REQUEST AND PROPOSED USE: A Conditional Use to permit the operation and maintenance of a Dog Kennel and Stock Farm. The applicant is desirous of keeping four dogs and 5ne horse on the parcel in question. 'GENERAL' LOCATION AND TAX MAP INFORMATION: The parcel is located on the south side of Graves Road between the intersections of Chemin Road and Sadberge Drive. Tax Map Sec. 171-15 (2) Grayson Estates, Sec. 1, Blk. B, Lot 9 (Sheet 47). ACREAGE:' EXISTING ZONING: EXISTING LAND USE (SUBJECT PARCEL): The lot in question contains approximately 3 quarters of an acre, is zoned Residential (R-15) and is occupied by a single family dwelling and a rear yard area set aside for the requested areas. ADJACENT AND' AREA ZONING AND LAND USE: Adjacent property (south, east and west) is zoned Residential (R-15) and occupied by single family dwellings. Property to.the north across Graves Road is zoned Agricultural (A) and is vacant pasture land. ''GENERAL' PLAN: Single family ~esidential development of the area encom- passing the parcel in question. ''STAFF' ANALYSIS A~ RECOMMENDATION: The majority of adjacent property sur- rounding the request parcel has been zoned and Subdivided (Grayson Es- tates) for single family residential use. Generally speaking, the land is flat and open, affording no buffering of either the existing horse pen or dog run. The dog run and paddock is located approximately 3 feet from the adjoining property line to the west. Pianning Staff upon review of the application and after inspecting the parcel offers the following observations. 1. The lot in question as well as the majority of adjacent property had been developed for single family residential use. The keeping of both a horse and four dogs on the lot exercises a more than normal situa- tion, relative to neighborhood pet keeping. 2. During the site inspection, odor from the horse was readily noticeable and although the applicant has made an attempt to keep the parcel clean and orderly the appearance of the dog enclosure, dog run and horse paddock is not in keeping with other back yard uses in the area nor with reasonable residential use in general. 3. Staff noted that in addition to the subdivided residential property a number of large parcels within the area are agriculturally zoned. These parcels are in close proximity to subject parcel. This being the case and alternative to keeping the animals on the applicant!s lot would be to maintain the animals on the adjacent property which is larger and more suited for the accomodation of such uses. 4. Another alternative would be to deny the request of the keeping of the horse, allowing a restrictive kennel operation on a conditional basis. Such a situation would immediately relieve the most obJec- tional aspect of this use. Still another alternative would be to (over) phase lout the entire operation over a period of time. In conclusion Planning Staff is of the opinion that the lot in question is too small for keeping of the animals requested. In addition it is be- lieved that the existing situation offers a detriment to the adjacent residential property and a potential hazard to the health and welfare of the neighborhood. MOWEVER~ SHOULD THE COMMISSION SEE FIT TO RECOMMEND APPROVAL OF ALL OR A PART' O? THE REQUEST THE STAFF OFFERS THE FOLLOWING CONDITIONS FOR CON- SIDERATION AS AN ATTEMPT TO GUARANTEE A MORE ACCEPTABLE SITUATION. 1. This Conditional Use shall be granted to and for William R. Rose- bury, III and shall not be transferable nor run with the land. 2. a. This Conditional Use shall be restricted to the keeping of no more than 3 dogs and 1 horse for a period of time not to ex- ceed 18 months from the date of approval. b. This Conditional Use shall be restricted to the keeping of no more than 3 dogs and for a period of time not to exceed 2 years from date of approval. 3. The sale or offering for sale of dogs other than those now present on the parcel and their offspring shall be prohibited. 4. The keeping of the dogs in question shall be restricted to either the interior of the existing residence or confined to no more than 2 dogs kept in exterior runs or kennels constructed for' this purpose. 5. The keeping of the horse shall be confined to the rear portion of the lot (area now fenced). 6. The horse enclosure shall bo secured so as to confine the animal and the enclosure area is to be cleaned and made free of manure daily. When necessary, fresh straw and disinfectant shall be applied to eli- minate the proliferation of odor and propagation of insects.
