REQUEST'AND PROPOSED USE: A Variance to use a parcel of land for
dwelling purposes which fronts along an unimproved public road.
The applicant plans to build a single family dwelling on thi~

LOCATION AND TAX MAP: In Bermuda Magisterial District, this parcel
fronts along the south line of North Street andis located approx-
imately B20 feet southeast of its intersection with Spruce Avenue.
Tax Map Section 156'g (B) Popolar Hills, Lot ~ (Sheet 45/44).
PROPERTY ACREAGEa ZONING AND LAND USE: This parcel is 4. TB acres in
area, zoned Agricultural (A) and is wooded and vacant,
ADJACENT AND AREAa ZONING AND LAND USE: Adjacent property is zoned
Agricultural (A) except that to the south which is zoned Residential
(E-7)o Adjacent property is occupied by a single family dwelling
or remains wooded and vacant.
UTILITIES: Old Cominion Soil Consultants report this parcel is suitable
for installation of a septic tank and drainfield system and an
individual well. Howeverj because of the limited area.of useable
soils~ this home site should be used as a three bedroom house.
DRAINAGE AND EROSION: Surface and roof water should be directed away
from the drainfield areaj and the finished grade should not allow
ponding of surface water n-ear the drainfieldo

STAFF ANALYSIS AND RECOMMENDATION: In this case, the applicant plans to
build a single family dwelling on this lot. He states that access to
Spruce Street will be over and across North Street which is an un-
improved public'road. Staff reviewed the application and finds that
due to soil conditions of this lot, no larger than a three bedroom
dwelling should be located on this property. Staff visited the sit~
and finds that there are three families now using North Street for
access to Spruce Avenue.
RECOMMEND APPROVAL OF THIS REQUEST SUBJECT TO THE FOLLOWING CONDITION$~
A ~$ foot wide_public road easement, measured from the centerline
of North Street, be dedicated from Point A to Point B as shown
on the attached map. This dedication would be with the under-
standing that the County will not build or maintain this road
until it is brought to State standards by others.
