On motion of Mr. Purdy, seconded by Mr. Martin, it is resolved that this Board approves the application of the Bellwood-Drive-In Theatre for a pyrotechnic display on July 4, 1968, provided it is cleared with the proper authorities. On motion of Mr. Dietsch, seconded by Mr. Apperson, it is resolved that the request for a pyrotechnic display by Mr. Safferwich of the Dutch Village Town House be and it hereby is denied, due to the congestion in the area. On motion of Mr. Browning, seconded by Mr. Martin, it is resolved that this Board requests the Treasurer of the County to give to the Delinquent Tax Collector the 1966 Personal Property bills as soon after July 1, 1968 as possible. On motion of Mr. Martin, seconded by Mr. Purdy, it is resolved that the preliminary plans for the Health Department expansion be and they hereby are approved and the firm of E. Tucker Carlton and Associates be authorized to complete the working drawings. There were read a number of letters from various citizens concerning the recent statements in the papers of the Board's proposed stand on the confinement of dogs. Most letters were in support of this ordinance. On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that the recommen- dation of the Fire Committee to purchase 1000' of hose for the Wagstaff Fire Depart- ment be and it hereby is approved. There was read a notice that a public hearing would be held at the Bon Air Elementax School on July 2, 1968 at 9:30 A.M. to discuss the proposed Rt. 147 and Robious Road intersection. On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that the request the Highway Department for the County to seek permits for utilities on all roads before said roads are accepted into the State Secondary System be and it hereby is referred to the Commonwealth's Attorney for investigation. On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that the Highway De. partment be and it hereby is requested to extend the 35-mph speed limit on Rt. 10 at Chester eastwardly to Parker Lane. On motinn of Mr. Purdy, seconded by Mr. Dietsch, it is resolved.that this Board authorizes the installation of 700 ft. of sidewalk in the Enon area on Walnut Drive and charge same to the 3¢ Road Fund of the County. Mrs. Cline of the Penn Acres Subdivision comes before the Board objecting to the operation of Mr. Hugh Hawthorne, who at present runs a business in said subdivision and states that the starting up of trucks in the early morning ~as wrecked her end of the neighborhood, that the debris is unsightly and detrimental to the neighborho¢ Mr..Hugh Hawthorne states that he has purchased a lot on Rt. 360 and will move as soon as he can comfortably do so, that Mrs. Cline has no real complaint and approxi- mately eight (8) women from the Subdivision come in support of Mr. Hawthorne. Mr. Martin apologizes for not getting in touch with Mrs. Cline and letting her know that the problem had been solved and that Mr. Hawthorne would move. No action wa taken. On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved that the followi~ ordinance having been duly advertised, be and it hereby is re-adopted: To empower and authorize the Chief of Police of Chesterfield County, or his designate, to make regulations for the preservation of the safety, health, peace, good order, comfort, ccu~venience, morals and welfare of the County of Chesterfield and its inhabitants and to provide penalties for violation thereof. Whereas, there has been disorderly conduct, disturbances and disorderly assemblages in public places within, this County which constitute a danger to the safety, health, peace, good order and welfare of the citizens of this County. Whereas, the aforesaid acts commenced on the evening of Monday, April 8, 1961 and have persisted and continue to exist all of which present a clear and preaent- danger to the citizens of this County, and their property; NOW THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF THE COUNTY OF CHESTERFIELD DO HEREBY ORDAIN: That the Chief of Police, or his designate, is hereby authorized and empower~ to regulate, restrict or prohibit ~ny assembly of persons or the movement of persons and vehicles in the said County and said power and authorization shall include the banning of persons and/or vehicles from the streets and sidewalks during, such hours as said Chief of Police, or his designa~e, may deem proper in the necessary protec- tion of persons and property. Any person or persons violating any provision of said regulation, restrictior prohibition or curfew shall upon conviction thereof be punished pursuant to Section 1~6 of the Code of the County of Chesterfield, as amended. This ordinance shall be in full force and effect immediately upon passage. On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that the water con- tract AC-466 for North Oak Apartments in the amount of $7162.55 be and it hereby is approved. It was reported that the cost of a portion of the Pocoshock sewer line would be $265,000 of' which approximately $150,000 had been prumised in prepaid connection: ~The County Engineer recommended most heartily that this portion of the trunk sewer be installed as soon as possible. On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that the County Engineer be and he hereby is authorized to install a trunk sewer line up the Poco- shock Creek to Turner Road, subject to the satisfactory guarantees from the indivi- duals promising prepaid connections. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the Treasurer and he hereby is requested to transfer the sum of $200,000 from the Sewer Service Installation Fund 76-360 to the Sewer Improvement, Replacement and Extension Fund. On motion of Mr. Browning, seconded by Mr. Apperson, it is resolved that the Treas~ er of the County be and he hereby is requested to appropriate the sum of $50,000 to the Water Operating Fund 61-210 from the unappropriated surplus of said fu~d. There was a short discussion concerning the request of Mr. Charles Stiga11 for the use of the County,s water treatment plant at Swift Creek as a meeting place for the Central Chesterfield Masonic Lodge. There was read a letter from Mr. Alan Kiepper, City Manager of the City of Richmond requesting the County to reconsider its de~slom~to disallow the use of a single ditch for both water and gas lines and promised an approximate 13% saving of the County citizens who use gas from the City of Richmond. Mr. Painter states that in most other localities in Virginia the use of one ditch by these two utilities is not allowed and presented a list of thirteen reasons why the County should not allow the City of Richmond to install gas and water together in the County. There was no action taken by the Board to change its previous decision. C & P,Telephone Company - Installation of Buried Telephone Cables (1) 360 West Shopping Center (2)' North Arch Road at Scottingham, Section D (3) Old Coach Hills, Section A. City of Richmond - Installation of Underground Gas Mains (1) Drewry's Bluff Apartments The County Engineer reported that bids for the installation of sewer mains on the south side of Falling Creek were too high. On motion of Mr. Apperson, seconded by Mr. Purdy, it is resolved that this matter be deferred for further consideration. 67-92. The request of Doris M. Hooper, et als for rezoning from Agriculture to Residential -2 on a parcel of land on Warwick Road in the vicinity of Warwick Acres in Manchest~ District, is subject to a drainage survey which has not been completed. Upon consideration of this matter, and on motion of Mr. Dietsch, seconded by Mr. Browning, it is resolved that this matter be deferred to Sept. 11, 1968. 68-28. Mr. W. S. Carnes, represented by Mr. Fred Gray, Attorney, comes before the Board requesting the rezoning from Agricultural to General Business (C-2) in Dale Magis- terial District, on a parcel of land of irregular shape fronting 1~0 feet on Hopkin-, Road and extending westwardly 814.27 feet along the south line of Bonnie Bank Road to the northeast line of Chippenham Parkway, being situated in the southwest corner of Hopkins Road and Bonnie Bank Road. Refer to Sec. 52-11 part par. 3. Mr. Gray states that the highest and best use of the land in question is for the e~ pansion of the parking area for the shopping center, that Meadowbrook Club does not object, that the owner would cut one tier of parking spaces an~ a driveway tO same, and plant the approximate 50 ft. ingrass and shrubbery. Mr. FN%d Pack who reSi4es at 5024 Prestonwood, states that he represents the Beech- wood citizens and that a buffer zone was previously given for appeasement for the rezoning, ~hat in the previous plan it was stated that the dwelling would be con- structed facing Bonnie B~nk Road and expresses concern for the und~eloped lots in the northeast corner of P~estonwood and Bonnie Bank Roads. He submits a petition signed by 114 cit~ns, 49 of whom reside on Prestonwood Road and presents a dele- gation of 8 person'~ ~to oppose a shopping center. Mrs. Ed Ray opposes the proposed zoning stating that a buffer Zone had been allowed in the previous zoning, that the minutes of the said meeting did not reflect the iactual statements concerning the buffer zone. !Mr. Fred Gray states it would be harmful to the traffic pattern to force all the people on Hopkins Road in order to get to the Shopping Center. Mr. Apperson states that he is concerned about the cove~iven to the neighborho( and that the County should uphold this covemant. He states further that the Board should uphold the Planning Commission's decision. Mr. Martin and Mr. Dietsch state that theyhave not examined the property in detail. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that the decisi, without debate be deferred to JUly 10, 1968. 68-38. Mr. C. D. Kidd comes before the Board requesting the rezoning from Agricultural to General Business (C-2) in Manchester Magisterial District on a parcel of land of irregular shape fronting 340 feet, more or less, on German School Road and extendin~ westwardly 315 feet, more or less, being 80 feet north of Rte. 60 and being present. ly zoned General Business for a width of 220 feet from the southern property line. Refer to Sec. 19-12 par. 7. There appearing no one to oppose this zoning request, it is on motion of Mr. Dietsc] seconded by Mr. Martini resolved that the afore described land be and it hereby is rezoned to General Business with the stipulation that approval of plans and land- scaping be given by the County Planner and that a drainage plan be submitted to the Engineering Department for approval. 68-39. Mr. Lowell V. Smith comes before the Board requesting the rezoning from Agricultura2 to General Business (C-2) on a parcel of land of irregular shape fronting 75.5 feet on Warwick Road and extending eastwardly 283 feet, being 850 feet south of U.S. Rte. 60, in Manchester Magisterial District. Refer to Sec. 19-15 par. 12.1. There appearing no one in opposition to this request, it is on motion of Mr. Dietsc] ~econded by Mr. Martin, resolved that the aforedes~4~ibed parcel of land be and it hereby is zoned for General Business with the specific understanding that plans and specifications will be approved by the County Planner and that the County will not maintain the narrow right of way north from Warwick Road into the property in question. It is here noted that Mr. Apperson abstains from voting. 68-40 Mr. E. E. Harris, represented by Mr. George Farley, comes before the Board request- ing the rezoning from Residential-2 to General Business (C-2) on a parcel of land o~ irregular shape fronting 334.77 feet on Covington Road and extending eastwardly 200 feet, being 230 feet north of U.S. Rte. 60 in Manchester Magisterial District. Refe~ to Sec. 20-5 (2) lots 107 and 108. Mr. Farley states that the area is not deWeloped, that $10,000 will have to be spent in piping Reedy Creek' through the property. Mr and Mrs. Loser state they ob-. ject'to the rezoning because of the drainage, condition of Reedy Creek and show pic- tures of water backing up and flooding the general area. It was pointed out that the Planning Commission had recommended that the area south of the Creek only be ~approved for rezoning. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the aforedescribed parcel of land be and it hereby is re~oned to General Business as requested, provided the plans and site layout be al~proved by th, County Planner, that the proper channelization of Reedy Creek be controlled by the Engineering Department, that parking be on the south side only of Lot 107, amd that a fence be placed on the north line of Lot 107, which would be mutually agreeable to the owner and the Planning Department. It is here noted that Mr. Browning abstains from voting. 68-41. Mr. Richard H. Rubin, represented by Mr. Cox of J. K. Timmons & Associates,'come before the Board requesting the rezoning from Agricultural to Residential-2 on a parcel of land of irregular shape fronting 300 feet,more or less,on Providence Road and extending eastwardly 1290 feet, more or less, being 2100 feet more or less sou~ of U.S. Rte. 60 in Manchester Magisterial District. Refer to Sec. 2807 par. 19. There appearing no one to oppose this zoning request and the Planning Commission having recommended approval, it is on motion of Mr. Dietsch, seconded by Mr. Appers, resolved that the aforedescribed parcel of land be and it hereby is rezoned for R-2 purposes. 68-43. The application of Mr. J. Warren Deaner, who requested the rezoning from Agricultu- ral to Residential-2 on a parcel of land of irregular shape fronting 353 feet on Dorset Road and extending southeastwardly 500 feet, more or less, being opposite the intersection of Grant Lake and Dorset Roads in Manchester Magisterial District. Refer to Sec. 41-11 part. par. 16, and it is here noted that neither Mr. Deaner nor his representative is present. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Martin, i' is resolved that the aforedescribed parcel of land be and it hereby is rezoned for R-2 purposes. It is here noted that Mr. Apperson votes No and Mr. Browning abstains from voting. 68-44. Mr. Jospeh C. Hillier, represented by Mr. Thomas S. Winston, come before the Board requesting the rezoning from Residential-2 to Local Business (C-I) on a parcel of land of irregular shape fronting 128.60 feet on the southeast line of Rt. 10 (Hundred Road) and 309.84 feet on the west line of Buckingham Street and better known as 4701 Hundred Road in Bermuda Magisterial District. Refer to Sec. 115-10 (3) 27B. There appearing no one in opposition to this request, it is on motion of Mr. Purdy, seconded by Mr. Apperson resolved that the aforedescribed parcel of land be and it hereby is rezoned to C-l, with the provision that the site layout, landscaping and other plans be approved by the County Planner. 68-45? Mr. Milton C. Woodfin orals, represented by Mr. Graham Jennings, come before the Board requesting the rezoning from Agricultural to Industrial (m) on a parcel of land of irregular shape fronting 2132.8 ft. on Rte. 619 and extending eastwardly 2623 ft. being 3350. ft. northeast of Rte. 618, in Bermuda Magisterial Dist. Refer t( Sec. 119 par. 4. There appearing no one in opposition to this request, however, a letter was read from the Mt. Blanco Park Association opposing the request, it is on motion of Mr~ Purdy, seconded by Mr. Dietsch, resolved that the aforedescribed parcel be and it hereby is rezoned for Industrial purposes, with the provision that site layout and plans be approved by the County Planner. 68-46. Mr. L. R. Goyne, Jr. comes before the Board requesting the rezoning from Agricultu- ral to Industrial (M) on a parcel of land of irregular shape containing 35.60 acres having a northern depth of 2100 feet, more or less, and an eastern width of 1050 feet, more or less, being 1441 feet northeast and 2080 feet northwest of Rte. 619 ~and Bermuda Hundred Road respectively'in Bermuda Magisterial District. Refer to iSec. 118 par 7. There appearing no one in opposition to this request, it is on motion of Mr. Purdy, seconded by Mr. Browning, resolved that the aforedescribed parcel of land be and it hereby is rezoned for Industrial purposes, with the provision that the site layout and plans be approved by the County Planner. 68-47. Mr. Joseph G. Woodfin and Mr. David M. Woodfin, represented by Mr. George Farley come before the Board requesting the rezoning from Agricultural to General Business (c-2) on a parcel of land of irregular shape fronting 200 feet on U.S. Rte 360 and extending northwestwardly 240 feet being 1000 feet northeast of Walmsley Boulevard in Manchester Magisterial District. Refer to Sec. 39-12 par. 6. Mr. Farley pointed out that the property has been used for business for 30 years or more and is presently non-conforming, that the Planning Commission had recommended approval, that Mr. Woodfin plans to raze the present building.and is stopped from. doing so under the present non-conforming use. Mr. Dietsch states that this is spol or strip zoning and should not be allowed to expand. Mr. Graham Jennings states'that the character of the land involved prohibits its residential use and that the present owner put a life time in building the business and should be allowed to sell same. Whereupon, Mr. Dietsch makes a motion which is seconded by Mr. Martin: Resolved that the requested zoning be denied. Upon discussion of the question, Mr. Woodfin': counsel withdraws the application for rezoning. Upon consideration of which and on motion of Mr. Dietsch, seconded by Mr. Martin, i' is resolved that this withdrawal of the zoning request be aoPepted. 68-21U. The application of Mr. Russell L. Connelly requesting a Use Permit in Matoaca Magis- terial District to Sell fertilizer was deferred to June 27, 1968 in the absence of anyone supporting this request. 68-22U. Mr. George T. Tiers comes before the Board requesting a Use Permit to operate a tel~ vision repair service in their home on a parcel of land of rectangular shape front-i lng 150 feet on Rte. 618 Bermuda Hundred Road and extending northwardly 300 feet, being 600 feet, more or less, east of Dausen Drive in Bermuda Magisterial District.
