Apperson, seconded by kr.Browning, it is resolved that the Executiwe Secretary contact the State Corporation Commission concerning the possibility of getting a gas franchise in parts of the County. On motion of &r. Apperson, seconded by ~'~r. Browning, it is resolved that the following water contracts be and the same are hereby approved: A-267 - Shady Spring Farms A-387 - K~mdale Acres A-55 OC- Cambridge ~19,860.~O 6,720.00 8,065.75 It is here noted that the Commonwealth's Attorney will draft a guarantee to be signed by all of the owners of the Shady Springs Farms Subdivision for the installation of water in stub roads. On motion of Mr. Apperson, seconded by Mr.Browning, it is resolved that sewer contract 6102-3~A in the amount of ~113,666.25 be awarded to Lyttle and Barnes Construction Company and the sum of ~2295.O0 not be assessed the contractor if the job is completed properly and as expeditiously as possible. On motion of I~lr.Apperson, seconded bv Mr. Goyne, it is resolved that the minutes of July t~ and July 29, 1965, be and they hereby are approved as comrected. On motion of Mr. Martin, seconded by Mt. Browning, it is resolved that the right of way Engineer be requested to get a 50-ft. right of way on Monath Road, so that said road will meet the ~equirements of the State Highway Department. ~ On motion of Mr. Britton, seconded by ~%r.Apperson, it is resolved that the subdivider responsible for the drainage in the Barleth Heights Subdivision be requested to purchase a 12" pipe to be installed, free of charge, by the Highway Department at the intersection of Kinsway Lane and Cross Road. On motion of Mr.Browning, seconded by Mr. Goyne~ it is resolved that this Board requests the Highway Department to give sufficient copies of the proposed budgets for distribution to the Board members and the Executive Secretary. On motion of Mr.Browning, seconded by ~r. Apperson, it is resolved that the Board requests the Highway Department to investigate the drainage problem on Mfs.Mann's property fronting on Third Avenue in Ettrick, and report the best possible solutiom to this drainage problem. On motion of Mr. Goyne, seconded by Mr. ADperson, it is resolved that this Board requests the Highway Department to surface treat Jean Drive .2 of a mile on Rt.60~!~ same to be included in the current budget. On motion of I~lr. Goyne, seconded by Mr. Apperson, it is resolved that this Board requests the Highway Department to view Pine Street extended to the home of Mr. Womack, in the Locust Grove Subdivision, and give the County an estimated price to improve said road. On motion of Mr. Britton, seconded by l~r. Apperson, it is resolved that County officials investigate the request for an alley-way between Warwick Road and Lovells. Road, and approve the request of certain citizens in this area for opening this alleyway if possible. On motion of Mr. Martin, seconded by Mr. Apperson, it is resolved that the Engir~ering Department be requested to again review the possible crossing of the Southern RR. to connect Stratford Hills with Bloomfield Road in CrestWoodFarms and to investigate the rights of way and the cost of crossing said Railroad. On motion of Mt.Martin, seconded by Mr.Britton, it is resolved that this Board requeSt the Highway Department to investigate a drainage condition in the rear of Lots 6, 7, and 8, BlockD, Section~ A, Subdivision of Woodmont and to recommend some method of alleviating this condition. On motion of ~r. ~lartin, seconded by Mr.Britton~ it is resolved that the Engineering Department be requested to investigate a drainage problem on the north side of Shoreham Road and east of Rt. 147. On motion of M~r.Goyne, seconded by Mr. Apperson, it is resolved that the Highway Department be requested to install a 24" culvert on the north side of Rt.608, beginning at the western line of Clifford West's property and extending eastwardly to the western ~nd of the eastermost driveway of Fletcher Tyler, and to install a 24" culvert on the southern side of Rt.608, beginning at the western lin~ of the Johnson property and going to the western side of the driveway of Fletcher Tyler. It is here noted that the County is to pay the cost of the culvert pipe to elimina~.e the effects of the deep ditches on both sides of Rt.608 when said road was recently improved. The Highway notified the Board that the following r~ds have oeen officially acce~t~d into the ~tate Secondary System of roads: Victoria Hills Subdivision~ Sections B and D: E~lene Drive - from Route 14&, 0.03 miles north of Route 1548 and running northeastwardly 0.23 miles to a turn around ~iilsmith Road - from Route 15~9, 0.04 miles north of Route 1548 and running eastwardly for 0.13 miles to a turn around Grantshire Road - from a point on Route 1549, O.13 miles north of Route 1548 and running eastwardly for 0.15 miles to a turn around Erlene .go~a~t - from a poiht on Route 616, 0.54 miles north of Route 619 and running westwardly for 0.08 miles to a turn around 0.23 Mi. O.13 " 0.15 " O. 08 ,, Ayrshi re Subdiv i sion: Black Heath Road - from a point on Route 667, 0.55 miles west of Route 727 and running northwardly for 0.33 miles to a turn around On motion of Mr. Horner, seconded by Mr. Browning, it is resolved that the Highway Department be requested to surface-treat one-half mile on Rt.693, beginning at Rt.360 ~nd running southwardly and to surface treat Rt,783, beginning at Rt.360 and continuing southwardly, the total price not to exceed ~3OO0, same to be charged to the 3¢ Road Fund of the County. The drainage problem on Rt.391~. Sher~rook Road, was discussed and it was generally agreed that Mr.R.V.Lancaster, III, Resident Engineer, Virginia Department of Highways, would again view the size of the culvert under this road. On motion of Mt.Martin,seconded by Mr. Goyne, it is resolved that the Highway Depart- ment be requested to surface treat Rt.?8? at a cost not to exceed ~2000 and charge same to the 3¢ Road Fund of the County. Mr. and Mrs. W.T.Henshaw, represented by ~'~r. Jack Armstrong, Attorney, come before the Board seeking aVariance from the subdivision ordinance to allow the construction of a home on a private road leading westwardly off the Harrowgate Road. It was cited that the Board of Supervisors had originally approve~t~is request upon the condition that the Planning Commission would agree to the location of the yroposed road. However, the Planning Commission on studying the proposal and viewing the soil analysis denied the proposed location of a road, making several 'suggestions for possible changes. Mr. Henshaw states that he wants only to build one more house on this property and does not wish to have a subdivision nor provide for one in the future. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Apperson, it is resolved that a Variance from the subdivision ordinance be granted toMr. Henshaw allowing him to construct one dwelling on a private road, provided he agrees to move the road if the Planning Commission insists or meet any other Planning Commission regulations when further development is contemplated, and provided further that the deed from Mr. Henshaw to his son-in-law be reviewed by thai Commonwealth ' s Attorney. ~ It is here noted that ~,~r.Martin and M~r. On motion of Mr. Goyne, seconded by [~'ir.Apperson, it is resolved that the Building Inspector be authorized to issue a building permitif the County Planning Commission agreed to the location of the proposed house. It is here noned that ]~.r. Browning does not vote. 65-50. ~.ir.Garland Do~d comes before the Board requesting the rezoning from ~gricultural to General Business in Bermuda Magisterial District, of a 5.O-acre rectangular shaped parcel of land fronting 522 feet on U.S.Route#l and 301, and extending westwardly 402 feet, being 150 feet north of Sunset ~venue and presently zoned for a depth of 300 feet. It was cited thav vhe Planning Commission recommenc~s approval. Upon consideration whereof, and on motion of Mr. Gpyne, seconde~ by Mr. Britton, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned to General ~usiness 65-52. Mr. J.~'l.~,Nilkinson appears before the Board to request withdrawal of the application for rezoning from Agricultural to Local Business (O-l) in Midlothian Magisterial Disr, ric%, of a rectangular shaped parcel of land fronting 115 feet on Hull Street Roa~ (Rte.360) and ex%ending southeastwardly 322 feet along Tanbark Road, ~rcel being southeast of the intersection of Tanbark Road and Rouve 360. Upon consideration w~her?of, and on motion of Mr .'Britt on , seconded by ~lr. Goyne, it is resolved that this moar~ approves the request to withdraw the rezoning application on the aforedeacribed parcel of land. ~. 65-53. Mr. Linwood Harris comes before the Board representing Mr. Allen G. Witherin~ton, requesting _r_e~zo~n~ng ~n_~nc.heste~r Ma.~,~st~rial District, from Residential-2 to General Bus =~ %~-~ oI ~ rectanguiar shaped ~arcel of land fronting 210 feet on Forest Hill avenue and exter~inz northwardly 85 feet, being 220 feet east of the eastern line of Ohippehham Parkway. It was cited that the Planning Commission had recommended approval of the request subject to the Board of Supervisor2' approval of the plans. ~hereupon, ~ir. Harris presented plans of the propose6 project owned by Brown and Armstrong, Architects, whidah were generally acceptable to the Board. Upon consideration whereof, and on motion of Mr .Brit ton, seconded oy ~'~r. Goyne, it is resolved that the aforedescrioed parcel of land be ~nd it hereby is rezoned for General Busir~ss purposes, and the construction authorized in conformity with the plans filed with the Board's papers. 65-5&. M~. Isiah G.Waller comes Oefore %he Board requesting the rezoninE in Bermuda Magisterial District, from =gricultural to General Business (C-2) of a rectangular sh_~ pa=cel of land 102 feet on Lawing Drive (Itt. 818) and extending westwardly 150 feet, being 275 feet north of the intersection of Route 620 and Rt. 818. It was cited that the Planning ommmss~on had recommended that the rezoning be ~ ' . reduced to a Use Permit for a specific use ?~qaereupon, Mr.Waller states that he is a long-time citizen of the County and wishes %o put in a barber shop and Service Station. Upon consideration whereof, and on motion of Mr. Goyne, seconded bM Mr. Browning, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Business - 65-55. Mr.O.S.Hast[~g2..~ comes before the Board requesting the rezoning from R~e~fi~-~.ti~al-, to General Business in Midlothian Magisterial District, of a a-acre parcel of land of irresular shape, being 325 feet southeast of the intersection of Robious Road and RoUte 60 and 1300 feet northeast of Route 60 with a 695 foot frontage parallel to Route 60 and extending northeastwar~hly 3&5 feet; and also, a &.~ acre parcel of land of irregular shape being 700 feet southeast of the inter- section of Mobious Road and Route 60 and 930 feet northeast of Route 60 with a ~,77 foot frontage parallel to Route 60 and extending northeastwardly &lO feet, the first being for the extension of a proposed trailer park, the second for a sewage lagoon. It was cited that the Plannin~ Commission had recommended approval of this request and on motion of Mt.Martin, seconded by Mr. Britton, i't is resolved that the afore- described parcel of land be and it hereby is rezoned for General Business purposes., 65-56. Mr. Porter Vau~han, having applied previously for the rezoning of the following property: In Manchester Magisterial District, the rezoning is requested from Agricultural to Residential_2 of a rectangular shaped parcel of land fronting 500 feet on West Road and extending southeastwardly 970 feet, being ~11 feet southwest of Turner Road and better known as the proposed subdivision of Belmont Farms. The County Planner noted theft neither ~lr. Vaughan nor Mr.J K.Timmons his representative, could be present, ~*nd ' ' '~%hereas, the Planning Commission had recommended approval of this 'request and there appearing no opposition, it is on motion of Mr.Britton, seconded by Mr. Martin, resolved that the aforedescribed parcel of land be and it hereby is rezoned for Residential-2 purposes. It is here noted tha9 ~'~r. apperson and ~[r. Browning vote "No" since the applicant or representative was not present. 65,57. ~'~r. Fred Gray, representing Mt.William C.Trueheart, comes before the Board requesting the re~oning from ~gricultural to Residential-2 of a Lmrcel of land of iregutar shape, beginning et a point 710 feet north of Castlebury Drive and ex- tending 2160 feet southwardly along the eastern side of Old Centralia Road (Rte.609.) to a point 550 feet sp~uth of '~[oodvale Road, said parcel having a maximum depth of ~00 feet, in Bermuda Magisterial District. The Planning Commission recommended approval. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Yiartin, it is resolved that the aforedescribed parcel of land b~ and it hereby re~oned for Residential-2 purposes. 65-58] Mr.H.O.Browning comes before the Board requesting the rezoning from Agriculture and Residential-2 to General Business (C-2) of an irregul@r shaped parcel of land, fronting 590 feet on the northeast line of Hickory Road (Rte.629) 8~0 feet on the northwest line of ~iverRoad (Rte. 36), 550 feet on the west line of New Road, and 570 feet on the southeast line of Woodpecker Road (Rte.627),with a meandering rear property line to the point of beginning. It was cited that the Planning Commission had recommended approval. ~;hereupon Mr. Robinson, representin~ Campbell Estate raises some objections concerning the notice. Upon consideration whereof, and on motion of Mr.Goyne, seconded by Mr. Martin, it is resolved that this ~atter be def~.rred to August 23, 1965 at 3 :O0 ~.m. 65-i5U. Mr.Thomas C.Spain, Trading as the Chester Cleaners, comes before the Board~ requesting a Use Permit to operate ~ dry cleaning plant on a rectangular shaped parcel of land fronting 50 feet on Center Street and extending westwardly 1~0 feet, being~lSO feet north of Route 10 in'Bermuda Magisterial District. There~appearing no one in opposition to this request, it is on motion of Mr. Goyne, seconded by Mr. Britton, resolved that a U~se Permit to operate a dry cleaning plant on the aforedescribed parcel of land be and it hereby is granted on the aforedescribed parcel of land. 65-16] Mt. Harvey B. Lowe comes before the Board requesting a Use Permit to operate a 30Orfoot tower and associate b'~ildings, on a g-acre p~rcel of land, 'fronting 320 f~eet on a 2C-foot right of way and extending westwaddly ~20 feet. said ~rcel being, located 1250 feet west of a point on Sandy Ford Road (Rte. 669), said point is located 1750 feet southwest of the intersection of Sandy Ford and Little Roads, and b~eing a part of Parcel 74 on Map S~.ction 179 of the current County Zoning Maps,i in Matoaca Magisterial District. There appearing no one in opposition to this request~ it is resolved on motion of Mr. Bro~ning, seconded by Mr. Goyne, that a Use Permit to ope~'ate a Radio Tower on the aforedescribed pa~rcel of land be and it hereby is approved. 65-17U. ~]r. Adam E.Bennett comes before the Board requesting a Use Permit to operate a sign paining shop in a garage, on a ~rcel o{ land of irregular shape, froating 240 feet on Kingsland Road (Rte. 611) and ex~ending southw~rdly 570'feet, being 611 feet west of Dorsey Road (Rt. 162) in Bermuda Magisterial District. Ther.e appearing no one in opposition to this request, it is on motion of Mr. Goyne, seco~nded by ~ir. Britton, it is resolved that a Use Permit to operate a s~gn painting shop~ on the aforedescribed parcel of land be and it hereby is granted. This day the Board considered the request of Pierre C.Warwick and Sarah M.?,~arwick,. his wife, and the Engineering Department of Chesterfield County to abandon a portion of an easement acquired b7¢ the County of Chesterfield by Agreement between Pierre C.Warwick and Sarah ~.Wa~ick, his wife, and the County of Chesterfield, Virginia, dated February 11, 1963 and recorded February 13, 1963 in Deed Book 701, Page 474, in the Clerk's Office of the Circuit Court of ~hesterfield County,Virginia. Now, Theref~re, Be it r~solved, on motion of Mr. Britton, seconded by Mr. Browning: That the Chairman and Clerk of this Board are authorized to execute ahe deed relinquishing .and releasing a portion of the easement granted by the aforesaid instrument, to Pierre C.Warwick and Sarah M.Warw~ck, his wife, and deliver said deed to them. On motion of l~ir.Apperson, seconded by Mr. Goyne, it is resolved that the Treasurer of Chesterfield County be and he hereby is requested to transfer the sum of $55;000.00 from the unappropriated surplus of the Gene~'al Fund to Item 19-601.
