Approve the exchange of parcels of land for the park and school sites and the
relocation of ingress and egress easements within Magnolia Green and
authorize the Chairman of the Board and County Administrator to execute the
deed.
Summary of Information:
On October 9, 2013, the Board held a public hearing to consider the
relocation of the park and school sites within Magnolia Green as shown on the
attached plats. we will be exchanging an existing park parcel containing
15.801 acres, and school parcel containing 21.951 acres (a total of 37.752
acres) for a park parcel containing 26.781 acres, and a school parcel
containing 25.526 acres (a total of 52.307 acres). These larger sites are
centrally located within the development, adjacent to community amenities and
will be connected by pedestrian trails. The revised Lower Magnolia Green
Conceptual Plan, Case 80TS4133, with the proposed relocated parcels has been
approved by the Planning Department. There was no public comment.

RECOGNIZING MR. NAZAR ALJASSAR
UPON ATTAINING THE RANK OF EAGLE SCOUT
WHEREAS, the Boy Scouts of America was incorporated by Mr. William
D. Boyce on February 8, 1910, and was chartered by Congress in 1916;
and
WHEREAS, the Boy Scouts of America was founded to build character,
provide citizenship training and promote physical fitness; and
WHEREAS, after earning at least twenty-one merit badges in a wide
variety of skills including leadership, service and outdoor life,
serving in a leadership position in a troop, carrying out a service
project beneficial to his community, being active in the troop,
demonstrating Scout spirit, and living up to the Scout Oath and Law,
Mr. Nazar Aljassar, Troop 800, sponsored by Bethal Baptist Church has
accomplished those high standards of commitment and has reached the
long -sought goal of Eagle Scout, which is received by only four percent
of those individuals entering the Scouting movement; and
WHEREAS, growing through his experiences in Scouting, learning the
lessons of responsible citizenship, and endeavoring to prepare himself
for a role as a leader in society, Nazar has distinguished himself as a
member of a new generation of prepared young citizens of whom we can
all be very proud.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors recognizes Mr. Nazar Aljassar, extends congratulations
on his attainment of Eagle Scout, and acknowledges the good fortune of
the county to have such an outstanding young man as one of its

RESOLUTION RECOGNIZING AND SUPPORTING AMTRAK AND
VIRGINIA DEPARTMENT OF TRANSPORTATION PROVIDING
ROLL-ON/ROLL-OFF BICYCLE SERVICES
WHEREAS, Petersburg Station, located at 3516 South Street in
Chesterfield County, serves as a transportation center to the Tri -City areas
and along with the Main Street Station in Richmond, the Staples Mill Road
Station in Henrico County, and the Ashland Station in Ashland, serviced more
than 400,000 riders across the metropolitan area in 2012; and
WHEREAS, the Richmond region will serve as the site for the 2014 USA
Cycling Collegiate Road National Championships, to be held May 2, 2014,
through May 4, 2014, and the 2015 Union Cycliste Internationale Road World
Championships, to be held September 19, 2015, through September 19, 2015, and
together the Richmond Region will take center stage for the world of cycling;
and
WHEREAS, Chesterfield County supports the expansion of the region's
cycling infrastructure, including the proposed addition of more than 30 miles
of recreational trails to create the IMBA Ride Center at Pocahontas State
Park; and
WHEREAS, Amtrak does not provide roll-on/roll-off services for bicycles
on east coast routes, though pilot programs in Pittsburgh, Vermont, New York
and Michigan have proved very successful; and
WHEREAS, the Chesterfield County Board of Supervisors believes that many
cyclists and spectators will travel by train to participate in the upcoming
cycling events and continue to use this service as a gateway into the
region's expanding bicycle network; and
WHEREAS, it is anticipated that making the changes necessary to
transport bicycles in the Amtrak trains will increase participation in the
cycling events, encourage an increase in tourism and have a positive economic
impact on Chesterfield County and the Richmond Region; and
WHEREAS, Chesterfield County desires to work with Amtrak, the Virginia
Department of Transportation and neighboring localities to best accommodate
the influx of cyclists who are anticipated in the Richmond Metropolitan
Region during the cycling events.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors requests that Amtrak and the Virginia Department of
Transportation provide roll-on/roll-off bicycle services for all trains
stopping at Petersburg Station in the Village of Ettrick in Chesterfield
County and all other regional stations to accommodate participants in
upcoming cycling events and enable the Richmond Region to endure as a
bicycle -friendly community.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented
to representatives of Amtrak and the Virginia Department of Transportation,
and that this resolution be permanently recorded among the papers of this
Board of Supervisors of Chesterfield County, Virginia.

Set a Public Hearing Date to Consider the Restriction of Through Truck
Traffic on North Enon Church Road

The Board is requested to set December 11, 2013, as a public hearing date to
consider the restriction of through truck traffic on North Enon Church Road
from Leslie Lane to Meadowville Road.
Summary of Information:
The county has received a request from residents to restrict any through
truck or truck and trailer or semi -trailer combination, except pickup or
panel trucks, from using North Enon Church Road (Route 746) from Leslie Lane
(Route 2496) to Meadowville Road (Route 618). The recommended alternate
route is North Enon Church Road (Route 746), Meadowville Technology Parkway
(Route 618), and Meadowville Road (Route 618).
The Virginia Department of Transportation (VDOT) has four criteria it
considers when a restriction is requested. A requested restriction must meet
the first two criteria, in that: 1) a reasonable alternate route is provided;
and 2) the character or frequency of truck traffic on the route proposed for
restriction is not compatible with the affected area.
Evaluation of the second criterion will include safety issues, accident
history, engineering of the roadway, vehicle composition, and other traffic
engineering related issues.

In addition, a requested restriction must meet either of the last two
criteria, in that: 1) the roadway is residential in nature, with at least 12
dwellings on both sides within 150 feet of the roadway centerline per 1,000
feet of roadway; or 2) the roadway must be functionally classified as either
a local or collector road.
Staff recommends approval of the restriction.
Recommendation:
Staff recommends that the Board set December 11, 2013, as a public hearing
date to consider a through truck traffic restriction on North Enon Church
Road from Leslie Lane to Meadowville Road, and authorize the advertisement
for that hearing.

PLANNING COMMISSION ACTION AND RECOMMENDATION
At its October 15, 2013 meeting, the Planning Commission, on a vote of 4
to 1, forwarded a recommendation of approval of the attached policy
amendment.
POLICY HISTORY AND AMENDMENT SUMMARY
On April 10, 2013, following a recommendation by the Planning Commission,
the Board of Supervisors adopted amendments to the Zoning Ordinance and a
policy regarding the locations of Alternative Financial Institutions.
Subsequent to the adoption, the Board considered several proposals for
these institutions. During those considerations, concern was expressed
that the policy would allow such institutions within freestanding
buildings. It was suggested that the policy be amended to require the
institutions to be located within a structure housing three or more
independent uses that is located in a shopping center which should serve
to minimize their visual appearance within the surrounding community. The
attached amended policy would accomplish this goal.
On August 28, 2013, the Board of Supervisors referred the attached policy
amendment to the Planning Commission for consideration and recommendation.

PROPOSED AMENDMENTS TO ALTERNATIVE FINANCIAL INSTITUTION POLICY
Planning Commission and Board of Supervisors Zoning Guidance
(D;GTB- The following general guidelines will be used for evaluation of zoning
applications for alternative financial institutions. Compliance with these
guidelines will not automatically address all site or operationally specific
concerns associated with a particular zoning application. Additional conditions
of zoning may be imposed and/or recommended to address such concerns, or to
insure compliance with the Plan fer Ghesterfiel comprehensive plan or the
purposes of the Zoning Ordinance.4-
A. Definition: Alternative financial institutions (AFIs) provide short-term,
high -interest personal lending services. These institutions include: check
cashing establishments (not including incidental check cashing), motor
vehicle title lenders, pawnbrokers, payday lenders and other businesses with
similar business models and land use impacts that are not specifically
enumerated by the Zoning Ordinance, as determined by the Director of
Planning. For the purposes of this policy, AFIs do not include banks, credit
unions, savings and loan associations, or precious metals dealers.
B. Criteria: AFIs should be located in compliance with the following criteria

Summary of Information
PLANNING COMMISSION ACTION AND RECOMMENDATION
On October 15, 2013, following a public hearing, the Planning Commission, on
a vote of 4 in favor and 1 opposed recommended approval of the attached
ordinance amendment with one modification, increasing the maximum number of
chickens kept from four (4) to six (6) (Sec. 19-65(k)(2)).
AMENDMENT OVERVIEW
The Zoning Ordinance currently permits the keeping of a maximum of twelve
(12) chickens in an Agricultural (A) District on parcels containing less than
three (3) acres. The Ordinance does not limit the number of chickens kept on
Agricultural parcels having more than three (3) acres.
Prior to 2002, the Ordinance permitted the keeping of a maximum of twelve
(12) chickens in Residential Districts. In 2002, the ordinance was amended
to require a conditional use for the keeping of any chickens in a Residential
District.

Summary of Information (Continued)
Recent community interest and pending conditional use applications to allow
chicken keeping in Residential Districts prompted the Board of Supervisors to
direct staff to consider possible amendments to the ordinance to allow the
use in all single family Residential Districts. In June, 2013, staff provided
information to the Board outlining possible considerations in the preparation
of an ordinance amendment.
On August 28, 2013, the Board directed staff to prepare an ordinance
amendment to allow the keeping of chickens in Residential Districts and refer
the amendment to the Planning Commission for public hearing and
recommendation no later than the Commission's regularly scheduled meeting in
November, 2013.
As recommended, chicken keeping would become a use permitted in Residential
Districts subject to specific restrictions. If these restrictions are met,
no further zoning action would be required. If one or more of these
restrictions is not met, conditional use approval would be required.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997,
AS AMENDED, BY AMENDING AND RE-ENACTING SECTIONS 19-65 AND 19-301 OF
THE ZONING ORDINANCE RELATING TO THE KEEPING OF CHICKENS IN
RESIDENTIAL ZONING DISTRICTS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Sections 19-65 and 19-301 of the Code of the County of Chesterfield, 1997, as
amended, are amended and re-enacted, to read as follows:

Sec. 19-65. Uses permitted with certain restrictions.
The following uses shall be permitted in the R-88 District subject to compliance with the
following conditions and other applicable standards of this chapter. If these restrictions cannot
be met, these uses may be allowed by conditional use, subject to section 19-13:

(k) Keeping of chickens provided that:
(1) The use is incidental to a dwelling on the premises-,
(2) A maximum of four (4) chickens are kept;
(3) Roosters are not kept,
(4) At all times, chickens are kept within a single building having a single attached
fenced outside run as follows:
a. The building is a minimum of 10 sauare feet and a maximum of 20 souare feet:
b. The fenced outside run area is a maximum of 40 square feet and has a
minimum area of 5 square feet per chicken-, and
c. The fenced outside run area is securely enclosed on the tot) and sides with a
wire mesh or similar material
(5) The building and attached outside run area are located in the rear yard and setback
a minimum of 25 feet from all property lines: and
(6) Slaughtering of chickens does not occur.

The Board of Supervisors is requested to set a public hearing for December
11, 2013 to consider the real estate tax exemption request of Chesterfield
Alternatives, Inc.
Summary of Information:
Under Virginia law, real and personal property used for benevolent purposes
may be classified as exempt from taxation by the Board of Supervisors. This
year, Chesterfield Alternatives, Inc ("CAI") a benevolent, non-profit
organization has requested a tax exemption for a 1.241 -acre parcel (Parcel
No. 777683034100000) located at 5117 Cogbill Road. A map of the parcel is
attached.
CAI uses the property as a group home for adults with intellectual
disabilities. The home is licensed by the Virginia Department of Behavioral
Health and Developmental Services. Residential support services are provided
by the County's Community Services Board.

The parcel is assessed at $278,300, leading to an annual real estate tax of
$2,643.85. This is below the $5,000 maximum amount permitted by the Board's
policy.
Staff has reviewed the information which state law requires the Board to
consider before granting an exemption and finds that the information is
consistent with CAI's status as a benevolent, non-profit organization that is
eligible for the tax exemption. The criteria which the Board must consider
under state law are attached.
In order to consider this request, the Board must schedule a public hearing
for December 11, 2013.

CRITERIA FOR CONSIDERING TAX EXEMPTION
REQUESTS UNDER STATE LAW
1. CAI is exempt from taxation pursuant to §501(c) of the Internal
Revenue Code;
2. CAI does not possess a current annual alcoholic beverage license
for serving alcoholic beverages for use on the property;
3. No director of CAI is paid any compensation for service to the
corporation and its salaries are not in excess of reasonable salaries for
services performed by the employees;
4. No part of the net earnings of CAI inures to the benefit of any
individual;
S. CAI provides services for the common good of the public; and
6. CAI does not attempt to influence legislation or intervene in any

Sections 19-240 through 19-240.4.
Summary of Information:
On September 24, 2008, the Board of Supervisors adopted Sections 19-240
through 19-240.4 which specify tree planting, replacement and preservation
requirements during development of single-family residential projects located
within the Upper Swift Creek Watershed area.
Staff and the development community during the recent surge in residential
development activity discovered that the ordinance would be more effective if
the requirement was shifted from a subdivision section basis to an entire
project.
By unanimous vote at their October 15, 2013 public hearing, the Planning
Commission recommended approval of the proposed amendments as presented by
staff. There was only one person who spoke during the Public Hearing. He was
seeking confirmation, and was reassured, that the standards were not being
reduced.

Summary of Information (Continued)
In response to concerns identified by staff and the development community,
amendments to this ordinance are proposed in order to:
A. Provide for compliance on an overall subdivision development basis,
B. Establish tree canopy area credits for planted trees.
A. This amendment proposes to allow subdivision tree canopy requirements to
be calculated on an overall project basis. Currently, Section 19-240.2
requires compliance with tree canopy requirements at the time of each
subdivision construction plan review. Each construction plan typically
represents only a portion of the overall development. This results in an
ordinance that is not sufficiently flexible to allow for compliance on an
overall development basis.
B. The ordinance requires planting of trees to provide tree canopy coverage
at maturity of twenty years. The development community has requested
information for standards of tree canopy areas of planted trees. Staff
recommends this information be based on documentation established by the
Virginia Nursery and Landscape Association. Tree canopy area information for
individual trees will be included in the Chesterfield County Plant Material
List. This amendment also proposes to: assign oversight responsibilities to
the planning department and to update referenced names of professional
associations.
The proposed amendment is attached for your review and consideration.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTIONS 19-240 THROUGH 19-240.4 RELATING
TO THE PRESERVATION OF TREES DURING DEVELOPMENT IN
THE UPPER SWIFT CREEK WATERSHED
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Sections 19-240 through 19-240.4 of the Code of the County o„fChester geld. 1997,
as amended, are amended and re-enacted to read as follows:
CHAPTER 19 ZONING
Sec. 19-240. Tree planting, replacement and preservation in the Upper Swift Creek
Watershed.
The purpose of Sections 19-240 through 19-240.4 is to promulgate regulations for the
planting and replacement of trees destroyed or damaged during the development or
redevelopment process for single-family residential projects, pursuant to Section
15.2-961 of the Code of Virginia, including the preservation of trees during development
in appropriate instances.
Sec. 19-2401. General Standards.
(a) All trees to be planted shall meet the specifications of the American Nursery and
Landscape Association of Nurn.,f.rm en
(b) The planting of trees shall be done in accordance with either the standardized
landscape specifications jointly adopted by the Virginia'` u-sefyfman'sNursery
and Landscape Association, the Virginia Society of Landscape Designers and the
Virginia Chapter of the American Society of Landscape Architects, or the road
and bridge specifications of the Virginia Department of Transportation. The
county shall maintain current copies of these specifications available to the public.
(c) The minimum size standards for trees shall be in accordance with Section 19-518

(d) The canopy area of planted trees shall be in accordance with the Chesterfield

be approved by the planning_department based on credible published
documentation.
Sec. 19-240.2. Canopy Requirements.
(a) Construction plans. All construction plans for subdivision plats shall include
detailed landscape plans prepared in accordance with Section 19-517 to provide
for the planting and replacement of trees on site to the extent that, at maturity of
twenty (20) years, the minimum tree canopy shall be as follows:
(1) Fifteen (15) percent tree canopy for sites zoned single family residential,
with densities between ten (10) and twenty (20) units per acre.
(2) Twenty (20) percent tree canopy for sites zoned single family residential,
with densities of ten (10) units or less per acre.
Upon written request, the director of planning maygrant approval for any residential
project to comply with tree canopy requirements of Sections 19-240 through 19-240.4 on
an overall project basis. Compliance on an overall basis will require review and approval
of a tree canopy master plan in accordance with Section 19-240.2 (b) (2).
(b) Tree Canopy Master Plan.
(1) All preliminary subdivision plats submitted after <insert adoption date of
this amendment> shall include a tree canopy master plan for review and
approval.
Q The tree canopy master plan shall serve as a guide to be followed for each
construction plan, and shall be updated during the development of the
overall residential project. Any revision must be submitted for review and
approval by the director of planning. The plan shall show in graphic
format all areas set aside to satisfy tree canopy requirements and the
means by which such requirements will be satisfied.
(b)LcjExclusions. For the purpose of calculating the area of a site for tree canopy
coverage requirements, the following areas shall be excluded:
(1) Ponds and unweeded nonwooded wetlands.

(2) Properties reserved or dedicated for school sites, playing fields and other
nonwooded recreation areas, and other facilities and areas of a similar
nature.
(3) Portions of a site which contain existing structures that are not the subject
of a pending application.
(e)(d) Credits for Preservation of Existing Trees. Existing trees which are to be
preserved may be included in the calculation of the canopy requirements, and may
include wooded preserves, if the construction plans identify such trees and the
trees meet standards of desirability and life -year expectancy as established by the
director ofenvir-,..,mental eagineer-i^ planning.
Sec. 19-240.3. Exceptions to Requirements.
Upon written request of the developer, the director of environmental efiginee i -:
planning may approve reasonable exceptions to, or deviations from, the requirements of
Sections 19-240 through 19-240.2 in order to allow for the reasonable development of
farmland or other areas devoid of healthy or suitable woody materials, for the
preservation of wetlands, or when the strict application of requirements would result in
unnecessary or unreasonable hardship to the developer. In such instances, the director of
. - t—all engineer -i planning may approve satisfaction of a portion of a
development's tree canopy requirement through use of a tree canopy bank or off-site
planting or replacement of trees provided that the canopy thereby substituted is located
within the Upper Swift Creek Watershed.
See. 19-240.4. Enforcement.
Penalties for violations of the requirements of Sections 19-240 through 19-240.3
shall be the same as those applicable to other violations of this chapter as set forth in
Section 19-5. Notwithstanding the foregoing, this section shall apply only to tree canopy
areas that (i) have been included in open space maintained by a home owners'
association, (ii) are subject to a perpetual conservation easement, or (iii) are included on
individual lots which have not received a certificate of occupancy.

Summary of Information:
A recent review of the taxation chapter of the County Code revealed that the
section on personal property tax exemptions for bicycles and mopeds and the
section on the E-911 system tax contained an outdated definition (Sec. 9-60)
and citation (Sec. 9-141) to the Code of Virginia. The proposed amendments
to these sections will conform the definition to the 'Code of Virginia and
correct the citation.

With respect to the consumer utility tax on telephone service, that tax is no
longer collected pursuant to County ordinance. Instead, the tax has been
collected by the Commonwealth pursuant to state law for years with the
County's share allocated under a state administered formula. Accordingly,
this section of the County Code is obsolete. The Commissioner of Revenue has
been properly administering this tax program in accordance with current state
law and repeal of this section in the County Code will have no effect on
taxpayers, on the revenue which is allocated to the County, or on the day-to-
day operations of the Commissioner's office.

amendments.

Sec. 9-60. General provisions.
The following household goods and personal effects of county residents are
hereby exempt from taxation as tangible personal property:
(a) Bicycles and mopeds as
defined by Code of Virginia 46.2-100.
(b) Household and kitchen furniture, including gold and silver plates, plated
ware, watches and clocks, sewing machines, refrigerators, automatic
refrigerating machinery of any type, vacuum cleaners and all other
household machinery, books, firearms and weapons of all kinds.
(c) Pianos, organs, phonographs, record players and records to be used
therewith, musical instruments of whatever kind, radio, television and
other home entertainment equipment.
(d) Oil paintings, pictures, statuary, curios, articles of virtue and works of art.
(e) Diamonds, cameos or other precious stones and all precious metals used as
ornaments or jewelry.
(f) Sporting and photographic equipment.
(g) Clothing and objects of apparel.
(h) Computers and accompanying equipment not used in a business.
(i) All other tangible personal property used by an individual or a family or
household incident to maintaining an abode.

Sec. 9-141. Amount of tax.
Pursuant to the authority set forth in Code of Virginia, § 58.1 3813 58.1-1730, the
county hereby imposes a tax to be used by the county to pay the capital, installation and
maintenance costs and recurring maintenance, repair, system upgrade, and overhead costs
of its E-911 system. The tax shall be levied upon each purchaser of telephone service
from a corporation coming within the provisions of Code of Virginia, § 58.1-2600 et seq.
The tax shall be in the amount of $2.00 per telephone line per month.
(2) That this ordinance shall become effective immediately upon adoption.

The Board is requested to approve the attached priority list and letter
regarding Chesterfield County's transportation needs, and authorize this
information be forwarded to the Virginia Department of Transportation,
Commonwealth Transportation Board, and the county's Congressional and
State Legislative Delegations.
Summary of Information:
Each year, the Board of Supervisors is requested to adopt a priority list
of primary and interstate transportation needs for consideration by the
Virginia Department of Transportation (VDOT) when VDOT updates their Six -
Year Improvement Program (SYIP) . VDOT's SYIP identifies projected funding
for primary and interstate roads, rail, transit and other federally -funded
specialty projects.
The Commonwealth Transportation Board (CTB) held a public meeting for the
FY2015-FY2020 SYIP on November 6, 2013, at the VDOT Central Office
Auditorium. Written comments regarding the FY2015-FY2020 SYIP are being
accepted until December 6, 2013. This meeting and comment period is being
held to obtain input into the SYIP prior to releasing the draft SYIP in
the spring.

Staff recommends a letter be sent to VDOT for inclusion in the public
record expressing support for the priority projects and the revenue
sharing program. The draft letter is Attachment B. The letter should be
submitted to the Richmond District CTB member and the county's legislative
delegation.
A summary of the Chesterfield County projects included in VDOT's current
FY2014-FY2019 Six -Year Improvement Program is shown on Attachment C.
The Secondary Road Six -Year Program will be presented in the spring for
the Board's consideration.
Recommendation:
Staff recommends:
1) The Board approve the recommended priority list of primary and
interstate transportation needs and letter; and
2) Direct the County Administrator to forward the list and letter to
the Richmond District Commonwealth Transportation Board member,

SUBJECT: VDOT FYI 5-FY20 Six -Year Improvement Program
Chesterfield County Priority Projects
Dear Commissioner Whirley:
On behalf of the Chesterfield County Board of Supervisors, I am submitting Chesterfield County's
priority list of highway projects. Chesterfield County is requesting funding for the projects and asking that this
priority list be entered into the Richmond District Public Meeting record for the FYI 5 -FY20 Six -Year
Improvement Program.
Our number one priority project involves improvements to the Route 288/Route 360 Interchange.
Traffic volumes on Route 360 in the vicinity of the interchange are over 80,000 vehicles per day. Traffic
exiting Route 288 southbound to Route 360 westbound backs up onto Route 288 during the evening commute
period restricting through traffic on Route 288 to a single lane and resulting in numerous accidents. We are
currently working with VDOT in the preliminary design stages. This multi -phased project is estimated to cost
between $300 million to $400 million. Some funding, $12.5 million, has been allocated in the SYIP;
however, significant additional funds are required to properly address the congestion issues at this location. It
is imperative that funding for this project be programmed now.
Our second funding request is for an existing project in the Six Year Improvement Plan: Route 10
(Bermuda Triangle Road to Meadowville Road) Widening_projeet. This project is funded with both RSTP funds
from the MPO and funds from the Governor's Transportation Initiative of 2011, totaling $30 million.
Preliminary engineering for the project is underway and has revealed the need for additional improvements, not
anticipated initially, to address future traffic volumes. As you know, this corridor is important to the economic
vitality of our region. We estimate an additional $15 million is needed for this project. We will be holding a
public hearing for the project in January and hope to advertise the project in 2016, if funding is made available.
Our third funding request is for the Route 10 (Whitepine Road to Frith Lane) Widening Project. This project
involves widening Route 10 to six lanes. Approximately 36,000 vehicles per day use this section of Route 10
which includes the Route 288 interchange. The county was able to secure $1.3 million in RSTP funds,
allocated in FYI 9, for this $12 -million project. Additional funding is needed to fully fund and advance the
project.

The last funding request we would like to bring to your attention is for the Route 360 (Genito Road to Warbro,
Road) Widening project. This section of road carries 41,000 vehicles per day. The first phase of this project,
which should be under construction in early 2014, has been funded with Regional Surface Transportation
Program funds from the Richmond MPO. The second phase involves reconstructing and widening the
eastbound lanes of Route 360 in this section. This second phase of widening will complete a ten -mile long,
six -lane principal arterial that connects Chippenham. Parkway, Route 288 and extends to western Chesterfield.
The county secured $0.8 million in FYI 9 RSTP funds for this $5.5 -million project. Additional funding is
needed to fully fund and advance the project.
We would like to express our appreciation to the Commonwealth Transportation Board for the continued funding
for the revenue sharing program. This program is an excellent way to partner with the state to deliver priority
projects. In addition, we are appreciative of the on-going support and cooperation we get from you, the Central
Office, District, and Residency Staff.
If you need additional information or clarification, please let us know•. If funding is provided for these projects,
the county stands ready to manage them through construction. We look forward to working with you in the

RECOMMENDED PRIORITY PROJECT DESCRIPTIONS
1. Route 288/Route 360 Interchange Improvement Proiect — Traffic volumes on Route 360 in the vicinity of
the interchange are over 80,000 vehicles per day. Traffic exiting Route 288 southbound to Route 360
westbound (over 1,600 vehicles during the peak hour) backs up onto Route 288 during the evening commute
period restricting through traffic on Route 288 to a single lane and resulting in numerous accidents. Route
288 and Route 360 carry 56,000 and 74,500, respectively, in the vicinity of the interchange. The proximity
of the Route 360/Old Hundred Road/ Commonwealth Center Parkway intersection contributes to the
congestion at the interchange. VDOT is currently conducting a study to determine how to address the
congestion at this location. This multi -phased project is estimated to cost between $300 million to $400
million. Some funding, $12.5 million, has been allocated in the SYIP; however, significant additional funds
are required to properly address the congestion issues at this location.
2. Route 60 (Alverser Drive to Old Buckingham Road) Widening Proiect Revenue Sharing (50% state and
50% county) and federal Regional Surface Transportation Program (RSTP) funds will be used to widen
Route 60 to six lanes between Alverser Drive and Old Buckingham Road. Existing volumes on Route 60 are
44,000 vehicles per day. In the next twenty years, the volume is projected to rise to 66,000 vehicles per day.
The county is managing the project. Design is underway. Construction is anticipated to begin in 2014.
3. Route 10 (Bermuda Triangle Road to Meadowville Road) Widening Proiect — This project involves

improvements to the intersection of Route 10 and Meadowville Road and widening Route 10 between
Bermuda Triangle Road to Meadowville Road to eight lanes. The project has been funded by the Governor's
Transportation Initiative of 2011 and additional federal funds secured by the county. The county is
managing the project. Preliminary engineering for the project is underway and has revealed the need for
additional improvements, not anticipated initially, to address future traffic volumes. Existing volumes on
Route 10 are 46,000 vehicles per day. In the next twenty years, the volume is projected to rise to 68,000
vehicles per day. An additional $15 million is needed to fully fund the project. A public hearing is planned
for January 2014, with acquisition of right-of-way and utility relocation in 2014. If funding is made
available, construction could begin in 2016.
4. Route 10 (Route 1 to 1-95) Widening Proiect - Revenue Sharing (50% state and 50% county) and federal
Regional Surface Transportation Program (RSTP) funds will be used to widen Route 10 to six lanes between
Route 1 and 1-95. Existing volumes on Route 10 are 42,000 vehicles per day. In the next twenty years, the
volume is projected to rise to 62,000 vehicles per day. The county is managing the project. Studies to
identify the project scope are underway.
5. Route 360 (Winterpock Road to Woodlake Village Parkway) Widening Project -The county was
successful in securing federal funds and revenue sharing funds to provide a third lane on Route 360 from
Winterpock Road to Woodlake Village Parkway. Existing volumes on Route 360 are 44,000 vehicles per
day. In the next twenty years, the volume is projected to rise to 65,000 vehicles per day. The county is
managing the project. Utility relocations are underway and the project was advertised for construction in
October. Construction will begin in December if an acceptable bid is received.
6. Route 10 (Whitepine Road to Frith Lane) Widening Project - This project involves widening this section
of Route 10 to six lanes. Approximately 36,000 vehicles per day travel on this part of Route 10 which
includes the Route 288 interchange. In the next twenty years, the volume is projected to rise to 53,000
vehicles per day. The county was able to secure $1.3 million in RSTP funds, allocated in FYI 9, for this $12 -
million project. Additional funding is needed to fully fund and advance the project.
7. Route 360 (Route 288 to Genito Road) Widening Project - This section of road carries 65,000 vehicles
per day and the volume in twenty years is projected to be 79,000 vehicles per day. The first phase of this
project, which should be under construction in early 2014, has been funded with Regional Surface
Transportation Program funds from the Richmond MPO. The second phase involves reconstructing and
widening the eastbound lanes of Route 360 between Lonas Parkway and Castle Rock Road. This second
phase of widening will complete a ten -mile long, six -lane principal arterial that connects Chippenham
Parkway, Route 288 and extends to western Chesterfield. The county secured $0.8 million in FY19 RSTP
funds for this $5.5 -million project. Additional funding is needed to fully fund and advance the project.
8. Route 360 (Woodlake Village Parkway to Otterdale Road) Widening Project - This section of Route 360
carries over 26,000 vehicles per day. This volume is expected to increase to 41,000 vehicles per day by the
year 2030. The project involves widening Route 360 to six lanes.
9. Huguenot Road (between Route 60 and Alverser Drive) Widening Project - The county was successful
in securing Federal funds to provide the third lane on both north and south bound Huguenot Road just north
of Route 60. Existing volumes on Huguenot Road are 35,000 vehicles per day. In the next twenty years, the
volume is projected to rise to 43,000 vehicles per day. VDOT is managing the project. Plans are available.
Construction is planned for 2015.
10. Route I at Old Bermuda Hundred Road Intersection Improvement - The county was successful in
obtaining federal funds for a project to improve and signalize the intersection of Route 1 at Old Bermuda
Hundred Road. VDOT is managing the project. Plans are available and right-of-way acquisition will begin
in November. Construction is scheduled to begin January 2016.
11. Centralia Road (Memory Lane to Chester Road) Widening Project -Centralia Road carries between
10,000 and 13,000 vehicles per day. A high number of traffic accidents are occurring on Centralia Road
between Memory Lane and Chester Road. The construction of a third lane to accommodate left turns would
help address the accident problems.
12. Route 288/Chester Road Interchange Improvement Proiect — The county was successful in securing
federal funds to address congestion on the Route 288 northbound exit ramps to Chester Road. VDOT plans
to construct turn lane improvements on the ramp and signalize the intersection on Chester Road.
Construction is scheduled for late Fall 2013 and should be complete by May 2014.
13. Powhite Parkway Extension; East-West Freeway; North-South Freeway - Preliminary engineering and
partial right-of-way acquisition are necessary for the county's outer beltway (Powhite Parkway Extension
from Charter Colony Parkway to Route 360; East-West Freeway from Route 360 to Interstate 95).
Preliminary engineering is needed to properly identify the location of the beltway. Right-of-way should be
acquired where growth threatens to block the corridors.
14. Powhite Parkway Extension (Watermill Parkway to Woolridge Road Extended) Widening Project —
This project involves construction of four lanes of the Powhite Parkway from Watermill Parkway to
Woolridge Road Extended and construction of Woolridge Road Extended to Spaldwick Lane.
15. Sirmalization - The installation of traffic signals is needed at various intersections. Signalization requests on
primary roads received through Board members include: Route 360 at Lynchester Drive; Route 360 at
Lynview Drive; Route 360 at Broadstone Road; Route 10 at Ecoff Avenue; Route 10 at Parker Lane; Route
10 at West Rock Spring Drive; River Road at Pickett Avenue; Route I at Sand Hills Drive; and signal
improvements along the Route 60 corridor.
16. Sight and Sound Barriers (Powhite Parkway and Route 288, various locations) - These barriers are
needed to reduce the impacts of the roadways on adjoining neighborhoods.
17. Park -and -Ride Facilities — Preliminary engineering is required to identify
potential park-and-ride facility locations. These facilities will be needed in the future to help reduce
countywide traffic congestion. VDOT has a statewide Park & Ride initiative and is implementing a pilot
project in the Richmond/Tri-Cities region to construct park and ride lots where needed.
18. Removal of Tolls on the Powhite Parkway - Funding is needed to retire the debt on Powhite
Parkway from Chippenham Parkway to Route 288 which will allow the tolls to be removed. Debt on the
Powhite Parkway is a combination of the principal on bonds, Toll Facilities Revolving Account debt, VDOT
Construction Fund debt and long-term notes debt. VDOT is in the process of repaying the remaining $8
million loaned by the county for the project. These funds will be used towards the FY15 revenue sharing
local match.
19. High Speed Rail - Funding is necessary to develop high-speed rail service in Chesterfield County and the
region. Stimulus funds ($75 M) have been programmed for high-speed rail improvements between
Richmond and Washington D.C. No funds have been programmed for improvements south of Richmond.
20. Interstate 295/Meadowville Road Interchange PEoiect, Phase 11 — This project involves construction of
the interchange loops and widening of Meadowville Road over 1-295. The road widening requires the
construction of a new bridge on Meadowville Road. Some funding, $3.5 million in FYI 9, has been allocated
to the bridge widening. Additional funding is needed to fully fund and advance the project.
21. Ettrick Multimodal Station — Funding is needed to make improvements to the existing train station to
address future ridership growth. This project involves acquiring the existing train station property,
constructing a new station, providing on-site improvements to parking and circulation and improving
vehicular, pedestrian and bicyclist access to the station.

Smoketree Drive from the Smoketree Community Recreation Center to the eastern

sidewalk between Epiphany Catholic Church and Courthouse Road has not been
identified at this time.
A VDOT/County design/right-of-way/construction agreement, similar to those
the county has executed in the past, will be necessary. Under the terms of
the agreement, the county will administer the design, right-of-way and
construction of the project and be reimbursed by VDOT for the $470,400.
All work required is anticipated to be within existing right-of-way. It is
requested that the County Administrator be authorized to proceed with the
customary project activities including the award of a construction contract
up to $400,000 to the lowest responsive and responsible bidder.
Recommendation:
Staff recommends the Board take the following actions for the Smoketree
Drive(Smoketree Community Recreation Center to Epiphany Catholic Church)
Sidewalk Project:
1. Appropriate $470,400 in anticipated VDOT reimbursements;
2. Transfer $117,600 from the General Road Improvement Account for the
local match;
3. Authorize the County Administrator to enter into the customary
VDOT/County agreements/contracts, permits/mitigation agreements and
surety agreements, acceptable to the County Attorney;
4. Authorize the County Administrator to proceed with the design and right-
of-way acquisition, including advertisement of an eminent domain public
hearing if necessary; and to accept the conveyance of right-of-way and
easements that are acquired;
5. Authorize the Chairman of the Board of Supervisors and County
Administrator to execute easement agreements for relocation of
utilities;
G. Authorize the County Administrator to proceed with the advertisement of
a construction contract for the project;
7. Authorize award of a construction contract, up to $400,000, to the
lowest responsive and responsible bidder; and
8. Authorize the County Administrator to execute all necessary change
orders for the work, up to the full amount budgeted for the project.

Veteran's Day ceremony on November 16, 2013, at Bensley Park to honor all

Adopt the attached ordinance amending Code Section numbering of Chapter 10,
Fire Protection, of the County Code.
Summary of Information:
The Virginia Statewide Fire Prevention Code (VSFPC), which is enforced by the
Fire Marshal's Office, provides that localities may amend state fire
protection law to the extent that they make the law more stringent than the
VSFPC. Traditionally, the County has amended the VSFPC to provide more
stringent regulation in such areas as open burning and fireworks displays.
Recently, it was observed that several of the numbered code sections within
the county fire code did not correlate with the appropriate code sections in
the VSFPC because the VSFPC has been amended. Additionally, one existing
County Code provision is no longer needed because it is now expressly covered
in the VSFPC itself. The County needs to update the county code sections to
accurately link to the proper sections of the most recent VSFPC.

volume of greater than 2,500 cubic feet (70 m3) in any structure or on any premises, except
under conditions approved by the code official.
315.5 315.6 Storage, Park or Repair. Add subsection 315.5 315.6 as follows:
No person shall store, park or repair any vehicle, tool or equipment that has a fuel tank that
contains a flammable or combustible liquid or liquefied petroleum gas as a source of fuel within
or on any occupancy in Use Group R, or part thereof, unless such building or structure is built for
the purpose of such storage, parking or repairing in accordance with all requirements of the
Uniform Statewide Building Code and this code. The owner or manager of any occupancy in Use
Group R shall notify their tenants in writing of this code requirement at the time the tenants
initially occupy the apartment and annually thereafter. A copy of this written notification shall be
available for review by the code official. This section shall not apply to detached one- and two-
family dwellings unless such storage, parking or repairing is conducted as a business. Such
businesses must then comply with all applicable provisions of the Uniform Statewide Building
Code and the Chesterfield County Code.
Chapter 5. Fire Service Features
503. 503.8 Illegal Use. Add subsection 503.7 503.8 as follows:
1. No person shall park or leave an unattended vehicle in or otherwise obstruct with a
vehicle any designated or marked fire lane.
2. No person shall place or locate any equipment, materials, or any other object in or
otherwise obstruct any designated or marked fire lane.
3. The penalty for violation of section 503.8(1) shall be the same as outlined for other
parking violations in the Chesterfield County Code. The penalty for violation of section 503.8(2)
shall be the same as for all other violations of this chapter.
Chapter 9 Fire Protection Systems
901.6.1.1 Limited Area Sprinkler Systems. Add subsection 901.6. 1.1 as follows:

All limited area sprinkler systems shall be inspected annually and maintained according to NFPA
25 and in accordance with the following standards:
1. The sprinkler control valve shall be permanently marked with a sign stating "Sprinkler
Control Valve." Markings made with embossed plastic tape, pencil, ink, crayon, or similar
materials shall not be considered permanent. The sign shall be secured with noncorrosive wire,
chain, or other means.
2. Markings shall be provided in a conspicuous place at the sprinkler control valve and shall
state: "Notify the Fire Department (748-6240 '?48-1251) before closing valve."
3. Valves connecting the limited area sprinkler system to the domestic water supply shall be
locked open in an approved manner,

All modifications, additions, or repair work beyond the scope of routine maintenance and
inspections require permits issued by the Building Official in accordance with the Uniform
Statewide Building Code.

operational or otherwise impaired.

Chesterfield County currently contains two enterprise zones approved by the
state: the Jefferson Davis Enterprise zone designated on January 1, 1994 and
the Walthall Enterprise Zone designated on January 1, 1996. The enterprise
zones were established for an initial period of ten (10) years and were
renewed for two (2) additional five (5) year terms. Due to recent changes in
the law, the County no longer meets the demographic criteria to maintain the
enterprise zones. Thus, the Jefferson Davis Enterprise Zone, along with the
associated Hull Street Road Subzone, will expire on January 1, 2014, and the
Walthall Enterprise Zone, along with the associated Midlothian Turnpike
Subzone and Meadowdale Meadowbrook Subzone, will expire on January 1, 2016.

The General Assembly, however, recently adopted Va. Code § 58.1-3850 which
allows localities to establish, by ordinance, "technology zones", and
authorizes localities to grant incentives and regulatory flexibility to
businesses locating in technology zones identical to what is authorized for
businesses locating in enterprise zones, provided that the benefits allowed
in technology zones may not extend beyond a ten (10) year period.
The proposed ordinance amendments create new technology zones defined by the
same geographical boundaries of each presently existing enterprise zone and
subzone. Creating the technology zones will ensure that the various benefits
provided by county ordinance to businesses located in enterprise zones will
be retained in the County Code and will not expire upon expiration of the
enterprise zones on January 1, 2014 and January 1, 2016 respectively. Among
the changes is an amendment to the fee schedule in the zoning ordinance (§19-
25), which was considered by the Planning Commission on September 17, 2013.
The Commission recommended approval of the amendment.
Staff recommends adoption of the proposed amendments.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTIONS 5-5, 6-5, 8-13, 9-31, 9-64, 9-220, AND 18-22
RELATING TO ENTERPRISE ZONES AND SUBZONES
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Sections 5-5, 6-5, 8-13, 9-31, 9-64, 9-220, and 18-22 of the Code of the County of
Chesterfield, 1997, as amended, are amended and re-enacted to read as follows:

(b) Fee schedule. Fees shall be charged in accordance with the following schedule:

d. A building or auxiliary permit fee will not be charged for commercial
construction located in an "enterprise zone" or "subzone" as designated by
the Commonwealth of Virginia or "technology zone" as designated by the
Con-Anenwealth of lir a county and administered by the Chesterfield
County Bleek &aifil. Economic Development Office. This exemption
shall continue for the life of the enterprise zone or subzone or technology
zone.
Sec. 6-5. Tax and fee relief for qualified businesses located in an enterprise zone or
subzone or technology zone.
(a) Any business required to obtain a license based on gross receipts or purchases pursuant
to this chapter, which is located in or makes improvements to a building within an
enterprise zone or subzone designated by the state or technology zone designated by the
state county, on or after the date on which the enterprise zone or subzone or technology
zone was established, may receive relief during the tax and fee relief period, of those
taxes and fees which are calculated on the increase in gross receipts or purchases over
the business' gross receipts or purchases during the base year. The base year under this
section shall be the calendar year immediately preceding the year that the business
initially qualifies for tax and fee relief under this section. For taxpayers who file federal
income tax returns on a fiscal year basis, the base year shall be the fiscal year ending
during the calendar year immediately preceding the year that the business initially
qualifies for tax and fee relief under this section. For a newly established business, a
new branch or a business relocating from outside Chesterfield County, the base year

amount shall be zero and the tax and fee relief period shall begin in the tax year that
the business qualifies for tax and fee relief and shall last for four additional tax
years, or for as long as the business remains within any enterprise zone or subzone or
technology zone in Chesterfield County, whichever period is shorter. For existing
businesses which are already located in Chesterfield County, the tax and fee relief
period shall begin in the tax year after the business qualifies for the relief and shall last
for four additional tax years, or for so long as the business remains within any
enterprise zone or subzone or technology zone in Chesterfield County, whichever
period is shorter.
(b) A business shall qualify for the tax and fee relief provided for in subsection (a)
as follows:
(1) An application for tax relief under this section must be submitted to the
county's economic development department and the benefit accessed by the
business within one year of start of operations in the zone or subzone.
(2) If the business newly locates from outside any enterprise zone or subzone
or technology zone in Chesterfield County to a building or tenant space within
any enterprise zone or subzone or technology zone in Chesterfield County after
the date on which the enterprise zone or subzone or technology zone is
established, it shall qualify for tax and fee relief immediately upon
occupying the building.
(3) If the business relocates within any enterprise zone or subzone or technology
zone in Chesterfield County to a building or tenant space after the date on
which the enterprise zone or subzone or technology zone is established, it shall
qualify for tax and fee relief immediately upon occupying the building
provided it has not received tax or free relief at its previous zone or subzone
location.
(4) If the business builds a new building which receives its certificate of
occupancy after the date on which the enterprise zone or subzone or
technology zone is established, it shall qualify for the tax and fee relief
immediately upon occupying the building.
(5) If the business shares occupancy of a new building which receives its
certificate of occupancy after the date on which the enterprise zone or subzone
or technology zone is established and is a separate and distinct business from
any other business which occupies the same building, it shall qualify for tax
and fee relief immediately upon occupying the building.
(6) For purposes of determining initial eligibility for tax and fee relief under
this section, the term "locate" does not include a transfer of ownership of an
existing business operation within an enterprise zone or subzone or technology
zone to another entity which is wholly or partially owned or controlled by or
affiliated with the prior business owner, but such a transfer of ownership shall

not disqualify a currently eligible business from enjoying the benefits under this
section for a full five years, even if such transfer occurs during the five-year
eligibility period, regardless of the change in ownership.
(7) Each business shall be limited to one five-year period of the tax and fee
relief under this section.
See. 8-13. Fees.
(d) No business located within an enterprise zone or subzone designated by the
Commonwealth of Virginia or technology zone designated by the Commonwealth 0

Sec. 9-31. Partial exemption for certain rehabilitated, renovated or replaced commercial
or industrial structures.
(a) A partial exemption from real estate taxes is granted to certain commercial or
industrial property which qualifies under the criteria listed in subsection (b).
(b) For real property to qualify for the partial exemption granted by this section, the
following criteria must apply:
(1) Any real estate upon which there is an existing commercial or industrial
structure shall be deemed to have been substantially rehabilitated, renovated or
replaced when a structure 25 years old or older has been improved so as to
increase the assessed value of the structure by 15 percent or more. For a motel
or hotel, the structure shall be no less than 35 years of age. For structures other
than a motel or hotel in an area designated by the Commonwealth of Virginia as
an enterprise zone or subzone or technology zone, the structure may be,) 5 years
old or older. Subject to the limitations set forth below, the rehabilitated,
renovated or replaced structure may be used for any purpose, including mixed
use, that is allowed by the building code and the applicable zoning regulations
for the property.
(c) Prior to beginning the rehabilitation, renovation or replacement the owner of any
real estate meeting the criteria stated in this section shall apply for the exemption on
forms provided by the county. Upon receiving the application, the county assessor shall
determine the base value of the structure. This base value determination shall be
effective for two years from the date of determination, but applicants may reapply after

this time period expires. The owner shall pay an application fee of $50.00 for each
application which shall be refundable upon completion of the replacement or
rehabilitation. Property located in an enterprise zone or subzone or technology zone
shall be exempt from paying an application fee.
Sec. 9-64. Rebate --Machinery and tools used by certain businesses located within an
enterprise zone or subzone or technology zone.
(a) Any business which after January 1, 2006 either (i) locates in an enterprise zone or
subzone o r technology zone designated by the stat or (ii) undergoes a facility
expansion or renovation which results in an increase of 15 percent or $50,000.00,
whichever is greater, in the assessed value of its machinery and tools over the value of
its machinery and tools from the previous year ("base year"), shall qualify for the rebate
specified below, to the extent permissible under the Constitution of Virginia.
(b) An application for enterprise zone or technology zone benefits must be submitted to the
Chester -field Geunty department of Beconomic Ddevelopment Department and the
benefit accessed by the business within one year of start of operations in the
enterprise zone or subzone or technology zone, or within one year of a qualifying
facility expansion or renovation in order to receive the machinery and tools tax rebate.
Sec. 9-220. Enterprise zones and subzones and technology zones.
(a) Pursuant to section 58.1-3850 of the Code of Virginia the following technology
zones are created: effective January 1, 2014, the Jefferson Davis Technology Zone and the Hull
Street Road Technology Zone-, and effective January 1, 2016, the Walthall Technology Zone,
Midlothian Turnpike Technology Zone, and the Meadowdale Meadowbrook Technology Zone.
The Jefferson Davis Technology Zone shall be defined by the same geographical boundaries of
the Jefferson Davis Enterprise Zone established in the county on January 1, 1994 excepting the
area designated as the Hull Street Road Enterprise Subzone, which effective January 1, 2014,
shall define the boundaries of the Hull Street Road Technology Zone. The Walthall Technology
Zone shall be defined by the same geographical boundaries of the Walthall Enterprise Zone
established in the county on January 1. 1996, excepting the areas designated as the Midlothian
Turnpike Enterprise Subzone and the Meadowdale Meadowbrook Enterprise Subzone, which
effective January 1, 2016, shall define respectively the boundaries of the Midlothian Turnpike
Technology Zone and the Meadowdale Meadowbrook Technology Zone. The Jefferson Davis
Enterprise Zone shall cease to exist on January 1, 2014. The Walthall Enterprise Zone shall

(b) Pursuant to section 58.1-3850 of the Code of Virginia, all tax incentives and
regulatory flexibility granted by county ordinance to properties located in a technology zone are
granted for a period of ten years.

(f) No capital cost recovery charge shall be charged for a meter that is five-eighths of
an inch in size or smaller which serves any business that is located in an enterprise
zone or subzone designated by the Commonwealth of Virginia or technology
zone designated by the Commenwealth e Vir county if the business is
connecting to the county utility system for the first time. This exemption shall continue
for the life of the enterprise zone or subzone or technology zone.
(2) That this ordinance shall become effective immediately upon adoption.

by amending and reenacting Sections 5-5,

25 relating to Technology Zones.
The proposed amendments would enact
Technology Zones within the County.
Further, with respect to Section 19-25, the
amendment would extend to Technology
Zones the exemption from paying
Planning Department fees that currently
applies to Enterprise Zones. For site plan
and administrative variance submittals in
either an Enterprise Zone or Technology
Zone, the amendment would also delete the
requirement that the director of planning
determine that such exemption requests
are in compliance with the comprehensive
Plan.
After the public hearing, the Board
may make changes in the proposed
amendments, which with respect to
Section 19-25, could range from no chane
in the current fee schedules to changing,
all fees in accordance with the proposed
amendment, or any combination of fees

Hold a public hearing and amend Section 15-31 of the County Code relating to
the requirements to issue a business license for a bail bondsman.
Summary of Information:
Bail bondsmen are required to obtain a business license from the Commissioner
of the Revenue in order to operate in the County. The Code of Virginia
previously required a bondsman applying for a business license to obtain a
certificate from the Chesterfield County Circuit Court stating that the
applicant is of good moral character. The Code of Virginia has been amended
to require applicants to obtain a state bondsman certification (called a
"license") from the State Department of Criminal Justice Services, instead of
the certificate from the local Circuit Court, and grandfathers existing
businesses in good standing from having to comply with this new state law
requirement. While bondsmen will still have to obtain a business license from
the County, the proposed amendment will make the County Code consistent with
the state statute.
The Commissioner of Revenue and staff recommend that the ordinance be adopted
after the public hearing.

BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 15-31 of the Code of the County of Chester geld, 1997, as amended, is
amended and re-enacted to read as follows:
Sec. 15-31. Certificate.
Every person, other than a guaranty, indemnity, or fidelity and surety company
doing business in the state pursuant to Code of Virginia, §§ 38.2-2400-38.2-2420, as
amended, that desires to be in the business of entering into or offering to enter into bonds
for others, for compensation, whether as a principal or surety, whose situs is located in
Chesterfield County, shall obtain a eei4ifieate bondsman license pursuant to Code of
Virginia, § 58.1-3724, from a ChesWffield Gow-Ay eireuit eouit 'judge stating that the
applieafft is ef geed mef-al eharaeter and is entitled te a business heense. the
Department of Criminal Justice Services. Any bondsman or his agent who has heretofore
obtained a certificate and business license under this section and whose certificate,
business license and right to act as a bondsman continues to remain in full force and
effect is exempted from this requirement. The circuit court may revoke any such
certificate previously issued by it for good cause.
(2) That this ordinance shall become effective immediately upon adoption.
