Hold a work session on the County Administrator's FY2004 Proposed
Budget
Summary of Information:
This time has been set to continue work sessions on the County
Administrator's FY2004 Proposed Budget. This is the final budget work
session. On February 12th, staff presented FY2004 projected revenues
and the Community Services Board budget. On February 26th, staff
presented Human Services and the School Board presented its budget. On
March l0th, presentations were made by Social Services, Police and Fire
and Emergency Medical Services. On March 12th, staff presented an
overview of the County Administrator's Proposed FY2004 Expenditure
Budget in addition to presentations from Management Services and the
Constitutional Officers.
This work session will include a review of presentations from the
Community Development Division and the Community Development Block
Grant Office.

Subiect: Streetlight Installation Additional Funding Approval

Board Action Requested:
This item requests Board approval of additional funding for a previously
approved streetlight in the Matoaca District.
Summary of Information:
Streetlight requests from individual citizens or civic groups are received in
the Department of Environmental Engineering. Staff requests cost quotations
from Virginia Power for each request received. When the quotations are
received, staff re-examines each request and presents them at the next
available regular meeting of the Board of Supervisors for consideration.
Staff provides the Board with an evaluation of each request based on the
following criteria:
1. Streetlights should be located at intersections;
o
There should be a minimum average of 600 vehicles per day (VPD)
passing the requested location if it is an intersection, or 400 VPD
if the requested location is not an intersection;

Petitions are required and should include 75% of residents within
200 feet of the requested location and if at an intersection, a
majority of those residents immediately adjacent to the
intersection.
Cost quotations from Virginia Power are valid for a period of 60 days. The
Board, upon presentation of the cost quotation may approve, defer, or deny
the expenditure of funds from available District Improvement Funds for the
streetlight installation. If the expenditure is approved, staff authorizes
Virginia Power to install the streetlight. A denial will cancel the project
and staff will so notify the requestor. A deferral will be brought before
the Board again when specified.
MATOACA DISTRICTs
In the Carters Mill subdivision, in the vicinity of 13033 Carters
Valley Road:
At the February 12, 2003 Board of Supervisors Meeting, the Board
approved funding in the amount of $198.63 for the installation of
a streetlight at the above noted location.
The current installation site for this light as staked by the
Electrical Cooperative is approximately 100 feet into the
requestor's lot. The requestor has asked that the light be
relocated the eastern edge of his lot so as to conform to the
eventual road configuration. The requestor's lot is located
adjacent to a temporary road stub. The relocation will require
additional trenching and wiring that will increase the cost of
this installation by $125.00.
In order for this project to proceed the Board will have to
appropriate an additional $125.00 for a total of $323.63.

Nominate/Reappoint a member to serve on the Airport Advisory Board
Summary of Information:
The purpose of the Airport Advisory Board is to advise the Board of
Supervisors on those matters pertaining to the airport, including long term
conceptual planning, the Airport Master Plan, and airport safety & security.
The Advisory Board may perform other duties as directed by the Board of
Supervisors.
Due to the resignation of Mr. William Chandler, from the Midlothian District,
and the relocation of Mr. Steven R. O'Leary, who currently serves the Dale
District, moving to the Midlothian District, Mr. Barber has requested, and
Mr. O'Leary has consented, to serve a three year-term, which will expire
March 26, 2006.
Under the existing Rules of Procedures, appointments to boards and committees
are nominated at one meeting and appointed at the subsequent meeting unless
the rules of procedures are suspended by unanimous vote of the board members
present. Nominees are voted on in the order in which they are nominated.

Kiwanis Club a music/entertainment festival permit for the Chesterfield
Celtic Heritage Festival on April 4-5, 2003.
Summary of Information:
The Central Chesterfield Kiwanis Club proposes to conduct an outdoor concert
in conjunction with the Chesterfield Celtic Heritage Festival on April 4-5,
2003 at the Chester Village Green. The event is scheduled to take place on
Friday, April 4 from 7:00-10:00 p.m. and on Saturday, April 5 from 10:00
a.m.-9:00 p.m. The Kiwanis Club is co-sponsoring the event with The St.
Andrews Society of Richmond, and all net proceeds from the event will be
divided between the two organizations. Music will include traditional Celtic
folk bands and bagpipe band performances.
Admission tickets will be sold in advance for $5.00 for adults with children
under 12 free when accompanied by adults. It is anticipated that
approximately 200 people will attend the event on Friday evening, and
approximately 2,000 people on Saturday. Food and beverages will be provided
by outside vendors.

Dear Mr. Parthemos,
Thank you for your assistance in helping the Chesterfield Celtic Heritage Festival
Committee in applying for the Music and Entertainment Festival Permit for the April
4 - 5, 2003 special event.
The Central Chesterfield Kiwanis, whose contact is located at 3300 New Found
Lane, Chester, Virginia is the applicant for the event permit. The Cultural Heritage
Festival will include Celtic folk music and bagpipe band performances as well as
demonstrations of dancing and traditional athletic events (schedule and listing of
performers is attached). The Kiwanis are working in conjunction with The St.
Andrews Society of Richmond, whose contact is located at 3410 E. Broad Street,
Richmond, to promote the event. These two nonprofit organizations shall receive all
net proceeds generated by the event. The media sponsors for the event will be the
Chester Village News, 88.9 WCVE, and Comcast. Other corporate sponsors are
being pursued to offset the cost of the festival.
The Festival will be held on Friday, April 4 from 7pm - 1 Opm, and on Saturday,
April 5 from 10am - 9pm at the Chester Village Green on Center Street, Chester.
The Chester Village Green is owned by Chester Development Assoc. L.C.. They are
located at 4211 Old Hundred Road, Chester, VA, 23831.
The Central Chesterfield Kiwanis and the St. Andrews Society of Richmond is
assuming full responsibility for the festival. We are currently seeking corporate
sponsors to help offset some of the major costs.

A copy of the admission ticket is attached. Tickets are being sold through the civic
associations associated with the event. We expect to have 200 participants attending
the Friday Evening program and 2000 attending the Saturday event. The ticket cost
is $5 per adult, with children under the age of twelve being admitted for free when
accompanied by an adult.
We have contracted with Shoosmith Brothers Inc. to provide and service portolets
for the event. Units will remain in place from 4/4/03 - 4/7/03.
Shoesmith Brothers, Inc. is providing a dumpster and trash receptacles for the event.
The Chesterfield Jaycees and members of the festival committee will monitor the
trash throughout the day and clean up the site at the conclusion of the event.
Shoosmith will remove the dumpster on 4/7/03.
Food and beverages are being provided by vendors, to include The Lions Club of
Chester, the Central Chesterfield Kiwanis Club,The Civitans of Chester, and the
Chester Rotary Club.
Lodging for entertainers will be provided by the Hampton Inn Chester. No other
lodging will be necessary for the event.
We are alerting the Chesterfield County Fire Department of the event and program
schedule. We will work with the event security officers in the event of an emergency
to notify the proper emergency medical personnel.
Adequate parking facilities are available to park at the Chester Village Green. In the
case of bad weather or overflow parking, the Chester Baptist Church Parking lot will
be utilized and shuttles will be run to the event. The Chester Civic Association will
coordinate parking at the event. A donation of $1 per car will be collected.
The two streets leading into the park area will be closed to vehicular access after
6:30 on Friday evening and after 9:30 on Saturday Morning. These two gates will
serve as the control points for the event. Plastic drift fencing will be used to further
secure the perimeter.

Board Action Requested: The Board is requested to authorize the award of a
$331,500 construction contract to Shoosmith Bros., Inc. for the
Route 10/Enon Church Road Turn Lane Project.
Summary oflnformation: In November 1999, the Board authorized the County
Administrator to enter into a VDOT/County agreement for the design/right-
of-way/construction of the Route 10/Enon Church Road Turn Lane Project. On
February 2, 2003, staff advertised a road construction contract for the
project. Bids were received on February 28, 2003. Bid results are listed on
Attachment A. Shoosmith Bros., Inc. submitted the low bid of $331,500. The
bid is approximately 20 percent lower than the engineer's estimate for the
project.
Recommendation: Staff recommends the Board authorize the award of a
$331,500 construction contract to Shoosmith Bros., Inc. for the
Route 10/Enon Church Road Turn Lane Project.

That the Board of Supervisors authorize Sheridan Books to reprint 700-1,000
copies of the O'Dell Chesterfield Historic Sites Book.
Summary of Information:
The Virginia Department of Historic Resources (DHR), circa 1981, provided
funding for Mr. Jeffrey O'Dell to research and publish a historic sites book
for Chesterfield County. The completed and published book was copyrighted to
Chesterfield County. Due to demand, the Historic Society requests to reprint
the book for sale. A grant has been secured to help underwrite the
reprinting costs from DHR. The Historic Society plans to reprint 700- 1,000
copies and sell them at a retail price of $65.00 per book.

Summary of Information:
This change order includes miscellaneous items related to the construction
and renovation of the Airport Terminal building. There are 21 separate items
on the change order ranging in cost from $140.00 to $8,872.00. Some of the
more significant items include: cost for pre-cast sills, modification of in-
fill walls, required electrical enhancements, drainage issues, additional
tile work, additional preparation and painting.

Budget and Management Comments:
This item requests the Board of Supervisors to approve change order #6 in
the amount of $46,012 for the construction contract with Haley Builders
for the addition/renovations to the Chesterfield County Airport terminal
building. The Board is also being requested to appropriate anticipated
state reimbursement in the amount of $29,542. The balance of $16,470 for
the local match is available in the project contingency account.
This project is primarily finished with the exception of Dunch list items
and a certificate of occupancy should be issued before March 26, 2003.

Set Public Hearing For April 9, 2003 to Consider the Conveyance of

Board Action Requested: Set a public hearing for April 9, 2003 to consider the
conveyance of 5.1 acres on Chester Road to Chesterfield Alternatives, Inc.
Summary of Information:
The County has designated as surplus property a parcel of land containing 5.1
acres, more or less, on Chester Road. The assessed value is $92,000. The
Community Services Board ("CSB") has negotiated an agreement with
Chesterfield Alternatives, Inc. ("CAI") to construct a 7,800 square foot
building on the parcel that could be used by the CSB for its program serving
adults with serious mental illness. CAI has determined that if it can
acquire the site for a nominal value ($10), it could finance and construct a
building and lease to the CSB on a long-term basis. The CSB has a critical
need for a modern, custom-designed facility to replace its current aging and
outdated facility now leased from a private landlord. The CSB has determined
that suitable rental space is not currently available. Once CAI completes
construction of the structure, the CSB would have exclusive use of the
facility to house its program, which will serve up to 150 County citizens
with psychiatric disabilities in need of specialized rehabilitation services.
CAI has agreed to manage the property and maintain it according to standards
set by the CSB.

The Board of Supervisors is requested to approve a request of The Our Gang
Limited Partnership for modification of the Airport Industrial Park
Restrictive Covenants relating to minimum building size.
Summary of Information:
The Our Gang Limited Partnership ("the Partnership") is owner of
property located at 7611 Whitepine Road in the industrial park. The
Partnership is in the process of selling the property. The Airport
Industrial Park restrictive covenants provide that "It]he minimum size of the
principal building. .[on a lot in the Park] shall be 7,000 square feet."
The County approved a site plan for this property in 1978 that showed a
building of only 4,6501 square feet because the site plan also proposed a
"future" expansion that would increase the building to 7,000 square feet.
However, since the future expansion never occurred, the property is not in
conformance with the covenants and, as such, is preventing the sale of the
property.
The Partnership has requested that the County waive that portion of its
restrictive covenants that requires a minimum building size of 7,000 square
feet. The request has been reviewed and approved by the County's Planning
Staff and Department of Economic Development. The Partnership has requested
a waiver of this provision in order to bring the property into compliance
with the restrictive covenants and to close on the sale of the property.

The Board of Supervisors has the right under the restrictive covenants
to waive, modify, alter or amend any of the covenants, conditions, and
restrictions so long as such action does not reduce the overall quality of
the property affected. Planning Staff recommends approval of the
Partnership's request because: (1) the County approved the site plan in 1978
and (2) the current building size will not reduce the overall quality of the
parcel or the Industrial Park.
Further, the County Attorney recommends that if the Board approves this
request, that, by such approval, the Partnership also be required to record
an instrument in the land records of the County Circuit Court that reflects
the Board's decision and minutes in approving this modification of the
restrictive covenants for the subject parcel.

Water Assessment Lien on Property Owned by Kenneth and Jane Akom

The Board of Supervisors is requested to authorize the County
Administrator to execute an agreement subordinating the County's water
assessment district lien to a first mortgage for Kenneth and Jane Akom.
Summary of Information:
Kenneth and Jane Akom own a home in the Autumn Oaks/Chalkley Road Water
Assessment District, which was created in 1998. The Akom's portion of the
assessment is $4,715.00 and a lien has been recorded to protect the
assessment.
The Akoms are preparing to refinance their mortgage. However, their
bank will not close their loan unless the County subordinates the water
assessment lien to it. Staff does not believe that subordinating the
assessment lien to the loan will negatively affect the County's lien, because
the new loan does not increase the first mortgage amount from what it was
when the County's lien was first recorded.
Water assessment liens are repaid semi-annually when real estate taxes
are paid. The repayment period is ten years. The landowners have made all
installment payments in a timely fashion.

SUPPORTING PRESIDENT GEORGE W. BUSH AND THE U.S. MILITARY
WHEREAS, on September 11, 2001, the United States of ~erica was
attacked by terrorists who killed thousands of innocent Americans, as
well as men and women from at least 33 other nations; and
WHEREAS, following these acts of terrorism, President George W. Bush
resolved that those responsible, and those who engaged in or supported
terrorism, would be brought to justice; and
WHEREAS, Iraqi dictator Saddam Hussein is known to possess and have
used weapons of mass destruction, including poison gas and other toxins,
against his own people; and
WHEREAS, besides murdering thousands of his own people, he has
exported violence to Kuwait, which his military invaded in 1991; and
WHEREAS, the United States of America led a coalition of forces that
defeated Saddam Hussein's forces, driving them out of Kuwait, and
restoring liberty in that nation; and
WHEREAS, since that time, Saddam Hussein has steadfastly failed to
abide by the terms set forth by the United Nations at the time of the
cease fire agreement; and
WHEREAS, Saddam Hussein has failed to demonstrate that he has
destroyed all weapons of mass destruction, as required by the United
Nations; and
WHEREAS, Saddam Hussein's regime has been linked to various
terrorist organizations; and
WHEREAS, it would be foolish for America to sit and wait for Saddam
Hussein to provide weapons of mass destruction to terrorist groups to use
against our nation at some future time; and
WHEREAS, the men and women of the U.S. military, with support from
more than 50 other nations, are now in Iraq protecting liberty by
removing an oppressive regime that threatens free people everywhere; and
WHEREAS, nearly 30 Chesterfield County government employees, as well
as many more Chesterfield County residents, are among military and
military reserve forces involved in this fight for freedom.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of
Supervisors, this 26th day of March 2003, hereby declares its support for
President George W. Bush and the U.S. military in this fight for freedom
from terrorism, expresses its gratitude for the sacrifices of our
military and their families, and wishes our servicemen and women, and
those of our coalition forces, a rapid victory, a safe return to their
homes and families, and the well-deserved satisfaction of having made the
world a safer place for freedom-loving people.

RECOGNIZING THE LATE BRETT SAMUEL JONES BY NAMING THE ROBIOUS
COMPLEX AMERICAN LEAGUE BASEBALL FIELD IN HIS HONOR
WHEREAS, for seven years Brett Samuel Jones played baseball in the
Huguenot Little League; and
WHEREAS, Brett had a passion for baseball and excelled as a player
and a teammate; and
WHEREAS, shortly after Brett began playing baseball with Huguenot
Little League, he developed leukemia, and courageously fought the disease
for nearly five years; and
WHEREAS, while Brett underwent debilitating treatments, he continued
playing baseball and played almost every game, even when his family could
not imagine how he could continue; and
WHEREAS, Brett would be so weak from chemotherapy that prior to some
seasons he did not have the energy to run from home to first base, but
would continue to train so that he could play when the season started;
and
WHEREAS, Brett would ask his parents to schedule his chemotherapy
sessions so that he could play baseball, and despite his illness, almost
never missed a game; and
WHEREAS, Brett was an American League player who played on American
League teams each year, and was selected for the American League All-Star
team the last five years he played; and
WHEKEAS, in November 2001, Brett finally succumbed to the disease
against which he so valiantly fought; and
WHEREAS, Brett's easygoing smile, courage, teamwork and example
inspired all those who knew him; and
WHEREAS, Brett's death was a loss not only to his family but also to
the entire Huguenot Little League community and the County of
Chesterfield; and
WHEREAS, Brett exemplified all that Little League should represent
and through his courage and example, will continue to live in our hearts
and inspire us to face any challenge with determination and grace; and
WHEREAS, Chesterfield County will forever honor Brett, by naming the
Robious Sports Complex American League field in his memory.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of
Supervisors, this 9th day of April 2003, publicly recognizes the late
Brett Samuel Jones, the brave and courageous young man who impacted and
inspired all those who knew him and urges all Chesterfield County

Hold a public hearing to consider the appropriation of the $1,127,779 per
diem refund received from the Riverside Regional Jail Authority. The refund
will be used to offset the expected shortfall in the regional jail budget.
Summary of Information:
This date and time has been scheduled to hold a public hearing to consider
the appropriation of $1,127,779 received from the Riverside Regional Jail
Authority (RRJA) as a refund for per diem payments. RRJA generated excess
funds last fiscal year in the amount of $3,723,924. Excess revenue was
generated by the RRJA selling beds to federal agencies, contracting with the
State to hold %nmates under the Jail Contract Bed program, and selling beds
to non-member jurisdictions.
The Authority voted to refund, to participating localities, $2,346,334, of
which $1,127,779 is Chesterfield County's share. Of the funds remaining,
$1,000,000 will be deposited into the RRJA expansion fund and $377,589 will
be added to the RRJA operating reserve fund to meet the reserve requirement
per the bond obligation agreement.

Summary of Information (Cont.):
The average daily population for Chesterfield County at the Regional Jail in
FY2000 was 232.4. In FY2001, the average daily population was 281.4 and in
FY2002 the average daily population was 444.6. The average daily population
for the current fiscal year, through January, has been 470.9. More arrests
and subsequent convictions are two factors contributing to the
uncharacteristically high populations at both the local and regional jails.
If current factors remain constant, the average daily population for the
twelve-month period could easily be 470 at the regional jail, at a cost of
approximately $6,347,718. The current fiscal year budget for per diem
payments, based on the Regional Jail's budget submission, is $5,234,500.
This would cause overspending of more than $1.1million. The refunded $1.1
million will be used to provide revenue support for the FY2003 budget.
It is uncertain as to whether revenue excesses and refunds will be generated
in the future. As the member jurisdictions continue to increase their
utilization of beds, it will gradually force the removal of the federal
inmates, Jail Contract Beds, and non-member jurisdictions in order for the
facility to accommodate the needs of its member jurisdictions. State cuts
for jail per diems could impact future refunds as well.

Summary of Information:
This date and time has been scheduled to hold a public hearing on the
proposed ordinance clarifications in the Building Inspection area.
Staff is requesting clarification type changes in the ordinances that relate
to building inspection. No rate increases are proposed. These
clarifications, in some cases, will change the rates to a flat rate versus a
calculation of the estimated cost of the improvement. An example would be
the cost of a permit inspection for a retaining wall. Currently this cost
would be based on the estimated value of the retaining wall; and therefore,
the customer would have to know the value and the permit fee would be a
formula based on that value. The proposed code change being recommended
would state a specific flat rate for the inspection of a retaining wall.
Some other clarification examples relate to electrical and plumbing fees,
providing cost differential, based on whether an electrical and plumbing
"rough in" inspection is required or not. Ail of these code changes are
being recommended to clarify for builders whether or not a fee is required,
and, if so, the exact amount of the fee. The proposed changes are expected
to improve service to our customers. In all cases the resultant fee
clarification will not increase the permit fee paid by an applicant.

permit must pay the fees set forth in this section before the building official issues a

Summary of Information:
This date and time has been scheduled to hold a public hearing on the
proposed Environmental Engineering ordinance fee change.
The Proposed FY2004 Biennial Financial Plan includes a recommendation to
implement a new $1,000 fee in the Environmental Engineering area for
resubmittal of previously approved subdivision plans. This is a fee that
would only be charged when a project or plan that has already been reviewed
and approved by staff is resubmitted by a developer or engineer for a
requested change not initiated by the county. Resubmitted, previously
approved plans account for about 34% of staff time review--or the equivalent
of one engineer position. This fee is anticipated to generate about $20,000
in FY2004. However, future revenue generated from this fee should decrease
as the private sector implements improvements within their own organizations
to reduce the need for resubmittals.

BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 8-13 of the Code of the County of Chesterfield, 1997, as
amended, is amended and re-enacted to read as follows:
Sec. 8-13. Fees.
(a) The applicant shall pay a program administration fee to the county at the
time that he submits to the environmental engineer an erosion and sediment control plan.
The amount of the fee shall be:
(i)
For an erosion and sediment control plan for land which is 10,000
square feet or larger and not located in a proposed subdivision:
$1,060.00, plus $50.00 for each acre of land to be disturbed.
(ii)
For an erosion and sediment control plan for land which is 10,000
square feet or larger and located in a proposed subdivision:
$1,060.00, plus $50.00 for each lot.
(iii)
For an erosion and sediment control plan for land which is less
than 10,000 square feet and is not to be used for a single-family
residence: $100.00.
(iv)
For any building permit application or erosion and sediment
control plan for land which is less than 10,000 square fee and is to
be used for a single-family residence, separately built or any
amendment thereto that changes the proposed building footprint
from that of the initial submission: $40.00.
(v)
For resubmission of all or part of an erosion and sediment control
plan for a subdivision or residential development for which plan
approval has previously been granted, there shall be a fee of
$1,000.00 unless the resubmittal was requested by or on behalf of
the County.

Summary of Information:
This date and time has been scheduled to hold a public hearing on proposed
Utilities ordinance fee changes.
The current rate structure requires that the cost of projects that provide
additional capacity to support continued development be recovered from
capital cost recovery charges. To provide the required funds, it is
necessary to increase the water capital cost recovery charge (water
connection fee) by $1,000 for an equivalent residential unit. Effective
July 1, 2000, the Board of Supervisors approved the first of a planned
four-year, phase-in of this increase from $2,592 to $2,842. The rate was
increased a second time from $2,842 to $3,092 effective July 1, 2001. The
third phase-in of this increase from $3,092 to $3,342 became effective July
1,2002. For FY2004, staff is recommending the final phase-in with a fourth
$250 increase from $3,342 to $3,592 effective July 1, 2003. The proposed
ordinance is attached.

increase is being recommended to cover an unexpected $10 million cost
increase from the City of Richmond for capital improvement projects. The
requested increase in water charges equates to $1.26 on an average bi-
monthly bill. The requested wastewater increase is primarily to cover $17
million for nutrient removal facilities at wastewater treatment plants due
to the Chesapeake Bay Act. The requested increase in wastewater charges
equates to $1.08 on an average bi-monthly bill. With the combined
increases, an average bi-monthly bill could increase approximately $2.34.

Summary of Information:
This date and time has been scheduled to hold a public hearing on the
proposed ordinance fee changes as outlined in Ordinance Amendment A (Board's
proposal with staff's technical clarifications and construction inspection
fee) for the Planning Department. This public hearing also encompasses the
Planning Commission's recommendation which is also attached (Ordinance
Amendment B inclusive of clarifications and construction inspection fee).
In June 2002, the Board adopted changes to certain Planning Department fees
for development review. The changes resulted in an approximate five percent
reduction to commercial development review fees and an increase to
residential review fees consistent with the County Administrator's
recommendation. The County Administrator's recommendation was part of a
three-year phase in of fee increases to recover approximately 80% of the
direct costs of performing such reviews.
The Proposed FY2004 Biennial Financial Plan includes a recommendation to
increase the current rates for many of the Planning Department's residential
development review fees. The Adopted FY2003 Biennial Financial Plan included
the first phase of increases. The Proposed FY2004 Biennial Financial Plan

includes the second phase-in of fee increases. If implemented, the
recommended fee increases as outlined in Ordinance Amendment A would recover
approximately 62% of the Planning Department's development review costs.
These fee increases are anticipated to generate an additional $87,800 in
revenue above the FY2003 adopted level.
The proposed financial plan also includes a new $25 per dwelling unit fee (at
the time of building permit) to cover expenses directly related to reviewing
residential building permits and certificate of occupancy reviews conducted
in the field. This fee increase would generate approximately $62,000 and
would cover the cost to create an additional construction inspector position
to handle the increased workload in the area of proffered conditions
enforcement. This position would help to improve customer service by
reducing inspection time.
Staff is also requesting minor technical amendments to the ordinance language
consisting of clarifications that align more closely with the Board's intent
to distinguish between fees charged for residential and commercial
development proposals. Other Planning Department commercial fees remain
unchanged.
The Planning Commission held a public hearing on the proposed amencrments at
their February 18, 2003 meeting. The Planning Commission approved a
recommendation to limit the increase in any single residential fee category
to no more than 20 percent. Doing so will reduce the projected revenue in the
County Administrator's proposed FY2004 budget by approximately $30,700,
recovering about 60 percent of Planning Department development review costs.
The Commission was also supportive of the new $25 fee and technical
adjustments mentioned above. The Planning Commission's recommendation is
included as Ordinance Amendment B.

Summary of Information:
This date and time has been scheduled to hold a public hearing on the
proposed ordinance change in the Fire Department.
The Proposed FY2004 Biennial Financial Plan includes a recommendation to
implement a new $400 burn permit fee for open burning of large volumes of
materials in excess of 320 cubic feet. The fee will not affect homeowners who
burn tree or garden trimmings. The revenue generated by the fee would be
used to fund a new position in the Fire Marshal's office to help regulate and
monitor open burning. The new position would also assist with fire safety
inspections when not involved with open burning. Estimated revenue in the
first year is $90,000 based on 225 permits being issued.
Historically, the Virginia Department of Environmental Quality has been the
regulatory agency that issued permits and monitored open burning. In 1998
the state relegated this responsibility to the local governments. Continued
development in Chesterfield County has increased the number of staff hours
necessary to regulate open burning.

Investigations into citizen complaints often lead to findings that open
burning practices do not conform to open burning regulations. Closer
monitoring of open burning would reduce the number of citizen complaints.
The cost to clear land is approximately $3900 more per acre if a developer
grinds or removes stumps and other debris from the site. The development
community clearly saves money through open burning and would incur the cost
of regulating this practice. Currently several other localities, such as
Albemarle County, Arlington County, Fairfax County, James City County, Prince
William County, and York County charge open burning fees.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED BY AMENDING
AND RE-ENACTING SECTION 10-3 RELATING TO
OPEN FLAMES OR BURNING
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 10-3 of the Code of the County of Chesterfield, 1997, as amended, is amended
and re-enacted to read as follows:
Sec. 10-3. Fire prevention code--Amendments, additions and deletions.
The Virginia Statewide Fire Prevention Code is hereby amended and changed pursuant to
Code of Virginia, §27-97, in the following respects:

F-403.1. Title and Purpose. Delete and substitute section F-403.1 as follows:
This article shall be known as the Chesterfield County Ordinance for the Regulation of Open
Burning. The purpose of this article is to protect public health, safety, and welfare by
regulating open burning within Chesterfield County to achieve and maintain, to the greatest
extent practicable, a level of air quality that will provide comfort and convenience while
promoting economic and social development, and minimizing public nuisance. This article is
intended to supplement the applicable regulations promulgated by the State Air Pollution
Control Board and other applicable regulations and laws.
F-403.2. Definitions. Delete and substitute section F-403.2 as follows:
For the purpose of this article and subsequent amendments or any orders issued by
Chesterfield County, the words or phrases shall have the meaning given them in this section.

"Automobile graveyard" means any lot or place which is exposed to the weather and upon
which more than five motor vehicles of any kind, incapable of being operated, and which it
would not be economically practical to make operative, are placed, located or found.
B. "Bonfire" means an outdoor fire utilized for ceremonial purposes.
C. "Clear area" means an area free of vegetation, leaves, brush, or other materials capable of
contributing to fire spread.
D. "Clean burning waste" means waste, which does not produce dense smoke when burned and
is not prohibited to be burned under this ordinance.

"Construction waste" means solid waste, which is produced or generated during construction
of structures. Construction waste consists of lumber, wire, sheetrock, broken brick, shingles,
glass, pipes, concrete, and metal and plastics if the metal or plastics are a part of the materials
of construction or empty containers for such materials. Paints, coatings, solvents, asbestos,
any liquid, compressed gases or semi-liquids, and garbage are not construction wastes and
the disposal of such materials must be in accordance with the regulations of the Virginia
Waste Management Board.
F. "Debris waste" means stumps, wood, brush, and leaves from land clearing operations.
G. "Demolition waste" means that solid waste which is produced by the destruction of structures
and their foundations and includes the same materials as construction waste.
H. "Garbage" means rotting animal and vegetable matter accumulated by a household in the
course of ordinary day-to-day living.
I. "Hazardous waste" means refuse or combination of refuse which, because of its quantity,
concentration or physical, chemical or infectious characteristics may:
a. Cause or significantly contribute to an increase in mortality or an increase in serious
irreversible or incapacitating illness; or
b. Pose a substantial present or potential hazard to human health or the environment
when improperly treated, stored, transported, disposed, or otherwise managed.
J. "Household refuse" means waste material and trash normally accumulated by a household in
the course of ordinary day-to-day living.

"Industrial waste" means all waste generated on the premises of manufacturing and industrial
operations such as, but not limited to, those carried on in factories, processing plants,
refineries, slaughter houses, and steel mills.

"Junkyard" means an establishment or place of business, which is maintained, operated, or
used for storing, keeping, buying, or selling junk, or for the maintenance or operation of an
automobile graveyard, and the term shall include garbage dumps and sanitary landfills.
"Landfill" means a sanitary landfill, an industrial waste landfill, or a
construction/demolition/debris landfill. See solid waste management regulations for further
definitions of these terms.
N. "Local landfill" means any landfill located within the jurisdiction of a local government.
O. "Occupied building," means any structure occupied or intended for supporting or sheltering
any occupancy.

"Open burning," means the burning of any matter in such a manner that the products
resulting from combustion are emitted directly into the atmosphere without passing through a
stack, duct or chimney.
Q. "Open Burning Container" means a container intended to contain fire and prevent fire spread
outside of the container. The container shall be constructed of a material that, in the form in
which it is used and under the condition anticipated, will not i~ite, burn, support
combustion, or release flammable vapors when subjected to fire or heat. Examples would
included; a barbecue pit, clean metal drum, or non-combustible block enclosure.
"Open pit incinerator" means a device used to burn waste for the primary purpose of reducing
the volume by removing combustible matter. Such devices function by directing a curtain of
air at an angle across the top of a trench or similarly enclosed space, thus reducing the
amount of combustion by-products emitted into the atmosphere. The term also includes
trench burners, air curtain destructors and over draft incinerators.
"Recreational Fire" means an outdoor fire burning materials other than rubbish where the
fuel being burned is not contained in an incinerator, outdoor fireplace, barbeque grill or
barbeque pit and has a total fuel area of 3 feet or less in diameter and 2 feet or less in height
for pleasure, religious, ceremonial, cooking, warmth or similar purposes

"Refuse" means trash, rubbish, garbage and other forms of solid or liquid waste, including,
but not limited to, wastes resulting from residential, agricultural, commercial, industrial,
institutional, trade, construction, land clearing, forest management and emergency
operations.
"Salvage operation" means any operation consisting of a business, trade or industry
participating in salvaging or reclaiming any product or material, such as, but not limited to,
reprocessing of used motor oils, metals, chemicals, shipping containers or drums, and
specifically including automobile graveyards and junkyards.
"Sanitary landfill" means an engineered land burial facility for the disposal of household
waste which is so located, designed, constructed, and operated to contain and isolate the
waste so that it does not pose a substantial present or potential hazard to human health or the
environment. A sanitary landfill also may receive other types of solid wastes, such as
commercial solid waste, nonhazardous sludge, hazardous waste from conditionally exempt
small quantity generators, and nonhazardous industrial solid waste. See solid waste
management regulations for further definitions of these terms.
¥ W. "Smoke" means small gas-borne particulate matter consisting mostly, but not exclusively, of
carbon, ash and other material in concentrations sufficient to form a visible plume.
J0¢ X "Special incineration device" means a pit incinerator, conical or tepee burner, or any other
device specifically designed to provide good combustion performance.

"Structure" is an assembly of materials forming a construction for occupancy or use
including stadiums, gospels and circus tents, reviewing stands, platforms, staginzs~
observation towers, radio towers, water tanks, storage tanks (underground and above
ground), trestles, piers, wharves, swimming pools, amusement devices, combustible fences.
and other structures of this general nature but excluding water wells. The word "structure"
shall be construed as though followed by the words "or part or parts thereof" unless the
context clearly requires a different meaning.

incineration device for the purpose of a salvage operation or for the disposal of debris waste,

Open burning or the use of special incineration devices permitted under the provisions of this
ordinance does not exempt or excuse any owner or other person from the consequences,
liability, damages or injuries which may result from such conduct; nor does it excuse or
exempt any owner or other person from complying with other applicable laws, ordinances,
regulations and orders of the governmental entities having jurisdiction, even though the open
burning is conducted in compliance with this ordinance. In this regard special attention
should be directed to Code of Virginia, § 10.1-1142, of the Forest Fire Law of Virginia, the
regulations of the Virginia Waste Management Board, and the State Air Pollution Control
Board's Regulations for the Control and Abatement of Air Pollution.

Upon declaration of an alert, warning or emergency stage of an air pollution episode as
described in part VII of the Regulations for the Control and Abatement of Air Pollution or
when deemed advisable by the state air pollution control board to prevent a hazard to, or an

unreasonable burden upon, public health or welfare, no owner or other person shall cause or
permit open burning or use of a special incineration device; and any in process burning or use
of special incineration devices shall be immediately terminated in the designated air quality
control region.

within an approved open burning container or a clear area of at least 20 feet. No recreational
or warming fire shall be allowed within 20 feet of a structure.

Open burning for camp fires or other fires that are used solely for recreational purposes, for

during the burning. The sign shall be at least 4 feet by 8 feet in size and lettering shall be
a minimum of 10 inches in height and in contrasting colors. The sign shall be located in
an area visible to the general public; and
15. The permit holder must maintain liability insurance in the minimum amount of
$1,000,000 general liability coverage at all times while burning is taking place. At the
time of permit application, a certificate of insurance coverage shall be submitted to the
fire marshal; and
16. In the event the fire department is dispatched to the burn site and must extinguish the fire,
the permit holder shall be liable for costs associated with response.
Open burning is permitted for disposal of debris on the site of local landfills provided that the
burning does not take place on land that has been filled and covered so as to present an
underground fire hazard due to the presence of methane gas provided that the following
conditions are met:

All reasonable effort shall be made to minimize the amount of material that is
burned;
No materials may be burned in violation of the regulations of the Virginia Waste
Management Board or the State Air Pollution Control Board. The exact site of the
burning on a local landfill shall be established in coordination with the regional
director and Chesterfield Goumy Fire & EMS t~pam,e~, Fire and Life Safety
Division; no other site shall be used without the approval of these officials.

Safety Division to ensure that the operation of the devices will not endanger the public health
and welfare. Permit application shall include the fee for the permit, completed information
form, site plan drawing of burn site and proof of liability insurance for the party performing
the burn. Permits granted for the use of special incineration devices shall at a minimum
contain the following conditions:

Such efforts shall include, but are not limited to, the removal of pulpwood, sawlogs and
firewood.

Division.
The permit holder must maintain liability insurance in the minimum amount of

anticipates holding all other rates constant. The real estate tax rate
advertised for this public hearing is $1.07. This gives the Board of
Supervisors the flexibility to adopt a real estate tax rate of $1.07 or
lower on April 9.

AN ORDINANCE TO ESTABLISH THE ANNUAL TAX LEVY
ON VARIOUS CLASSES OF PROPERTY FOR THE
COUNTY OF CHESTERFIELD
BE IT ORDAINED by the Board of Supervisors of the County of Chesterfield
that for the year beginning on the first day of January, 2002 2003, and ending on the
thirty-first day of December, 2002 2003, the taxes on property in all the Magisterial
Districts of the County of Chesterfield shall be as follows:
Sec. 1. Real Property and Mobile Homes.
On tracts of land, lots or improvements thereon and on mobile homes the tax shall
be $1.07 on every $100 of assessed value thereof.
Sec. 2. Personal Property.
(a) On automobiles, trailers, boats, boat trailers, other motor vehicles and on
all tangible personal property used or held in connection with any mining, manufacturing
or other business, trade, occupation or profession, including fumishings, furniture and
appliances in rental units, the tax shall be $3.60 on every $100 of the assessed value
thereof.
(b) On aircraft as defined by Section 58.1-3503 and -3506 of the Code of
Virginia, 1950, as amended, the tax shall be $.50 on every $100 of the assessed value
thereof.
(c) On motor vehicles owned or leased by members of volunteer rescue
squads, volunteer fire departments, volunteer police chaplains and by auxiliary police
officers as provided in Section 9-57, Code of the County of Chesterfield, 1997, as
amended, the tax shall be $.96 on every $100 of the assessed value thereof.
(d) On wild or exotic animals as defined by Section 58.1-3506 of the Code of
Virginia, 1950, as amended, the tax shall be $0.01 on every $100 of the assessed value
thereof.
(e) On motor vehicles which use clean special fuels as defined in Section
58.1-2101 of the Code of Virginia, 1950, as amended, the tax shall be $3.24 on every
$100 of the assessed value thereof.
(f) On motor vehicles, trailers, and semitrailers with a gross vehicle weight of
10,000 pounds or more used to transport property for hire by a motor carrier engaged in
interstate commerce, the tax shall be $.96 on every $100 of the assessed value thereof.

Sec. 3. Public Service Corporation Property.
(a) On that portion of real estate and tangible personal property of public
service corporations which has been equalized as provided in Section 58.1-2604 of the
Code of Virginia, 1950, as amended, the tax shall be $!.08 1.07 on every $100 of the
assessed value thereof determined by the State Corporation Commission.
(b) The foregoing subsections to the contrary notwithstanding, on automobiles
and trucks belonging to such public service corporations the tax shall be $3.60 on every
$100 of assessed value thereof.
Sec. 4. Machinery and Tools.
On machinery and tools used in a manufacturing or mining business the tax shall
be $1.00 on every $100 assessed value thereof.

The FY2004 recommendation for this program totals $2,050,532 which is
comprised of $1,512,532 in new CDBG allotments and $532,304 in new HOME
allotments, and $5,696 in Reprogrammed HOME funds.
The County's Community Development Block Grant and HOME Annual Plan for
FY2004 is required to be submitted to the U.S. Department of Housing and
Urban Development by May 15, 2003. The submission must follow a required
public hearing by the Board of Supervisors. A Review Committee has made
its recommendation to the County Administrator on the County's FY2004 CDBG

Chesterfield County has
found a new friend.
Last week, the Board of
Supervisors voted in favor of in-
viting Zacatecas, Mexico, to be-
come a "sister city" to the metro
Richmond area.
Arthur S. Warren, ehman of
the Chesterfield Board of Super-
visors, said he hopes the relation-
ship will help foster strong ties
between Mexico and the United
States.
"i think an important business
rdationskip can be made here,"
he said, adding that Chester-
field's Hispanic population is
growing.
"This is a way for us to sup-
port other regions," he said.
Several county officials said
government leaders have not yet
planned any trips to the Mexican
city.
What does Zacatecas have in
common with Chesterfidd?
According to Michad Zajur,
founder and president of the Vir-
ginia Hispanic Chamber of Com-
merce, the city has a populat/on
of about 350,000 in a state with a
population of about 1.5 million
-- similar to Chesterfield.
Its main industries are agricul-
ture and textiles.
Several tourism Web sites de-
scribe Zacatecas as a colonial city
and well-to-do university town

It is one of the biggest silver
producers in Mexico and has a
sizable middle class.

The sister city concept was
stated in 1956 to establish
greater friendship and Under-
standing between U.S. citizens
and those from other nations,
county officials said.

this in an important "sister to sis-
ter' relationship.

tions with other people," he said.
In May, four officials from the
Mexican state of Zacarecas
toured metro Richmond to lay
the groundwork for a sister city
rehtionship.
During the visit, Leodegario
Varela, a Zacatecas state legisla- '
tot, said his state and Virginia
have several things in common,
most notably a history that in-
dudes a struggle between Euro-
pean colonists and indigenous
peoples and battlegrounds in
wars for independence.
The delegation visited several
sites in the Richmond area in-
cluding the Maggie L. Walker
Governor's School for Govern-
ment. and 'International Studies,
La Siesta, 'Virginia Common-
wealth University and the Vir-
ginia State Capitol.

NOTICE OF PROPO'SED REAL PROPERTY TAX INCREASE
The County of Chesterfield proposes to increase property tax levies.
1. Assessment Increase: Total 'assessed value of real property, excinding additional assessments due to new construction
or improvements to property, exceeds last year's total assessed value of real property by 4.70%.
2. Lowered Rate Necessary to Offset IncreasedAssessment: The tax rate which would levy the same amount of rcal estate
tax as last year, whea multiplied by the new tutu] assessed value of rcal estate with the ~xcinsinns mentioned above, would
be $1.03 per $100 of assessed value. This rate'will be known as the "lowered tax rate".
3. Effective Rate Increase:The County of Chesterfield proposes to adopt a tax rate of $1.07 per $100 of assessed ~
The difference between the lowered tax rate and the proposed rate would be $0.04 per $100, or 3.88%. This difference
will be known as the "effective tax rate increase,.
Individual property taxes may, however, increase at a percentage greater than or less than the above percentage.
4. Proposed Total Budget Increase: Based on the nroposod real property tax rate and :hanges in other revenues, the total
general fund budget of Chesterfield County wilfexc~ed last year's adopted budget by 2.02%.
5. Total taxable and exempt property us of I/1/03 is $18,394,900,936; of this amount total taxable property is
$'17,280,148,636 or 93.94% of total taxable and exempt property. The total tax-exempt property is $1,114,752;300 or
6.06% of total taxable and exempt property.
