REQUESTS: Conditional use to pernut two (2) computer-controlled, variable message, electronic
signs (EMC) in a General Business (GS) District.
L An EMC incorporated into an identification sign located along Jefferson
Dads Highway; and
II. An EMC incorporated into an identification sign located along West
Hundred Road.
PROPOSED LAND USE:
Computer-controlled, variable message, electronic signs, incorporated into two (2)
freestanding identification signs for the Bermuda Square shopping center are
proposed. One sign would be located along property frontage of both Jefferson
Dads Highway and West Hundred Road.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL SUBJECT TO THE CONDITION AND ACCEPTANCE OF
THE PROFFERED CONDITION ON PAGE 2.
STAFF RECOMMENDATIONS
L Recommend approval of the proposed sign to be located along Jefferson Dads Highway,
for the following reason:
The proposed electronic message center sign conforms to the adopted Electronic
Message Center (EMC) Policy.

II. Recommend denial of the proposed sign to be located along West Hundred Road, for the
following reasons:
A. As currently located, the proposed electronic message center sign does not
conform to the adopted Electronic Message Center (EMC) Policy relative to
separation between such signs.
B. The requested exception to the Policy could set a precedent for sinular
requests.
(NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY
PROFFER CONDITIONS. THE CONDITION NOTED "STAFF/CPC" WAS AGREED UPON
BY BOTH STAFF AND THE COMMISSION. THE CONDITION NOTED "CPC" IS A
CONDITION RECOMMENDED BY THE PLANNING COMMISSION.)
CONDITION
(CPC) The identification sign with acomputer-controlled, variable message, electronic
sign (EMC) located along West Hundred Road shall maintain a minimum spacing
of 983 feet from the EMC located on property identified as Tax ID 799-654-9625.

PROFFERED CONDITION
(STAFF/CPC) In addition to Ordinance requirements, any computer-controlled, variable
message, electronic sign shall conform to the following standards:
a. Copy shall be limited to a maximum of three (3) lines and shall not
move but may fade;
b. The message or display shall be programmed to change no more
than once every thirty (30) seconds;
c. Sequential messaging shall be prohibited;
d. Flashing and traveling messages shall be prohibited;
e. Bijou lighting and animation effects shall be prohibited;
£ The electronic message center shall be incorporated into an
architecturally designed sign stricture that is compatible and
complimentary to the building it serves; and
g. Brightness shall be limited so as not to exceed 0.3 foot candles
above ambient light as measured using a foot candle meter at a
distance of forty five (45) feet. (P)

This request will have no impact on these facilities.
LAND USE
Comprehensive Plan:
The Comprehensive Plan suggests the property is appropriate for Regional Mixed use.
Area Development Trends:
The area along and around the intersection of West Hundred Road and Jefferson Dads
Highway is characterized by commercial developments. These uses are anticipated to
continue in this area, as suggested by the Plan.
Zoning HistorX:
A portion of the property has been zoned commercially since the 1960s and the
commercial area began to increase in size with subsequent rezoning requests beginning in
1970. The Bermuda Square shopping center has been located on the property since the

1970s. The shopping center is undergoing renovations and new freestanding signage is
proposed, which would include the incorporation of computer-controlled, variable
message, electronic signs.
Development Standards:
The applicant plans to constrict new identification signs with electronic message boards to
identify the shopping center (Attachment 1). The proposed signs would comply with the size
and height requirements of the Ordinance which currently permit a freestanding sign 62.5
square feet in area (including changeable copy) and fifteen (15) feet in height to identify the
development. The Ordinance would allow a sign of this size and height on both Jefferson
Davis Highway and West Hundred Road because both roads are major arterials.
The proposal would comply with the Electronic Message Center (EMC) Policy relative to
lines of copy, tinting of message changes with no sequential messaging, sign appearance,
brightness and lack of flashing and traveling messages, bijou lighting and animation.
(Proffered Condition)
The Policy requires a nunimum of 1,000 feet of spacing between Electronic Message
Centers (EMC's). Adequate spacing, in compliance with the Policy, is proposed between the
locations of the two (2) proposed signs for the shopping center and between these signs and
the closest EMC sign along Jefferson Dads Highway, which is approximately 1,300 feet
south of the sign proposed on Jefferson Davis Highway. However, the sign to be located
along West Hundred Road would not comply with the minimum spacing requirements of
the Policy. The existing shopping center identification sign along West Hundred Road is
approximately 983 feet west of the location of an EMC sign at the Clarion Hotel site at 2401
West Hundred Road (Tax ID 799-654-9625). The applicant would prefer to erect the
replacement sign at the same location as the existing shopping center identification sign on
West Hundred Road. However, he has not offered a condition to ensure compliance with
spacing at the current location. He has indicated that the sign could be relocated further west
to achieve the minimum spacing as recommended in the Policy, if necessary.
CONCLUSION
REQUEST L
The proposed electronic message center sign to be located along Jefferson Davis Highway conforms
to the adopted Electronic Message Center (EMC) Policy. Therefore, approval of this sign is
recommended.
REQUEST II:
The proposed electronic message center sign to be located along West Hundred Road does not
conform to the adopted Electronic Message Center (EMC) Policy relative to separation between
such signs. In addition, the requested exception to the Policy could set a precedent for similar
requests. Given these considerations, denial of this sign is recommended.

However, should the Board wish to approve this sign, as recommended by the Planning
Commssion, imposition of the condition on Page 2 is recommended.
CASE HISTORY
Planning Commission Meeting (9/16/14):
The applicant accepted the recommendation. There was no opposition present.
Mr. Patton indicated the proposed separation between the signs along West Hundred
Road is adequate, provided the distance is not decreased.
On motion of Mr. Patton, seconded by Dr. Brown, the Commission recommended
approval subject to the condition and acceptance of the proffered condition on page 2.
AYES: Messrs. Wallin, Patton, Brown, Gulley and Waller.
The Board of Supervisors, on Wednesday, October 22, 2014 beginning at 6:30 p.m., will take
under consideration this request.
