PROPOSED LAND USE: Areal estate office is planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITION ON PAGE 2. AYES: MESSRS. WALLIN, BROWN, GULLEY AND WALLER. ABSENT: MR. PATTON. STAFF RECOMMENDATION Recommend approval for the following reasons: A. The proposed zoning and land uses conform to The Chester Plan, which suggests the property is appropriate for Office/Residential Mixed Use. B. The proposed zoning and land uses are representative of and compatible with existing and anticipated area development. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER MAY PROFFER CONDITIONS. THE CONDITION NOTED "STAFF/CPC" WAS AGREED UPON BY BOTH STAFF AND THE COMMISSION.) (P) GENERAL INFORMATION T ,~cati~n The request property is located on the north line of West Hundred Road, east of Old Centralia Road and is better known as 3720 West Hundred Road. Existing Zonin R-7 Size: .4 acre Existing Land Use: Single-fanuly residential Adjacent Zoning and Land Use: North, South, East and West - R-7; Office, single-fanuly residential, Thomas Dale High School or vacant Public Water and Wastewater Systems: UTILITIES The existing building is connected to the public water and wastewater systems. This use will not impact the public water and wastewater systems. ENVIRONMENTAL Drainage and Erosion: This request will have no impact on these facilities. 2 14SN0~88-2014SEP 17-BC1S-RPT PUBLIC FACILITIES Fire Service: The Chester Fire Station, Company Number 1, currently provides fire protection and emergency medical service (EMS). This request will have a nunimal impact on Fire and EMS. County Department of Transportation: This request will have a nunimal impact on the transportation network. Vir ink is Department of Transportation: VDOT notes that based on discussions with the applicant the existing stricture will be used as a real estate business serving no more than two (2) employees. As such, VDOT has no objection to the request. However, should the land use change and/or additional vehicle trips be generated (i. e. additional employees) beyond that presented, fiirther improvements to the site's access may be warranted in accordance with Department standards. LAND USE Comprehensive Plan: The Chester Plan designates the request property for Office/Residential Mixed Use where professional and adnunistrative office development (such as doctor, lawyer, accountant and real estate offices) and residential development of varying densities are appropriate. The Plan also establishes the Chester Plan as a Special Area Plan, being a community with unique characteristics, history or challenges that warrants additional planning efforts and extensive public involvement. Area Development Trends: Properties to the north, south, east and west are zoned Residential (R-7) and are occupied by offices (pernutted by conditional use approval), single-fanuly residences or remain vacant. Thomas Dale High School is located immediately to the north. It is anticipated that office and residential uses will continue in the area as suggested by the Plan. Development Standards: The applicant proposes to convert the existing single-fanuly dwelling into an office for a real estate business. The request property lies within the Chester Village Corridor East and Emerging Growth Area. The purpose of Chester Village Corridor East is to maintain and reinforce the character, identity, and pedestrian scale of villages by continuing and enhancing existing patterns of development. In addition, the purpose of Emerging Growth Area standards is to promote high quality, well-designed projects. These requirements 14SN0~88-2014SEP 17-BC1S-RPT specifically address access, landscaping, architectural treatment, setbacks, parking, signs, buffers, utilities and screening of developments within these areas. If this request is approved, these standards would apply to any redevelopment or new constriction on the request property. Buffers: The applicant requests the elinunation of the required buffer on the request property (Proffered Condition). A buffer of forty (40) feet is required on property zoned for Neighborhood Office (O-1) when it is adjacent to Residential (R-7) property. However, buffers with the Chester Village Area may be waiver or modified during site plan review when adjacent property is not designated for single-fanuly residential uses by the Plan. Property to the north is designated for public uses (Thomas Dale High School), thereby negating the need for a buffer. Development trends and the Chester Plan continue to support adaptive reuse of single- fanuly homes to neighborhood office uses along the Route 10 corridor. This land use designation includes parcels to the east and west of the request property. Therefore, elinunation of the buffer along the east and west property lines will not be detrimental to adjacent property owners. CONCLUSION The proposed zoning and land uses comply with the Plan, which suggests the property is appropriate for Office/Residential Mixed Use. In addition, the development requirements of the Zoning Ordinance ensure land use compatibility with existing and anticipated area development. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (8/19/14): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Waller, seconded by Mr. Gulley, the Commission recommended approval and acceptance of the proffered condition on page 2. AYES: Messrs. Wallin, Brown, Gulley and Waller. ABSENT: Mr. Patton.
