Subject: County Administrator's Comments County Administrator's Comments: County Administrator: Board Action Requested: Acceptance of Check to Chesterfield County from the United States Fish and Wildlife Service under the Refuge Revenue Sharing Act. Summary of Information: Since 1935 the U. S. Fish and Wildlife Service has made annual revenue sharing payments to counties for refuge land under its administration. Chesterfield County receives these payments, as Presquile National Wildlife Refuge is located within its borders. Annual revenue sharing payments are based on ~ of 1% of the fair market value of refuge land, and can be used for any governmental purpose. Mr. Joseph F. McCauley, Refuge Manager for the United States Fish and Wildlife Service, will present a revenue sharing check in the amount of $5,338 to the County. Accompanying Mr. McCauley is Mr. Jason Gray representing Congressman J. Randy Forbes from the Fourth District. Attached is a report prepared by our Utilities staff and the Appomattox River Water Authority staff showing test results for MTBE from 1998 to the most recent readings. Test results show that MTBE has been below reportable levels since 2001. Joan will update the Board of Supervisors on the E.P.A. actions related to MTBE. O. ~Hank" Holland, III will retire from the Chesterfield County Police Department on September 1, 2003, after providing 28 years of quality service to the citizens of Chesterfield County; and WHEREAS, Officer Holland has faithfully served the county in the capacity of Patrol Officer, Drug Abuse Resistance Education (D.A.R.E.) Instructor and Mentor for the U.S. Eastern Regional District for D.A.R.E., Desk Officer, Department of Criminal Justice Services Instructor and Total Quality Improvement (T.Q.I.) Facilitator; and WHEREAS, Officer Holland served the Police Department as a K-9 Officer from 1977 to 1979; and WHEREAS, Officer Holland began his public service to the citizens of Chesterfield County at the age of 16 as a volunteer fireman at Manchester Volunteer Fire Department, and again served with this volunteer unit from 1974- 1975; and WHEREAS, Officer Holland received national, state and local recognition for his duties as a D.A.R.E. Officer, including Officer Holland's D.A.R.E. students at J. G. Henning Elementary School contributing two of the fifteen amendments of the Children's Bill of Rights signed by President Clinton; and WHEREAS, Officer Holland received a Virginia PTA Honorary Life Membership in recognition of his noteworthy loyalty and high achievement in promoting the welfare of children and youth; and WHEREAS, Officer Holland received a Certificate of Commendation for his actions on July 26, 1999, at Johnston Willis Hospital, where he led a cadre of employees in controlling two fires that had a serious potential for damage due to their location near several nitrous oxide tanks, an electric transformer and fuel lines, and a total of 23 fire extinguishers were used to keep the fires under control until the arrival of the Chesterfield County Fire Department; and WHEREAS, officer Holland has received many letters of commendation and appreciation from the Police Department, federal, state and local law enforcement agencies, and citizens for his performance and dedication to his law enforcement duties; and WHEREAS, officer Holland has provided the Chesterfield County Police Department with many years of loyal and dedicated service, and Chesterfield County and the Board of Supervisors will miss Officer Holland's diligent service. It is only by the Grace of God, my family, friends, fellow police officers, and our citizens that I am able to stand here now before you. Being a participant in the changes in our County since 1975, I have concluded all along that we are a productive community. We have always had the best of people working to make a strong County Government. Even in the days of totally volunteer fire departments, rescue squads, and a small police department, the citizens of this county were served by dedicated people who made a personal decision to serve their community. On a hot summer day in June of 1960, our family arrived in Chesterfield County to begin a new chapter in our lives. The six of us arrived in a 1953 two door Studebaker, with no air conditioning in the late afternoon heat. The youngest was less than a year old. It was the days when you did not have disposal diapers and the only formula for babies was milk. My parents made a landmark decision to build a better life with the opportunities afforded in the Capital City area. Their "First Choice" to begin this adventure was Chesterfield County. The rest is history forty-three years later. My choice to serve Chesterfield County was derived from the police officers that served our community. I considered these officers to be "Legends". For so few to cover such a large diversified county, they dedicated themselves to the task. Everyone knew and respected them. On September 1, 1975, I had the honor to be appointed and join these true "Legends". Throughout my career I have enjoyed working with the best. I have never contemplated leaving this department for another, whether it be Federal, State, or Local. As I leave my duties as a public servant, I trust that technology will continue to automate the necessary documentation duties to keep the police officer out in the community to do what they are trained and dedicated to do best. I want to thank you and all whom have served this county for supporting this police department during my tenure. You have spoken about us with sincere pride. Your pride is a great honor to those officers who serve our citizens on a daily basis. This county will continue to grow and be strong because of our legacy. May those who will serve remember to be of good stewards for the citizens and businesses that have made Chesterfield County their "First Choice". May God continue to bless and protect you. Subject: Adoption on an Emergency Basis of an Ordinance and Resolution Exempting Concession Operations of Certain Youth Athletic Organizations from State Food Handling Laws County Administrator's Comments: ~.~___z~--/~,~.~.~J /~~. County Administrator: Board Action Requested: Staff requests that the Board of Supervisors adopt the attached ordinance and resolution on an emergency basis and set a public hearing date of September 17, 2003 to consider re-adoption of the ordinance. Summary of Information: The State Board of Health has recently issued a ruling that concessions sales at youth athletic activities are bound by regulations controlling the preparation and handling of foods. In the past, the Health Department had not required concession operators to purchase a permit and did not regulate their activities. All youth athletic associations will now be required to pay for a permit and be subject to stringent rules and regulations regarding the preparation, handling and sale of food similar to those imposed on restaurants. It is anticipated that subjecting concessions to the new requirements will limit the type of food that can be sold and hurt athletic association fundraising efforts. The state Code allows the County to exempt concession stands at youth athletic activities from state regulation by adoption of an ordinance Preparer: Michael S. Dr. William Nelson has been consulted regarding the ordinance. He agrees with the staff recommendation to adopt the proposed ordinance, which will allow concessions to continue to operate as they have in the past. Under the proposed ordinance, however, the County Health Department will issue advisory standards on the safe operation of concessions and will provide educational material and training to the operators of the concessions to promote safe practices in food preparation and handling. Staff has requested that the ordinance be adopted on an emergency basis to go into effect immediately before the fall athletic season begins. Attached is a resolution, which lists the affected organizations and for which staff seeks an exemption at this time. When an ordinance is adopted on an emergency basis, the Board must hold a public hearing and readopt the ordinance within 60 days or else the ordinance will no longer be effective. Staff is requesting that the Board schedule a public hearing on September 17, 2003 to consider re-adoption of the ordinance. 0623: 62664.1 (62610.1, 62698.1) O000:LZ AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND REENACTING SECTION 12-41 RELATING TO CONCESSION STANDS AT YOUTH ATHLETIC FACILITIES BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 12-41 of the Code of the County of Chesterfield, 1997, as amended, is amended and reenacted to read as follows: ARTICLE III. REGULATION OF FOOD AT COUNTY FAIRS AND CONCESSIONS AT YOUTH ATHLETIC ACTIVITIES Sec. 12-41. Applicability of state law. (a) The Code of Virginia, tit. 35.1, shall not apply to the county fairs sponsored by the Chesterfield County Fair Association or concession stands at youth athletic activities, when such stands are promoted or sponsored by either a youth athletic association or by any charitable nonprofit organization or group thereof which has been recognized by resolution of the county as being part of its youth recreational program. (b) The advisory standards issued by the state board of health are incorporated herein by reference and shall apply to the sale, preparation, serving, transporting and handling of food at such fairs. The county health officer or his designee shall supervise the sale, preparation, service, transporting and handling of food at such fairs. (c) It shall be the duty of the county's director of health, or a qualified person designated by him, to provide education and consultation, establish advisory standards and exercise appropriate supervision regarding the safe preparation, handling, protection and preservation of food at concession stands at youth athletic activities, to protect the public health. (2) That this ordinance shall become effective immediately upon adoption. 0000:1.3 0623:62610.1 RESOLUTION OF CHESTERFIELD COUNTY RECOGNIZING YOUTH ATHLETIC ASSOCIATIONS AND OTHER CHARITABLE, NON-PROFIT ORGANIZATIONS WHICH ARE PART OF THE COUNTY'S YOUTH RECREATIONAL PROGRAM WHEREAS, § 35.1-26 of the Code of Virginia permits the County to exempt by ordinance or resolution certain organizations from the state food handling laws; and WHEREAS, on this 27th day of August, 2003, contemporaneously with this resolution, the Board has adopted on an emergency basis an ordinance to exempt organizations which are part of the County's youth recreational program; and WHEREAS, state law requires that the County identify which organizations shall be exempt from state law pursuant to the ordinance. Summary of Information: With the technical assistance of Palmer & Cay, a national benefits consulting firm, County and Schools staff recently completed the rate renewal process for the 2004 Employee Health and Dental Programs. In order to provide employees with quality health and dental care options, it is recommended that the County renew its current dental contract with United Concordia and its current health care contract with Anthem Healthkeepers. MAMSI will not be offered in 2004 because the plan would not retain the necessary membership required in the contract unless there is a substantial increase in rates. The purpose of the meeting is to receive comments from local government officials and citizens that will assist the CTB in updating the Virginia Transportation Six Year Improvement Program for FY05. The Virginia Transportation Six Year Improvement Program lists projects expected to go to construction in the next six years or have been partially funded for design and construction. VDOT's meeting provides the County with the opportunity to recommend priority projects to the CTB on Chesterfield's primary and interstate road needs. The County's Secondary Road Six Year Program for improvements to the County's secondary road system will be considered by the Board of Supervisors in a separate agenda item. The recommended priority list is shown on Attachment A. A location map and description of each project is shown on Attachment B. Interstate 295/Meadowville Road lntercham~e This interchange is needed to help promote economic development and to prevent unacceptable levels of service in the future on Route 10, Meadowville Road, and North Enon Church Road. The County has completed the design and has the right-of-way needed for construction of the interchange. This project received a $1.67 million allocation in VDOT's current transportation development plan but the project is not funded for construction in the current transportation development plan. Centralia Road (Route 10 to Chester Road) - intersection improvements, various locations Centralia Road carries approximately 11,000 vehicles per day. This volume is expected to increase to 16,000 vehicles per day by the year 2020. A high volume of truck traffic and the lack of turn lanes reduces the operational efficiency of the road. This project is not included in VDOT's current transportation development plan. Route 360 (Route 288 to Swift Creek) - widening to eight lanes This section of Route 360 carries between 52,000 and 62,000 vehicles per day. This volume is expected to increase to between 77,000 and 90,000 vehicles per day by the year 2020. Four lanes have been provided eastbound. However, a fourth westbound lane is needed to relieve congestion. Traffic routinely backs up on the Route 288 ramp at rush hour. The Route 288 project included construction of two additional lanes on Powhite Parkway from Route 288 to Coalfield Road. This project will extend the four lane road through the Coalfield Road intersection. This project is not in VDOT's current transportation development plan. 10. Powhite Parkway Extension; East-West Freeway; North-South Freeway Preliminary engineering and right-of-way acquisition is necessary for the County's "outer bcltway" (Powhite Parkway Extension from Route 288 to Route 360, East-West Freeway from Route 360 to Interstate 95, and North-South Freeway from East-West Freeway to Interstate 85). Preliminary engineering is needed to properly identify the location of the beltway. Right-of-way should be acquired where growth threatens to block the corridors. This project is not in VDOT's current transportation development plan. 11. Signalization (Countywide) The installation of traffic signals is needed at various intersections. Signalization requests on primary roads received through Board members include: Route 360 at Lynview Drive, Route 360 at Broadstone Road, Powhite Parkway/Old Hundred Road at Brandermill Parkway, Route 10 at Ecoff Avenue, Route 10 at Parker Lane, River Road at Pickett Avenue, Route 1 at Bermuda Hundred Road, Route 1 at Sand Hills Drive, and signal improvements along the Route 60 corridor. VDOT's current transportation development plan includes approximately $200,000 each year for signalization needs throughout the entire Richmond District. 12. Sight and Sound Barriers (Countywide) These barriers are needed to reduce the impacts of the roadways on adjoining neighborhoods. Route 145/Kingsdale Road Intersection - signalization and intersection improvements Route 145 carries approximately 10,000 vehicles per day and Kingsdale Road has approximately 3,500 vehicles per day at the Kingsdale Road intersection. Installation of a traffic signal and turn lanes are needed to make this intersection function properly. This project received a $300,000 allocation in VDOT's current transportation development plan. A total of $588,000 in additional funding for this project is projected in the second and third years in the current plan. The County, working through the MPO, has provided the necessary funds ($692,000) to advance the project to construction in 2003. Park and Ride Facilities (Countywide) Preliminary engineering is required to identify potential park and ride facility locations. These facilities will be needed in the future to help reduce Countywide traffic congestion. This project is not included in VDOT's current transportation development plan. Remove Tolls on the Powhite Parkway Funding is needed to retire the debt on Powhite Parkway from Chippenham Parkway to Route 288 and allow the tolls to be removed. This project is not included in VDOT's current transportation development plan. High Soeed Rail Stop Funding is necessary to develop high speed rail service in Chesterfield County and the region. This project is not included in VDOT's current transportation development plan. Chippenham Parkway / Route 60 Access The Board provided funds for a land use and transportation plan for the Route 60/Chippenham Parkway area. Additional access to Cloverleaf Mall, from Chippenham Parkway, would be provided by a new Chippenham Parkway Interchange. This new interchange would provide relief to traffic congestion along Route 60 at Chippenham Parkway, improve access to existing development, and provide access to undeveloped land located south of Cloverleaf Mall. This project is not included in VDOT's current transportation development plan. 000 . 5 IATTACHMENTB I Page 4 of 4 I FY05 Regional Financial Planning and Programming Meeting September 25, 2003 I am Arthur Warren, Chairman of the Chesterfield County Board of Supervisors. I appreciate the opportunity to present some of Chesterfield County's primary and interstate road needs to the Commonwealth Transportation Board. For the record, I am submitting Chesterfield County's priority list of highway projects. A copy of the list is attached. In the interest of time, I will only address our highest priorities. Our number one priority project, widening Route 360 to eight lanes from Swift Creek to Winterpock Road, has not been funded for construction. Both the County and the Department have worked towards getting this project constructed to help alleviate congestion along the 360 corridor. The current Six Year Plan designates available funds on this project to construct a short westbound lane section. Right-of-way acquisition and construction for the eight-lane project will be delayed ATTACHMENT C Page 1 of 3 000 6 as funding is not available for completion of the project. The Department needs to provide funds for completion of the eight-lane project in the FY05 Allocation. Route 10 in the Enon area is our second priority project. Route 10 needs to be widened to six lanes from Route i to Meadowville Road. In September 1999, construction plans for the widening of Route 10 from 1-95 to Meadowville Road were approved by the Commonwealth Transportation Board. This project is ready to go to right-of-way and construction if funding was in place. The project could be constructed in phases with the first phase being the section from 1-95 to Ware Bottom Spring Road. The third priority I would like to discuss is the Route 60 Project from Courthouse Road to Old Buckingham Road. This section of Route 60 needs to be widened to six lanes. Traffic volumes on this corridor are already heavy and are expected to increase in the future. Widening of this section of Route 60 should relieve some of the traffic problems we are experiencing on Old Buckingham Road. ATTACHMENT C Page 2 of 3 Finally, the last project I would like to discuss is our fourth priority which is the Interstate 295/Meadowville Road Interchange. Construction of this interchange is needed to promote economic development and prevent unacceptable levels of service on Route 10 and other area roads. The County has completed design on the project and has control of the remaining right- of-way needed for construction of the interchange. The current Six-Year Plan allocated $1.67 million in FY0~ for this project. We would like to thank Congressman Forbes for his efforts in obtaining these funds. Funding for construction of this project should be programmed in the next Six Year Plan. County Administrator: Board Action Requested: Summary of Information: On August 28, 2002 the Board of Supervisors imposed water use restrictions in the County that were subsequently removed on November 13, 2002. At that August meeting, Dick Page requested that the Board also restrict two-cycle engine use on Lake Chesdin to reduce MTBE and TAME residue in the lake (MTBE and TAME are chemical additives to gasoline). In addition, he believes that the water at Lake Chesdin should be treated differently to reduce manganese levels in the water distribution lines leaving the treatment plant. Mr. Page will again address whether the Board should impose use restrictions or treatment changes at Lake Chesdin. Subject: Public Hearing to Consider Changes to the County Code to Allow the County to Collect a Fee to Help Defray the Cost of Operating the County's Police and Sheriff Training Academies County Administrator's Comments: County Administrator: Board Action Requested: Staff requests the Board to hold a public hearing to consider adoption of an ordinance to allow the County to collect a fee to help defray the cost of operating the county's Police and Sheriff Training Academies. Summary of Information: State Code section §16.1-69.48:1 establishes fixed fees to be collected by general district courts in criminal and traffic cases. Each fee is apportioned such that $1.00 is allocated to support regional criminal justice training academies. Effective July 1,2003 State Code section §9.1- 106 was amended to allow a locality to charge a similar fee if they do not participate in a regional academy, but were operating a certified independent criminal justice academy as of January 1, 2003. The county meets this criteria as it operates both a Police and Sheriff certified academy. This ordinance change proposes collecting a $1.00 court fee upon conviction for criminal or traffic offenses in general district courts to support the funding of the county's Police and Sheriff academies. Summary of Information: The FY2004 School Capital Improvement Program totals $24,632,900. Of this amount, $17,162,200 was appropriated by the Board of Supervisors on April 9, 2003 as part of the approved budget. The remaining $7,470,700 is funded through the Reserve for School Capital Improvements (CIP Reserve). The School Board must request this CIP Reserve transfer from the Board of Supervisors. For FY2004, the CIP Reserve amount of $7,470,700 and an estimated $16,369,200 in Virginia Public School Authority bonds are to be used for the following projects: Greenfield Elementary School - $3,707,000; Manchester High School - $4,000,000; replacement and/or repair of major systems at various schools (major maintenance) - $7,325,000; upgrade and replacement of computer equipment - $3,250,000; and the Technology Master Plan - $3,170,300. It is anticipated that the $3,250,000 of replacement computer equipment will be expended this summer and early fall to replace all low-end computers in the system currently running Windows 95 in all of the Standards of Learning labs at elementary and middle schools throughout the system. An additional $360,000 will be used to purchase additional computers for the new Matoaca High School as the second year of the phase-in schedule. The remaining $3,860,700 of CIP Reserve will be used for major maintenance to include roof replacements, replacing carpet with tile in various schools, HVAC upgrades, window and door replacements. The 2002-2004 biennium budget for Virginia includes $793,000 in construction funds. These funds are needed to complete the funding required for the Greenfield Elementary School addition. In addition to the above-mentioned funding sources, estimated interest earnings of $620,900 have been appropriated to pay the arbitrage rebate on the 1998 general obligation bonds ($315,000) and to help offset the first interest payment on the February 2003 refunded debt. Other needs for FY2004 in this area include school construction management charges. The ordinances provide for recovery of costs in the same manner as county taxes are collected. The revised ordinances amend Sections 11-31 and 11-32 of the County Code to provide civil and criminal penalties for violations in accordance with changes in the state code effective July 1, 2003. The civil penalties are $50 for the first violation and $200 for subsequent violations within a 12-month period. The maximum penalty for violations arising from the same facts is $3,000 in a 12-month period. Violations are a class 3 misdemeanor if three or more civil penalties have been imposed against the same property owner within a 24-month period. The $100 civil penalty for failing to keep grass mowed to no more that 12 inches in height in occupied residential property was not addressed by the state code amendments. BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 11-31 of the Code of the County of Chesterfield, 1997, as amended, is amended and re-enacted to read as follows: Sec. 11-31. Unlawful conditions of trash, garbage, refuse, litter and other substances generally. (a) No owner of any lot or parcel of land within the county shall permit trash, garbage, refuse, litter and other substances which are reasonably liable to endanger the health of any person or injuriously affect public health or safety to remain on the lot or parcel. (b) Trash, garbage, refuse, litter and other debris shall be disposed of in personally owned or privately owned receptacles that are provided for such use and for the use of the person disposing of such matter or in authorized facilities provided for such purpose and in no other manner not authorized by law. (b-) (c) Whenever the county administrator or the official designated by him determines that any such unlawful conditions exist, he shall notify the property owner of record of such determination by certified mail, return receipt requested, sent to the address listed in the real estate tax records, requiring such property owner to correct the condition. If the condition is not corrected within ten days after receipt of such notice, the county administrator or his designee may order such condition to be corrected, either by county forces or by a private contractor. The actual cost, together with an administrative handling charge of $15.00, shall be billed to the property owner and if not paid shall be added to and collected in the same manner as the real estate tax on such property. The county administrator or his designee shall certify the costs and 1325(23):62067.1 1 00016 expenses to the treasurer of the county, who shall collect such amount; and if such amount shall remain unpaid for a period of 60 days, then the treasurer shall certify such charges as being unpaid to the clerk of the circuit court of the county, who shall maintain a record book of such delinquent costs and expenses on file in the records of his office. (d) Every charge authorized by this section with which the owner of any such property shall have been assessed and which remains unpaid shall constitute a lien against such property ranking on a parity with liens for unpaid local taxes and enforceable in the same manner as provided in Code of Virginia, tit. 58.1, ch. 39, art. 3 (§§ 58.1-3940 et seq.) and art. 4 (§§ 58.1- 3965 et seq.), as amended. The County may waive such liens in order to facilitate the sale of the property. Such liens may be waived only as to a purchaser who is unrelated by blood or marriage to the owner and who has no business association with the owner. All such liens shall remain a personal obligation of the owner of the property at the time the liens were imposed. (e) Violations of this section shall be subject to a civil penalty of $50 for the first violation, or violations arising from the same set of operative facts. The civil penalty for subsequent violations not arising from the same set of operative facts within 12 months of the first violation shall be $200. Each business day during which the same violation is found to have existed shall constitute a separate offense. In no event shall a series of specified violations arising from the same set of operative facts result in civil penalties that exceed a total of $3,000 in a 12- month period. (f) Such violations shall be a Class 3 misdemeanor in the event three civil penalties have previously been imposed on the same defendant for the same or similar violation, not arising from the same set of operative facts, within a 24-month period. (2) That this ordinance shall become effective immediately upon adoption. 1325(23):62067.1 3 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 11-32 RELATING TO UNLAWFUL CONDITIONS OF WEEDS, GRASS, SHRUBBERY, TREES AND OTHER VEGETATION GENERALLY BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 11-32 of the Code of the County of Chesterfield, 1997, as amended, is amended and re-enacted to read as follows: Sec. 11-32. Unlawful conditions of weeds, grass, shrubbery, trees and other vegetation generally. (a) (1) No owner of any vacant developed or undeveloped property, including property (2) (3) upon which buildings or other improvements are located, within the boundaries of platted subdivisions or any other areas zoned for residential, business, commercial or industrial use in the county shall permit to remain thereon, any grass, weeds, brush or other uncontrolled vegetation in excess of 18 inches in height. No owner of any lot or parcel of land shall permit to grow or remain thereon any hedge, shrub, tree or other vegetation, the limbs, branches or other parts of which overhang, extend or protrude into any street, sidewalk or public alley in a manner which obstructs or impedes the safe and orderly movement of persons or vehicles thereon, or in the case of trees, when the dead limbs or branches thereof are likely to fall into or across such street or sidewalk, thereby endangering such persons and vehicles. No owner of occupied residential real property shall permit to remain on such property or any part thereof a grass or lawn area of less than one-half acre when growth on such grass or lawn area exceeds 12 inches in height. This paragraph shall not apply to land zoned for or in an active farming operation. 000165 1325(23) :62068.1 1 (4) (b) Upon remedying any such unlawful condition, the owner shall dispose of such vegetation in a manner that eliminates any potential fire hazard. Whenever the county administrator, or the official designated by him, has determined by reports, inspections or otherwise, that any such unlawful condition exists, he shall notify the owner of the land upon which the violation exists to cut or cause to be cut the grass, weeds, brush or other uncontrolled vegetation within such reasonable time as is specified in the notice. Such notice shall be in writing, shall be delivered by hand or mailed to the last known address of the owner and shall be complied with by the owner. If such grass, weeds, brush or other uncontrolled vegetation are not cut within the required time, the county official designated by the county administrator shall cause them to be cut and the costs and expenses thereof, including an administrative handling charge of $35.00, shall be billed to the property owner and if not paid shall be added to and collected in the same manner as the real estate tax on such property. The county administrator or his designee shall certify the costs and expenses to the treasurer of the county, who shall collect such amount; and if such amount shall remain unpaid for a period of 60 days, then the treasurer shall certify such charges as being unpaid to the clerk of the circuit court of the county, who shall maintain a record book of such delinquent costs and expenses in the records of the clerk's office.
