11-26-68 MinutesVIRGINIA: At an adjourned meeting of the Board of Supervisors of Chesterfield County, held at the Courthouse on November 26, 1968, at 2:00 P.M. Present: Mr. Irvin G. Director Richmond Regional Planning Commission It was cited that the proposed Ordinance on the Policemen's Pension and Retirement System had been advertised for a public hearing at this time and date. There was read a letter from Mr. Kenneth Campbell, the County's Actuary, citing the effect that the proposed O~dinance change would have on the financing of the Police men's Retirement System. There appearing no one in opposition to this Ordinance, it is on motion of Mr. Dietsch, seconded by Mr. Martin, resolved that the loll( ordinance be and it hereby is adopted: AN'ORDINANCE establishing a retirement system to be known as Chesterfield County Policemen's Pension and Retirement System[ establishing Chesterfield Police. men's Pension and Retirement Board~ setting forth the general powers, authority, and duties of such board[ providing rules and regulations for determining eligi- bility for retirement and to receive such pensions and benefits as prescribed here- in] prescribing how much each member shall contribute monthly to fund the system and providing for annual contributions by the County to assure that the system sha] be financially solvent[ providing for effective date of such ordinance under certa~ conditions. BE IT ORDAINED by the Board of Supervisors of Chesterfield County, Virginia: 1. There is hereby established the Chesterfield Policemen's Pension and Retiremen' System as provided for herein. 2. There is hereby established the Chesterfield Policemen's Pension and Retiremen- Board consisting of five members, three appointed by the Board of Supervisors from the citizens of Chesterfield County for terms of two, three, and four years, respectively, one member shall be the chief of Police of the Chesterfield County Police Department and one member shall be an employee of the Chesterfield County Police Department elected annually by the membership of the Police Department. Retirement Board shall have the duty to operate and administer the retirement syste and review all applications for retirement or other benefits as provided and shall have the further duty to investigate the reports that minor children of a deceased police officer are not properly cared for and if such reports prove true, shall have the authority to make payments for the said minor children as they deem in the best interest of said children. Any member on disability retirement is subject to review by Retirement Board, and any member has the right to ap~e~ the decision of the Retirement Board to the Board of Supervisors. Such Board shall at its first meeting, and annually thereafter, elect one of its members as president, one as secretary and may also elect a vice president, and shall elect a treasurer. 3. The general powers, authority and duties of such board shall be as follows: a) To make and adopt by-laws, rBles and regulations lawful to be made, which the Board may deem necessary for the proper conduct of its affairs[ b) To provide for such clerical, legal, and medical and other services as the Board may deem necessary or proper, and provide for the payment of suitable sation for such services~ c) To provide for, and require, deductions from the salaries of active and paid members of such police department and cause the same to be paid into the trea- sury of the Board, certain percentages of salaries, as hereinafter specified, for the purpose of raising funds for the necessary purposes of the Board in the admini~ tration of its affairs. d) Draw warrants on the treasury of the Board, for the payment of pensions benefits hereunder, and costs and expenses of administration, which warrants shall be signed in the name of the Board and countersigned by its president. 4. The treasurer of such Board shall be the custodian of all the funds and securi- ties of the Board, and shall give bond, payable to the Board in such amounts and with such surety as may be required by the Board, conditioned for the faithful per- formance of his duties and the proper accounting for all funds and securities comir into his hands, the cost of the Bond to be paid out of the funds of the Board[ and he shall disburse the funds of the Board on warrants drawn on him by the Board, signed and countersigned as herein above provided for. 5. MEMBERSHIP: Membership in the retirement system shall be voluntary for Police Officers presently employed at the time this ordinance becomes effective. Thereafter, all police officers employed by the County shall be required to become members of the retirement system. Each member shall contribute monthly an amount equal to three per centum (3%) of his monthly compensation. 6. ELIGIBILITY FOR RETIREMENT AND PENSION: Any member who has attained the age of fifty-five (55) years and twent~ (25) years creditable service with the Chesterfield County Police Department shall be eligible for retirement. Creditable service shall mean one years credit for each year as a member of the Police Department before chartering of the Chesterfie[ Police Benevolent Association and one year's service for each year as a member of the Chesterfield Police Benevolent Association and one year's service for each yeaI after this plan is adopted. Each year a member of the Chesterfield Police Benevo- lent Association is in the Armed Forces involuntarily shall count as one year cred] able service providing the member returns to the Police Department after being Honorably Discharged from the Armed Forces. Upon retirement, a member shall receive an annual retirement allowance which shall equal one and one fourth per centum (1~%) of the highest five (5) years average income multiplied by the number of years of his creditable service. When any member shall have reached the age of sixty years or over and has twenty-five (25) years of creditable service, he shall be eligible for retirement and his mini- mum retirement payment shall be One Hundred and Seventy-five dolloars ($175.00) peI month. If any member after retirement shall die, leaving a widow, then the widow of such member during her widowhood, shall receive an annual allowance, payable month- ly, equal to one-half (~) of the member's retirement payment. Said widow receives this amount until she reaches eligibility age for receiving maximum Social Sec~rit~ Benefits. If he leaves no widow, or the widow dies or remarries, then such child or children, if any, of the deceased member, under the age of eighteen (18) years, shall be paid such allowance until such child or children die or attain the age of eighteen (18) years, whichever shall occur first. If more than one child survives the deceased member, the allowance shall be divided among them and paid in such manner as the Retirement Board may determine. If a member hereafter dies in service at any time before retirement from a cause determined by the Retirement Board to be compensable under the Virginia Work- men's Compensation Act, there shall be paid an annual allowance payable monthly,to the widow of such member during her widowhood, if he leaves a widow, equal to one- half (~) of the members pension if he had retired at his earliest retirement age. (average of highest five (5) years income multiplied by the number of years of cre- ditabl.e service plus the number of years member would have been required to work t¢ reach his earliest retirement age.) If he leaves a widow and child or children under the age of eighteen (18) years of age, then the widow shall receive full amount of pension until child or children reaches the age of eighteen (18) years. tf he leaves no widow, or the widow, or the. widow, or the widow dies or remarries, then such child or children, if any, of the deceased member, under the age of eigh. teen (18) years shall be paid full allowance until such child or children die or attain the-age of eighteen (18) years, whichever shall occur first. If more than one child survives the deceased member, the allowance shall be divided among them in such manner as the Retirement Board may determine. Any benefits payable under the Virginia Workmen's Compensation Act shall offset against any benefits payable under the retirement system. Any member at any time before retirement who becomes permanently disabled without misconduct from a service connected disability which prevents him from carrying out any duties as a member of the Police Department shall be retired and receive an annual retirement allowance payable monthly which shall equal one and one fourth per centum (1¼%) of the average of highest five (5) years income multi- plied by the number of years of creditable service plus the number of years member would be required to work to reach his earliest retirement age. Any benefits pay- able under the Virginia Workmen's Compensation Act shall be offset against any benefits payable under this system. Any memb er at any time before retirement who has ten or more years of cre- ditable service, who becomes permanently disabled without misconduct from a disa- bility which prevents him from carrying out any duties as a member of the Police Department shall be retired and receive an annual retirement allowance payable monthly which shall equal one and one fourth per centum (1¼%) of average of highes' five year (5) income multiplied by the number of years of creditable service plus the number of years member would have been required to work to reach his earliest retirement age. 7. DEATH BEFORE ELIGIBILITY FOR RETIREMENT AND SEPARATION FROM SERVICE: In the event a member of the Chesterfield County Police Department who part~ cipates in the retirement system shall die before retirement from a cause determin~ by the Retirement Board not to be compensable under the Virginia Workmen's Compen- sation Act, his estate shall receive the amount he has contributed to the Retire- ment Fund. If a member resigns or is separated from the Police Department, he Sha[ on application, be paid the amount of his contributions paid into said Retirement Fund and into the Chesterfield Police Benevolent Associated, Incorporated, or if he had at least fifteen (15) years creditable service, he may elect to leave the amount contributed in said fund and he shall be paid annually one and one fourth per centum (1¼%) of his highest five (5) years annual average for creditable ser- vice multiplied by the number of years of creditable service in monthly installment when such member reaches the eligibility age for receiving maximum Social Security Benefits. In the event of his death prior to reaching eligibility age for receiv- ing Social Security Benefits, then the amount contributed shall be paid his estate 8. CONTRIBUTIONS BY THE BOARD OF SUPERVISORS: The Board of Supervisors shall contribute annually sufficient funds to as- sure the proper operation of the system and the payment of benefits falling due hereunder. Each annual contribution shall be actuarially determined percentage of payroll such that the aggregate Present value of future contributions at such per- centage rate, together with the current assets of the fund and the aggregate prese] value of future member's contibutions shall equal the present value of all benefit: under the system. 9. DEDUCTIONS FROM SALARIES: There shall be deducted from the.salaries of such policemen who are members of the retirement system such amounts as provided for herein which shall be paid County of Chesterfield, virginia, by the Chesterfield Police Benevolent Associatio! investments under the laws of this Commonwealth. Mr. Robert Clark, of Carlto~ T~ylor and Clark, comes before the Board presenting the bids ior the additions to the Health Building at the Courthouse and recommends by letter, that the County accept the low bid. Upon consideration whereof, it is on ~otion of Mr. Apperson, seconded by Mr. Martin, resolved that this Board accept the base bid of $320,000 submitted by Thom~s E. Nuckols~ which bid was the lowest of thirteen bids received. And be it further resolved that Alternate I in the amount of $3800.00 be and ~t hereby is accepted, and the bid is hereby awarded to T. E. Nuckols, Contractor. These roads serve 1 house. And be it further resolved, that the Board of Supervisors guarantees to the Virgin Department of Highways, SO-ft. rights of way for these roads. Plat recorded in Plat Book 13, pages 82, 83 & 84 on March 12, 1964. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Logan Street, in Logancourt Subdivi sion, Midlothian Magisterial District, which shows that in the opinion of the Coun'y Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, andon motion of Mr. Martin, it is resolved that Logan Street, in Logancourt SubdiviSion, Midlothian District, be and it hereby is estab-~ lished as a public road. And be it further resolved, that the Virginia Department of Highways be and it her, - by is requested to take into the Secondary Road System, Logan Street, from the northern end of maintenance on Rt. 1705, northwardly .09 mi. to a temporary cul-de. sac. This road serves 4 houses. And be it further resolved, that the Board of Supervisors guarantees to the Virgin a Department of Highways, a 50-ft. right of way for this road. Plat recorded in Pla Book 16, page 2 on September 5, 1967. This day the country Road Engineer in accordance with directions from this Board made report in writing upon his examination of LaBrook Concourse, in LaBrook Con- course Subdivision, Manchester Magisterial District, which sh~ws that in the opinl of the County Road Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of Mr. Dietsch, it is resolved that La- Brook Concourse, in LaBrook Concourse Subdivision, Manchester District, be and it hereby is established as a public road. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System, LaBrook Concourse,from a point on Rt. 644 .03 mi. northwest of its intersection with Rt. 2247, eastwardly and northwardly .37 mi. to U.S. Route 60. This road serves as a connecting road. And be it further resolved, that the Board of Supervisors guarantees to the Virgin Department of Highways, a 60-ft. right of way for this road. Plat recorded in Dee. Book 935, pages 95-99 on October 24, 1968. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Wood-Dale Road, Castlebury Drive, Rochelle Road and Kiefer Road, in Truheart Heights Subdivision, Section "2", Bermu~ Magisterial District, which shows that in the opinion of the County Road Engineer it is expedient that said roads be established as public roads. Upon consideration whereof, and on motion of Mr. Purdy, it is resolved that Wood- Dale Road, Castlebury Drive, Rochelle Road and Kiefer Road, in Trueheart Heights Subdivision, Section 'J2", Bermuda District, be and they hereby are established as public roads. And be it further resolved, that the Virginia Department of Highways be and it her~ by is requested to take into the Secondary Road System, Wood-Dale Road, from its intersection with Rt. 609, hortheastwardly .07 mi. to its intersection with Rochet] Road, thence northeastwardly .03 mi. to a dead end~ Castlebury Drive, from its int~ section with Rt. 609, northeastwardly .07 mi. to its intersection with Rochelle Ro~ thence northeastwardly .03 mi. to a dead end~ Rochelle Road, from a point on Castl~ bury Drive .07 mi. northeast of its intersection with Rt. 609 northwardly and east- wardly .11 mi. to a cul-de-sac, and from the same point on ~astlebury Drive, south- eastwardly .17 mi. to Wood-Dale Road, thence southeastwardly .06 mi. to Kiefer Roa~ thence southeastwardly .03 mi. to a dead end~ Kiefer Road, from its intersection with Rochelle Road ~astwardly .02 mi. to a dead end. These roads serve 4 houses. And be it further resolved, that the Board of Supervisors guarantees to the Virgin~ Department of Highways, 50-ft. rights of way for these roads. There was presented a letter from the Midlothian Fire Department requesting the County to pay for a watch light in the vicinity of the Midlothian Fire Department. On motion of Mr. Martin, seconded by Mr. Apperson, it is resolved that this matter be investigated and the light paid for by the County in the future. On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved that a light b~ installed for the Matoaca-Ettrick Rescue Squad.
