appropriate for residential use of 2.51 to 4.0 units per acre. This request lies on 148.8 acres fronting approximately 2,550 feet on the west line of Harrowgate Road, across from Wellspring Road. Tax ids 791-641-1825 and 793-640-0587 (sheet 34). 14. There shall be no public road access to Hill Spring, Foxwood or Greyfield Place subdivisions. Emergency access shall be permitted through Foxwood subdivision. If emergency access is provided, such access shall be vacated at such time that Wellspring Road extended is constructed to Branders Bridge Road. This item requests Board approval of a New Streetlight Installation in the Clover Hill District. Summ of Information. Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections; o There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection, or 400 VPD if the requested location is not an intersection; CONTINUED NEXT PAGE Preparer: Richard M. The Board, upon presentation of the cost quotation may approve, defer, or deny the expenditure of funds from available District Improvement Funds for the streetlight installation. If the expenditure is approved, staff authorizes Virginia Power to install the streetlight. A denial will cancel the project and staff will so notify the requestor. A deferral will be brought before the Board again when specified. "As many as six drivers may leave early in the morning from other residences on Wynnewood Drive; these include two (2) high school teachers in the city of Richmond and a young man subject to irregular assignments in his employment by Capital One at Innsbrook. "Senior citizens reside at four (4) properties on Wynnewood Drive with residents at 2100 and 2125 having suffered serious heart problems. A resident at 7100 Wynnewood Court is an "early-retiree" subject to heart irregularities that require immediate hospitalization at times. "We invite any officials responsible for determining the lighting needs on Wynnewood Drive and Wynnewood Court to visit this spot on a dark night or early morning when yard lights 000016 are not turned on at 2109 Wynnewood Drive and 2119 Wynnewood Drive. The School Board's FY2003 Approved Annual Financial Plan included an appropriation of $17,063,500 and 283.5 full-time equivalent positions in the School Grants Fund. In addition, the school division applies for other grants during the year that can be used to enhance the current instructional program. CCPS staff has received awards for six (6) new grants for FY2003. In addition, the Jobs for Virginia Graduates has been reinstated through alternate funding ($92,474) and the School to Work Grant will continue in FY03 specifically to expand the number of automotive technology trainers and computers that interface with one another ($51,000). Two grants, Goals 2000 for $169,000 and Technology Literacy for $57,700 were not approved for FY03. All of these revisions now require School Board approval. The total increase to school appropriations is $1,630,924 and 28.1 FTE. Attachment A reflects the FY2003 approved budget for grants compared to actual grant awards received. These funds will be used to help provide a quality program of English as a Second Language (ESL) instruction to the 819 ESL students who attend CCPS. A portion of the funds will be used to train all 31 ESL teachers the procedures for measuring language proficiency using ESL standardized tests. In addition, funds will be available to provide a brochure to the parents and community explaining the ESL program of CCPS. No local funds are involved. Title II - Part D Technology Grant for $115,355 was awarded to CCPS in FY03 through State Superintendent's memo #120. These funds will be used to promote initiatives that provide teachers, principals, and administrators with the capacity to integrate technolo~ effectively into curricula and instruction. In addition, the ongoing professional development will be improved by providing constant access to training and updated research through electronic means. Another initiative will be to support the development and utilization of electronic networks and other innovative methods of delivering curricula for students in areas that otherwise would not have access. The funds will be used for training, software, supplies, and computer equipment. No local funds are involved. Falling Creek Elementary REAL (CDBG) Grant was included in the approved County's Community Development Block Grant Plan (CDBG) in the amount of $6,000. The CDBG Plan was approved by the Board of Supervisors on April 10, 2002. These funds will be used to provide part-time salaries and transportation for ~an after-school remediation program four days per week. Harrowgate CVS Tutoring - CCPS received notification from the CVS Charitable Trust, Inc. that Harrowgate had been awarded $75,000 to fund a three-year tutoring program. The funds will be used to hire high school students in the Harrowgate area to tutor elementary students in reading and math. No local funds are involved. Phillip Morris Anti-Tobacco Media Blitz Grant. - The Virginia Tobacco Settlement Foundation awarded CCPS $66,709 for an anti-tobacco media blitz project. Manchester High will use their Mass Communications Specialty Center to create materials and media advertisements for anti-tobacco campaigns. These items will be shown through CCPS schools and materials will be distributed to all CCPS secondary schools. Surveys will be taken in the spring to determine if the campaign items worked and how well. Manchester students will compile the survey tool as well as the other items. Local funds needed for this project are already available through the Mass Communications program at Manchester High. MCD Award - CC Goes to School - In June School Pupil Transportation was awarded $5,000 from the MCD Award funds for their project CC Goes to School. This project provides a mobile classroom for on-site training to primary grade students on specific safety related topics. No local funds are involved. Summary of Information: The bond referendum, overwhelmingly approved on November 5, 1996, yielded $174,799,000 for new schools, renovations, and technology and will benefit every school in the county. In addition, $31,310,000 was committed over this six-year period from the CIP Reserve. Projects approved in the bond referendum with current appropriations are included in the following CIP analysis. Attachment A-1 is a financial schedule delineating the current status (as of September 30, 2002) of the School CIP projects. This schedule includes the beginning budget by project including the appropriation for the November 2002 VPSA bond sale, the current budget including changes by project this year, and the revised needs budget resulting in a surplus or deficit. The schedule also provides the project status (open, complete, or delayed) for the current period. The current status reported for this quarter is as of September 30 and reflects an overall projected deficit; therefore, recommended revisions at first quarter are discussed below and are included in Attachment A~2. Additional funding needed for these eleven projects is $370,000. Bailey Bridge Middle is currently undergoing renovations including additional classroom space. Because of this, the food service areas at this location need additional serving lines requiring an appropriation of $85,000. Salem Middle dining room renovations are underway and in order to complete this project, funding of $150,000 is needed. Swift Creek Middle is the last kitchen in the system to need air conditioning. The cost to provide this is estimated at $150,000. Perrymont Road School Renovations - In order to prepare food for the students at the Perrymont Road location, extensive renovations are needed for the kitchen and food serving areas in this building. The estimated cost for this renovation is $325,000. The projects listed above are to be funded by the School Federal Food Service program. Revenues for federal lunch reimbursement need to be adjusted upward by $400,000. Salaries and benefits can be reduced by $145,000 and capital funds of $535,000 can be used to fund the capital project needs at this time. The total increase in the School Federal Food Service Fund would be $400,000. The amount of $1,080 000 will be transferred to the School CIP fund. ' Clover Hill High and James River High also have some building renovations underway. While the cafeteria and kitchen areas are being renovated at these locations, serving line renovations will be done at a cost of approximately $135,000 and $100,000, respectively. The Midlothian and Thomas Dale High School cafeteria renovations were less than anticipated ($90,000 and $60,000, respectively) and the savings on these projects will be used towards the needs at Clover Hill and James River. The balance ($85,000) of the projects will be transferred from the operating and capital accounts in the School Non-Federal Food Service Fund. There is no change in the Non-Federal Food Service Fund appropriation. Based on the September 30 first quarter review of these food service improvement projects, the School Board staff has projected a deficit in many of the projects as indicated on Attachment A-1. The $400,000 increase in the Food Service Fund is due to revised estimates of federal lunch reimbursement revenue. The balance of $680,000 that is needed to cover the total federally funded project improvements will be covered by a $145,000 reduction in the salary and benefit budget and by $535,000 in capital expenditures already budgeted in this fund but no longer needed. Summary of Information: In June 2002, the Board adopted changes to certain Planning Department fees for development review. The changes resulted in an approximate five percent reduction to commercial development review fees and an increase to residential review fees consistent with the County Administrator's recommendation. The County Administrator's recommendation was part of a three-year phase in of fee increases to recover approximately 80% of the direct costs of performing such reviews. The attached ordinance increases residential review fees to the next step of the three-year phase-in.
