Carter to the Chesterfield Museum Committee. On motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that General Lesli D. Carter be and he hereby is appointed to the Chesterfield Museum Committee. On motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that the framing be purchased for the old pictures owned by the Chesterfield Museum at a cost not to exceed $60.00. On motion of Mr. Purdy, seconded by Mr. Apperson, it is resolved that County officz ials take whatever steps necessary to preserve the old Indian canoe presently hous- ed in the Exhibition Building. on motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the minutes of April 23, 1969, be and they hereby are approved with the following corrections: "On motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that Mr. Clyde 1 Coleman, Chairman of the Manchester Community Center, be notified officially of the! Fire Program for the coming year." On motion of Mr. Purdy, seconded by Mr. Dietsch, the following ordinance is adopted AN ORDINANCE to vacate the 10 foot easement drainage and utilities along the back line of Lots 46 and 45, Section 1, Plan of Bruce Farm Subdivision, 5 feet of which extends over and into Lot 25, Plan of Bruce Farm, known as Section 2 and runs parallel to the northern side line of said lot and the 10 foot easement for drainage and utilities running along the common boundary line of Lots 45 and 46 Section 1, Plan of Bruce Farm, 5 feet of which is on Lot 45 and 5 feet of which is on Lot 46~ said lots are more fully shown in Plat Book 8, page 77. WHEREAS, Ernest P. Gates and Charles C. Moore, owners of the property in question, have petitioned the Board of SUpervisors of Chesterfield County, Virginia to vacate the 10 foot easement for drainage and utilities along the back line of Lots 46 and 45, Section 1, Plan of Bruce Farm Subdivision, 5 feet of which extends over and into Lot 25, Plan of Bruce Farm, known as Section 2, and runs parallel to the northern side line of said lot and the 10 foot easement for drainage and utili- ties running along the common boundary line of lots 45 and 46, Section 1, Plan of Bruce Farm, 5 feet of which is on Lot 45 and 4 feet of which is on Lot 46[ said lots are more fully shown in Plat Book 8, page 77[ and notice that the Board of Supervisors would consider the adoption of an ordinance vacating said easement hav- ing been given in accordance with Section 15.1-431, Code of Virginia, 1950 as amend ed ~ , NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County of Chesterfield, Virginia: 1. That pursuant to Section 15.1-431, Code of Virginia, 1950, as amended, that the 10 foot easement for drainage and utilities along the back line of Lots 46 and 45, Section 1, Plan of Bruce Farm Subdivision, 5 feet of which extends over and into Lot 25, Plan of Bruce Farm, known as Section 2, and runs parallel to the north ern side line of said lot and the 10 foot easementfor drainage and utilities runnin along the common boundary line of Lots 44 and 46, Section 1, Plan of Bruce Farm, 5 feet of which is on Lot 45 and 5 feet of which is on Lot 46~ said lots being more fully shown in Plat Book 8, page 77, is hereby vacated. This ordinance shall be in full force and effect in accordance with Section 15.1~431, Code of Virginia, 1950, as amended, and a certified copy thereof shall be recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia.. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the following three ordinances pertaining to the vacation of easements in the Darrelton Subdivi- sion be and they hereby are adopted: WHEREAS, there is recorded in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia, in Plat Book 11, Page 54, a subdivision plat entitle "Darrelton", made by J. K. Timmons Civil Engineer, dated July 1 1959 recorded August 19, 1956~ and ' ' , WHEREAS, there is shown on the aforementioned subdivisinn plat and the copy of the survey attached hereto, marked in red, an easement for an alley subject to the rights of the County of Chesterfield, Virginia, 16 feet in width, running from the northern edge of Snead Road (formerly Bangle Road), in a northerly direction for 203.92 feet between a certain lot, piece or parcel of land in Manchester Distri t of Chesterfield County, Virginia, and designated as Lot 3, Darrelton and Lots 1 and 2, Darrelton; and WHEREAS, Raymond H. Thornhill and Mary B. Thornhill, his wife, are fee simpl owners of all that certain lot, piece or parcel of land hereinbefore designated as Lot 1, Da~relton in Chesterfield County, Virginia, and known as 2229 Hey Road~ and WHEREAS, such vacation will not destroy or abridge any of the right or pri- vileges of other property owners within the bounds of the area of land shown on suc plat of subdivision or of any person, firm or corporation specifically designated as the beneficiary of such easement on such subdivisionplat or to whom the benefit thereof have been granted by writing duly of record; and NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of ChesterfieL County, Virginia, doth consent to the vacation of 8 feet of the western half of the above described easement which runs from the northern edge of Snead Road (formerly Bangle 'Road) in a northerly direction for 203.92 feet between a certain lot, piece or parcel 'of land in'Manchester District of Chesterfield County, Virginia, and de- signated as Lot 3, Darrelton and Lots 1 and 2 of Darrelton, the bounds of which vacated portion of said easement are fully shown on the plat of Darrelton made by J. K. Timmons, Civil Engineer dated July 1, 1959, recorded August 19, 1959, and tha same be made a part of that certain lot, piece or parcel of land herein referred to as Lot 1, Darrelton and known as 2229 Hey Road. And that it is further resolved that the Chairman and Clerk, respectively,of the Board of Supervisors are herebY approved, authorized, and directed to execute, affix and attest the seal of the County to such instruments as may be neCessary to effect such vacation. This resolution is conditional upon and shall become operative and effective when the owners shall have acknowledged for recordation, in a form to be approved b the Commonwealth,s Attorney, an appropriate Deed of Vacation. When such Deed of Vacation, so approved by the Commonwealth's Attorney, shal have been duly recorded in the office of the Clerk of the Circuit Court of Chester- field County,~ Virginia, the said .Clerk shall indicate the vacation of that portion of said 16 foot easement described herein, and shall index the same on the grantor side of the general index to deeds in the names of the parties hereto. The above resolution is adopted.this 14th day of May, 1969. Rauls, his wife, are fee simple owners of all that certain lot, piece or parcel of land hereinbefore designated as Lot 3, Darrellton in Chesterfield County, Virginia, and known as 5852 Snead Road (formerly Bangle Road); and WHEREAS, Donald W. Rauls and Mary H. There was a request by Mr. W. Brooks George for the County of Chesterfield to pass a resolution requesting the State Highway Commission to re-name Rt. 60 to the James A. Anderson Highway. Upon consideration whereof, and on motion of Mr. Martin, seconded by Mr. Apperson, the following resolution is adopted: WHEREAS, U.S. Highway 60 is a major east-west thoroughfare in the State of Virginia and runs through the County of Chesterfield, and WHEREAS, U.S. Highway 60 has not been given a name by the State Highway Com- mission in the State of Virginia~ and WHEREAS, General james A. Anderson devoted much of his life to develop and improve the State Highway system of roads in Virginia~ and WHEREAS, U.S. Highway 60 passes near the home of General James A. Mr. Browning questions Mr. Davidson, the Secondary Road Engineer, concerning the progress of the Ettrick Cemetery Road, James Street improvement, the Woodpecker Roa, Bridge and Halloway Avenue. Mr. Davidson replied that the Cemetery Road project is progressing, the rights of way are clear, that James Street is in question but he will look into the matter, that the Woodpecker Road bridge will be started this summer and the Halloway Avenue cOnstruction is in doubt. He is not sure of the curb and gutter and storm sewer part of this road. There were received from the Supervisor of Bermuda District petitions signed by over 1000 persons requesting the improvement of Harrowgate Road. Upon consideratio: whereof, and on motion of Mr. Purdy, seconded by Mr. Dietsch, it is resolved that a copy of the~e petitions be sent to the Highway Department along with a request to take whatever steps are neceesary to improve this road. Mr. Davidson cites the fact that the ~ighway Department wishes the Board's feelings in.closing Strathmore Road and Dalebrook Road as these roads cross Chippenham Park- way. Upon consideration whereof, and on motion of Mr. Apperson, seconded by Mr. Browning it is resolved that the County Planner investigate these conditions and present a report to the Board of Supervisors as soon as p~s~ible. Mr. J. K. Timmons comes before the Board speaking for the abandonment of Longview Drive. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Martin, it is resolved that the following resolution be and the same is adopted, with the provision that the new right of way along Longview Drive be dedicated simultaneously with the abandonment: WHEREAS, Julian E. Savage and John S. Mr. J.' K.Timmons comes before the Board speaking in behalf of the new plan of the development of Salisbury West and whereas this is a new concept in the subdivision of land in the County, it was generally agreed that this matter be studied further at a later date. A representative of the Commonwealth Gas Distribution Company comes before the Boar. requesting a permit to allow this Company to install a gas line from the subdivisio of Woodmont to Bon Air. UPon consideratiinn whereof, and on motion of Mr. Martin, seconded by Mr. Dietsch, it is resolved that this Board grant a construction permit along Rt. 147 for the installation of a gas line subject to the approval of the County Engineer. ~ The Chairman pointed out that the budget for the year 1969-' 70 had been thoroughly discussed by the citizens of the County on April 23, 1969, in an open hearing and this being the date and time advertised for the passage of the proposed budget for the coming fiscal year, asked for any comments from the people assembled. Mrs. Charles Elmore comments on the salaries proposed for school teachers and admin~ istrators and questions the Board concerning the assessment of personal property, the change in the form of government, the assessment of timber land. the assessmentii of machinery and tools, the purpose of the $100,000 exemption in th~ busineSs and professional license tax, the purpose of the $1,000,000 in the budget for a hospital, the purpose of the 35% ratio in real estate assessments and states that planning districts are a security against annexation. Most of these questions were answered by' the Executive Secretary. Mr. Robert Van Vleck of the County Council of Parent-Teachers' Associations stat'ed that he believes the cut in the School budget is excessive, questions the advertis-li ing but states that the Board should not give a blank check to the School Board, that it is impossible to discuss where cuts will be made since they have no idea how the School Board will work the cut in the new budget. These questions were also answered by the Board. Mr. Sam Wagstaff assures the Board that the cut in the School budget is necessary, that the School Board has made the taxpayers mad by the amount of increases in the administrative personnel salaries. Mr. Franklin M. Pinchbeck states that the four Supervisors opposing the increase in the school budget represent less than half of the voters in the County and that the right of one man one vote is not true in Chesterfield. Mr. J. K. Timmons states that the people in the County of Chesterfield are looking to the Board to act wisely, to analyze the budget and to carefully spend the money of the County in the proper proportions. Mrs. L. E. Armstrong questions the school cut. Mr. C. E. Hawkins cites the salary increases for administrative personnel as being too much. Mr. Apperson states that his contact with the School officials indicate that the present proposed cut in the school budget is more than the schools can comfortably handle, that incoming industry is greatly concerned with the County's educational posit~on, and upon further considerati6n and on motion of Mr. Apperson, seconded by Mr. Dietsch, suggests that the Board modify its cut by reducing the amount of the cut $385,294.00 Those voting for the resolution - Mr. Dietsch and Mr. Apperson Those voting against the resolution - Mr. Browning, Mr. Martin, Mr. Purdy and Mr. Horn~r. Upon further consideration of the budget Mr. Browning makes the following motion which was seconded by Mr. Martin: ' A tentative budget for the County of Chesterfield in the amount of $46,414,013.00 for the fiscal year ending June 30, 1970, was advertised in the Richmond Times-Dis- patch on April 30, 1969, and Mayl4, 1969, was set as a public hearing on said bud- get. Therefore, it is resolved, that this Board of Supervisors of Chesterfield County, Virginia, held public hearings in accordance with the resolution passed on April 9, 1969, for informative purposes on a contemplated budget for the fiscal yea 1969''70. This budget is for informative and fiscal planning purposes and it is no approved, adopted or ratified by the Board of Supervisors. Whereupon a vote was taken on the resolution. Barber comes before the Board requesting a Use Permit to repair clocks in his home on a parcel of land of irregular shape fronting 110.0 feet on Stansbury Avenue and extending southwestwardly to a depth of 150.0 feet, more or less, being 170 feet, more or less, north of the intersection of Ullswater Avenue and Stansbury AVenue and better known as 1424 Stansbury Avenue in Manchester Magisterial District Refer to Sec. 29-8 (2) Blk. B, lot 42, and presents a list of property owners in th, area saying that they approve of this request. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that a Use Permit be granted to Mr. Barber to repair clocks in his home on the aforedescribed parcel of land, provided no alterations be made to the home or signs displayed. There was read a proposed amendment to the Dog Orginance to provide for a different confinement and disposition of unredeemed dogs. Mrs. Berle Pearson suggested certain changes in the proposal and suggested further that those in authority discuss the proposed changes in the Dog Ordinance with a group of County citizens. After some discussion, it is on motion of Mr. Dietsch, seconded by Mr. Apperson, re. solved that a Study group be formed to discuss this proposed change. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved that this Boardii request the Judge of Circuit Court the Honorable Ernest P. Gates to appoint Mr Clarence Guy Williams, Jr. as a Police Officer for the County of Chesterfield.' Mr. A. L. Davis comes before the Board requesting some assistance in the installa- tion of a sewer line from Brookhaven Road northwestwardly to serve this property fronting on Rt. 360. It was pointed out that the proposed cost for this sewer line is $2349.00 and that Mr. Davis has an average water bill of $22.00 per month. On motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved that the County in-i stall this sewer extension provided Mr. Davis pay $1000.00 toward the cost of this line. Mr. Andrew J. Asch, Jr., and Mr. Preston Clark come before the Board and state that they are ready to develop St. Johns' Wood and that he had agreed to pay 21% of the downstream cost of the drainage project. Upon consideration whereof, and on motion of Mr. Dietsch, seconded by Mr. Purdy, it is resolved t~st this Board authorize the condemnation of the proposed drainage and utility easement across the property owned by Warren G. Duchene and Virginia M. Du- chene, said owners having rejected the County's bona fide offer to purchase the easement. And be it further resolved, that the said easement being necessary in the public interest and critical to the public need it is hereby declared that an emergency exists. It is here noted that Mr. Apperson votes Nay. On motion of Mr. Dietsch, seconded by Mr. PUrdy, it is resolved that the County pay its agreed portion of 79% of the cost of constructing a ditch across the Duchene property. On motion~of Mr. Browning, seconded by Mr. Apperson, it is resolved that Project 6511-2 for the construction of the Matoaca Sewer Lagoon be and it hereby is awarded to the Halifax Builders, Inc. who submitted the low bid of $169,990.00. On motion of Mr. Dietsch, seconded by Mr. Maztin, it is resolved that the following Ordinance be and it hereby is adopted: AN ORDINANCE AMENDING AND READOPTING THE FIRE PREVENTION CODE of the County of Chesterfield prescribing regulations covering conditions hazardous to life and property from the fire or explosion and establishing an office of fire chief and providing officers therefor, and defining their powers and duties. BE IT ORD~NED 'by the Board of Supervisors of the County of Chesterfield, Virginia: Section 1. Adoption of Fire Prevention Code. There is hereby adopted by the Board of Supervisors of Chesterfield County for the purpose of prescribing regulations covering conditions hazard- ous to life and property from fire or explosion, that certain code known as the Fire Prevention Code recommended by the American Insurance Association, being particularly the 1965 edition thereof and the whole thereof, including any amendments that may be made from time to time, save and except such portio as are hereinafter deleted, modified or amended (by section 4 of this ordinanc Of which code not less than three copies have been and now are filed in the office of the Executive Secretary of Chesterfield County and the same is hereb adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the CoUnty. Section. 2. Establishment of Office of Fire Chief: duties of Fire Chief. (a) The Fire Prevention Code shall be enforced by the Chief of the Fire Department of the County of Chesterfield which is hereby established and shall be operated under his supervision./ (b) The Chief of the Fire Department shall be appointed by the Board of Supervisors on the basis of examination to determine his qualifications. His appointment shall continue during ~ood behavior and satisfactory service, and he shall not be removed from office except for good cause after public tri&l. (c) The Chief of the Fire Department shall be changed with the preven- tion of fires and the protection of life and property against fire, and he shall be responsible for the maintenance and care of all property and equipmen used by his department, the planning and directing of all fire fighting and fire prevention activities, the performance of various miscellaneous public services of an emergency nature and the management of personnel and all opera- tions of the fire department. (~d) The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time become necessary. He shall recommend to the Board of Supervisors the employment 'of technical in- spectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shal be open. to members and non-members of the Fire Department, and appointments made after examination shall be for an indefinite term with removal only for good cause. (e) The Chief of the Fire Department shall make a report annually to the Executive Secretary of the County~ it shall contain all proceedings under this Code, with such statistics as the Chief of the Fire Department maywish to include therein~ the Chief of the Fire Department shall also recommend any amendments to the Code which, in his judgment, shall be desirable. Section 3. Definitions. (a) Wherever the word "Municipality" is used in the Fire Prevention Code, it shall be held to mean the County of Chesterfield. (b) Wherever the term "Corporation Counsel'' is used in the Fire Preven tion Code, it shall be held to mean the Attorney for the Commonwealth. (c) Wherever the words "Chief of the Bureau of Fire Prevention" are used in the Fire Prevention Code they shall be held to mean the Chief of the Fire Department. Section 4. Amendments to the Fire Prevention Code. The Fire Prevention Code is hereby amended and changed in the followin~ respects: (a) Section 22.2 c. is hereby deleted. (b) Section 1.9 and all sections pertaining to the issuance of permits are hereby deleted. (c) Article 28 is hereby amended by adding Section 28.15 which reads as follows: It shall be unla~wful for anyone to sell fire extinguishers or fir alarm systems in the County without a UL or Factory Mutual Approval. Section 5. Modifications. The Chief of the Bureau of Fire Prevention shall have power to modity any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provide, that the spirit of the code shall be observed, public safety secured, and sub- stantial justice done. The particulars of such modification when granted or allowed and the decision of the Chief of the Bureau of Fire Prevention thereont, shall be entered unpon the records of the department and a signed copy shall I be furnished the applicant. It Section 6. Atopeal s il When it is claimed that the provisions of the code do not apply or that the true intent'and meaning of the code have been misconstrued, or wrongly interpreted, the aggrieved party may appeal from the decision of the Fire De- partment to the Board of Supervisors within thirty days from the date of the decision appealed. Section. Penalties. (a) Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detaile statement of specifications or plans submitted and approved thereunder or who shall fail to comply with such an order as affirmed or modified by the'Board of Supervisors or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every much violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less the ten dollars nor more than five hundred dollars or by imprisonment for not less than five days nor more than ninety days or by both such fine and imprisonment The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not other. wise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. (b) The application of the above penalty shall not be held to prevent the enforced removal or prohibited conditions. Section 8. Repeal of Conflicting Ordinances. All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed. Section 9. Validity. · The Board of Supervisors hereby declares that should any section, para- graph, sentence, or word of this ordinnance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the Board of Super-I~ visors that it would have passed all other portions of this ord~na~ dent of the elimination herefrom of any suc~ portion as may be ~ec~e~-~~. Section 10. Date of Effect This ordinance shall take effect and be in force from and after its ~pproval as required by law.
