PROPOSED LAND USE: A freestanding identification sign for Rivers Bend South shopping center is proposed. This sign would exceed the ordinance limitation for area of signs for a project. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITION ON PAGE 2. AYES: MESSRS. PATTON, BROWN AND WALLER. NAYS: MESSRS. WALLIN AND GULLEY. STAFF RECOMMENDATION Recommend denial for the following reasons: A. The sign standards of the Zoning Ordinance provide sufficient signage to identify a shopping center project. B. Approval of this request potentially sets a precedent for other projects to seek sinular exceptions. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITION NOTED "CPC" IS A CONDITION RECOMMENDED BY THE PLANNING COMMISSION.) Pro~Tiding a FIRST CHOICE community through excellence in public ser~Tice PROFFERED CONDITION The Applicant in this case, pursuant to Section 15.2-2298 of the Code of Virginia (1950 as amended) and the Zoning Ordinance of Chesterfield County, for themselves and their successors or assigns, proffer that the property known as Chesterfield County Tax Identification Number 815-652-7510 ("the Property") under consideration will be developed according to the following amended proffers if, and only if, the request subnutted herewith is granted with only those conditions agreed to by the Applicant. In the event this request is denied or approved with conditions not agreed to by the owner and Applicant, the proffer shall immediately be null and void and of no further force or effect. (CPC) Master Plan. The Textual Statement dated June 23, 2014 shall be considered the Master Plan. (P) GENERAL INFORMATION T ,~cati nn The request property is located on the south line of East Hundred Road, east of Rivers Bend Boulevard and is known as 241 East Hundred Road. Tax ID 815-652-7510. Existing Zonin C-3 Size: 42 acres Existing Land Use: Commercial Adjacent Zoning and Land Use: North - R-15 and C-3 with conditional use planned development; Commercial South - C-3 with conditional use planned development; Vacant East - C-5 with conditional use; Commercial West - C-3 with conditional use planned development; Commercial UTILITIES; ENVIRONMENTAL; FIRE SERVICE; AND TRANSPORTATION This request will have a nunimal impact on these facilities. 14SN0~7 ~-20141li L23-B(1S-RPT Virginia Department of Transportation (VDOT~: No advertising is permitted within the State-maintained right-of--way of East Hundred Road. Sign placement shall not restrict the sight line of vehicles utilizing the access to 241 East Hundred Road. Sign plan subnuttal andlor consultation with VDOT for verification of compliance with the aforementioned items is advised. LAND USE Comprehensive Plan: The Comprehensive Plan suggests the property is appropriate for Neighborhood Business use. Area Development Trends: The area is characterized by commercial zoning and land uses along this portion of the East Hundred Road corridor. The Plan anticipates this type of use continuing in the foreseeable future. Zoning HistorX: On March 10, 2004 the Board of Supervisors, upon a recommendation of approval from the Planning Commission, approved C-3 zoning on the subject property and adjacent property to the south and west (Case 02SN0296). Subsequently, a shopping center has developed on the subject property with commercial uses on two (2) outparcels. Freestanding Project Identification Sign: The subject property, along with adjacent properties to the south and west, are considered as one (1) project known as Rivers Bend South shopping center and identified on Attachment L In 2006, a pernut for a project identification sign, fifty (50) square feet in area and fifteen (15) feet in height, was issued for this center and the project sign was erected on the adjacent property to the west (Sheetz site). The applicant is requesting an exception to linutations of the ordinance to replace the existing freestanding project sign with a new sign that is larger in area. (TextLial Statement) It should be noted that in addition to a freestanding prof ect identification sign, the ordinance also pernuts freestanding signs for outparcels, twenty (20) square feet in area and eight (8) feet in height. Such signs are currently located on the CVS Pharmacy and Sheetz outparcels. In addition, the ordinance pernuts building mounted signs for individual tenants within the center which also assists in identification. CONCLUSION The Zoning Ordinance provides adequate signage for a project that enables citizens to identify and locate a given business or service. Approval of this request could encourage other businesses to seek sinular exceptions, leading to proliferation of oversized signs. Given these considerations, denial of this request is recommended. CASE HISTORY Planning Commission Meeting (6/17/14): The applicant's representative did not accept staff's recommendation, but did accept the Planning Comnussion's recommendation. Opposition was present, expressing concerns relative to the lack of compliance with ordinance sign standards; and the opport~inity for the use of banners and building- mounted signage facing East Hundred Road. 4 14SN0~7~-20141liL23-BOS-RPT In response to a question from Mr. Patton, the applicant's representative noted that, with the future widening and speed limits along East Hundred Road, tenants need more visibility. In addition, Mr. Patton requested, and the applicant agreed, that the proposed sign height would be reduced from twenty (20) feet to fifteen (15) feet. Dr. Wallin noted that if the development community was concerned with the sign linutations of the ordinance, then consideration could be given to amending the ordinance so as to be fair and equitable to all business owners. On motion of Mr. Patton, seconded by Dr. Brown, the Comnussion recommended approval and acceptance of the proffered condition on page 2. AYES: Messrs. Patton, Brown and Waller. NAYS: Messrs. Wallin and Gulley. Applicant (6/23/14): A revised Textual Statement was subnutted to reduce the sign height. The proffered condition was amended to reflect the revision date of the Textual Statement.
