Inthisrequest,theencroachmentisaresultofclearingandgradingfortheconstructionofa parkingfacilityanditsassociatedappurtenancesforPhaseIIoftheColonyVillageApartment Complex.Thisproposedcomplexwillcontainthreeadditionalapartmentbuildings(106units), twogaragebuildingsandassociateddrivesandparking.Thedeveloperfindstheencroachment tobeanecessarycomponentoftheprojecttoaccommodatetheconstructionofarequired parkinglot. implementationofthelimitsofChesapeakeBayPreservationAreas Theapplicantassertsthat (CBPAs),whichincludeRPAassociatedwiththeunnamedtributarytoProctorsCreekandits connectedandcontiguouswetlands,wouldprecludetheuseoftheproposedimpactedareafor theinclusionoftheproposedsitedevelopmentfeatures/layout.Consequently,theapplicant exceptiontotherequirementsofSection19.1524oftheZoningOrdinanceasit requestsan relatestotheChesapeakeBayPreservationAct(CBPA).Theapplicanthassatisfactorilymetthe requiredsixfindingsasprescribedbyordinanceforencroachmentintotheRPA(ExhibitB).
