PROPOSAL
A condition of zoning required the recordation of a fifty (50) foot buffer and building setback along North
Spring Run Road (Attachments 2 and 3). Approximately thirty-five (35) feet of this buffer crosses the
request property, with the remainder located on community open space.
A pool is proposed within a portion of a fifty (50) foot buffer and building setback. To permit this
encroachment, the applicants request a zoning amendment to delete the portion of the buffer located on
their lot. The remaining portion of the fifty (50) foot buffer located on community open space would
remain.The pool would meet the six (6) foot minimumsetbacks along the side and rear.Approval of an
amended subdivision plat (to remove the buffer notation from the property) would also be required.
BUFFER AND OPEN SPACE
As shown on Map 4, the applicants’ rear property line is located approximately forty-two (42) feet away
from the right-of-way of North Spring Run Road and seventy-five (75) feet from its edge of pavement. An
area of dense evergreen vegetation within the community open space buffer exists and would be
maintained.

The existing vegetation, separation of the request property from Spring Run Road, and the six (6) foot tall
privacy fence within the community open spacewould minimize potential adverse impacts(noise, glare
and privacy), provide adequate separation and screening to the applicants’ rear yard, and maintain the
appearance of continuity for the buffer that would remainin community open space.
A condition is recommended by staff to mitigate the impact of the buffer deletion on area properties:
