Ao~a rson, Special Water contracts be approved: A-569D - Marlboro, Section "B" A-520F - Meadowbrook, Section it is resolved that the following $11,417.76 6,972.50 On motion of Mr.,kpoerson, seconded by Mr.Goyne, in regular meeting assembled that the Chairman of said Board be and he hreby is authorized to enter into an agreemen.t with the Atlantic Coast Line Railroad Company and to sign aame on behalf of said County, whereby said Railroad Company grants unto said County the right or license to install and maintain, for the purpose of a water main, a line of 12-inch cast iron pipe attached to an overhead highway bridge on Dundas Road over said Railroad Company's right of way and tracks at Bellbluff, near Richmond,Richmond; as more particularly described in said agreement, which a~reement, is dated Septe~nber 22; 1965, a copy of which agreement is filed with this Board of Supervisors. On motion of iCr.~lartin, seconded by Mr. Anpe rson, it is resolved that Sewer Contract 6531-D for the installation of sewers in Dwayne Park, Section 2.~ be and it hereby is approved. On motion of ~.Apperson, seconded by Mr.Browning, it is resolved that the contract for the installation of sewers in German School Board, No.6102-26A, be awarded to the lowest bidder, which is apDrently the Van Dor~,n Bros., who submitted a bid of $30,445.85, which award is subject to the approval of the Consulting Engineers.~ On motion of Mr.Apperson, seconded by Mr.Goyne, it is resolved that the contract between the Southern Railway Company and the County of Chasterfield for the installation of a 36" sewer main under the Southern Ry. Company's tracks approximately 50 feet east of the Powhite Creek, be aoproved and the Chairman and Clerk of this Board are authorized to sign said contract. On motion of Mr.Apperson, seconded by I',lr.Browning, it is resolved that Mt. Charles Quaiff be authorized as Agent of the County to release utility liens. Mr.N.H.Graves comes before the Board citing the fact that he has paid $500.00 for a sewer connection under some protest and req~ests the County to reimburse him $300.00. Upon consideration whereof, and on motion of I~ir. Goyne, seconded by R'lr. Martin, it is resolved that this ~atter be continued to further study. The County Engineer presented a proposed street name map which was printed in larger print with inserts from the built-up areas, and it was generally agreed that this was a marked improvesent over the existing County maps. There was cited the fact that the Highway Department had accepted .79 of a mile of a new road, the same being a short-cut on Rt.621. On motion of Mr.Apperson, seconded by M~.Browning, it is resolved that the Virginia Departmen~ of Highways is hereby requested to take into the Secondary System of roads, roads in the Shenandoah Subdivision. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Orange Bill .avenue in Orange Hill Subdivision, Matoaca District, Chesterfield County, Chesterfield, Virginia, which shows that in the opinion of the Ccunty ~Qoad Engineer it is expedient that said road be established as a public road. Upon consideration whereof, and on motion of kr. Browning, it is resolved that 0range ~ill Avenue in the subdivision of Orange ~-iitl, ~.'iatoaca Dist~ct, be, and it hereby is established as a publi¢ road. And be it further resolved, that t~e Virginia Department of Highways be and it hereby ia requested to take into the ~econdary Road ~ystem, orange Hill Avenue~ beginning at a point on Rt. 1145, .O~. miles south of Rt. 11~.6 amd extending southwardly ,04 miles to Rt. 1113. T~is road serves 3 houses. And be it fl~rther resolved~ that the Board of Supervisors guarantees t~ the V±rg~nia Department of~ Highways right of way of not less than 5~ feet for this roa~. Upon consideration whereof, and on motion of Mr. Martin, ~t is resolved that Swanag~ Road, Stanmore Road, Stanmore So~uare~ Stanmore Place and Stanmore Court, in the subdivision of Shenandoah, Section "B"~ in Midlothian District, be~ and they hereb~ are established as public roads. And be it furthe~ resolved, that the Board of Supervisors of Chesterfield County guarantees to the Virginia Department. of Highways, rights of way of not less than 50 feet on Swanage Road, Stanmore Road, Stanmore Place and Stanmore ~ourt, and 100 feet right of way on Stanmore Square. Subdivision recorded in Plat Book Pages 79 and 80,on July This day t~e County Road Engineer in accordance w~th directions from this Board made r~port in writing upon his examination of Tuxford Road, Knightbridge Road, Stanmore Road, Swanage Road and Highgate Road in the Subdivision of Shenandoah Section "A", Midlothian District,which shows that in the opinion of the County . Road Engineer, it is expedient that said road~ be established as public roads. Upom consideration whereof, and on motion of Mr.Martin, it is resolved that Tuxford Road~ Knightbridge Road, Stanmore Road, Swanage Road and Highgate Road, in the subdivision of Shenandoah, Midlothian District, be, and they hereby are established as public roads. And be it further resolved, that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System, Tuxford Road, beginning at a point on Rt. 60~ .18 miles west of Rt.672, and extending southwestwardly .~0 ~iles; Knightbridge Road~ beginning at a point on Tuxford Road .16 miles southwest of Rt.60 and extending northwestwardly .04 miles to the property line and southeastwardly .08 miles to Swanage Road; Stanmore Road~ beginning at a point on Tuxford Road .27 miles southwest of R~.60 and e, xtending southwardl~ .10 miles; Swanage Road, beginning at a point on Knightbridge Road .08 miles south- eastwardly of Tuxford Road and extending southwestwardly .10; Highgate Road~ beginning at a point on Stanmore Road .O? miles south of Tuxford Road and extending 'eastwardly .13 miles to Swanage Road. These roads serve 29 homes. And be it further resolved~ that the Board of Supervisors of Chesterfield County guarantees t~ the Virginia Department of Highways, rights of way of not less than~50 feet ~n Knightbridge R~ad, Stanmore Road, Swanage Road and Highgate Road and 60 f~et on Tuxford Road. Subdivision recorded in Plat Book 14, page 2A., on September !$ 1964. There was discussed briefly the hearing on October 26~ 1965 of the Interstate Rt.295 and it was generally agreed that the County would be represented by all Supervisors who could possibly go. On motion of Mr.Martin, seconded by Mr. Apperson, it is resolved that the A~reemen~ between the State Highway Department and the County of Chesterfield'would provide for the duties of each party to the contract in the raising of certain roads and maintenance of road improvements be and it here~y is approved and the Chairman and Clerk of this ~oard are hereby authorized to si~n said Agreement. On motion of Mr.Apperson, seconded by Mr. Browning, it is resolved that this Board requests the Highway Department to clear the right of way and install a culvert at the intersection of Stratford Road and the Southern RR. so that the County may begin the fill of this property incident to constructing a grade crossing and to charge the cost attendant to this work ~o the 3¢ Road Fund of the County. There was read two letters involving t~he rejection of the Board's request for traffic lights at the intersection of uford Road and Forest Hill Avenue, Cherokee Road and Rt. lg7 and Che~kee Road and ~orest Hill Avenue. On motion of Ylr.Martin, seconded by Mr. Goyne, it is resolved that the Police Department be requested to temporarily post a Police Officer at the intersection or Rts. 892 and 147 and Buford Road and Forest Hill 2venue during peak hours to ascertain Zhe effectiveness of traffic control. On motion of Mr. Apperson, seconded by Mr. Browning, it is resolved .that this Boardi rescind t~e action taken on Frontier Drive on September 29, 1959, smnce said right of way has been abandoned. On motion of i~ir.A~person, seconded by Mr. Browning, it is resolved thav this Board · requesEs the Highway Department to take into the Secondary Roa~ Sysx;em, .06 of a mile on Frontier Drive, the same being the northwest 5© feet of an 80-ft. right of way, is recorded in Plat Book 10, Page 30. On motionof Mr. Goyne, seconded by ~tr. Browning, it is resolved that the Police Department in conjunction with the Highway Department investigate the parking problem at the intersection of RtS. 10 and 1~ and to report the results of s~ch investigation as soon as possible. The matter of s~dewalks on Osborne Road, Old ~entralia Road and Enon Road a~ain comes before the Board and on motion of Mr. Goyne, seconded by }f~.ADperson, it is resolved that the entire Board view the locations in the County at wh~dn sidewalks have been requested. On motion of l¥~r. Browning, seconded bv ~r. Amperson, it is resolved thav the Highwa~ Department be and it h~.reby is requested to take into the S~condary System of roads a short section of Orange Hill A~ene in the Village of Ettrick. (See page 2&l) Mr.Edwin' Gregory comes before the Board complaininK about the procedure of cutting off water service to force the payment of delinquent water bills; however, no action was taken on this matter. ~'¢.R.R.Harweli comes before the Board questioning the County's sewer connection fee reouest for this store on Center Street in Chester. Whereas, there seems to be ~ome misunderstanding, it is on motion of Mr.Goyne, seconded by Mr.Browning, resolved that this matter be delayed for further investigation. Mr. William R.Shelton and i~r. David Meade ~'~ite, representing the Chesterfield- Colonial Heights Bar Association, come before the Board citing the fact that both the Circuit and County Courts have an expectionally heavy case icad and that it seems apparent that additional judges will be required in the rear future. Upon consideration whereof, and on motion of i~ir. Goyne, seconded by [~ir. Apperson, it is resolved that the Chairman appoint a Commit%Ce to meet with a Committee from the Bar Association to discuss the need for additional facilities. The Chairman after consideration agreed to appoint said 'Committee within a few days. This day again the matter of the Taxicab Ordinance was again discussed and all questions concerning the ordinance s eemedt0 have been resolved with the exception!~l of the insurance demands. Upon consideration wher~of, and on motion of Mr. Apperson, seconded by Mr.Browning,~ it is resolved that this rotter a~ain be discus~ed.~.. on November 10, 1965. 65-62. ~'~essrs. Clavis and George Smith, representing the Regola Land Corporation, come before the Board, requesting the rezonzng ±'~mm ~'~.grxcultural to Resmdent~al-m of a 21-acre parcel of land of irregular shape, fronting 1261 feet on Ecoff ~¥enu~ and extending northwardly 977 feet, and its western boundary being 865 feet alongi! an existing branch, said parcel being 1~5 feet west of the Seaboard Air ~ine Railroad crossing in Bermuda Magisterial District. It wa.~ cited that the Planning Commission had recommended approval and t~ere appearing no one in opposition to this request, it is on motion of Mr.Apperson, seconded by ~;~r.Browning, resolved that the aforedescribed parcel of land be and ii~ hereby is rezoned to Residential-2. 65-6~. Mr.L.A.McDonald comes before the Board requestin~ the rezoning fr~m Agricultural to General Bu,~imess (G-2) of a rectangular shaped parcel of lamd, fronting 70 feet on Route 60 and extending northwardly 768 feet, being 1~6 feet east of the center line of Turner Road extended, in Manchester Magisterial Distri There appearing no one in opposition to this request, it is on motion of Mr.Marti seconded by Mr. Amperson, resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Business with the stipulations recommended by the Planning Commission, that no junk yard will be permitted on this land. 65-65. [~lr. Carlton Schmidt, representing the Southern Bank and Trust Company comes before the Board requesting the rezoning from Residential-? to General Business (~-2) of a parcel of land of irregular shape fronting 93 feet on Brandon Ro~d and extending northeastwardly 180 feet at its furtherest point, bein~ approximately 570 feet southeast of the intersection of Brandon Road and Belt Boulevard, and better known a.~ 1~3 Br~ndon Road, in Manchester Magisterial District. There appearing no one in opposition to this request, and the Planning Commission having recommended approval, it is on motion of Mr. Browning,~.i seconded by Mr. Apperson, resolved that the aforedescribed parcel of land be and it hereby is rezoned to General Buainess. 65-67. Mr.A.L.Huband,~r., comes before the Board requesting the rezoning from Residential-2 to General Business (C-2) of a rectangular shaped parcel of land fronting 90 feet on Route lO and extending eastwardly 145 feet, being approximately! 325 feet south of Eppe~n Avenue in Manchester Magisterial District. ivir. Huband cites the fact that he will accept a C-1 zoning as recommended by the Planning Commission. Mr.Mundry Dillard states that he opposes the Local Business zoning, but would approve a Use Permit for doctors' offices. Mr.Frank Sullivan and others who live to the east of the requested rezoning oppose the request. - Upon consideration whereof, and on motion of Mr. Govne, seconded by }~r.Browning, it is resolved that the aforedescribed parcel of land be and it hereby is rezoned to Local Bus~ness. 65-68. R'[r. James A.Saady comes before the Board requesting the rezoning from aKricuttural to General Business (C-2) of a rectangular shaped parcel of land fronting 105 feet on Coxendale Road (Rt. 615) and extending 625 feet in a southwardly direction, being 250 feet east of the right of way line of 5oute 95, Richmond-Petersburg Turnpike in Bermuda Magisterial District. Mt. Seedy states he has no objections to any future industrial zoning in the area. Upon consideration wkereof, and on motion of Mr.Goyne, seconded by Mr. Brovming, it is resolved that the aforedescribed parcel of land be and it. hereby is rezcned to General ~usiness. 65-69. I'~r.R.P.Sowers, representing Toddsbury Land Corporation, comes before the Board requesting the rezoning from Agricultural to General Business (C-2) of a rectangular shaped parcel of lane fronting 557 feet on Hopkins Road, and extendingi eastwardly 900 feet, its northern boundary being a branch which is the so~,thern right of way line of Route 892, and its southern boundary beinK the northern right of way line of the proposed Meadowbale Bo~levard in Dale Magisterial District. Mr. Sowers explains generally the proposal .of the business area and presents )~r. George Wilson, Land Planner, who explains the unique design of the proposed business area. ~'ir.P.L.Travis, Commercial Realtor, explains why he thinks the [lan justified the z oni ng. Mr.Ed Grigg, President of the Toddsbury Corporation, states that his company will install curbs and gutters, sewers and water, and will build the shopping center at a cost of ~1,225,000 to $1,500~000 and c~tes further that his Company will give the land and possibly some money toward building a public Library in the area~ ~.Grigg presented a petition si~ned by 205 people in favor of this zoning. Mr. Berkley and Mr. Moore, who live in Meadowbrook, speak for the zoning. Mr. Sidney Floyd speaks for the zoning. Mr.Fred Gray, Attorney, for the opposition presented a petition signed by 219 resident~ who live in close proximity to the requested rezoning, who are opposed to the zoning request and states that the Board of Supervisors has met the need for business zoning in the area; that the County should not be misled by fancy plans or f~oled by the gift to the Library. Dr. Kubu, resident of M~adowbrook, speaks against the rezoning. Twenty-four people appear in protest. i~'~r.Apperson states that the persons across the street who are opposed to this zoning may be the least affected in that the value of their land may be raised considerably, that there seems to be more than adequate business already constructlad in the area and several parcels zoned on which stores have not been built Mr. Goyne states that the Board should not be concerned with the economics of this i~ situation, that the Coumty ~hould support the construction of such a shopping c e~ er. Mt. Browning corrects the impression gives that he voted favorably on this matter at the Planning Commission meetin~ and stat=s he did not vo%a~.~ at that time. Mr. Apperson states that there is great need for an overall land-use plan which should be followed insofar as possible sn that the citizens of the ~ounty may hav~ some assurance of a business which will ultimately be. Upon consideration whereof, and on motion of R~r. Apperson, seconded by Mr.Browning, it is resolved that the request for rezoning of this property be denied. It is here noted that Mr. Goyne votes No. 6~.-70. Mr.R.P.Sowers, representing the Scott Realty Corporation, comes before the Board seeking the rezoning from Agricultural to Residential-2 of an irregular shaped parcel of land beginning at a point on the eastern line of Dalebrook Road 210 feet south of Route 892 right of way line and extending southeastwardly 2994 feet along Dalebrook Road to the intersection of Dalebrook and Beulah Roads, s~id parcel also having a frontg~e of 16)5 feet along Beulah Road, its northern boundary being the northern line of the proposed Meadowdale Boulevard in Dale Magisterial District.
