The parcel to the south is occupied by the Meadowbrook Plaza Shopping Center, and the property to the east is that comprising the western extremities of Meadowbrook Country Club. The request before the Board is for a use permit on the adjacent parcel to allow an operation which will become an integral part of the day care nursery conducted at 4232 Bonniebank Road. The applicant has purchased this parcel to exoand those facilities. On April 1, 1964, the Board of Zoning ~opeals granted a use peEnit to Mr. Sterling Monk for the operation of a day nursery on the adjacent parcel at 4232 Bonniebank Road~ and on June 9, 1971, the Board of Supervisors granted a similar request on the oarcel expanding the operation. Planning Staff is of the opinion that this proposed use will serve as a desired transition between the commercial activity of the Meadowbrook Shopping Center and those residentially developed and undeveloped proper- ties. The developer shall submit a plan to the County EnMineering Department which will provide for on and off site drainage control. The plan shall explain the method and show the facilities to be utilized in the hydraulic engineering of this pro~ect. This plan shall be approved by the Engineering Department prior to the issuance of any building permit and implemented prior to the issuance of any occupancy permit. 2) Utility (water and sewer) plans shall be submitted to and approved by the County Engineering Department prior to the issuance of any building permit. 3.~No sign shall be permltted3~ /~-- 4) Off street parking shall be provided allowtn¢ for a minimu/n of 15 spaces. To accomplish this parking requirement it is suggested that a semi-circular driveway be utilized. Tax Map Sec. 51-11 (1) parcel 1 The parcel in question is zoned Residential (R-2) as is adjacent property to the northwest and southeast while property to the southwest and north- east is zoned Agricultural (A). The primary use of the property is for a single family residence. The reeuest is for a use permit to stable and train horses and to beach riding. Staff feels that the use will cause no detriment to adjacent properties provided the following conditions are imoosed: 1) No sign be permitted. 2) Operation to be limited to between 9:00 A.M. and 9:00 P.M. 3) No additional structures to be built either in direct or indirect relationship to this ooeratlon. 4) Permit to be valid for a period of three (3) years, renewable upon satisfactory re-application. 72~.11U H. This parcel is zoned Agricultural (A) as is all adjacent property. request is for a use permit to "grade and improve land to a usuable condition."~ The The applicant indicated that, "dirt that is removed to be used in con- structing road embankments." The Planning Department has interpreted this to mean a "Barrow Pit" operation. Such a use would be subject to the regulations as set forth in Eec. 17-11 of the zoning ordinance. Providing the proper regulations and controls are instituted, Planning Staff feels that this project will offer no detriment to the area or adjacent properties. Such a plan is to be comprised of vegetative and engineering practices (as outlined in the "Erosion and Sediment Control Technical Handbook" published by the James River Soil and Water Conservation District) to be utilized as erosion and sediment control measures for the project. The plan shall be approved by the Engineering Department and all plan measures shall be instituted prior to any earth removal. 3) All provisions of Sec. 17-11 shall be complied with. The appli- cant shall present to the Planning Department a statement outlining his intent and method of compliance with regard to each sub-paragraph (a through 1) within the aforementioned section. Such a statement is to be presented and anoroved prior to any earth removal. 4) All roads on the parcel shall be dampened each day of the operation with a water truck utilizing a spray system. 5) This permit shall be valJd for a period of one (1) year renewable upon satisfactory re-application to Board of Supervisors.
