Subject: Nomination/Appointment to the Youth Services Citizen Board County Administrator's Comments: County Administrator: Nominate/appoint a member to serve on the Youth Services Citizen Board. Summary of Information: The purpose of the Youth Services Citizen Board is to advise the Board of Supervisors regarding planning and policies affecting youth development and to provide a community forum to focus on youth issues. At -Large. Board members recommend the appointment of Andre Tolleris from Appomattox Regional Governor's School for a term of November 1, 2013 through June 30, 2014. Mr. Tolleris meets all the eligibility requirements and has indicated his willingness to serve as an at -large member. Under the existing Rules of Procedure, appointments to boards and committees are nominated at one meeting and appointed at the subsequent meeting unless the Rules of Procedure are suspended by a unanimous vote of the Board members present. Subject: Streetlight Cost Approval County Administrator's Comments: County Administrator: This item requests Board approval of a streetlight installation in the Dale District. Summary of Information: Requests for streetlights, from individual citizens or civic groups, are received in the Department of Environmental Engineering. Staff requests cost quotations from Dominion Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections and 2. A petition is required which must be signed by 75% of the residents within 200 feet of the proposed light and shall include a majority of the homeowners living at the proposed locations. The Board, upon presentation of the cost quotation, may approve, defer, or deny the expenditure of funds from available District improvement Funds for the streetlight installation. If the expenditure is approved, staff authorizes Dominion Virginia Power to install the streetlight. A denial of a project will result in its cancellation and the District Improvement Fund will be charged the design cost shown; staff will notify the requestor of the denial. Projects cannot be deferred for more than 30 days due to quotation expiration. Quotation expiration has the same effect as a denial. Summary of Information: The Board of Supervisors approved funding for an Intermediate Care Facility in the FY2013 Adopted Capital Improvement Program. This new facility will be used to provide intensive level care for individuals with intellectual and medical disabilities. The construction contract for the facility was approved by the Board in May 2013 and site work is currently underway. Stand-alone financing transactions in an amount such as this are not the most cost effective from either a transaction cost or pricing perspective. In an effort to maximize the effectiveness of the financing transaction, the county intends to issue, in the spring of 2014, tax-exempt obligations to finance the construction of the ICFMR facility as well as several other projects already approved in the CIP (i.e. the police administration building / lobby renovation and expansion project). Subiect: Adoption of Resolution to Opt -out of the Local Disability Program Provided by the Virginia Retirement System Because the County Will Purchase an Enhanced Disability Benefit Plan County Administrator's Comments: County Administrator: The Board of Supervisors is requested to adopt the attached VRS resolution electing not to participate in the Virginia Local Disability Program. The resolution must be received by the Virginia Retirement System by November 1, 2013. In place of this program, the county will purchase the disability benefits described below. Summary of Information: The 2012 General Assembly created VLDP for political subdivision and school employees who will be covered under the VRS Hybrid Retirement Plan effective January 1, 2014. Public Safety employees will remain in the traditional VRS plans and will not be covered by this disability program. Participation in VLDP is automatic unless the political subdivision's governing body elects to opt out and provide a comparable employer -paid disability program. The decision to participate or opt -out is irrevocable. Approximately 50 public entities in Virginia have voted to opt out of the VLDP program and hundreds more (including Chesterfield County) have been granted an extension to the opt -out deadline, allowing additional time for review. County staff has identified a replacement disability benefits plan provided by the Standard Insurance Company that offers employees superior benefits to the VLDP at a lower cost. Standard's rates are 0.,79 percent of Hybrid Retirement Plan covered payroll and are guaranteed for three years. County staff believes that larger localities like Chesterfield County, with more sophisticated safety and wellness programs, will determine that it is better for their employees to opt out of the VLDP. This will result in adverse selection, whereby only localities with higher disability risk will remain in the program. This will cause VLDP rates to increase at a greater rate in the future than will occur under private plans like that offered by Standard. The plan provided by Standard offers customized coverage that meets the requirements of Chapter 11.1 of Title 51.1 of the Code of Virginia and exceeds code requirements in the following areas that are advantageous for the employee and employer to control claim costs by encouraging participation in rehabilitation and return to work: • Return -to -Work Incentive - smaller reduction to LTD than VLDP • 10*-. Rehabilitation Incentive - helps claimants focus on recovery • Reasonable Accommodation Benefit - reimburses employers up to $25,000 for worksite modifications that help a claimant return to work. The School Board is scheduled to consider adoption of the opt -out resolution at its October 8, 2013 meeting. The other $9 million was distributed, based on population, among the state Metropolitan Planning Organizations (MPO) or to CTB at -large members for allocation to areas of the state not within a MPO. The Richmond MPO received just under $1M and the Tri -Cities MPO received $170,000. For FY2014, the county requested and received $470,400 in Enhancement funds for the Smoketree Drive (Community Recreation Center to the Church of the Epiphany main entrance) Sidewalk Project, in the Clover Hill district. The county is awaiting authorization from VDOT to begin design of the project. Transportation Alternative Projects are financed with 80 percent VDOT funds and a minimum 20 percent local match. The local match is usually provided from county funds, other sources, and/or from in-kind contributions. VDOT staff will review project applications for eligibility and the CTB and MPO will select projects for funding. Summary of Information: Chesterfield County currently contains two enterprise zones approved by the state: the Jefferson Davis Enterprise Zone designated on January 1, 1994 and the Walthall Enterprise Zone designated on January 1, 1996. The enterprise zones were established for an initial period of ten (10) years and were renewed for two (2) additional five (5) year terms. Due to recent changes in the law, the County no longer meets the demographic criteria to maintain the enterprise zones. Thus, the Jefferson Davis Enterprise Zone, along with the associated Hull Street Road Subzone, will expire on January 1, 2014, and the Walthall Enterprise Zone, along with the associated Midlothian Turnpike Subzone and Meadowdale Meadowbrook Subzone, will expire on January 1, 2016. The General Assembly, however, recently adopted Va. Code § 58.1-3850 which allows localities to establish, by ordinance, "technology zones", and authorizes localities to grant incentives and regulatory flexibility to businesses locating in technology zones identical to what is authorized for businesses locating in enterprise zones, provided that the benefits allowed in technology zones may not extend beyond a ten (10 -),.:year period. For taxpayers who file federal income tax returns on a fiscal year basis, the base year shall be the fiscal year ending during the calendar year immediately preceding the year that the business initially qualifies for tax and fee relief under this section. (2) If the business newly locates from outside any enterprise zone or subzone or technology zone in Chesterfield County to a building or tenant space within any enterprise zone or subzone or technology zone in Chesterfield County after the date on which the enterprise zone or subzone or technology zone is established, it shall qualify for tax and fee relief immediately upon occupying the building. (3) If the business relocates within any enterprise zone or subzone or technology zone in Chesterfield County to a building or tenant space after the date on which the enterprise zone or subzone or technology zone is established, it shall qualify for tax and fee relief immediately upon occupying the building provided it has not received tax or free relief at its previous zone or subzone location. (4) If the business builds a new building which receives its certificate of occupancy after the date on which the enterprise zone or subzone or technology zone is established, it shall qualify for the tax and fee relief immediately upon occupying the building. (5) If the business shares occupancy of a new building which receives its certificate of occupancy after the date on which the enterprise zone or subzone or technolg& zone is established and is a separate and distinct business from any other business which occupies the same building, it shall qualify for tax and fee relief immediately upon occupying the building. (6) For purposes of determining initial eligibility for tax and fee relief under this section, the term "locate" does not include a transfer of ownership of an existing business operation within an enterprise zone or subzone or technology zone to another entity which is wholly or partially owned or controlled by or affiliated with the prior business owner, but such a transfer of ownership shall 0623:89461.1 2 Ci 00-086 not disqualify a currently eligible business from enjoying the benefits under this section for a fall five years, even if such transfer occurs during the five-year eligibility period, regardless of the change in ownership. (a) A partial exemption from real estate taxes is granted to certain commercial or industrial property which qualifies under the criteria listed in subsection (b). (b) For real property to qualify for the partial exemption granted by this section, the following criteria must apply: (1) Any real estate upon which there is an existing commercial or industrial structure shall be deemed to have been substantially rehabilitated, renovated or replaced when a structure 25 years old or older has been improved so as to increase the assessed value of the structure by 15 percent or more. For a motel or hotel, the structure shall be no less than 35 years of age. For structures other than a motel or hotel in an area designated by the Commonwealth of Virginia as an enterprise zone or subzone or technology zone the structure may be 15 years old or older. Subject to the limitations set forth below, the rehabilitated, renovated or replaced structure may be used for any purpose, including mixed use, that is allowed by the building code and the applicable zoning regulations for the property. (c) Prior to beginning the rehabilitation, renovation or replacement the owner of any real estate meeting the criteria stated in this section shall apply for the exemption on forms provided by the county. Upon receiving the application, the county assessor shall determine the base value of the structure. This base value determination shall be effective for two years from the date of determination, but applicants may reapply after 0623:89461.1 3 00008 7 this time period expires. The owner shall pay an application fee of $50.00 for each application which shall be refundable upon completion of the replacement or rehabilitation. Property located in an enterprise zone or subzone or technology zone shall be exempt from paying an application fee. Sec. 9-64. Rebate --Machinery and tools used by certain businesses located within an enterprise zone or subzone or technology zone. (a) Any business which after January 1, 2006 either (i) locates in an enterprise zone or subzone o r technology zone designa4ed by 4he stMe or (ii) undergoes a facility expansion or renovation which results in an increase of 15 percent or $50,000.00, whichever is greater, in the assessed value of its machinery and tools over the value of its machinery and tools from the previous year ("base year"), shall qualify for the rebate specified below, to the extent permissible under the Constitution of Virginia. (b) An application for enterprise zone or technology zone benefits must be submitted to the Chesterfield County department of E -economic Ddevelopment Depaftm and the benefit accessed by the business within one year of start of operations in the enterprise zone or subzone or technology zone, or within one year of a qualifying facility expansion or renovation in order to receive the machinery and tools tax rebate. Sec. 9-220. Enterprise zones and subzones and technology zones (a) Pursuant to section 58.1-3850 of the Code of Virginia the following technology zones are created: effective January 1, 2014, the Jefferson Davis Technology Zone and the Hull Street Road Technology Zone; and effective January 1, 2016, the Walthall Technology Zone, Midlothian Turnpike Technology Zone, and the Meadowdale Meadowbrook Technology Zone. The Jefferson Davis Technology Zone shall be defined by the same geographical boundaries of the Jefferson Davis Enterprise Zone established in the county on January 1, 1994 excepting the area designated as the Hull Street Road Enterprise Subzone. which effective January 1, 2014, shall define the boundaries of the Hull Street Road Technology Zone. Summary of Information: In May 2012, the Board added the Nash Road Bridge Replacement over Reedy Branch project to the Secondary Six Year Plan to replace the current bridge, which is posted with an eleven (11) ton weight restriction. In 2010, the Matoaca Road and Hickory Road Intersection Improvement project received funding from the Tri -Cities Metropolitan Planning Organization to address poor horizontal and vertical alignments and to reduce accidents. In August, the Virginia Department of Transportation (VDOT) notified the county that they would be "advance obligating" funds for the preliminary engineering phase of these projects and asked if the county would administer the projects. Staff recommends the county administer the preliminary engineering phase of the projects in hope that future funding can be advanced and construction accelerated. A VDOT/County agreement for preliminary engineering, similar to those the county has executed in the past, will be necessary. Under the terms of the agreement, the county will perform preliminary engineering and be reimbursed by VDOT for the $654,369. To move the projects forward quickly, staff recommends the county administer the projects. As project plans are developed, staff will meet with affected property owners to discuss the impacts of the project on their property. A judgment will be made after the meetings as to whether a formal citizen information meeting/public hearing is needed. In either case, staff will only bring the detailed design to the Board for formal approval if there are significant concerns expressed by the property owners directly impacted by the project. Staff is requesting approval of the FY2015 - FY2017 Revenue Sharing Three - Year Plan. Upon Board approval, staff will submit the FY2015 project request to VDOT. Summary of Information: The General Assembly this year passed House Bill 1589 which would permit the county to pass an ordinance to demolish or remove a derelict nonresidential building or structure with the consent of the property owner. on July 17, the Board of Supervisors referred consideration of House Bill 1589 to the Building Inspection Department and County Attorney's office and requested a report by October 9, 2013. Representatives of the Building Inspection Department, County Attorney's office and Revitalization Team met to consider House Bill 1589 and analyze whether or not the county should adopt an ordinance in order to engage in the demolition process permitted by the new state law. Staff felt that the law's limitation to nonresidential structures made it unlikely to be needed within the county and funding currently allotted for demolition actions by the building inspection department is not sufficient to undertake demolition as provided under the new state law; additionally, other currently available codes and ordinances to address unsafe/unsecure structures and spot blight offer sufficient methods to address the county's needs with respect to derelict structures. Summary of Information: The developer of Magnolia Green has requested to relocate the park and school sites within its development as shown on the attached plats. We will be exchanging an existing park parcel containing 15.801 acres, and school parcel containing 21.951 acres (a total of 37.752 acres) for a park parcel containing 26.781 acres, and a school parcel containing 25.526 acres (a total of 52.307 acres). This request has been reviewed by county and school staff and has been approved by the Subdivision Team. These larger sites are centrally located within the development, adjacent to community amenities and will be connected by pedestrian trails. Summary of Information: On April 27, 2011, the Board authorized staff to proceed with the design and construction of the Genito Road/Old Hundred Road/Charter Colony Sidewalk and Streetlight Project. The Board also authorized the advertisement of an eminent domain public hearing, if needed. The design of the project is complete and right-of-way acquisition is underway. Staff has been successful in acquiring right-of-way and easements from seven of the eleven property owners impacted by the project. Staff has been unable to reach agreement with four owners. Multiple attempts to discuss the purchases were made with all property owners. Three of the owners are not local and were non-responsive. Several contacts with people associated with the fourth property have been made; however, none have been successful in identifying an officer of Waterford Associates, Inc. No counter offers have been received. If the county proceeds with eminent domain, certificates of deposit will be filed with the court, which will immediately entitle the county to enter and use the right-of-way and/or easements prior to the commencement and conclusion of eminent domain proceedings in court. The county will then be obligated to purchase the right-of-way and/or easements from the landowners. Sufficient funds are available in the budget to pay the anticipated condemnation costs. Staff will continue to negotiate with the owners in an attempt to reach a settlement after the certificate is filed, and, if requested, the owners will be paid the county's estimated value prior to the condemnation hearing. The project is scheduled to be under construction in January 2014.
