Burnett, Executive Secretary Board of Supervisors Chesterfield, Virginia 23832 Dear Mr. Burnett: The approved salary of an unnamed clerk-typist for the fiscal year ending June 30, 1971 was $3360.00. Since this position has not been filled by a permanent employee, I respectfully request that this approved salary, ~360.00, be transferred from Salaries for Permanent Employees to Salaries for Temporary Employees. An item of $250.00 was approved for the fiscal year ending June 30, 1971 for a cupboard unit with adjustable shelves under the classification of Office Furniture and Rental of Equipment, 11-031-403.1. This amount is not sufficient to cover the cost of this cabinet delivered to the Treasurer's Office. I respectfully request that ~0 be transferred from an approved item titled Binders, also classified as Office Furniture and Equipment 11-03t-403.1, to the cupboard unit. The cost of our repairs to office furniture and equipment (including service contracts) has been greater for the current fiscal year than was estimated. I respectfully request that $300.00 be transferred from Stationery and Office Supplies, 11-031-319.0, to Repairs, 11-031-215.0. There are many deep holes in the streets which need immediate attention. Anthony and I met at the club property which has a property line in common with your railroad to review a complaint from ]tim concerning the surface water Milch is draining onto your right-of-way at a point approximately 429 feet north of Mile Post 129 in Chesterfield County, Virgtnina. Enclosed is a rough sketch which shows what the situation was, is, and is suggested to be. Suffice it to say that Mien the club was developed the County required and the club constructed a storm drainage system on its property which ultimately dumps onto the railread track south of Mt~e Post 129. This stomm drainage system is a 60 inch storm sewer draining the area from Robious Road (State Route 711). The high- way department cut drainage ditches along Robioum Road in such a fashion that they drain through property east of the club onto a point where it Joined up with the club's storm sewer and flowed ultimately to and under your railO road. This is not natural drainage and your railroad at this point is built up in such a fashion that water can- not drain naturally. The volume of water generated from our storm sewer system plus that from the highway department collecting at a single point and then proceeding to your railroad in my humble opinion will ultimately create a problem for you. The drainage across the club property was diverted onto the railroad at the club eastern property line. This diversion is perpendicular to your track and in a record storm in AuFust it caused some minor problems for you. When I discussed the matter with Mr. Anthony, I suggested that any potential problem insofar as the railroad is con- Pa ge Two September 30, 1970 Mr. L. H. Smith cerned would be alleviated if the ditch were anRled so that the water would come in in a fashion that would not damage the railroad. By so doing, it would also alleviate the likeli- hood of the water building up to a point where it would blow your pipe south of Mile Fost 129. I sincerely feel that what is done is to the best interest of both you and the club, al- though I think it should come in at a fairly flat angle rather than perpendicular. Since you do not feel that my su~g..ested solution is acceptable, I have been in con. tact with Chesterfield County authorities for a meetinA to seek an amicable solution. As I stated to you, the water is drainin~ from the ditches along the highway on Robious Road through man-d~F~ ditches which dump on the eastern property line of the Briarwood Swim & Racquet Club. Since our method of disposition of the water is tmsatisfactorv to you and the clrd~ is unwillinF, for the water to continue to dump on it, a workable solution must be found with Chesterfield County and the State ~{ighway Department, I'Ve could very easily simply block the ditch and stop the water from comin~ onto our property and therefore alleviate the problem of the water cominE onto the rail- road, but this would flood Robious Road, and this we do not desire to do. The situation does not constitute a serious problem to the railroad at the present time because of the time of year, if for no other reason, and i {~ould intend to pursue th~ matter with the County and the State tiighway Department before doing anything else. Keith, Jr. Attorney at Law 2922 Hathaway Road Richmond, Virginia 23225 Dear Mr. Keith: Reference your letter of September 30, and I appreciate your bringing to me the drainage problem created at our Mile Post 129 in Chesterfield County, Va., by the Briar Wood Swim and Racquet Club constructing a storm drainage system flowing onto Railway property. This matter has been thoroughly investigated. A ditch was cut through 6-foot bank on Southern's right of way without our permission which allows water to flow directly toward our track, and during last heavy rain washed out ballast on west side for some thirty feet. To angle the ditch as you suggest will not solve the prob- lem as the ditch between the track and the bank is not large enough to carry the surface water, even from a moderate rain. This ditch is about 3 feet deep from the top of our rail and is so narrow that our ballast line runs to the bottom of the ditch. We, therefore, recommend that the bank be closed that was opened on our property and the water diverted back to the old drain- age courseo Please advise when this has been done.
