Kofron Matoaca Magisterial District 6402 River Road. January 22, 2014 BS REQUEST: Renewal of manufactured home permit (Case 07SNOll4) to permit a temporary manufactured home in a Residential (R-7) District. RECOMMENDATION Recommend denial for the following reasons: A. The manufactured home is inconsistent with the traditional single-family dwelling design standards established in the surrounding area and, as such, may have an adverse impact on the character of the area's residential uses. B. There is no evidence of extenuating circumstances that would warrant continued location of the manufactured home on the request property. C. The approval of this request may set a precedent for the placement of other temporary manufactured homes in this area. (NOTE: CONDITIONS MAY BE IMPOSED. THE ORDINANCE LIMITS THE MAXIMUM PERIOD OF TIME FOR WHICH THIS PERMIT MAY BE GRANTED TO SEVEN (7) YEARS. SHOULD THE BOARD WISH TO APPROVE THIS REQUEST, APPROVAL WOULD BE FOR SEVEN (7) YEARS UNLESS CONDITIONED FOR LESS TIlVIE.) GENERAL INFORMATION Location: The request property is located off the north line of River Road, across from Pickett Avenue and is better known as 6402 River Road. Tax ID 780-609-2158. Pro~Tiding a FIRST CHOICE community through excellence in public ser~Tice Existing Zonin R-7 Size: 1.8 acres Existing Land Use: Manufactured home Adjacent Zoning and Land Use: North and West - R-7; Single-family residential use or vacant South - C-3; Single-family residential use or commercial East - R-7 and O-2; Single-family residential use or vacant Utilities: The existing residence is connected to the public water and wastewater systems. The request will not impact the public water and wastewater systems. ENVIRONMENTAL ENGINEERING AND TRANSPORTATION This request will have no impact on these facilities. Fire Service: The Matoaca Fire Station, Company Number 8, and Ettrick-Matoaca Volunteer Rescue Squad currently provide fire protection and emergency medical service (EMS). This request will have a minimal impact on Fire and EMS. LAND USE Comprehensive Plan: The Comprehensive Plan suggests the property is appropriate for Neighborhood Business and Suburban Residential II uses (2.0 to 4.0 dwellings per acre). Area Development Trends: Area properties are primarily zoned residentially and are occupied by single-family residential use or are vacant. Property to the southeast is zoned commercially and is occupied by a bank. It is anticipated that residential and commercial uses will continue in the area, as suggested by the Plan. 2 14SN0129-20141_~N22-B( )S-RPT Zoning and Permit HistorX: On September 27, 2006 the Board of Supervisors approved a temporary manufactured home permit on the request property (Case 07SNOll4). The applicant (Sarah Sylvester) was the mother of William and Linda Kofran and the occupant of the temporary manufactured home. The Kofran's were the owners of the property and the manufactured home. The request would allow Mrs. Sylvester to live close to her children due to her health conditions. While staff was not supportive, the Board approved the request for a period of seven (7) years noting a unique situation that warranted deviation from staff's policy regarding the new placement of manufactured homes in established residential areas. The permit expired in September of 2013. A variance for no public road frontage was approved for the request property by the Board of Zoning Appeals on October 4, 2006 (Case 07ANOll2). Conditions of approval for the variance specified access easement and driveway requirements. Proposal: The applicants are seeking renewal of the original manufactured home permit for an additional seven (7) years. While the original occupant was the applicants' mother, the applicants' sister and brother-in-law (Gene D. and Teresa S. Irving) would now be the occupants of the home. The temporary manufactured home and property would continue to be owned by applicants. The applicants indicate that their sister and brother-in-law have health issues and, as occupants, could maintain the manufactured home. CONCLUSION The manufactured home is not in keeping with area development. While the initial permit served a temporary need for the care of an immediate family member (mother), there are no extenuating circumstances presented that would warrant continued location of the manufactured home on the property. Given these considerations, denial of the request is recommended. Should the Board wish to approve this request, imposition of the following conditions would be appropriate: CONDITIONS 1. The applicants and/or Gene D. and Teresa S. Irving, shall be the owners of the manufactured home. Occupancy of the manufactured home shall be limited to Gene D. and Teresa S. Irving. (P) 2. This manufactured home permit shall be granted for a period not to exceed two (2) years from date of approval (P) 3. No permanent-type living space may be added to the manufactured home. The manufactured home shall be skirted but shall not be placed on a permanent foundation.
