Grlffith requests the rezol lng from Residential-2 to Local ~usiness (C-i) for use as dental offices on a parcel of l~nd o£ rectangular shape fronting 75 ft. on ~elt ~o~levard (Rte. 161) 68 6CS. wardly 2100 feet, more or less, being 32~0 feet south o£ Woodpecker Road (Rte. 626 requesting the rezoning from Residential-2 to Industrial (M) on a parcel of land o~ irregular shape containing 18 acres, more or less, fronting 400 feet more or less on the north line of Kingsland Road and fronting 1350 feet more or less on the eas~ right of way line of the A.C.L. Railroad right of way, being in the northeast cor- ner of said intersection. Refer to Sec. 81-2 parcels 19 and 20, and presents topo- graphic maps of' the general area and states the condition of the neighborhood with proposed construction and showed generally that the majority of the adjacent pro- perty owners did not object. And states further that the traffic count is 569 vehicles per day and the proposed use would add less than 2% to this traffic. He presented a letter from the Highwa5 Department stating that the road would be widened and improved in 1970. An official from the SAL-ACL states that Industrial sites of this nature are hard to find and requests that the property be so rezoned. Mr. Thomas Winston, representing about 40 citizens, appearing at the Courthouse, states that it would be setting a dangerous precedent to zone a case which was applied for four days after its disapproval. Mr. John S. Scherer, ~r. James Stewart, Mr. Wilmoth, Mr.crostic, and Mr. W. S. Car- nes, all speak against the proposed rezoning. Mr. Purdy states that the property should be zoned Industrial since much of the adjacent land is so zoned but the Highway Department has no definite program to improve and widen Kingsland Road and therefore it is on motion of Mr. Purdy, secon~ ed by Mr. Apperson, resolved that the rezoning request be and it hereby is denied. Mr. Purdy, Mr. Dietsch and Mr. Apperson vote Aye. ~!r. Browning states that we should not refuse rezoning because of bad roads, that the Highway will improve the road, if necessary. Mr. Martin votes Nay. 68-8CS. Mr. E. P. Garrigan comes before the Board requesting the rezoning from Residential. 1 to General Business (C-2) on a parcel of land of rectangular shape having anort] ern depth of 260 feet and an eastern width of 292 feet, being 200 feet north and 400 feet east of Forest Hill Avenue and Grantwood Road respectively in Manchester Magisterial District. Refer to Sec. 11-1 parcel 27-3. Mr. Leon White, a resident of the area, states that he is opposed to this rezoning due to the noice of the present operation. Mr. Garrigan states he will do his best to cause the Telephone Company to change its operation procedures to eliminate the noise. On motion of Mr. Dietsch, seconded by Mr. Browning, it is resolved that the afore- described parcel of land be and it hereby is rezoned for General Business. 68-9CS. Dr. Julian C. Metts, ~r. comes before the Board requesting the rezoning from Resi- dential-1 to Local Business (C-l) on a parcel of land of irregular shape fronting 233.66 feet on Forest Hill Avenue and extending northwardly 150 feet more or less, being 310 feet west of Windsorview Drive in Manchester Magisterial Dist~t. Refer to Sec. 11-3 (7) Blk. A. lots 4 & 5, and states that Mr. Matze, the subdivider, ha~ no objections to the requested rezoning. Mr. Waymack requested that the parking in front of the Professional office be eliminated. Mr. Taliaferro does not object but states that he does not like to see the creepin~ depreciation of property in the area. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Martin, : it is resolved that the aforedescribed parcel be and it hereby is rezoned for Local Business, with the provisions that same be limited to medical profession, re-arran( ment of parking, a setback equal to that of adjoining offices, landscape screening' to protect residential properties to the rear and east side, subject to the approv- al of the County Planner. 68-10CS. Mr. J. Dennis Tucker comes before the Board requesting the rezoning from Agricultu] al.to General Business (C-2) on a parcel of land containing 3.45 acres fronting 95~ feet on the southwest line of Chippenham Parkway and 87.5 feet and 205 feet on the north line of Cascade Street and being 600 feet east of Route 10 in Dale Magister- ial District. Refer to Sec. 52-2 part of par. 6. Mr. Alan Long states he owns approximately 2 acres of land between Cascade Street and the proposed recreational area and that such a use would materially affect the value of his property. It was'reported that St. Barnabas Churchhad no objections if a Use Permit were granted for such a use. Since there is no g~neral agreement between Mr. Long and the applicant, it is on motion of Mr. Apperson, seconded by Mr. Browning, resolved that this matter be continued to April 10, 1968. 68-11CS. Mr. O. D. Rudy, speaking for the Shady Springs Corporation comes before the Board requesting the rezoning from Agricultural & General Business (C-2) to IndRstrial (M) on a parcel of land of irregular shape containing 169 acres, fronting 1~0 fee· on U. S. Rts. 1 & 301 and extending northwestwardly 4500 feet, more or less, being traversed and bounded on the north by Proctor's Creek in Bermuda Magisterial Dis- trict. Refer to Sec. 98-5 parcel 1, and states that his client owns approximately 120 acres south of the Power line and certainly would not do anything north of the ~ower line to adversely affect the value of this land. He states that the applica- tion had been filed some yearsago for the Industrial zonin~ of this land but had been dropped due to a technicality, and further that last year the Board of Super- visors passed a Land Use Map which showed that the highest and best use of the land was for Industrial purposes and agrees that any proposed use by an Industrial Plan~ may be further controlled by the Board of Supervisors. Mr. Tom Parker, Attorney, representing Mr. ~arks and others,states that the zoning for Industrial use of this land wollld have a detrimental effect on his home some 68-7UP Mr. ~ane~, Fire Marshal, and haul away the debris. On motion of Mr. Dietsch, seconded by Mr. ~ro-~ning, it is resolved that sewer con- nection for the Garage Apartment of Wilson Gay on 1801 Yale Avenue be set at for water and $100,dO for sewer, provided no meter is used Or additional sewer tap made, and that two Minimums be charged for water and sewer. It was cited that the request was for twenty-one new scho, buses and thirteen replacements. On motion of Mr. Purdy, seconded by Mr. Apperson, it is resolved that this Board authorizes the SChool Board to purchase twenty-five (25) new school buses. It is here noted that Mr. Dietsch and Mr. Martin vote No. On motion of Mr. Apperson, seconded'by Mr. Dietsch, it is resolved that the Chair- man and Clerk of this Board be and they hereby are authorized to sign the contract for the construction of the Court's addition to the Office building.
