Pittman, Jr. award for having the longest continuous full time service to the citizens of Chesterfield County. With the retirement of Mrs. Kidd, the award was then passed to Mrs. Joan Swearengin of the Utilities Department. Dunn Attachments: Yes ~-~ No Title: Director, Economic Development RECOGNIZING ROGAR INTERNATIONAL CORPORATION AS THE 2001 SMALL BUSINESS OF THE YEAR WHEREAS, the Chesterfield County Board of Supervisors established a Business Appreciation and Recognition Award to recognize existing businesses within the County that contribute to the County's economy and its citizens; and WHEREAS, Rogar International Corporation, located at 12738 Oak Lake Court in Chesterfield County, was founded by Mr. Robert Crist in 1975 and, after a review of over 20 cities, moved from Texas to Richmond, Virginia in 1989; and WHEREAS, the company's mission has remained the same over the past 25 years: to design, manufacture and market top-quality consumer products; and WHEREAS, Rogar began producing a line of unique wine openers and added a full line of pot racks a few years later, and its focus on fine craftsmanship, excellent customer service, innovative packaging and prompt delivery has enabled the company to meet the high standards of specialty retailers and upscale shoppers alike; and WHEREAS, the company most recently has built 66,000 square feet of office, warehouse and factory space on six acres of land in Chesterfield County, with another 20,000 square feet to be built in the near future, creating 40 to 50 jobs in the County with the recent move to the facility on Oak Lake Court; and WHEREAS, Rogar has donated products for various charitable organizations, including Richmond Planned Parenthood, Maymont Foundation, the Kidney Foundation of Virginia, and Saint Jude Children's Research Hospital. Subject: County Administrator's Comments: Streetlight Installation Approval County Administrator: Board Action Requested: This item requests Board approval of a New Streetlight Installation in the Bermuda District. Summary of Information: Streetlight requests from individual citizens or civic groups are received in the Department of Environmental Engineering. Staff requests cost quotations from Virginia Power for each request received. When the quotations are received, staff re-examines each request and presents them at the next available regular meeting of the Board of Supervisors for consideration. Staff provides the Board with an evaluation of each request based on the following criteria: 1. Streetlights should be located at intersections; There should be a minimum average of 600 vehicles per day (VPD) passing the requested location if it is an intersection, or 400 VPD if the requested location is not an intersection; Petitions are required and should include 75% of residents within 200 feet of the requested location and if at an intersection, a majority of those residents immediately adjacent to the intersection. Subject: Authorize the County Administrator or His Designee to Execute a Law Enforcement Mutual Aid Agreement with Henrico County County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to authorize the County Administrator or his designee to execute the Law Enforcement Mutual Aid Agreement with Henrico County. Summary of Information: Chesterfield County has been involved in discussions with Henrico County on a revised version of the existing law enforcement mutual aid agreement. Henrico and Chesterfield had previously entered into an agreement that has recently expired. The attached agreement has been revised to include revision of state code references, the addition of a simple procedure by which mutual aid can be requested, a reference to a region wide communications channel/system, the designation of "command staff" as the level of authority that can request mutual aid in the absence or incapacitation of the chief law enforcement officer, and substitution of a "no expiration" clause in lieu of the current four (4) year expiration term. The County is presently a party to a similar agreement with Colonial Heights, Hopewell, Petersburg and Prince George. Baker Title: Chief of Police 1222:54833.1 Attachments: Ycs ----]No LAW ENFORCEMENT MUTUAL AID AGREEMENT This AGREEMENT is made this day of and between the COUNTY OF HENRICO, VIRGINIA CHESTERFIELD, VIRGINIA. and the , 2001, by COUNTY OF WHEREAS, Code of Virginia §§ 15.2-1724, 15.2-1730, 15.2-1730.1, and 15.2- 1736 authorize localities and sheriffs to assist each other and to enter into reciprocal agreements for cooperation and to furnish certain law enforcement services; and WHEREAS, the COUNTY OF HENRICO and the COUNTY OF CHESTERFIELD have determined that the provision of law enforcement aid across jurisdictional lines will increase the ability to preserve the safety and welfare of the entire area; and WHEREAS, it is deemed to be mutually beneficial to each jurisdiction to enter into an agreement concerning mutual aid with regard to law enforcement; and WHEREAS, the parties desire that the terms and conditions of Law Enforcement Mutual Aid be established. WITNESSETH That for and in consideration of the mutual benefits to be derived by the COUNTY OF HENRICO and the COUNTY OF CHESTERFIELD from a Law Enforcement Mutual Aid Agreement ("Agreement"), the COUNTY OF HENRICO and the COUNTY OF CHESTERFIELD covenant and agree with the other, pursuant to proper resolution approved by each jurisdiction, as follows: The parties will endeavor to provide reciprocal law enforcement support within the capabilities available at the time the request is made and within the terms of this Agreement. Page 1 of 4 LAW ENFORCEMENT MUTUAL AID AGREEMENT No party to this Agreement shall be liable to the other party for any loss, damage, personal injury, or death to law enforcement personnel or equipment resulting from the performance of this Agreement, whether such occur within or outside the jurisdictional boundaries of the parties, nor for expenses arising out of assistance provided pursuant to this Agreement, unless otherwise agreed to by the parties. Requests for assistance pursuant to the terms and conditions of this Agreement shall be made to and authorized by the Chiefs of Police from whom assistance is sought or, in his or her absence or incapacitation, any member of his or her command staff. Such requests may be made in person or by electronic means, provided that the identity of the requestor is verified if electronic means are used. The personnel of the requested jurisdiction shall report to and render assistance under the direction of the Chief of Police of the requesting jurisdiction, except that the ultimate control of the personnel of any party rendering assistance shall rest with the officers or supervisors of such personnel. The parties shall be responsible for maintaining a radio communications system for use by the requested jurisdiction. Use 'of the Statewide Interdepartmental Radio System (SIRS) or other region-wide communications channel or system as a link between the communications or dispatch centers of each jurisdiction shall constitute fulfillment of this requirement. The services performed and expenditures made pursuant to this Agreement shall be deemed to be for public and governmental purposes and all immunities from liability enjoyed by the parties, their agents and employees within their respective jurisdictions shall extend to participation in rendering assistance pursuant to this Agreement. It is understood that for the purpose of this Agreement, the personnel of the responding parties are rendering aid once they have entered the jurisdictional boundaries of the party receiving assistance. Page 2 of 4 00;1.7 LAW ENFORCEMENT MUTUAL AID AGREEMENT Officers responding to this Agreement shall have all necessary authority to enforce the laws of the Commonwealth of Virginia and to perform the other duties of a law enforcement officer. Such authority and all actions pursuant to this Agreement shall be in conformance with the Code of Virginia §§ 15.2-1724, 15.2- 1730, and 15.2-1736, including future amendments, and all other applicable laws and regulations. This Agreement repeals and supersedes all previous written Agreements or oral understandings relating to the .provision of reciprocal law enforcement services. This Agreement represents the sole document regulating the provision of reciprocal law enforcement services between parties. This Agreement shall be effective from the date of execution, until terminated by either party or his or her successors, giving thirty (30) days prior written notice of termination to the other party. 10. Any notice required by this Agreement shall be deemed effective if given by registered or certified mail, return receipt requested, or by other receipted delivery, to the other party at their regular address of record. Summary of Information: The five-year license agreement with Capital Area Soccer Association has expired. The previous agreement allowed the opportunity for CASA to build an indoor soccer facility (cost $30,000} and run the winter league indoor soccer program for adult and youth players. CASA would like to continue use of the facility and will fund improvements to the exhibition hall for storage facilities in return for the opportunity. Subject: Set Public Hearing Date to Consider FY03 Enhancement Projects County Administrator's Comments: County Administrator: ~ Board Action Requested: The Board is requested to set November 28, 2001, as a public hearing date to consider FY03 Enhancement Projects. Summary of~nformation: The Virginia Department of Transportation (VDOT) Enhancement Program is intended to creatively integrate transportation facilities into the surrounding communities and the natural environment. Projects eligible for funding include pedestrian and bicycle facilities, pe.destrian and bicycle educational/safety activities, scenic easements, historic highway projects, landscaping, historic preservation, rehabilitation of historic buildings, preservation of railroad corridors, removal of outdoor advertising, archeological planning and research, mitigation of pollution due to highway runoff, and establishment of transportation museums. A $19 million per year statewide Enhancement Fund has been established for VDOT to carry out the program. Transportation Enhancement Projects are financed with 80% VDOT funds and a minimum 20% local match. The local match is usually provided from County funds, from others and/or by in-kind contributions. VDOT staff will evaluate project applications and make a recommendation to the Commonwealth Transportation Board for inclusion in the FY03-FY08 Virginia Transportation Development Plan. CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 2 of 3 Summary of Information: (continued) The proposed FY03 Enhancement Projects (see Attachments A and B) are the same as those approved by the Board for FY02 with the following changes: The Halloway Avenue Sidewalk project, Phase II has been deleted. This project was funded last year and will involve the construction of a portion of sidewalk along Halloway Avenue. The Centre Street Streetlights project has been deleted. It was completed with the road improvements. · The Halloway Avenue Sidewalk project, Phase III was added. Phase III will allow construction of additional sidewalk along Halloway Avenue. The Salem Church Road Sidewalk project (Public Phase), along the east side of the road between Chanson Road and Sara Kay Drive, has been deleted. It has been constructed. The Spirea Road Sidewalk project, from Mountain Laurel Drive to Sunflower Lane has been added. · Project costs have been updated to reflect current estimates. Each year the Board must reconfirm support for requested enhancement projects by adopting a resolution of support which guarantees the County will provide the local match. If the Board wishes to request enhancement funds for the five proposed FY03 priority projects listed on Attachment A, a resolution of support must be adopted for these projects and the Board would need to designate funds for the local matches. Unless the Board directs otherwise, projects listed on Attachment A under "Other Projects" will not be submitted for funding consideration this year. These other projects will stay on the "Proposed Enhancement Project" list for the Board's consideration in the future. Recommendation: Staff recommends the Board set November 28, 2001, as the public hearing date to consider FY03 Enhancement Projects, and authorize the advertisement for that hearing. District: Countywide CHESTERFIELD COUNTY BOARD OF SUPERVISORS AGENDA Page 3 of 3 Meeting Date: October 24. 200'1 Number Bud.qet and Mana.qement Comments: This request is to schedule a public hearing to consider the FY03 Road Enhancement Projects. These projects require a 20% local match. The five priority projects would require local matches as follows: $48,000 for the Point of Rocks Bike Trail, phase I, $10,000 for Genito Road Streetlight Project, $94,000 for the Cogbill Road Sidewalk (Meadowbrook HS to Meadowdale Library), $70,000 for the Halloway Avenue Sidewalk, Phase III project, and $80,000 for the Walton Park Sidewalk (Watch Hill Road and North Woolridge Road). The balance in the FY02 General Road Improvements account is $1,019,422. Staff recommends approval of the transfer of up to $302,000 from the General Road Improvements Account, subject to VDOT approval and match for these specific projects. Should these projects be approved by VDOT, the remaining balance in the General Road Improvements account after the required County matches will be $717,422. Summary of Information' On March 14, 2001, the Board of Supervisors referred to the Planning Commission a proposed amendment to the Floodplain Ordinance that would prohibit certain activities in designated floodplain corridor areas in the Swift Creek Reservoir Watershed. The ordinance amendment was one of three proposed ordinance changes necessary to implement the Watershed Management Plan and Maintenance Program for Swift Creek Reservoir that was adopted by the Board on October 25, 2000. This Plan designates these floodplain corridor areas as regional best management practices (BMP) facilities. The Commission conducted a public hearing on the matter on May 15, 2001 and held two work sessions to consider the issue. Further, staff conducted a public meeting with property owners who would be affected by the proposed measure. After consideration of the proposed amendment, the Planning Commission, at their meeting of/August 21, 2001 voted to recommend denial of the proposed ordinance amen_Vents. Currently, only 10% of septic system permit applications in the County use land test results from private on-site inspectors. Summary oflnformation: The Virginia Department of Rail and Public Transportation (VDRPT) will conduct public hearings at 7:00 p.m. on November 7 and 8, 2001, at the Science Museum of Virginia and Appomattox Regional Governor's School Auditorium, respectively. Prior to the public hearings, there will be an open-house from 5:00 p.m. to 7:00 p.m. to review project documents. The purpose of the hearings is to present information relating to the Tier I, Environmental Inventory Study for the Southeast High Speed Rail project and receive comments from local government officials and citizens that will assist in developing the project further. The North Carolina Department of Transportatio% with assistance from VDRPT, is leading the effort in completing necessary environmental studies for the Southeast High Speed Rail project. At that meeting the Board expressed several positions relating to high speed rail: Access to high speed rail service should be provided in Chesterfield County. The Ettrick/Virginia State University, Petersburg and Chester areas should be given consideration. High speed rail should be planned and constructed to accommodate future light rail service in Chesterfield County. The southeast high speed rail service should be planned to accommodate the proposed Petersburg to South Hampton Roads high speed rail service. There was no support for high speed rail service using the abandoned rail road right-of-way in Chesterfield because of the impacts on adjoining neighborhoods, impacts on an existing park facility, and impacts on future thoroughfare plan roads. Funds for high speed rail must not be provided by diverting funds from highway improvements. Recommendation' Staff recommends the Board adopt the attached resolution of support for Southeast High Speed Rail service and forward the resolution to VDRPT. District: Countywide WHEREAS, the development of high speed rail service between Washington, D.C. and Charlotte, North Carolina and between Petersburg and South Hampton Roads will help promote economic development in Virginia and North Carolina; and WHEREAS, the North Carolina Department of Transportation in cooperation with the Virginia Department of Rail and Public Transportation has completed the Tier I, Environmental Impact Statement for the Washington, D.C. to Charlotte service. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors supports the development of Southeast High Speed Rail service between Washington, D.C. and Charlotte, North Carolina, and encourages others along the corridor to join Chesterfield County in obtaining funding for this project so that it can be implemented. Summary of Information: When the Board approved the Secondary Six Year Improvement Plan in May 1999, the County Administrator was authorized to enter into the customary VDOT/County project agreement for projects in the plan, which included the Genito Road/Woolridge Road Project. Under the terms of the agreement, the County will perform the tasks required to construct the project and be reimbursed by VDOT for the County's costs. Bids for construction of the project were received on August 21, 2001. Shoosmith Brothers, Inc., submitted the low bid of $1,090,985. The bid was approximately twenty-two percent higher than the engineer's construction estimate for the project. Staff subsequently met with Shoosmith Brothers to determine if the bid could be reduced. A revised bid of $1,030,985 has been submitted. The revised bid is approximately 15% higher than the engineer's construction estimate. VDOT has agreed that the project can be awarded at this price. Summary of Information: The last aerial photography conducted for the County was in 1989. Later, in 1991, a project was done to create orthophotography from the aerial photography and to obtain a digital elevation model and digital topographic information. In 1991, digital imagery was in its infancy and was quite expensive requiring the County to purchase conventional hard-copy orthophotography. The cost of that project in 1991 was $564,826. With the maturation of the technology, the cost of digital imagery has substantially decreased in the intervening years making a digital product more affordable. Substantial development has occurred in Chesterfield County over the past 12 years causing the existing photography to be inadequate for current use. Additionally, because the existing orthophotography is conventional hard-copy images, it has never been added as a layer to the GIS for use in mapping products. The reserve account now stands at a dollar amount that can support the purchase of the above-mentioned products with the addition of $50,000 from the County's Transportation Department from funding obtained through the Richmond Regional Planning District Commission Pass-Through PL and State Funds program. This funding was obtained to update the eastern area of the County's Thoroughfare Plan on the GIS and requires new aerial photography to be purchased to properly update the plan. The Board appropriated the funds for reimbursement for this project on February 21 2001. ' On July 31, 2001, the GIS staff released a Request for Proposal for Digital Imagery Products and Services (RFP #01-5228-8578). Nine firms responded to the RFP. The responses were reviewed by an evaluation team made up of members of the GIS staff, Transportation Department, Information Systems Technology Department, and Purchasing Department. After careful review, it was determined that Merrick was clearly the most qualified of the respondents and the one most clearly able to provide the required services at a reasonable cost. The price would be $348,990 for the five deliverable products. Of the five products, the aerial photography, digital elevation model, and digital topographic layer will be updates to existing data while the digital orthophotographs and the digital planimetric layer will be new data. Staff Recommendations: It is recommended that the Board of Supervisors authorize the County Administrator to execute a contract between the County and Merrick in an amount not to exceed $348,990 to provide aerial photography, digital orthophotography, digital elevation model, digital topographic data, and digital planimetric data to update the data in the County's graphic database of the GIS. Staff is also requesting appropriation of $264,268 in use of reserves and $34,722 in anticipated current fiscal year revenue to be received. It has been twelve .years since the last aerial pictures of Chesterfield were taken and in that time the landscape has changed dramatically. During the past five years, revenues collected from the sale of GIS map products have been reserved for this purpose. The balance in this reserve is $264,268. The Environmental Engineering Department also anticipates receiving $34,722 in revenue from map sales in the current fiscal year. This revenue can be used as a source to offset the cost of this enhancement to GIS. This anticipated $34,722 in current fiscal year revenue must be appropriated to supplement the use of the reserve. The final funding source for this project, is a $50,000 grant from the RRPDC for the update of the Eastern Thoroughfare Plan. Boyce on February 8, 1910, and was chartered by Congress in 1916; and WHEREAS, the Boy Scouts of America was founded to build character, provide citizenship training and promote physical fitness; and WHEREAS, after earning at least twenty-one merit badges in a wide variety of skills including leadership, service and outdoor life, serving in a leadership position in a troop, carrying out a service project beneficial to his community, being active in the troop, demonstrating Scout spirit, and living up to the Scout Oath and Law; and WHEREAS, Mr. Douglas Lee Stewart, Troop 875, sponsored by Tomahawk Ruritan Club, has accomplished those high standards of commitment and has reached the long-sought goal of Eagle Scout, which is earned by only four percent of those individuals entering the Scouting movement; and WHEREAS, growing through his experiences in Scouting, learning the lessons of responsible citizenship, and endeavoring to prepare himself for a role as a leader in society, Douglas has distinguished himself as a member of a new generation of prepared young citizens of whom we can all be very proud. Summary of Information: Pursuant to state law, the County's Land Use Taxation Program provides reduced real estate taxes for property owners whose real property qualifies under the program. The current county Land Use Taxation Ordinance requires property owners to submit applications no later than November 1st of each year. This does not allow property owners who make changes following the November 1st deadline to take advantage of the tax benefits for the coming year. However, state law allows for a late filing extension of Land Use Taxation Applications with a late fee, if adopted by the Board of Supervisors. Preparer: Paul D. This would also allow current participants who make changes after the November 1st deadline to remain active in the Land Use Taxation Program. The property owner would be charged a late fee of $25.00 for each application that is submitted during the 60 day period following the November 1st deadline, however, this would allow for the property owner to qualify for tax benefits applicable to the Land Use Taxation program. 0075 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED BY AMENDING AND RE-ENACTING SECTION 9-18 RELATING TO LAND USE TAXATION APPLICATIONS BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 9-18 of the Code o_f the County qf Chester_field, 199 7, as amended, is amended and re-enacted to read as follows: Sec. 9-18. Applications--Required. (a) The owner of any real estate meeting the criteria set forth in Code of Virginia, §§ 58.1-3230 and 58.1-3233(2), may, at least 60 days preceding the tax year for which such taxation is sought, apply to the county assessor for the classification, assessment and taxation of such property for the next succeeding tax year on the basis of its use, under the procedures set forth in Code of Virginia, § 58.1-3236, provided that in any year in which a general reassessment is being made the property owner may submit such application until the later of 30 days have elapsed after his notice of increase in assessment is mailed in accordance with the Code of Virginia, § 58.1-3330, or 60 days preceding the tax year. The application shall be on forms provided by the state department of taxation and supplied by the county assessor and shall include such additional schedules, photographs and drawings as may be required by the county assessor. An application fee of $10.00 shall accompany each application. In addition, an application may be filed within no more than sixty days after the filing deadline specified herein upon payment of a late filing fee of $25.00. (b) A separate application shall be filed for each parcel on the land book.
