Young Old Gun Acres 32.00 County Garage: 9/15/~6 Dept. of Public Welfare Gas, ~, etc. lll.51 On motion of Mr.Britton, seconded by Mr.Martin, it is resolved that the plans, spec~ifications and layout of the Colonial Motor Freight Line at the intersection of T~urner ~oad a~d Rt.360, be approved, subject to the following conditions: (a) .That an erosion controlled ditch be constructed on the western property line. (b) That an 1S-ft. widening strip be dedicated along Turner Road (c) That the northeast corner of the property willbe so graded that the drainage will run towar~ Turner Road. (d) Tk~at~ the plans be at.:proved finally bv the Supervisors of the District. On motion of Mr. Britton, seconded by Mr.Ap~erson, it is resolved that ~gater contre~t C-&23 for the installation of a 12" water line between Brookbury and Wilkinson Terrace be awarded to the Halifax Builders who submitted the base bid of ~816.OO with the total bid on the contract for rock and materials expected ~o be $13,611.5~. There arose a brief discussion on the feasibility of putting fire hydrants in Bellwood Manor at the County's expense or requesting the citizens of the area to pay one-half,, which is the present policy. This matter was held for further inve stigat ion. On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that four pesple from the Engineering Department be authorized to attend the American Water ".forks Association meeting in Arlington, Virginia. On motion of Mr. Britton, seconded by Mr. Apperson, it is resolved that the bill from R.Stuart Royer in the amount of ~5969.00 for engineering services on the Hollandale drainage project be approved for payment. On motion of Mr.Britton, seconded by Mt. Browning, it is resolved that the followi~ ordinance be rand it hereby is approved: AN ORDINANCE to ~acate an unimproved 30-foot road at the eastern end of Cloverdale Subdivision, recorded in Plat Book ~, pages 34 and 35, and shown on plat made by J.K.Timmons & Associates dated August 12, 1966. WHEREAS_ Phil-Bob Corporation has petitioned the Board of Supervisors of Chesterfield County to vacate an unimproved 30-foot road at the eastern end of Cioverdale Subdivision, recorded in Plat Book 8, pages 3S and 35, and shown on plat made b~.- J.K.Timmons & Associates, dated August 12, i966, and notice of the adoption of such Ordinance has been given in accordance with Section 15.1-~31, Code of Virginia, 1950 as amended; NOW, THEorEm'ORE, BE IT ORDi~ii\ED i3Y THE ~0~ O~~ S~:~iVI~O~S O~~ T~E CO~NTY OF CHESTE~'I~D, ¥IRGI~i~: 1. There arose a discussion concerning the movingof the Hat, ca signs. Mr. R.V. Lancaster, Resident Engineer, Virginia Department of Hi~-ihways,a~tempted ~o explaim why these signs were relocated. Upon consideration whereof, and on motion of Mr. Browning, seconded by Mr.ADperson, it is resolved that the Executive SecretarM be requested to write ~ letter to ~'~r. L.R.Treat, District Engineer, of 'the Highway Department, requesting him to move the signs to their original location of a ~e~ months ago. On motion of Mr.BrZtton, seconded by Mr.Apperson, it is resolved that ~he County investigate the drainage situation in the Warwick Acres Subdivision. On motion of Mr. Goyne, seconded by Mt. Martin, it is resolved that this Board authorizes t~e Highway Department to use the widening strip on the northwest side of Osborne Road for the purpose of installing a sidewalk. On motion of Mr. Goyne, seconded by Mr]Britton, it is resolved that this Board requests the '~hief 6f Police to investigate the excessive speed of automobiles on Osborne Road. M~. R.V.Lancaster, III, Resident Engineer, Virginia Department of Highways, advised by letter that the road and bridge s~ecifications had been revised, effective O~tober 1, 1966. On motion of Mr. Goyne, seconded by Mr.Browning, it is resolved that the Highway Department be and it hereby is requested to give an estimate of the cost of improving Ida Avenue in the Searcy Subdivision. On motion of Mr.Browning, seconded by Mt.Martin, it is resolved that the Executive Secretary be authorized to write to the Judge of the Circuit Court requesting that the voting place in Matoaea Precinct be moved from the Matoaca School to the Fire House. The Board agrees to receive the salary and expense requests for the Co=~nonwealth's Attorney's office and the Office of the Commissioner of the Revenue. On motion of Mr.Britton, seconded by Mr. Apperson, it is resolved that the fol!owilng request for street lights be referred to the Street Light Committee: Intersection of Rt.620 and Route #1 Route 618 and Route #1 The Tyler Technical College Arcadi'a Street and Warwick Road North end of Warren Avenue The Church property in Midlothian It is here noted that October 2~ at 7:00 p.m. is the time agreed upon for a meeting of the Street Light Committee. Mr. Thomas Winston and approximately 30 people appear to request the elimination of the Business and Professional License Tax and present a petition with approximately 100 names in support of their request. Mr.Winston states that there was an implied promise o6 the part of the Board to eliminate this tax if the Sales T~x were imposed; that business men have to pay a Sales Tax and the red tape involved in Collecting the SalesTax was quite burdensome; that such a tax was unfair to be based on gross receipts and that the tax had no relation to profits. Mr. Edwin Gregory, Mr.H.R.Harwell, Mr. Henry Williams, Mr. Peyton Goodall, Mr. R. %;. Sandrid~e, Mr.Custis Cline, Mr. Garland Dodd speak in favor of the elimination or this tax. ~'lr.Cha]r~es Kelley states that he has been in the County for ten years and is against the reduction or elimination of these taxes and the County will need more money for education purposes, that merchants in the County are taxed much less in license taxes than merchants in other localities and that merchants should not want to promote the idea of featherbedding. Mr. Oates ~cCullen states that most of .the money collected from the Business License tax comes from foreign concerns doing business in chain stores in Shopping Centers. Dr.W. Massey, Jr., Mrs. L.E.Armstrong,and Mrs. John Gordon raise various points to tie effect that the tax should not be reduced or eliminated at this time. I~'h~.Apperson states that since all of the problems here discussed were caused by the Sales Tax that he would like to record his wishes to eliminate the 1¢ County Sales Tax. Mr.H,T.Goyne says he was not the instigator of the petition and points out t?at since the County has a surplus at this time that the entire tax should be elimina ted. The Chairman states that the Board would consider the arguments and will most likely introduce an Ordinance on October 27, 1966. On motion of M~.Hornerj seconded by Mr.Britton, it is resolved that Shoosmith Bros. be authorized to deepen the Hancock tract north of Genito Road on the Swift Creek Reservoir, at a cost of ;$28~0OO, one-half to be borne by the County and one-half by citizens of the area. 66-70. ~r. Graham Jennings, comes before the Board representing Amos and Agnes C- Dudek . requesting, the rezoni, ng from Residential-1 to Local Business (C-I) of a rectangu- lar shased parcel of land fronting 220 feet on Forest Hill Avenue and. extending ~50 feet in a northwestwar~ly direction, being 790 feet west of Kenmore Road in Manchester Magisterial District. Mr. G. Richard Brown, Architest, presents plans for the construction proposed. Mr. C. B. Marcuson states that he built his home in 1945, that such a use of the land adjacent which depreciate the value of his home to a great degree. Mr. and Mrs. Leo Sledd sneak in opposition. It was cited that the Plannin~ Commission had recommended disapproval. Upon consideration whereof~ and on motion of Mr. Britton, seconded by Mr. Martin, it is resolved that this matter be deferred for thirty (30) days in order to evaluate further the possible damazes and the necessity for such a use. 66-71. Mr. DelMonte Lewis comes before the Board reoresenting Mr. Wallace H. LaPrade, reouestin.z the rezoning from A~ricultural to Residentia~-I of a 5-acre parcel°of land of irregular shaoe, fronting 260 feet on Providence Road (Rte. 678) and ~x- tending eastwardly 10%0 feet, being 1500 feet south of the intersection of Hicks Road and Providence Roa~, in Manchester Magisterial District, and whereas the Planning Commission has recommended aooroval and there being no opposition, it is on motion of Mr. Britton, seconded by~r. Martinj resolved that the aforedescribed parcel of land be and it hereby is rezoned to Residential-1. 66-7~. Mr. Sidney L. Bollinger comes before the Board requesting the rezoning from Agri- ~ cultural to General Business (C-2) of a parcel of land of irregular' shape frontingl 159-1/2 feet on Hopkins Road and extending eastwardly 200 feet, said oarcel also fronting 200 ~feet on the south l~ne of Kingsland Road, being southeast of the intersection of Kingsland and Hopkins Roads, in Dale Magisterial District, and states that he has sold three lots to builders and cannot disoose of the lots in question for residential purposes. Mr. Gene Davis, Mr. Elliott and Mr. Louis Wheelhouse, speak in opposition to the prooosal and oresent petitions signed by some 80 families requesting that the rezoning be denied. It was cited that the Planning Commission had recommended disapproval. On motion of Mr. Apperson, seconded by Mr. Martin, it is resolved that the recom- . mendation of the Planning Commission be approved and that the request of Mr. Bollinger be denied. 66-73. Mr. William S. Smithers, representing Mr. Edward M. Ciejek comes before the Board requestin~ the rezoning from Agricultural to General Business (C-2) of a rectan- gular shaped parcel of land fronting 720 feet on Route 60 and extending southward-li ly 250 feet, its western boundary being Pocono Drive, in Midlothian District, and states that the Plannin~ Commission was in error when it recommended that the [ requeste~ rezoning be denied, that in truth this was the only use available for the property. Upon consideration whereof, an~ on motion of ?Ir. Martin, seconded by Mr. Goyne, it is res~ad that this matter be delayed to October 27, 1966 so that the Board will Bave time to view the nro~erty again. 66-76. Mr. Graham Jennings, representing the Mercer Cabinet Company, Inc., comes before the Bozrd requesting the rezoning from Residential-2 to Industrial (~) of a 2.9 acre parcel of ~and fronting 217 feet on the north line of Falling a - ~reek Avenue and also fronting ~93 feet along the eastern line of the Atlantic Coast Line Railroad, its eastern boundary belng the rear lot of those lots in Falling Greek Subdivision fronting on Rogers Avenue, said parcel presently zoned Industrial for an average dept~ of 1~O feet east of t~e A.C.L. Railroad in Manchester Magisterial District. ..'~r. JenninTs stated that the requested use of the prooerty would not affect anyone adversely and it was cited that the Planning CommiSsion had recommended that the request Be reduced to a Use Permit for the specific use of a cabinet shop. Whereupon Mr. Jennin.~s objected to the reduction and al'tar considerable discussion it is on motion of Mr. Britton, seconded by Mr. GoMne, resolved that the afore- described .property be and it hereby is rezoned for Industrial ~urr~oses. subject to the layout, ingress and egress, to be a~roved by the Board~of ~ ' ' ' . ~uperv~sors. Mr. Graham Jenninps, representin~ the Thurston i~otor Lines, Inc., comes before the Board requesting the rezoni~ from multi-family to General Busi~'~ess~. Mr. Pred Gr~~,~ representing Mr. G. Dallas Coons comes before *~h~ Board requesting the rezoning from Agricultural to Industrial (M) of a 50C-acre parcel of land of irregular shape ~aving a total broken frontage of 6975 feet along Bermada Hundred Road (P[te. 61~) and extending northwardly approximately ~800 feet to a frontage ,cad (t~te. 619} and ~00 feet north of the intersection of f~outes 618 and ~27 in Bermuda Magisterial District,- and there appearing no one in o~position to this request, an~ the Planning Commission havin~ recommended ap~rovai, it is on: motion of Mr. Goyne, seconded by ~.~r. A~erson, resolved that the aforedescribed' parcel of land be and it hereby"is rez~ed fo~ Industrial use. 66-16U. Mr. Norman D. Davis comes before the Board reauesting a Use Permit to ooerate a Camping Ground. for tents and campers on a 72-~cre parcel of land of irregular.shape, bein~ .....approximately 2~00, feet southwest of the intersection of z~ou~s ''~ ~ 653 and 65~, and 2050 feet southw8st of the intersection of Third Branch Creek and Route 65.3 c~ a private, unimproved road and being parcels 1~, !4-1 and 15 on tax map section 92., in Clover Hill ?"~agisterial District. ' There appesrin~ no one in opposition to this request, it is on motion of Mt. Hornet, seconded by Mr. Browning, resolved that a Use Permit be ~ranted to ~4r. Davis on the aforedescribed parcel of land for the purpose of operating a ca.nping ground. 66-t7U. Mr. E. M. Berryman, representing the Eastern Auto Distributing, Inc., comes before the Board requesting a Use Permit to operate a tire service and recapping shop on a rectangular shaped parcel of land fronting 150 feet on Hull Street-~oad (Rte. 360} and extending northwestward!y 192.01 feet, being approximately 700 feet. southwest of Warwick Road and shown as Parcel 17 on tax map 30-2, in Ma~chester Magisterial District, and states that there will be no odo~ nor pile of tires generally attendant to such a use. Mr. Luther Caudle and Mr. Walter Casen voice no objection if certain orovisions are made. ' Mr. and Mrs. Everett P. New, adjacent land owners, request the Board to turn down the rezoning request. Upon consideration whereof, and on motion of t,.~r. Britton, seconded by Mr. Browningl, it is resolved that a Use Permit be granted on the aforedescribed marcel of land f~r the purpose of o~erating a tire service and recapping shop, provided, no tires will be displayed on the front of the ~ro~erty except for a small amount placed in racks and that there be no stacks o~ tYres noticeable nor offensive odor emanating from the proposed use of this property. Mr. High comes before the Board seekin~ some relief from the construction of Sykes Road in Bon Air Manor. On motion of Mr. Martin, seconded by Mr. Goyne, it is resolved that ~his Board pay the $!000.00 cost for constructing approximately 300 feet of Sykes ~oad in the Bon Air Manor Subdision. Mr. and Mr Wade, owners of a trailer on Lots 4 and 5 in Chesterfield Manor Subdivision comes fefore the Voard requesting a Variance to allow the construction of a p~rch on to their trailer. Whereupon, Mr. Goyne reports he has investigated this request and on motion of Mr. Goyne, seconded by £~r.-Britton, it is resolved. that a Variance be granted to Mr. and Mrs. ~ade to allow the construction of a porch on to the existing trailer at this location. Hornet heretofore duly qualified as a member of the Board of Su~ervisors~. of the County of Chesterfield, V'~rg~n~a,' ' · and is presently serving as such; and WHEREAS, the prior qualifications of irvin G. Horner as a Supervisor as aforesaid is a bar to his qualification as a Director of the Richmond Metropolitan 'Authority; and WHEREAS, as a result 5f the foregoing, a vacancy exists on the Board of Directors of the Richmcnd Metropolitan Authority which is required by law to be filled by the aooointment of the Board of Supervisors of Chesterfield County, Vi~Kinia; NOW, THFJiEFORE, BE IT 2ESOLVED: That C. PORTER VAUGHAN be, and he hereby is appointed as a Director of the Richmond Metropolitan Authority to fill the vacancy created by the failure of the said Irvin G. Homer to qualify an~ to serve the remainder of t~e four year term tc which Irvin G. Homer was heretofore a~pointed, such term having commenced on Julyl, 1966. Britton, seconded by Mr. Apperson, it is resolved that the following sewer contracts be approved: S-65-~2D - Chatham, Section "Bt' S-66-48D - McLean Trucking Company On motion of Mr. Martin, seconded by Mr. Apperson, it is resOlVed that the County Engineer be authorized to install a 36" sewer main in Oxford Parkway instead of the temporary plan suggested. This way the County Road Engineer in accordance with directi~.~ns frcm this Board made report in writing upon his examination of Young Manor Drive and Shore Drive in Old Gun Acres Subdivision, Midlothian Magisterial District, which shows that in the opinion of the County Road Engineer it is exoedient that said roads be established as public roads· ~ Upon consideration whereof, and on motion of Mr. Martin, it is resolved'that Young Manor Drive and Shore Drive in Old Gun Acres, Midlothian District~ be and they hereby are established as public roads. And be further resolved, that the Virginia Deoartment of Highways be and it hereby is requested to take into the Secondary Road System, Young l~anor Drive, from a point on Rt. 673, approximately 1.2 miles north 8f.its intersection with Rt. 711~ eastwardly approximately .09 mile to the intersection of Shore Drive, thence eastwardly .25 miles to a cul-de-sac: Shore Du' · ~lve, from a mount on Young Manor Drive .09 mile East of its intersecti6n with kt. 673, northwardly and eastwardly approximately .~2 miles to a cul-de-sac These roads serve 2 houses. And be it further resolved, th@t the Board of Supervisors guarantees to the ¥irzinia Department of Highways, 50-ft. rights of way for these roads. This day the County Road Engineer in accordance with directions from this Board made re~ort inwritin~ u~on the examination of Cheyenne Road and A~a~he Road in the Huguenot Farms Su6division, Section 6, Midloth~an Magisterial ~istr~c~, which shows that in the o~inion of the County Road Engineer, it is expedient they said roads be establishe~ as ~ublic road~. Upon consideration whereof, and on motion of Dr. Martin, it is resolved tha~ Cheyenne Road and Apache Road in the Huguenot Farms Subdivision, Section 6, in Midlothian District, be and it hereby is established as public roads. And be it further resolved, that the Virginia Department of Highways be an~ it hereby is requested to take into the Secondary Road System, Cheyenne ~oad from the intersectio~ of Rt. 1791 and ~t. 1~9~ southwardly .12 of a mile to existing maintenance on Rt. 189~; Apache Place, from a point on Rt. 1791, .02 of a mile west of its intersection with Rt. 1~99, southwardlM .05 of a mile to a cui-de~$ac.~ And be it further resolved, that the Board of Supervisors guarantees to the Virginie Department of Highways a 50-f~ right of way for these roads.
