PROPOSAL
The applicant has been parking a single item of recreational equipment on his property since 2012
without the required zoning. The recreational equipment, a motor home, is parked on the gravel
portion of the existing driveway within the front yard. In June 2015, the Planning Department
received a proactive enforcement complaint relative to the parking of the recreational vehicle
within the front yard of the property.
The Zoning Ordinance permits the parking and storage of recreational equipment within a
residential district with certain restrictions:
No more than 2 items of equipment permitted to be stored outside of an enclosed
building
Equipment is located in the rear yard with minimum setbacks from the rear and
side property lines
Except for repair, wheels on the equipment are not removed
Equipment is not used for living or commercial purposes; and,
Equipment is not connected to utility services.
These ordinance restrictions are designed to minimize impacts of larger vehicles and equipment
on area residential development and the streetscape. If any of these restrictions cannot be met,
the use may be allowed by conditional use.
The applicant’s recreational vehicle complies with theordinance restrictions except that the
vehicle is parked within the front yard in the applicant’s driveway. Therefore, the applicant is
seeking conditional use approval to permit parking of the recreational equipment at his residence.
The following provides an overview of conditions that may reduce the impact of this use at the
requested location on area properties.

ALTERNATIVE PARKING & STORAGE LOCATION
Uponinspection of the property, staff determined that no practical alternate location for on-site
parking of the recreational vehicle exists. The property slopes to the rear (approximately 15%
slope) where a utility easement and creek are also located. Significant grading and other
improvements (such as a retaining wall) would be required to locate the vehicle in the rear yard in
compliance with the ordinance or in the side yard,as an alternative parking area.

The subject site is located in the Eastern Midlothian Turnpike Special Focus and Gateway
Revitalization Area, as denoted by Chapter 7 of the Comprehensive Plan, and the Providence
Middle School revitalization area identified as part of the county’s school-based revitalization
efforts. The Revitalization Office supports development in revitalization areas that represents a
substantial improvement above current conditions. The proposal represents a minor change of
use, without apparent site or building improvements. The Revitalization Office has no comment
on the proposal at this time.

CONDITIONS
Note:
The following conditions were recommended by both staff and the Planning Commission.
1. Non-Transferable Ownership. This Conditional Use approval shall be granted exclusively to
Harold Geyer, and shall not be transferable nor run with the land. (P)
2. Use. This Conditional Use approval shall be for the parking of one (1) recreational vehicle
having no more than two (2) axels and no greater than thirty-seven (37) feet inlength. (P)
3. Location of Recreational Vehicle.The recreational vehicle shall be parked within the front yard,
as shown on Exhibit A.
a.The parked recreational vehicle shall be setback a minimum of ten (10) feetfrom theside
property line.
b.The parked recreational vehicle shall be setback a minimum of six (6) feet from the front
property line. (P)
4. Landscaping. A single row of evergreen plantings shall be installed within each of the
areas identified as “Landscaping Areas” on Exhibit A to minimize the visibility of the
recreational vehicle from the street and adjacent properties. Landscaping Area A (north
of the driveway) shall include a minimum of three (3) privets being a minimum of a 3-
gallon plant at the time of planting and a minimum of three (3) eastern cedars with a
minimum initial height of three (3) feet. Landscaping Area B (south of the driveway)
shall include a minimum of three (3) privets being a minimum of a 3-gallon plant at the
time of planting and a minimum of two (2) eastern cedars with a minimum initial height
of three (3) feet. These plantings shall be permitted to be staggered and shall be planted
ten (10) feet on center. A plan depicting the landscaping shall be submitted to the
Planning Department within thirty (30) days of the approval of this request and
vegetation shall be installed within thirty (30) days of the approval of such plan. Other
types of evergreen plants may be substituted for those identified in this condition as
approved by the Planning Department at the time of plan review. (P)
