By so doing, the Board has set a precedent may cause the County many problems which should be noted. Off-site Easement Requirements by Virginia Department of Highways re~l Recently, the Virginia Department of Highways has been :lng all developers to carry drainage from subdivisions *by means easement to a natural watercourse. The Virginia Department of Lys defines a natural watercourse as a definite channel with 'bed mks within which water flows, either continuously or in season. ~pressions or swales through which surface or errant waters pass ,t classified as watercourses. A copy of a form letter, dated 20, 1972, which is sent to all developers is enclosed. Using the above criteria, it is estimated that 90% of all isions will require off-site easements and condemnation by the 'will 'be required for approximately two out of every three isions. These easements may 'be a few feet long or they may 'be feet long depending on each individual situation. BOARD OF IRWN G. H CLOVER C. J. PURD BERMUD J. RUFFIN , DALE DI.¢ C ROBERT'A. BURNETT AND UTiLITiES DEPARTMENT EXECUTIVE SECRETARY VIRGINIA of Supervisors 2 10, 1972 The question arises as to how these easements will 'be · ined. We have only one construction and maintenance crew at cesent time. If this practice continues, the County will most inly have to increase the number of right of way and drainage .%nel. Another problem involved is whether the easements will be ~d properly on adjacent property so that it can be developed future without easement vacations and re-dedications. Also considered is whether the County should use its power of m~ation for Obtaining easements which are required only by the Highway Department. All these questions need to 'be considered befor~ the County accepts thousands of feet of easement which are not nbeded now. ~ The County needs off-site easements if the developer has to lower the outfall in order to drain his property properly. We do no: need easements through undeveloped property when the outfall remai[s unchanged 'because these easements will *be Obtained as the prope:ty develops. of Su' off-S the pI in e as em~ Highw~ work. cc.' As an alternate solution, it is suggested that the Board ,ervisors request the Virginia Department of Highways to require .re easements only when needed by the County of Chesterfield as .rginia Department of Highways does not assume any responsibility :acquisition, ownership, construction or maintenance of these ~nts. It might 'be pointed out that the Virginia Department of Lys does not follow the natural watercourse rule in their own ute o_ar ~L Mamb e.r s ~_. wA. z~ ~rb~%se, Jr. Ve.~.yr truly yours Ro'~e~t 'A~ ~ainter uoungy L-ngineer DOUGLAS B.
